(Cheques will not be accepted) The eligible contractors/ vendors can obtain the tender documents from our office during working days 10.30AM to 5.30 PM on payment of specified tender fee (non-refundable) in the form of Demand Draft drawn in favour of State Bank of Mysore payable at BANGALORE The tender documents may also be downloaded from our website However, while submission of tenders the specified tender fee should be enclosed. The bank reserves the right to reject/ issue tender forms to any contractors without assigning any reasons thereof. The sealed tenders (both technical & price-bids) duly signed & completed in all respect superscripted as tender for the respective work along with the prescribed EMD in favour of State Bank of Mysore payable at Bangalore should be submitted to our below mentioned office on or before the date & time of submission of tenders mentioned below. 5 GENERAL CONDITIONS AND INSTRUCTIONS OF TENDER 1.00 The Contractor shall mean and include his heirs, executors and administrators. The Contractor shall be bound for the full complete execution of the contract to the entire satisfaction of the Employer/Architects The Client does not bind itself to accept the lowest or any tender and reserves to itself the right to accept or reject any or all the tenders, either in whole or in part without assigning any reason for doing so Each of the tender documents is required to be signed by the person or persons submitting the tender in token of his or their having acquainted himself / themselves with the conditions of contract, general specifications, general instructions and conditions etc., as laid down. Any tender with Any of the documents not so signed will be rejected If the tender is by an individual, it shall be signed by him giving his full name and complete address, if by a partnership firm, it shall be signed by all partners with their names in full and complete address or by the partner holding the Power of Attorney for the firm and a photostat copy of the Power of Attorney shall be attached or if by a firm incorporated under Companies Act, it shall be signed by the firm s duly constituted attorney and shall bear the official seal of the company The tender form must be filled in English and all entries must be made by hand and written in ink. Any tender in which there is over writing or erasure is liable to be rejected. All corrections must be attested by the tenderer with his dated initials as many times as the corrections occur. If any of the documents is missing or is unsigned, the tender will be considered invalid. No alterations made by the tenderer in the general instructions and conditions, contract forms, conditions of contract, Drawings, Specifications, description of work, quantities etc., shall be recognised and if any such alterations are made or any other conditions of any sort are attached, the tender is liable to be rejected The contractors should fill in the rates tendered in figures as well as in words. The amount for each item should be worked out and the requisite totals given. The tenders which do not fulfill these requirements are liable to be summarily rejected If differences are found between the rates given by the contractor in words and figures or in the amount worked out by him, the following procedure shall be followed. a) Where there is a difference between the rates in figures and words, the rates which correspond to the amounts worked out by the contractor shall be taken as correct. b) Where the amount of an item is not worked out by the contractor or it does not correspond with the rates written either in figures or in words, then the rate quoted by the contractor in words shall be taken as correct. 6 c) Where the rate quoted by the contractor in figures and in words tallies but the amount is not worked out correctly, the rates quoted by the contractor shall be taken as correct and not the amount. d) Where there is any discrepancy between the original, duplicate copies, the entries in the original shall be taken as correct Intending tenderers shall pay as Earnest Money as indicated in the form of Demand draft drawn in favour of the client, Bangalore. Earnest Money will be returned to the tenderer if his/their tender is not accepted but without any interest. Tenders without Earnest Money shall not be considered at all. Under no circumstances, Earnest Money Deposit will be accepted in form of cheques, fixed deposit receipts of bank or insurance guarantees The successful tenderer shall deposit a further sum (as indicated elsewhere in this document), as Security Deposit by Demand draft in favor of the client at the time of signing the contract for the execution and fulfillment of the contractor. This sum will carry no interest In addition to the Security Deposit held retention amount (as indicated elsewhere in this document) will be retained from each payment made to the contractor on his running bills, and this amount will carry no interest. On the Architect s/ Bank s Engineer s Certificate of virtual completion of the work, the contractor would be paid 50% of the Retention Money, and the remaining 50% shall be retained for a further period upto completion of defects liability period and issue of completion certificate by the architects/clients Within 14 days of the receipt of information from Architects/ Bank s Engineer of the acceptance of his/their tender, the successful tenderer shall sign the necessary contract papers with the employer. In case of any delay in signing of the contract, the Earnest Money shall be forfeited and the tender cancelled or the contract enforced as per the terms of the Invitation to tender, General Instructions and Conditions of Tender, and thus the tenderer shall thus be bound through a formal contract has not been executed and signed by the tenderer within the time stipulated All compensation or other sums of money payable by the contractor to the Employer under the terms of this contract may be deducted from his/their Earnest Money and the Security Deposits and Retention Money, if the amounts so permits the contractor shall, unless such deposit has become otherwise payable, within ten days after such deduction make good in cash the amount so deducted The contractor must not assign the contractor to anyone else. He must not sublet any portion of the contract except with the written consent of the Employer failing which the Architects may serve a notice in writing rescinding the contract whereupon the security deposit shall stand forfeited and at the absolute discretion of the Employer. 7 14.00 A schedule of probable quantities in respect of each work and specifications accompany these specials conditions. The schedule of quantities is liable to alteration by omission, deductions or additions at the discretion of the Architects with the consent of the employer The Tenderer must obtain for himself on his own responsibility and at his own expenses all the information which may be necessary for the purpose of making a tender and for entering into a contract and must examine the drawings and must consider and inspect the site of the work and acquaint himself with all local conditioned, means of access to the work, nature of the work, source of material and all matters pertaining thereto. No excuse as regards want of information or any particular point will be considered after the tender has been received. No advice of any change in rates or conditions after the opening of tender shall be entertained All the rates shall be filled up in figures as well as words without fail The rates and amount against each item of work shall be filled up only in tender papers issued to the tenderers The tenders shall be accompanied by the Earnest Money Deposit for the specified amount The tenders shall be duly signed by the competent person No paper or sheet shall be detached from the tender document issued to the tenderers All the drawings shall be returned along with the tenders The tenders shall be liable for rejection if any of the above said requirements are not compiled with All the rates quoted in the tender should be inclusive of all materials including wastage, freight, all types of taxes including works contract tax, duties, service tax, royalties, erection, construction, testing of materials/samples brought on site for approval, tools, tackles, plant and equipments, supervision, overheads and profits, statutory charges, costs for licenses and any other expenditure etc. and shall remain firm till completion of work.
