Galeai Tu ufuli is calling a hearing next week, where Attorney General Talauega Eleasalo Ale will be asked to testify. The committee will also look into why the government gave $10,000 bonuses to long time employees who have since retired. PAOUT PROBE In late September of last year, Galeai wrote to Gov. Lolo atalasi oliga regarding questionable payouts to officials and employees of the previous administration that totaled $891, This letter followed committee hearings where ASG officials testified and Galeai asked the governor for the Executive Branch to conduct an investigation into the legality of these payments, with the intention of recouping any ASG funds which were paid out contrary to law. Officials of the previous administration who received pay- (ontinued on page 12) Hike in Port fees will not trickle down to employee OT, says ASG by Leua Aiono Frost Samoa News correspondent In light of in tug boat fees going up at the Port Administration, employees in the Water Division of Port are hoping to see their overtime paid, which is something that the director of the Department of Human Resources says will not happen, due to the governor s ban on OT and the government s interpretation of a federal law exempting seamen from OT. Last week, Samoa News reported that port fees for use of the government tug boats will go from $250 to $425 during regular hours and $300 to $510 for off hours on all ships and vessels entering and leaving the main dock. Port Administration s Water Division, which handles such services, has 24 employees who attend to all the deck work and man the tugboats. These employees, according to the wife of one employee, have not been compensated for their off hour work (OT) from last year, October 2013 until now. Attempts to speak with the Water Division employees about this matter were met with no comment, citing their job security as the reason. Samoa News was told they are all career service employees that continue to work despite non-payment of their OT. The woman, who wished not to be named, said that her husband used to bring home a decent pay check that was just sufficient for their survival, yet nowadays, due to the offhours not being paid, they are struggling to make ends meet. Samoa News was told by a Port official, who also did not wish to be named, that the previous administration paid the OT of the Water Division employees through charges to the shipping agencies for the overtime. Samoa News points out these are the same complaints from employees at the Port Admin s Airport Division. Gov. Lolo. oliga is on record saying that OT should be handled by shift scheduling, allowing for more employees to be hired to work regular hours, rather than have OT happen for a few. Further, Samoa News understands OT fees are still being charged to aircraft and private sector companies which use airport services, i.e. agriculture, customs, etc. after hours. The candidates who attended the forum, which was held at the AS gymnasium, were Aumua Amata, apu J. Jamias, ark Ude, eleagi Suitonu-hapman, Rosie Fualaau Tago Lancaster, Togiola Tulafono, Tua au ereti atautia Jr., and Tuika Tuika. Incumbent Faleoamavaega Eni Hunkin was absent. eleagi said she agrees with our involvement, noting that it s because we are patriots who have dedicated their lives to the United States for freedom and peace, and we are part of the freedom and peace. After the war in Afghanistan and Syria there will be another war and another, because that is what happens when we have to fight for peace and freedom, so yes I do support the US involvement, she said. She also noted that if we don t get involved then we re going to be in trouble. Rosie also agreed with the US involvement and pointed out that the United States of America is part of the world community. She also said that while she supports it, it s time for the US ongress to define and spell out what are the exit strategies. Its time for the leaders in ongress to define our mission, when they will get out and also resources, because currently a lot of resources are being confiscated by the enemy, and they are using it against our people, said Rosie. No one likes war, said Amata, who also noted in order for everyone to be safe, there are certain things that we need to do, and the whole world looks to us for that support. ark says the whole ongress has the power to declare war and he believes that the American Samoa delegate to ongress should have the final say, whether American Samoan troops go into war, as American Samoa has the highest casualty rate since the war on terror was established. Evil prevails when good men do nothing, and I believe that you have a situation, and in order for you to have peace you have to prepare for war, you have to maintain a strong presence. ark said American Samoa has an interest in making sure the world is safe. Togiola supports the military where they are represented or deployed legally by the United States Government, however we need to consider the fact that sometimes the lines are very fine; but when it becomes blurry we need to be strong in supporting our people who are putting their lives on the line. We can t afford to send troops abroad and then have turmoil domestically. I object to that, as we have seen that in the Vietnam war and the results of that were devastating and we don t need anymore of that. He said the USA occupies a special position in the world where everyone looks to America for leadership pertaining to terrorism around the world, because eventually it ends up on our shores. Tuika also supports the US involvement in the war against terrorism and two of his children served tours in Iraq. I support them and I support the US, he said. Freedom is not free we ve been at war for the last 12 years and war is not a good thing because some of us don t make it back, said apu. He also stated that what happened was, we should ve never gone into Syria. Our journalists told us to get the hell out and now we re back fighting an even tougher war on terrorism because we looked the other way. Sorry to say, we re involved, but that s the only way that we can enjoy this freedom, said apu. ereti said he takes this question with a heavy heart as this is the greatest nation on earth. We don t let the world see whether our national interests are at stake, we don t make decisions to colonize or to combat our troops. Our purpose is to transfer courage and democracy wherever they are called, as this is what America is. [photo: AS-NR/Dan Helsham] by Joyetter Feagaimaali i-luamanu Samoa News Reporter ROSS EXAINATION OF 1ST WITNESS IN PROSTITUTION ASE ONTINUES The first witness, a woman known only as IL, took the stand in the government s case against Lusia Tusi aka Sheila, a co-defendant in the prostitution case which also implicates Fa asaina Park, the owner of the araoke Bar in Satala in the jury trial that began on onday. In the second day of cross examination, IL admitted that she had two fishermen boyfriends, who gave her money after they had sex and she kept the money for herself. (See yesterday s edition for initial part of IL s testimony) Sheila and Park are before a jury of four men and three women, and each are charged with promoting prostitution second degree, a class felony punishable with up to seven years in jail, a fine up to $5,000 or both, and two counts of third degree assault, which are both class A misdemeanors carrying a jail term of up to one year in jail and a fine of up to $1,000 for each count. Prosecuting for the government is Assistant Attorney General, Jennifer Bargmann while representing Park is Fiti Sunia. Sheila is being represented by Assistant Public Defender Joel Shiver. During yesterday s cross examination, IL told the court that she had two boyfriends, Nelson and Sone who were both fishermen, and who gave her money after they have sex with her. IL said that when Nelson s boat leaves, that s when Sone s boat comes into town. Sunia pointed out to IL that during their meeting when she was staying at the shelter, IL admitted that all the money she was getting from her two boyfriends, she kept for herself, and also sent some to her family in Samoa. The court also heard questioning by Sunia, who said that IL had filed complaints to obtain money from Park through the Department of Public Safety and in Hawai i. She told the court that the idea to file her complaint in Hawai i came from the Social Services. Upon questioning, IL also said that she told W (the second complaining witness) to join her by filing the complaints with DPS and in Hawai i to get Park to pay for the hours they worked at the bar. Shiver, who represents the co-defendant, Shiela, asked IL if her job description at the bar was that she was to make the male customers buy beer for themselves, and for her if she wanted, and she replied yes. Shiver further pointed out to IL that Nelson was well known at the bar and that he s a good guy to hook up with because he has money, and IL agreed. Shiver asked if she receive between $50- $60 per night after having sex with one of her boyfriends, and she said yes. IL also admitted that when Nelson or Sone leave, they leave between $300- $400 with her, as they will be away for several months and she sends that money to Samoa to her family. Shiver asked if anyone asked her to go with Nelson or Sone, after the bar closes and IL responded yes. Sheila told me to go with Nelson when he s at the bar but when Sone comes to the bar its Park that tells me to go, said IL. The jury trial continues today, with more witnesses called to the stand, including W, the second complaining witness and the four police officers who investigated the case. SO OSEEA TINAE ARRAIGNED IN HIGH OURT, DENIES THE SEX HARGES Former Village mayor for Fagatogo, So osemea Tinae was arraigned in High ourt yesterday morning where he entered a plea of not guilty to the criminal charges of rape and sexual assault which have been leveled against him. The defendant during his initial appearance in the District ourt on onday had waived his rights to a preliminary examination hearing. The PX hearing is for District ourt s Associate Justice, John Ward to determine if the government has sufficient evidence to have this matter bound over to the High ourt. During his arraignment yesterday morning So osemea denied the charges against him, through his attorney atailupe Leupolu. According to the government s case, the defendant is accused of raping a 15-year-old girl near the Juvenile Detention enter. A retired police officer, So osemea is 71 years old, and he allegedly told the girl that he was doing this because her family owes him a lot of money and then he ordered her out of the aiga bus. Someone passing by the area, saw the defendant and the young girl and reported it the police,which is how the incident came to light. (In our first story of this incident, Samoa News reported that So osemea was the mayor of Fagatogo. However, according to documents given to Samoa News, he has been replaced, but it is unclear if this happened due to the allegations, or beforehand.) TWO EN ARRESTED FOR PPD IN OTTOVILLE Two men made their initial appearance in the District ourt onday morning on charges of public peace disturbance and third degree assault. According to the government s case Norman Skelton and Eddie Satele were reported to the police because they were walking around with a machete on the main road in Ottoville and swearing out loud. It s alleged that when police approached the intersection in the area, they saw the two men sitting at the bus stop and when they were getting close to them, Skelton and Satele took off running. Police lost them at that time, however other police officers who were in the same area ran into Satele and Skelton, who was allegedly waving the machete at the cops in a threatening manner, say court filings. ASG shipyard completes emergency repairs on Tri- arine boat in record time by Fili Sagapolutele, Samoa News orrespondent Tri arine International is conducting its own investigation into the cause of an incident earlier this month where its purse seiner, the aptain Vincent Gann collided with another purse seiner inside the Pago Pago Harbor, causing an oil spill. As previously reported by Samoa News, the Vincent Gann collided on Oct. 16 with the vessel Ocean hallenger, causing damage to the Vincent Gann. The incident also sent a crew member of the Ocean hallenger to the hospital. American Samoa Shipyard Service Authority board chairman and acting general manager, David Robinson, along with two other local government officials, confirmed that the Vincent Gann belonged to Tri arine and that the vessel went through repairs at the shipyard. Responding to Samoa News questions, Tri arine spokesperson Heidi Happonen explained that damage was minimal to the bulk of the vessel and was repaired in dry dock by local welders. She says repairs were completed last weekend and Tri arine was grateful for the wonderful efforts of the shipyard to get them done so quickly. We are still investigating the details of what caused the incident, however it appears that a minor electronic failure led to a variance in speed when the vessel was approaching the dock, resulting in contact with the skiff of another vessel tied up [at the dock], she said. When the incident happened and Tri arine needed to repair the vessel, the shipyard already had on the slipway the Tongan government s naval patrol boat for repairs, while other, smaller longliners were awaiting their turn on the slipway. Responding to Samoa News inquiries, Robinson said the shipyard was asked to carry out emergency repairs to the vessel as there were two very large holes in the hull one in the bow, and a large gash in the hull along the port side. He explained that all fluids had to be pumped out to avoid spillage and the vessel was trimmed to avoid further ingress of water whilst it was moved from one side of the harbor to the shipyard. Once the vessel had been dry docked the work of cutting out the damaged plate and carrying out internal repairs commenced under the watchful eye of the shipyard management, the Trimarine Operations anager and the hief Surveyor of Offshore arine Surveyors from Hawaii, Robinson said. A time frame was set for four days to complete the work as rescheduling of repair work that was underway on the ingdom of Tonga s naval patrol boat when the accident occurred had to be halted to make way for the Tri arine vessel, and work on smaller longliner fishing boats had to be put back, he said. Shipyard staff worked in shifts for 24 hours each day in order the meet the deadline. The workforce performed beyond all expectations, in terms of their dedication and high level of skill that they showed given the complexity of the repairs, Robinson said of the staff, adding that the Tri arine vessel was back in the water in less than a week after dry docking. Robinson paid a special compliment to shipyard operations manager Wayne Smith and the welders on the staff and all the other members of the team involved in the repairs. At the start of the job, he said, many people were skeptical that it could be completed in the allotted time and some doubted that the skill level in the shipyard was sufficiently high to complete the task effectively. The workforce has really shone through and proved without question that no job is too complicated or technically difficult for them to handle, he said and thanked the captain of the Tongan naval patrol boat and his Australian navy advisors for their kind consideration in allowing their vessel to be put down to make way for the apt VG, and for it to be dry docked again to complete the work that was originally scheduled. He also thanked surveyor Ward Graessle from Honolulu who made arrangements for the work to be carried out in the shipyard, and to all the contractors and suppliers who helped with labor and materials to complete the work on schedule. This is another fine example of Samoan ingenuity and skill sets all available in the Territory, Robinson said. FEDERAL SEAAN PROVISION A provision of the federal Fair Labor Standards Act (FLSA) exempts bona-fide seaman employees from the mandatory payment of a 1/2 time premium for overtime hours worked. It also provides an explanation as to who is considered a seaman, includes members of the crew such as sailors, engineers, radio operators, firemen, pursers, and stewards. According to the USDOL, seamen employed on U.S. Flagged vessels are still entitled to their minimum wage based on their industry of employment rather than their specific activities for all hours worked (as cited in minimum wage law for American Samoa). USDOL s Wage and Hour Division director for the Honolulu District Office, Terence J. Trotter told Samoa News yesterday that he will be in American Samoa next month for meetings, and is always ready to provide education on any topic that relates to Wage Hour programs. He suggested that if employees or workers who have questions on whether the seaman exemption is applicable to their employment would like to discuss their entitlement to an overtime premium under the FLSA, please call the local USDOL investigator at It is important to note that there is typically a 2-year statute of limitations (under the FLSA) on the recovery of unpaid wages, he said via from Honolulu. LOUIS (AP) School officials concerned about students being waylaid by protests are asking the St. Louis ounty prosecutor to wait until classes are not in session to announce whether a white police officer will face charges for the fatal shooting of an unarmed black 18-year-old. A grand jury is expected to decide by mid-november whether to indict Officer Darren Wilson for the Aug. 9 death of ichael Brown. The shooting led to weeks of sometimes violent protests in and around the St. Louis suburb of Ferguson and spurred a national conversation about race and policing. Law enforcement officials are already bracing for potential fallout from the decision. Last week, Riverview Gardens School District Superintendent Scott Spurgeon sent a letter signed by six other superintendents asking St. Louis ounty Prosecutor Bob culloch to announce the grand jury decision after 5 p.m. or on a weekend, preferably a Sunday, when there are typically no school activities or functions. Riverview Gardens spokeswoman elanie Powell-Robinson said there have been no threats against students but there is concern that protests could make it hard for them to get to or from school or for parents to pick them up because of traffic and road closures. (AP) Prosecutors filed murder charges Tuesday against two Utah residents in the slayings of two alifornia sheriff s deputies during a shooting rampage that also left a motorist and third deputy wounded. Luis Enrique onroy-bracamonte, who was booked into jail under the pseudonym arcelo arquez, and his wife, 38-year-old Janelle arquez onroy, appeared separately in court for an arraignment, but did not enter pleas. They were both shackled and in a courtroom cell surrounded by sheriff s deputies during their appearances. onroy-bracamonte, his left forearm heavily bandaged from an injury he suffered before his arrest, asked Sacramento Superior ourt Judge Helena Gweon to slow down as she read the charges against him. Federal immigration authorities say onroy- Bracamonte has been living in the U.S. illegally after being convicted in Arizona for selling drugs in 1997 and deported to exico twice, most recently in The 14-count complaint charges both with the murder of one deputy, though authorities say onroy-bracamonte fired the fatal shots. He alone is charged with the other slaying. onroy-bracamonte is facing special circumstances that could qualify him for the death penalty. At an afternoon news conference, Sacramento ounty District Attorney Jan Scully said she and Placer ounty District Attorney Ronald Scott Owens, who are jointly prosecuting the pair, have not yet decided whether to seek his execution. The facts speak for themselves, she said, but added that prosecutors follow a legal protocol in making such decisions. We re not going to treat this case any differently. The prosecutors, joined by sheriffs from both counties, also declined to say if they have determined a motive for the shootings or why the pair had journeyed to alifornia, where they apparently had no ties. The couple appeared to be living quietly in the Salt Lake ity area until their arrest in alifornia. Attorneys for onroy-bracamonte and onroy declined to comment on the charges after the hearing. Jeff Barbour, the public defender who is representing onroy-bracamonte, said he had just been appointed and hadn t seen the police reports. Peter meto, who is representing onroy, said he would reserve his comments for court. Authorities say onroy-bracamonte, 34, fired all the fatal shots during Friday s rampage, first killing Sacramento ounty Deputy Daniel Oliver, then wounding a motorist while attempting to carjack his vehicle. The charges say he used a.9mm handgun in both initial shootings. Both are charged with the attempted murder and attempted carjacking of motorist Anthony Davis, onroy as an accomplice. Davis is recovering from multiple gunshot wounds. The couple is also charged with two more attempted carjackings and one successful carjacking. They fled to neighboring Placer ounty, where onroy-bracamonte is charged with killing a second deputy and wounding a third using an AR-15 assault rifle. He and his wife are charged with the murder of Placer ounty homicide detective ichael Davis. The complaint says he fired the fatal shot but that she was an accomplice. The complaint alleges that onroy-bracamonte stole a Placer ounty sheriff s department vehicle along with a sheriff s department shotgun. It also accuses the pair of attempting to murder two other Placer ounty sheriff s deputies, harles Bardo and Joseph Roseli, along with attempting to murder and wounding Placer ounty deputy Jeffrey Davis, who was treated for a gunshot wound to the arm. The charges say onroy-bracamonte fired the assault rifle at all three deputies, with onroy as an accomplice. Other charges say the pair possessed an assault rifle that is illegal in alifornia, and that onroy-bracamonte was a felon in possession of the rifle, stolen shotgun,.9mm handgun and a.380 caliber handgun. Investigators were trying to determine how onroy-bracamonte avoided scrutiny despite being fingerprinted by police in West Valley ity, Utah, during a misdemeanor hit-and-run arrest in Utah authorities never connected him to his real name or his previous criminal record.
