Comp alternatives are garnering more attention today than anytime in the past 25 years with states from Oklahoma to Alaska exploring workers comp options that are as diverse as the states considering them. Oklahoma, for example, has been working to control costs with workers compensation reform but when reform efforts fell short, frustrated employers began pursuing more aggressive measures. Vermont is looking to expand the reach of its compulsory system by integrating workers compensation into a 24-hour program while Alaska is considering a carve out program. And then of course with the enactment of the ObamaCare, insiders have already begun discussing the federalization of workers compensation as a possible next step. LEARNING LABS THE AFFORDABLE CARE ACT PART ONE AN OVERVIEW FOR TEXAS NONSUBSCRIBERS The Affordable Care Act (ACA) or ObamaCare was upheld recently by the U.S. Supreme Court meaning that employers must now begin taking the steps necessary to comply with the multitude of requirements or face fines and penalties. 2 LEARNING LABS NEW CONSIDERATIONS FOR HANDLERS OF PROTECTED HEALTH INFORMATION-PART ONE TEXAS HEALTH PRIVACY ACT This is the first of a two part series on new state law and federal regulations that must be considered by all handlers of Protected Health Information. Part One will address the Texas Medical Privacy Act (TMPA), a new state law that was enacted in Under the TMPA, new standards are established for covered entities, which many feel are more stringent than HIPAA. Learn what new measures are required of handlers of Protected Health Information, how these requirements impact those involved with injury benefit claims, how to comply with training requirements and examine the possible consequences of non-compliance. IMPACT OF NEW SMART ACT ON BENEFICIARY PAYMENT REPORTING This learning lab will detail changes required by the passage of the Strengthening Medicare and Repaying Taxpayers (SMART) Act. This new law brings about significant, substantive and procedural changes to the current Medicare Secondary Payer procedures required under Section 111 of the Medicare, Medicaid and SCHIP Extension Act. The goal of the SMART Act is to accelerate the processing of Medicare conditional payments by decreasing delays in the current system. Entities making payments to beneficiaries including nonsubscribers and subscribers to workers compensation are impacted by the new regulations. NEW CONSIDERATIONS FOR HANDLERS OF PROTECTED HEALTH INFORMATION-PART TWO HITECH ACT & HIPAA MODIFICATIONS This is the second of a two part series on new state law and federal regulations that must be considered by all handlers of Protected Health Information. Part Two will examine the Final Rule that was published recently by the U.S. Department of Health and Human Services, which implements provisions of the Health Information Technology for Economic and Clinical Health (HITECH) Act and significantly modifies and expands requirements under the Health Insurance Portability and Accountability Act s (HIPAA) Security and Privacy Rules. Subrogation clauses are common to nonsubscriber ERISA plans and require employees to reimburse the plan if they recover damages relative to a claim paid by the plan from a third party. New case law challenges the dominating trend in ERISA subrogation which, given the presence of a contractual agreement, favor 100% repayment, first and full recovery for the plan or insurer. In cases where a third party award does not exceed benefits paid, the challenge questions whether the insurer should be made whole first and at the expense of the injured party. CONFERENCE NAMETAGS Official conference name badges are required for admittance to all conference events and must be worn and visible at all times in the manner prescribed by TXANS.
