4 SECTION SITE ACCESS, CONSTRUCTION LIMITS, USE OF FACILITIES AND WORK HOURS PART 1 GENERAL 1.1 EXISTING FACILITY OPERATIONS The ARTCC is a 24 hour, 7 day per week operating facility. This facility is a critical operational center for air traffic control. The Contractor shall perform all work in a manner which does not conflict with or adversely affect the air traffic operational environment or functions of the ARTCC. In the event of any actual or potential conflict, air traffic control activities shall have priority over all Contractor activities. The Contractor shall plan for and provide services in such a manner and at such times that will not disrupt facility operations, and shall conform to those procedures considered essential by the FAA for ensuring air traffic safety. 1.2 CONSTRUCTION LIMITS AND ACCESS Access for the Contractor, sub-contractors, employees, deliveries, etc., will be designated by the RE. NO CONTRACTOR OR CONTRACTOR DELIVERIES WILL BE ALLOWED TO OCCUR IN THE ABSENCE OF THE RE OR THE RE S DESIGNATED REPRESENTATIVE ON SITE. The Contractor s presence on site and all Contractor deliveries must be pre-arranged with the RE. No deliveries arriving outside of normal working hours and/or the presence of the Contractor on site will be allowed unless as pre-arranged through the RE. The following requirements MUST be followed in order to obtain access to the facility site: A. All persons entering or delivering to this federal facility must have valid government issued identification. 1. Valid issued government identification is: a) ID issued by the federal, state, county, or city government or by the military. b) Must have the persons legal name. c) Must have a unique ID number. d) Must have an expiration date. e) Must have a picture of the individual. f) Must have the name of the agency issuing it. (examples: state issued drivers license or IDs, passports, or military ID.) B. CONTRACTORS MUST HAVE SUBMITTED, TO THE FAA, WORKERS OR OTHER COMPANY EMPLOYEES NAMES AND INFORMATION WHO THEY ARE REQUESTING ACCESS TO THE FACILITY AT LEAST 24 HOURS PRIOR TO ENTRY C. Persons entering on to federal property are prohibited from having on their person or in their vehicle to include all visitor lots: 1. Weapons of any kind to include but not limited to: a) Guns b) Knifes with blades over 3 inches except for valid tools. SITE ACCESS

5 c) Projection devices, bow & arrows, paint ball weapons, blow guns ect.. d) Clubs, batons, collapsible batons, or saps. e) Stun guns or tazers. f) Chemical agents, mace, or pepper sprays. g) Marshal arts weapons of any kind. 2. Open alcohol containers. (any container without an intact factory seal.) 3. Illegal drugs. 4. All animals with the exception of a verified service animal is prohibited on the facility and will never be left in a vehicle on the facility. 5. All persons, vehicles, and property is subject to search at all times. 6. Family members, friends, children or minors not listed on the work contract will not be granted access. D. The Contractor shall confine operations, activities, storage of materials and employee parking within the area, as designated by the RE. Additional space the Contractor deems necessary shall be obtained off site, at no additional cost to the Government. E. Access to the construction site shall be kept unobstructed. If temporary access obstruction is unavoidable, the Contractor shall advise the RE immediately. F. Temporary roadways and/or other access may be authorized only by the facility, via the RE. G. Vehicles transporting materials shall not be loaded beyond the capacity prescribed by Federal, State or Local law. H. Vehicles delivering materials shall not have any other project material loaded into/onto the vehicle except for the materials that will be left at the ARTCC job site. I. No deliveries will be accepted or permitted on site from anyone who does not meet the required Government issued identification requirements listed in this specification section. J. Obstruction of existing roadways, driveways, etc., to the ARTCC is strictly prohibited. Access to the loading dock and ramp shall be maintained. K. Damage caused by the Contractor's activities to existing paving, lawns, curbs, sidewalks, interior/exterior of the building shall be repaired. All costs of repairs shall be paid by the Contractor. After notice to proceed and prior to the commencement of construction, the Contractor and RE shall conduct joint inspections of the existing areas affected by the construction. Existing damage/defects shall be noted and will be used as the basis for determination of damages caused by the Contractor's operations. 1.3 CONTRACTOR'S USE OF PREMISES A. Contractor shall assume full responsibility for the protection and safekeeping of products stored on the site. SITE ACCESS

6 B. The Contractor and his subcontractors shall maintain the job site in a neat and orderly condition. C. Concessionaires shall not be allowed on the grounds of the facility. D. Use of the cafeteria is permitted except between the hours of 11:30 a.m. to 1:00 p.m. and only if the Contractor personnel are in clean clothes and shoes (as determined by the RE). 1.4 GOVERNMENT USE AND ACCESS TO PREMISES A. The Government reserves the right to enter the premises during the term of the contract for periodic work inspections and for maintenance of existing equipment. The Contractor shall allow the CO and RE complete access to all portions of the work. B. See Part II, Section I, Contract Clause entitled OTHER CONTRACTS, for work by other Contractors. 1.5 WORK HOURS A. Work shall be performed during normal working hours (7:00 a.m. to 3:30 p.m.) except for the following: 1. Work in the occupied control room (11:00 PM 6:00 AM) B. The Contractor may elect to work two shifts or may elect to work outside the normal working hours, early morning or late afternoons, due to weather conditions, provided that this is scheduled, coordinated, and agreed to by the RE, the facility and CO, a minimum of 5 working days in advance. No claims for increased overhead or equitable adjustment will be entertained if the Contractor elects to work more than one shift. C. Shutdowns and cutovers of environmental, utility and electrical systems impacting the facility operations shall be accomplished between the hours of 10 p.m. and 6 a.m. All preparatory work shall be completed prior to shutdown/cutover to minimize downtime. Shutdown and cutovers shall be scheduled and coordinated with the RE a minimum of 10 working days in advance of the shutdown/cutover. D. Construction noise within the facility must be minimized between 7:00 a.m. and 8:30 p.m. and shall be scheduled in advance, coordinated with the facility and approved by the RE. E. No work shall be scheduled or take place during the week of and the weekend preceding and following the Thanksgiving, Christmas and New Years Holidays. Only emergency work to restore critical services to the facility will be considered and a moratorium waiver must be submitted and approved. The moratorium period will not be counted against the contract construction duration for the project. SITE ACCESS

7 1.6 NOTIFICATION OF PLANNED OVERTIME WORK A. In the event the Contractor intends to work overtime, nights, weekends or holidays, he shall notify the RE, who will coordinate with the CO for approval, at least 24 hours in advance of his commencement of the overtime work and 48 hours prior to night, weekend or holiday work. 1.7 SECURITY REQUIREMENTS A. Contractor shall provide the CO prior to Notice-To-Proceed with a complete list of contractor and subcontractor personnel including social security number, date of birth, and city of residence. The list shall be kept current during project work. No Contractor employees, associates, or other representatives shall be permitted access to the ARTCC grounds until that person's name and information has been provided and the appropriate security investigation has been completed by an FAA security officer for approval of access to the site with specified restrictions, if any. The FAA security officer may refuse access to the site to any employee, associate or other representative at any time for any reason. B. Contractor and subcontractor personnel may be subject to a security investigation by the FAA. The Contractor shall promptly complete and return applicable security forms furnished with the contract document for each employee as required. Forms must be completed and returned to the CO prior to subject employees working in the facility. C. Contractor's personnel shall report to the FAA Security Guard at the front security gate and submit proper identification to obtain a FAA badge which will be worn on an outside garment at all times while on the ARTCC premises. The badge is a clip-on type, this badge shall be returned daily to the security guard when such personnel leave the ARTCC premises. This badge MUST be worn at all times. D. For projects with long durations (i.e. 3 months or more), the site superintendent must get approval for a NACI badge. This badge requires forms to be filled out and an approval process that will take 30 days or longer. Once approved a blue photo ID badge will be issued and the NACI badged individual will need to escort subcontractors and deliveries. The NACI badged individual shall retain this badge until the end of the project or the badge expiration date (whichever is sooner). At that time the badge MUST be returned to the RE. E. Work shall be arranged so that Contractor's personnel can be escorted when required by the FAA, in certain areas which are considered to be restricted. No Contractor employee, associate, or other representative shall have any visual, audible, or physical access to any area marked as a "closed area". Any persons gaining access to any "closed area" shall report the access to the CO who will coordinate with the FAA security office for a de-brief. Contractor's personnel shall not violate any security regulations pertaining to the ARTCC facility. Violators may be removed from the premises with the right to re-enter revocable. Contractor's day-to-day work schedules in the restricted areas shall be so arranged to allow for minimum escort. SITE ACCESS

8 F. Current procedures at FAA facilities include the "right to search". Access to the site constitutes consent to search. If in the judgment of the FAA Security Guard a cause to search a vehicle or the person of personnel exists, such search will be made. 11 SECTION ASBESTOS ABATEMENT PART 1 - GENERAL 1.1 SUMMARY Applicable provisions of Division 1 - General Requirements, Drawings, and other provisions and requirements of the Contract Documents apply to work of this Section. This specification is being included as part of the bid package to be followed for the removal of asbestos that would be disturbed during the course of the project. A. This Section includes the removal, control and disposal of friable and nonfriable asbestos containing materials (ACM) which will be encountered during the work of the Control Wing Renovation (M1 Control room, Attic) project at the Denver ARTCC, Longmont, CO. The work includes, but is not limited to: the construction of temporary enclosures to isolate the work area, the establishment of negative-air pressure within the isolated work area, the removal of ACM from the isolated work area, and the legal disposal of the removed ACM from FAA property. The scope of work would consist of: The removal of the following asbestos-containing materials (ACM): Carpet w/mastic, resilient tile w/mastic, ceiling tiles, dry wall ceiling, spray applied fire proofing, plaster/skim coat wall construction, and mudded TSI fittings. The work also includes the disposal of the generated ACM wastes. Specific operational procedures shall be outlined in the required Asbestos Abatement Plan called for elsewhere in this specification. The work also includes attendance and participation in onsite meetings, such as the pre-bid, pre-construction, and weekly meetings as required throughout the project. The Contractor shall refer to the Contract Drawings for more details of areas to be abated. A recommended abatement operation sequence is outlined in Section 3.8 ABATEMENT PROCEDURES. The contractor may submit a different operation sequence for approval as part of the overall process of submitting the Abatement Plan for approval. 1. Observe all existing conditions prior to submitting a bid. The Contractor is expected to have considered, and included in their bid, all aspects and liability of the existing conditions and their impact, particularly to cost and health and safety of workers and occupants, and proper function and operation of the facility. Additionally, the Contractor shall be aware of other work being performed. Failure to visit the site shall in no way relieve the Contractor from the necessity of furnishing materials or performing any work that may be required to complete the work in accordance with the Contract Documents without additional cost to the FAA. Additional site visits required by the Contractor, shall be scheduled with the FAA. ASBESTOS ABATEMENT

12 2. The quantities and locations of ACM and the extent of work indicated are only best estimates which are limited by the physical constraints imposed by occupancy of the facility. Accordingly, minor variations (plus or minus 15 percent) in quantities of ACM within the limits of containment for each abatement area are considered as having no impact on contract sum and contract time. Locations of ACM different than indicated on drawings but within the limits of containment are considered as having no impact on contract sum and contract time. Where additional asbestos abatement work is required beyond the above variations, the contract sum and contract time will be adjusted under provisions of Division of the Specifications. Work shall conform to applicable federal, state and local government regulations and to the requirements specified in these Contract Documents. Whenever inconsistencies occur between the referenced materials, the more stringent shall apply. The intent of these documents is to verify the work is conducted at the highest level of safety. A. Provide a copy of the company's health and safety program. J. Safety, Health and Accident Prevention Plan K. Project Personnel 1. Provide number of full-time workers that will be assigned to this project. 2. Provide number of crews and shifts for this project. L. Asbestos Abatement Plan Submit a detailed plan and schedule of the work procedures to be used in the removal of asbestos containing materials to the RE within ten (10) business days after the preconstruction meeting. The abatement plan shall be reviewed and approved by the contractor s Certified Industrial Hygienist (refer to section B) and shall include the information located in section C.4. M. Hazcom Plan - The Contractor shall provide a project site specific HAZCOM Plan to the COR prior to commencing site work. The HAZCOM plan shall be prepared in accordance with 29 CFR, Part and 29 CFR Federal Hazard Communications [HAZCOM] Standard. As a minimum, the plan shall contain the following: 1. Provide a name for the responsible HAZCOM point of contact. 2. Provide the name of the person responsible for updating the MSDS s. 3. Provide the name of the person responsible for LABELING all material on site. 4. Provide the name of the person responsible for training employees. 5. Provide the name of the person responsible for the Contingency Plan. 6. Provide the name of the person responsible of disseminating information to the FAA HAZCOM Point of Contact within 24 hours. 7. Provide the training and records of employees trained in HAZCOM. 8. Provide an MSDS for each and all chemicals brought on site. ASBESTOS ABATEMENT

15 9. Written procedures for the introduction of unanticipated chemicals at the job site. N. Laboratories Submit copies that the laboratory to be used by the Abatement Contractor for personnel and area air monitoring samples on this contract is accredited by the American Industrial Hygiene Association (AIHA) for Phase Contrast Microscopy and is participating in the American Industrial Hygiene Association (AIHA) Proficiency Analytical Testing (PAT) Program, and accredited for Transmission Electron Microscopy (TEM) analysis by the National Voluntary Laboratory Accreditation Program (NVLAP). O. Miscellaneous Submit copies of the Notification to the EPA, Asbestos Abatement Contractor's State License for Asbestos Removal, Hazardous Waste Manifest Form, and manufactures data on materials used at the site. P. Submittal Notarization Sign and date submittal, indicating name and title of person signing. Q. Title to Materials Provide all required Federal, State and Local documentation regarding the transportation and disposal of ACM and asbestos contaminated materials at the earliest possible time. Submit proof of proper ACM material disposal to RE. 1.4 SYSTEM DESCRIPTION A. The work consists of the containment and removal of asbestos containing materials. Asbestos is a material which can cause a serious health risk to humans. The work is governed by a body of local, state and federal rules, regulations and laws. The Asbestos Abatement Contractor agrees by accepting the contract that their company is fully knowledgeable of this information and will bear full responsibility for the health and safety of workers, FAA's employees and invitees, and third parties, who come in contact with the work site. B. The Contractor s Certified Industrial Hygienist shall be responsible for reviewing and approving the Contractor s abatement plan. C. The FAA will employ a Certified Industrial Hygienist to monitor conformance of the abatement contractor to the Contract Documents. This does not relieve the Contractor of any responsibility for conformance to contract requirements. D. Before any abatement work begins and in preparation of submitting the asbestos abatement plan, the Contractor and the FAA shall review the building and determine air sampling station locations to be used to establish baseline readings and to monitor ongoing abatement operations. At least two of these stations shall be in occupied areas ASBESTOS ABATEMENT

16 outside the designated work area. The Contractor shall monitor fiber counts and provide this information to the RE for posting within the building. E. The Contractor shall cooperate with the RE and the FAA. This cooperation shall include allowing access to the work areas to allow for visual and air monitoring, collecting samples, providing requested data on personnel, equipment, scheduling and facilitating FAA's monitoring of the work. F. The Contractor shall not allow anyone access to the site who is not authorized by FAA or the Contractor to enter the site of work. G. The Contractor shall provide personal protective equipment for two (2) authorized persons including full protective clothing and Powered Air Purifying Respirator (PAPR) with adequate filters without charge to the FAA. The Contractor shall allow full use of abatement facilities by the RE. H. The Contractor is responsible for maintaining a log of all personnel who enter the work place. A copy of logs shall be submitted to the RE on a weekly basis. I. The Contractor shall install warning labels in prominent locations adjacent to asbestos containing material identified in this specification to remain. The labels shall be installed before demolition or construction starts under this contract. The labels will remain in place as the property of the FAA. The labels shall be printed in large, bold letters on a contrasting background and conform to the requirements of 29 CFR and contain the following information: 1.5 PROJECT CONDITION DANGER CONTAINS ASBESTOS FIBERS AVOID CREATING DUST CANCER AND LUNG DISEASE HAZARD A. The ARTCC is a 24-hour per day, 7-day per week facility which is essential to the safe operation of Air Traffic. The Contractor will be responsible for the continuous protection of this facility and its employees and shall immediately notify the RE in the event of a breach of this protection. Coordinate construction and abatement activities with the RE in order to prevent any disruption of this critical operation. 1. Disruption of operations for any amount of time could jeopardize the safety of the flying public and may result is criminal prosecution. 2. The FAA will occupy the facility during construction activities. The Contractor shall cooperate fully with the RE during construction operations to minimize conflicts and to facilitate FAA usage. The Contractor shall perform the work so as ASBESTOS ABATEMENT

17 not to interfere with FAA operations. The Contractor shall provide FAA personnel access to equipment remaining in service. The Contractor shall construct containments to allow travel routes for FAA personnel and to allow moving of necessary equipment. 3. The work shall be limited to specific areas of the building and site. Unlimited Contractor access is specifically not permitted. Arrangements for use of the buildings and site will be restricted to those areas specifically allowed by FAA. Other contractors will be working at the site prior to and after asbestos abatement. The Contractor shall cooperate with other contractors and prevent work by others from jeopardizing the asbestos work. 1.6 SECURITY A. A partitioned and locked security area shall be provided for each asbestos regulated work area, whenever feasible. The Abatement Contractor shall maintain a logbook documenting entry into and out of the asbestos regulated work area. The Contractor shall not allow unauthorized personnel access to the site. Authorized personnel include the Abatement Contractor and his/her workers, CO and his/her representatives, the Environmental Contractor, representatives of regulatory agencies having jurisdiction over the project, FAA bargaining unit representatives and fire or medical response personnel in the event of emergency. No other person(s) may enter the areas occupied by the contractor or his/her equipment without submitting evidence of completion of required medical examinations and respirator training to the COTR/RE prior to entering the abatement areas. B. All facility-specific security procedures will be followed. 1.7 REQUIREMENTS (NOTE: SOME OF THESE ARE DUPLICATED FROM PREVIOUS SECTIONS) A. Medical - 1. Medical requirements shall conform to 29 CFR Before being exposed to airborne asbestos fibers, workers shall be provided with a comprehensive medical examination as required by 29 CFR and other pertinent state or local requirements. This requirement must have been satisfied within the past year. 2. Complete and accurate records shall be maintained on file at the work site of each employee's medical examinations, medical records and exposure data as required by 29 CFR and 29 CFR Provide documentation from a physician that employees or agents who may be exposed to airborne asbestos in excess of background levels have been provided with an opportunity to be medically monitored to determine whether they are physically capable of working while wearing the respirator required without suffering adverse health effects. In addition, the Contractor shall document that personnel have received medical monitoring as required in OSHA 29 CFR (g) and This documentation shall be submitted for each employee entering the regulated (removal) area. This document shall be current. 4. Provide a copy of the company's Medical Surveillance Program. B. Training - ASBESTOS ABATEMENT

18 1. Contractor personnel shall attend and successfully complete training per 40 CFR Part 763, Subpart E Appendix C or the regulations of the State of Colorado. Such training shall be current during time of qualification and will be maintained during the course of the project for workers directly involved in ACM removal, handling and disposal. Workers shall take and successfully complete the "Worker" course. Onsite supervisory personnel shall take and successfully complete the "Contractor/Supervisor" course. Worker and Contractor/Supervisor courses taken more than 1 year prior to commencement of work are acceptable provided that the individual has successfully completed the annual refresher training as required by applicable regulations. In addition, prior to the commencement of work, each worker shall be instructed by the Contractor's CIH and onsite competent person/supervisor on the content and requirements of the Contractor's Asbestos Abatement Plan, Safety, Health, and Accident Prevention Plan, Hazard Communication Program and all additional requirements of 29 CFR The Abatement Contractor shall maintain copies of workers state licenses at the work site for the duration of the project. 2. Provide a copy of the company's training program for supervisors and workers. The program shall include, but is not limited to, how often training is conducted, who conducts the training, when it is conducted, what the duration of the program is and how documentation of training is accomplished. 3. The Contractor shall submit signed certificates for each employee stating that each employee has: C. Plans and Programs - a) Received training in the proper handling of materials that contain asbestos. b) Understands the health implications and risks involved (including the illnesses possible from exposure to airborne asbestos fibers). c) Understands the use and limits of the respiratory equipment to be used. d) Understands the results of monitoring of airborne quantities of asbestos as related to health and respiratory equipment. D. Hazard Communication Program - A written hazard communication (HAZCOM) program shall be established and implemented in accordance with 29 CFR Copies of Material Safety Data Sheets for hazardous chemicals brought on-site by the Abatement Contractor shall be attached to the written HAZCOM Program. The Contractor shall provide a project site specific HAZCOM Plan to the COR prior to commencing site work. 1. The HAZCOM plan shall be prepared in accordance with 29 CFR, Part and 29 CFR Federal Hazard Communications [HAZCOM] Standard. As a minimum, the plan shall contain the following: a) Provide a name for the responsible HAZCOM person. b) Provide the name of the person responsible for updating the MSDS s. c) Provide the name of the person responsible for LABELING all material on site. d) Provide the name of the person responsible for training employees. 19 e) Provide the name of the person responsible for the Contingency Plan. f) Provide the name of the person responsible of disseminating information to the FAA HAZCOM Point of Contact within 24 hours. g) Provide the training and records of employees trained in HAZCOM. h) Provide an MSDS for each and all chemicals brought on site. i) Written procedures for the introduction of unanticipated chemicals at the job site The HAZCOM Program shall be approved by the Contractor s CIH. 2. Respiratory Protection Program - The Contractor shall establish in writing, and implement a Respiratory Protection Program in accordance with 29 CFR , 29 CFR , ANSI Z88.2, CGA G-7 and CGA G-7.1. NO. 12. This shall include evidence of most recent respirator fit-tests in accordance with 29 CFR The Respiratory Protection Program shall be approved in writing by the Contractor s CIH. 3. Safety, Health, and Accident Prevention Plan - The Contractor shall prepare a Safety, Health and Accident Prevention Plan (SHAPP) for all work that will be performed under this contract. The SHAPP shall be approved in writing, signed, and sealed by the Contractor s CIH. At a minimum, the plan will address the following: a) Site-specific hazards expected to be encountered during each phase of the work. b) Procedures that will be used to prevent injury/exposure of workers due to the hazards including preparation of Activity Hazard Analyses for each major phase of the work. c) A designated on-site point of contact that will be responsible for enforcing the plan. 4. Asbestos Abatement Plan - The Asbestos Abatement Plan is a detailed plan of the response actions to be taken and the control procedures to be used in the abatement of the ACM. The plan shall take into consideration all the individual ACM abatement work tasks as summarized in paragraph 1.4 and Description of Work Tasks. The plan shall be prepared by, signed, sealed, and dated by the Abatement Contractor's CIH. The plan shall include, but not be limited to, the following items: a) Detailed project drawings that include the locations and boundaries of asbestos regulated areas, clean rooms, local exhaust ventilation equipment, decontamination and load-out units, load-out path to other temporary waste facilities, access tunnels, and location of temporary utilities (electrical, water, sewer). b) The type of material(s) to be removed and the approximate quantity. c) Interface of trades involved in the construction and sequencing of asbestos related work. d) Type of wetting agent and asbestos encapsulant to be used. e) Abatement contractor s personal air monitoring strategies. f) A detailed description of the method to be employed in order to control the spread of ACM wastes and airborne fiber concentrations. 20 E. Industrial Hygienist - g) The specific security procedures to be used for all asbestos regulated work areas and critical equipment. h) Detail of the curtained doorway (Z-flap) construction i) A schedule for turning off and sealing existing HVAC systems. j) A description of the abatement methods and work practices to be used for each type of material and personal protective equipment to be worn by employees. k) Personal hygiene and decontamination procedures. l) Labeling procedures, including descriptions of warning signs and labels to be used. m) A description of the local exhaust ventilation systems to be used and air change calculations. n) A description of the method to be used to transport waste material, including the name address, phone number, contact, EPA licenses, and certificates of insurance for the transporter. o) Location and details of the EPA-approved landfill (name, POC, address, phone number, EPA NH license or permit). p) A project schedule in time line format. Personal air sampling and training shall be conducted under the direction of a CIH possessing at least two years of experience in asbestos abatement. In addition, the CIH shall assist the Contractor's competent person/supervisor in implementing and ensuring safety and health requirements are complied with during the performance of all required work. The CIH shall possess current EPA-or CO Asbestos Project Designer certification and certification in the comprehensive practice of industrial hygiene by the American Board of Industrial Hygiene (ABIH). The CIH will also be responsible for preparation/approval of the Contractor s Asbestos Abatement Plan, Respiratory Protection Program, HAZCOM Program, and SHAPP. Industrial Hygienists (IHs) and Industrial Hygiene Technicians (IHTs) supporting the designated CIH shall have at least 2 full years of practical on-site asbestos abatement experience and certification as Asbestos Project Monitor. IHTs shall also be successful participant in Proficiency Analytical Testing (PAT) program for PCM Analysis. The formal reporting relationship between the CIH and the support IHs and IHTs, the Contractor's competent person/supervisor, and the Contractor shall be indicated. F. Permits, Licenses, and Notifications - The Contractor shall obtain all necessary permits and licenses in conjunction with the anticipated asbestos abatement, transportation and disposal actions and timely notification furnished of such actions as required by Federal, state, regional, and local authorities and as otherwise specified herein. This may include, but not be limited to the following: 1. Required 10-day advance notification in accordance with 40 CFR Part 61, Subpart M 2. State worker and supervisor licenses for contractor personnel who will perform work on this contract. ASBESTOS ABATEMENT

21 3. The current permit for the disposal facility that will accept all asbestos waste generated as part of this contract. 4. The written notification provided to any rental company concerning the intended use of rental equipment, the possibility of asbestos contamination, and the decontamination procedures that will be used prior to the return of the equipment. 5. Evidence that the local fire department has been notified 10 days before fireproofing material is to be removed from a building; such notice shall specify that the material contains asbestos. 6. Additional permits, licenses, and notifications as applicable. G. Materials and Equipment - All materials and equipment to be used in the work shall comply with applicable regulations and standards. This may include, but not be limited to, the following items: Air monitoring equipment Airless Sprayer Chemical encapsulant Coveralls Disposal bags Disposal Container Duct Tape Encapsulants Eye protection Fiberboard drums Foot coverings Glove Bag Hard hats High efficiency filtered local exhaust equipment Other work clothing Paperboard boxes Personal protective clothing and equipment Polyethylene Sheet - Flame Resistant Polyethylene Sheet General Polyethylene Sheet Reinforced Prefabricated Decontamination Unit(s) Removal encapsulant Respirators Sheet Plastic Strippable Coating Underclothing Vacuum equipment Water filtration equipment Wetting Agent The Contractor shall submit manufacturer s documentation of DOP testing to the Environmental Contractor for review. H. Contractor Qualification Statement - The Contractor shall prepare a written qualifications and organizational report providing evidence of qualifications of the Contractor, Contractor's onsite competent person/supervisor, Contractor workers, all subcontractors (to include disposal transportation and disposal facility firms), subcontractor supervisors, subcontractor workers, IH firm, testing laboratory, and testing laboratory analysts, to perform asbestos abatement activities as required herein. The report shall specify the Contractor's staff organization to include subcontractors, IH firm and testing laboratory chain of command to be used for this project. The Contractor, IH firm and testing laboratory shall sign the report. The Contractor's qualification report shall contain the following information: 1. Contractor Identification a) The Asbestos Abatement Contractor shall be licensed by the State of Colorado for the purpose of removal, encapsulation, enclosure, demolition, and maintenance of structures of components covered by or composed of asbestos containing materials. 22 b) Company name and address (street and mailing if different) c) Name of individual supplying information d) Name of parent company, if any e) Address of office responsible for this project f) Telephone number 2. Insurance 3. Staff a) Insurance carrier and coverage b) Surety company c) Special coverage specifically regarding asbestos a) Name, address, and telephone number of principal b) Number of full time company employees c) Names of full and part time field supervisory personnel, and years of asbestos abatement experience d) Number of full and part time laborers e) Name of employee union, if any f) Usual ratio of supervisory to labor personnel used g) Evidence that Contractor's full-time onsite supervisor is designated as, and is qualified to be a competent person/supervisor in accordance with 29 CFR 1926 and possess at least three years experience in the administration and supervision of asbestos abatement projects, including work practices, abatement methods, protective measures for personnel, inspection of asbestos abatement work areas, evaluating the integrity of containment barriers, placement and operation of local exhaust systems, ACM generated waste containment and disposal procedures, decontamination unit installation and maintenance requirements, site safety and health requirements, etc. This designated competent person/onsite supervisor shall be responsible for ensuring compliance with applicable Federal, state and local requirements, the Contractor's SHAPP and the Asbestos Abatement Plan. 4. Testing Laboratory The name, address and telephone number of each testing laboratory selected to perform the sample analyses and report the results. For each laboratory selected to conduct phase contrast microscopy (PCM) of airborne samples using NIOSH Method 7400 or equivalent and transmission electron microscopy (TEM) of airborne samples using NIOSH Method 7402 (TEM confirmation of asbestos content of PCM results), written verification of the following criteria, signed by the Testing Laboratory principal and the Contractor shall be included: a) The laboratory is currently judged proficient in counting airborne asbestos samples by PCM by successful participation in the last four rounds of the American Industrial Hygiene Association s (AIHA) Proficiency Analytical Testing (PAT) Program. ASBESTOS ABATEMENT

23 b) The laboratory is fully equipped and each analyst possesses demonstrated proficiency to confirm NIOSH Method 7400 PCM sample analyses results from the same filter by conducting NIOSH Method 7402 TEM analyses. 5. Landfill and Transporter Qualifications a) Written evidence that the landfill is approved for asbestos disposal by the USEPA and state regulatory agencies. b) Copies of signed agreements between the Contractor, and each subcontractor to include transporters and the asbestos waste disposal facility to accept and dispose of all asbestos-containing waste generated during the performance of this contract. c) Qualification resumes of each subcontractor transporter to be used, indicating previous experience in transport and disposal of asbestos waste and evidence of compliance with applicable state and local waste hauler requirements for asbestos. 6. Certification of Worker Acknowledgment The form entitled Certificate of Workers Acknowledgment (Attachment 1) shall be completed for each employee. 7. Experience The Contractor shall prepare a summary of experience in asbestos abatement that includes the following: a) A brief description of company history. b) Evidence that the company has a minimum of five (5) years of asbestos abatement experience. c) A representative list of at least three successful asbestos abatement projects completed in occupied buildings such as hospitals, computer centers, or airports. List the project name, date, size, duration, removal cost, references and telephone numbers for each project. d) Evidence that company has successfully completed a CLASS 1 abatement with a minimum of 10,000 square feet of surfacing ACM in the last three years 8. Regulatory Compliance History - The Contractor shall: a) List and explain warnings and citations received from Federal, State, or local regulatory agencies related to asbestos abatement activities. Include project name, date, and resolution. b) List assessed penalties, liquidated damages, schedule overruns, and contract terminations that have occurred. Include resolutions as applicable. ASBESTOS ABATEMENT

24 I. Reports and Records c) List projects where the owner, architect, consultant or other authority halted removal activities. State project name, date, reason for shutdown, and resolutions. d) List asbestos-related legal proceedings/claims in which the company has participated or is currently involved. Include a description of the case and resolution. 1. Asbestos waste disposal record report The Contractor shall maintain final completed copies of the Waste Shipment Record for all shipments of waste material as specified in 40 CFR 61, Subpart M and other required state waste manifest shipment records as specified herein. Detailed information of all asbestos waste disposals shall be documented on the mandatory waste shipment record form. 2. Entry/Exit Log The Contractor shall maintain a Site Entry/Exit Log. The log shall be made available to the COTR/RE throughout the course of the project. 3. Insurance The Contractor shall purchase and maintain the following insurance coverage, with the stated minimum limits: Type of Coverage General Liability Contractual Liability Automobile Liability Property Damage Liability Worker s Compensation Pollution Liability Minimum Limit $1 million per occurrence $1 million per occurrence $1 million per occurrence for bodily injury $50,000 per occurrence for property damage $1 million per occurrence $1 million per occurrence $1 million per occurrence 1.8 WORK BY FAA The policies evidencing required insurance shall be written on a comprehensive form of policy listing the FAA as the certificate holder and contain no pollution exclusions. The policies shall also contain an endorsement to the effect that any cancellation or any material change adversely affecting the FAA s interest shall not be effective for such period as the laws of NH allow or until 30 days after the insurer or the Contractor gives written notice to the CO, whichever period is longer. Each policy shall include a provision that the FAA will be notified at least 30 days in advance of the effective date of any reduction in coverage or cancellation. A. Environmental monitoring and sample analysis of adjacent areas of the work and final clearance of the work area. B. The shut-down and re-start of mechanical equipment. C. The shut-down of electrical circuits and equipment. D. The removal of furniture and furnishings from the area prior to the start of the contract. Pre-cleaning may be required ASBESTOS ABATEMENT

25 1.9 HOURS OF WORK A. The Contractor shall strictly adhere to work hours as specified. Deviations shall be preapproved, in writing, by the RE 48 hours in advance. For abatement procedures that are in the control room that is occupied shall be 11 PM to 6 AM during the week. In the event that weekend work is agreed to the hours of work shall be determined by the RE. B. Request to change work hours or overtime proposed by the Contractor shall require the RE s written approval prior to implementing changes. The RE s rejection of request for change shall not result in changing contract sum or extending contract time SCHEDULE OVERRUNS A. If the work is behind the agreed time of completion, the CO shall deduct extra costs, including expenses, for FAA services due to the overrun, from the final payment to the Contractor, in addition to compensation for damages identified in other parts of the contract documents PRECONSTRUCTION MEETING A. The FAA will schedule a preconstruction meeting after the Notice to Proceed. The minimum agenda will consist of the following: 1. Designation of responsible personnel and name of the RE. 2. Establishing chain of authority. (The direction will be from the FAA in continual consultation with the RE.) 3. Tentative abatement schedule, as identified by the Contractor. 4. Critical work sequencing, scheduling. 5. Processing of field decisions and change orders. 6. Adequacy of distribution of Contract Documents. 7. Discuss procedures to be followed for Application for Payment. 8. Submittals: schedules, shop drawings, product data and samples, manufacturer's certifications of products, manpower reports, major equipment deliveries and priorities, procedures for maintaining record documents, use of FAA facilities by contractor (access, parking, office area, storage area, and waste load-outs), safety and first aid procedures, security procedures and housekeeping procedures. 9. Complete FAA form , Project Safety and Health Checklist as per order PROJECT CLOSEOUT A. Closeout Submittal - Upon completion of the work, the Contractor shall provide to the FAA, through the Contractor s IH, a closeout submittal. The closeout submittal will consist of the following documents: 1. Written certification on final completion of the work stating that the work complies with the Contract Documents. 26 PART 2 MATERIAL 2. Certification that items on the punch list issued at substantial completion have been completed or corrected and that tools, construction equipment and surplus materials have been removed from the site. 3. Contractor daily logs for abatement work. 4. Contractor entry/exit logs for each containment. 5. Copy of asbestos Waste Manifests for the project. 6. Copies of asbestos worker and supervisory personnel certifications, fit test records, and physicians written opinion forms. 7. Copies of air monitoring results. 2.1 MATERIALS AND EQUIPMENT A. Materials and products shall comply with the requirements of 29 CFR and 29 CFR B. Polyethylene Sheeting - ASTM D2l03, 6 mils thick, flame-retardant. Sheeting shall meet flammability requirements of NFPA 701, and flame spread and smoke density requirements of ASTM E84. C. Duct Tape - Pressure-sensitive adhesive tape, 3 mils (min.) thick by 2 or 3 inches wide, water-proof. D. Aluminum Foil Tape - General purpose aluminum foil tape. To be used to water proof area of work. See 3.6 WATERPROOF FLOORING SYSTEM. Total thickness of 5 mils with a foil thickness of 2 mils. Tensile strength of 15 lbs/in. E. EPDM - To be used to water proof area of work. See 3.6 WATERPROOF FLOORING SYSTEM. Thickness shall be a minimum of 45 mil. F. Protection Mat - To be used to water proof area of work. See 3.6 WATERPROOF FLOORING SYSTEM. Thickness shall be 4.5 oz per sq yd. G. HEPA Filtered Vacuum - Vacuum(s) shall be: 1. Capable of removing 99.97% of the asbestos particles (0.3 microns or greater in diameter) from the air. 2. Portable 3. Equipped with hoses of sufficient length to reach areas behind pipes, ducts and other obstacles. H. HEPA Filtered Ventilation System - Portable ventilation system designed to exhaust and clean the air inside the enclosure prior to exhausting to the outside of the building. The system shall be capable of filtering particles of 0.3 micron in size with an efficiency of 99.97%. Units shall be equipped with the automatic restart feature. I. Wetting Agent - Provide water to which a surfactant has been added.
