Phoenix XXXVI Program Rules Who May Participate? All United States distributors of battery-operated industrial lift trucks (including dealerships and factory branches) are eligible to participate. Qualifications in the current EnerSys travel program will be limited to principals and employees of such dealerships who are working in a sales capacity that affects battery and charger purchases at the time of program travel to Los Cabos, Mexico in 2016; and Port Douglas and Sydney, Australia in 2016. How Points are Earned Points will be earned: 1) When the U.S. distributor sells an electric lift truck that is equipped with a new IRONCLAD, Express or NexSys battery and/or qualifying EnerSys charger* during the program or 2) When a U.S. distributor sells an IRONCLAD, Express or NexSys battery and/or qualifying EnerSys charger* as replacement. * (Charger orders for use with EnerSys brand batteries other than IRONCLAD, Express or NexSys will not qualify for this program.) EnerSys (US) must invoice the sale to the distributor or to the distributor s OEM under a qualified OEM program for the sale to qualify. Orders placed with and invoiced by Manufacturer s Representatives of EnerSys or other third parties shall not count toward this program. In the event that the equipment passes through more than one dealership or factory branch, the organization selling to the end user will be awarded points. How Points are Scored A) Batteries 2 points per KWH capacity a. NexSys batteries receive 20 points each B) Chargers Qualifying charger lines must be billed by EnerSys as spelled out in How Points are Earned (above). Model point values follow: EnForcer EH3/EL1/EL3 = 30 EI1/EI3 = 35 EQ3 = 40 EIP1/EIP3 = 45 Express emax 10/15kW = 25 T10/15 = 50 emax 20/30kW = 100 U20/30 = 100 T20/30 = 200 C) All points for EnerSys batteries shall be valued per the following discount schedule from the list price in effect at the time of official order entry and placement with EnerSys headquarters in Reading, PA. 21.2% and below = 150% 21.3% to 25.9% = 125% 26.0% to 31.9% = 100% 32.0% to 34.9% = 75% 35.0% to 38.4% = 50% 38.5% to 39.9% = 25% 40% and higher = 0% NexSys NI1/NI3 = 35 What are the Qualifications for the Phoenix XXXVI Travel Program? Total points earned by a distributor will determine automatic qualifications in the Phoenix XXXVI travel program. One appointment (trip for two) to Los Cabos, Mexico (4,250 points) or one appointment (trip for two) to Port Douglas and Sydney, Austalia (9,000 points) will be awarded for the afore mentioned number of points earned by a distributorship. No more than two trips for two will be awarded to the same dealer or OEM from points accumulated from the same user for any reason. The winning dealership may elect the destination of their choice provided the dealership has enough points for all awards claimed. However, in order to properly manage distribution of appointments to the two destinations, distributors will earn no more than three Los Cabos trips before they are required to accept an Australia trip. And in turn, distributors are only allowed one Australia trip if that is their first destination choice and then must take three Los Cabo trips before selecting another Australia trip. We may be able to alter these requirements based on interest of destinations as the appointments are earned, as we have done in the past. Point distribution within a dealership is the sole responsibility of the dealership. Awards are made to the dealership, not to individuals, and the dealership shall decide which salesperson shall participate provided they meet details of Who May Participate section of this brochure. Distributorships or branches earning the requisite points for qualifications will be awarded appointments only if they demonstrate an ongoing achievement of keeping invoiced payments to EnerSys current. Point Registration Orders will be credited automatically when written if the distributorship or factory branch placing the order is known. Program Time Period The program period is June 1, 2014 through September 30, 2015, inclusive. To be counted, orders must specify shipment by November 30, 2015. No order that was counted in a previous travel program may be claimed in this program. The Award The award in this program consists of an appointment (trip for two / employee and guest) to the destination described in this Phoenix XXXVI brochure, and mentioned in these program rules. Both participants must be of legal age (21) and possess a current Passport. This is the only award offered or implied by this program. EnerSys regrets that appointees, who, for any reason, are unable to attend, will receive no substitute award. Distributorships will designate qualified individuals (see Who May Participate section) within their sales organizations who will earn appointments. Appointments may be granted only to the principals and employees of the distributorship who are so employed during the operation of this program. Award points and appointments are not transferable between distributorships unless common ownership can be demonstrated. Appointments are not transferable from one individual to another. EnerSys reserves the right to change or modify these rules at any time and to clarify the rules as needed. In the event of any dispute involving this program, the decision of the EnerSys program managers will be final. Tax Liability Tax Liability Awards are subject to applicable federal, state and local taxes. EnerSys is required by law to report some incentive trip awards. Winners will be required to provide EnerSys with form W-9. Awards made to incorporated dealers, as demonstrated in fully executed W-9 forms, will not be reported on individual 1099 forms.
