Utu told Samoa News that the American Samoa Government is trying to float bonds to finance projects (such as the relocation of the Tafuna jet fuel tanks) and to re-finance high interest loans, such as the ASG loans from the Retirement Fund. He said in order to obtain the lowest interest rate, ASEDA has to answer all kinds of questions relating to the overall condition of ASG. It would be similar to a family applying for a mortgage loan and having to answer the Four/ Five - type questions from the banker. (The 4 or 5 s of credit is a common term in banking and refers to credit history, capacity, collateral, capitol and conditions.) What I enumerated at the cabinet meeting is the a ano (the gist) of all the questions that ASEDA would expect from the bond raters. Asked as to when ASEDA expects to get the ratings, Utu said in June. Utu said the bond raters are reviewers from Standard & Poor s (S&P), Fitch, and oody s. (They are known as the Big Three rating agencies that assign bond credit ratings). Galeai Tu ufuli explained that he was responsible for calling the hearing to find out the status of the ASG workforce compared to the approved F 2015 budget. He also said that the summary report is based on the numbers within their department. PROPOSED BILL According to the bill, the cost of a business license has remained the same for over 30 years and the number of businesses operating in American Samoa has grown significantly, creating ever increasing demands on the limited resources of the territory. It states that it is in the best interest of the territory to reasonably increase the price of business licenses to recoup the increased costs associated with regulating business activity in American Samoa and to ensure the availability of necessary infrastructure for such business to operate. The proposed increases for annual business license fees found in the bill are as follows; For alcoholic beverage establishments beer tavern from $50 to $500; retail store $75 to $500; wholesale store $25 to $250; per auction sale for beer importer $25 to $250; beer vendor $25 to $250; alcoholic beverage importer $1,000 to $2,000; and alcoholic beverage vendor $1,000 to $2,000; The following are included under alcoholic beverage establishments billiard and pool hall: per table $25- $250; public dance hall $50- $250; and per theater-auctioneer $6.50- $250; For general business concerns: garage and/or repair shop $24- $250; service station $25- $250 and all other business, profession, agencies or activities $250. For a business requiring multiple business licenses as a result of engaging in multiple activities subject to being charged a business license fee an initial fee is to be paid at the highest rate charged for any of the activities they undertake, and each additional business license fee is to be paid at the rate of $100 per licensed activity. FEE REDUED B SENATE AND APPROVED IN FINAL READING The Senator approved in final reading the bill; however, they have reduced the fees the administration had proposed in their bill, yesterday. The senate amendments: For beer taverns was reduced to $300; retail store to $150; wholesale store to $150 per location; billiard and pool hall per table to $150; pubic dance hall to $150; movie theater per location to $300, auctioneer per auction sale to $150; beer importer to $200; beer vendor to $200; alcoholic beverage importer to $1,500; alcoholic beverage vendor to $1,500; garage and repair shop to $150; and all other business, profession, agencies or activities to $150. HEARING During the Senate hearing on the bill to increase business license fees, Senator Uti Petelo pointed out that it s been 30 years since the business license fee has been increased and the canneries which are making millions compared to mom and pop stores pay exactly the same amount to obtain a business license, which is $25. These changes are long over due, said the Senator, but took issue with why the Administration would want to charge billiard businesses per table for each license, and not apply the same to the taxi and aiga bus businesses. According to Uti, he conducted research with the tax office, and the taxi owners who file their taxes are always claiming a loss yet they are making money (he alleges) and pointed out that there is a need to apply the same policy, and have each taxi be licensed per taxi. 3 samoa news, Thursday, April 2, 2015 Page 3 Senate learns Economic Development Fund never had any money Getting rid of it is due diligence for bond rating, says Treasurer by Fili Sagapolutele Samoa News orrespondent The Senate Budget and Appropriations ommittee is requesting the most updated report on collection of corporate tax revenue before moving forward with an administration bill which seeks to repeal provision of the law dealing with the Economic Development Fund, which had originally been created to provide money for the Development Bank of American Samoa (DBAS). This was the committee s decision following a hearing on onday, where ASG Treasurer Uelinitone Tonumaipea confirmed to senators that it was the recommendation of ASG s off island consultants to repeal the Economic Development Fund provision, as it would free up funds to guarantee the repayment of the bonds, and would also help ASG with its bond rating, as the off island investors will see that there is money available to repay the bond, making the ASG bond rating much better. Tonumaipea pointed out that 25% of the corporate tax revenues are pledged for the repayment of the bonds, to be issued by the American Samoa Economic Development Authority (ASEDA). urrent law states that the ASG Treasurer shall establish an Income Tax Reserve Account upon enactment of the Samoan Income Tax Act and deposit in such account 25% of all corporate taxes, as and when collected, unless at the time of collection the reserve account has a net balance of not less than $1 million. In 2008, a new provision was added which stated that, upon reaching this requirement of $1 million the funds thereafter collected by Treasury are to be deposited into the Economic Development Fund, and remitted to DBAS for economic development. The administration s bill seeks to repeal the Economic Development Fund provision, which Gov. Lolo atalasi oliga said has never been funded since it was established in The same testimony was heard from Tonumaipea when he appeared onday to testify before the Senate Budget and Appropriations ommittee. The Treasurer explained that the governor is working on other avenues for economic development, through various plans. Responding to Sen. Galeai Tu ufuli s question, Tonumaipea acknowledged that it is the government s fault this account was never funded since its creation by law. Sen. Uti Petelo asked, what happens to any additional revenue collected from corporate taxes if the Income Tax Reserve Account reaches $1 million? The ASG Treasurer said it would remain with the government. Uti wasn t pleased with the response, saying that the law should be specific as to where the additional money will go once the $1 million ceiling is reached. Tonumaipea agreed, saying that the Senate has the authority to make necessary amendments to the bill to address the issue raised by Uti. When asked by Uti as to the amount of money spent annually on tax refunds, Tonumaipea said that it s about $5 million not including the portion of the Additional hild Tax redit, which is funded by the U.S. Internal Revenue Service. Uti pointed out that the $1 million as cited in the current law is not enough, adding that every year, people complain about the long waiting period to get their refund checks, and he now knows that there is not sufficient money in this account. He called on the committee to make the necessary amendment, and other senators echoed this move. OITTEE debate During the committee s debate, Sen. agalei Logovi i motioned to table the bill and requested that an updated tally of corporate tax revenues be sought from the Treasury Department. He said this report is needed, for the fact that 25% of corporate tax is earmarked for the income tax account, and another 25% to reserve for the bond issue. There is not much money left in the general fund for ASG operations, he said. For example, if total corporate tax collection is $10 million that means $2.5 million is earmarked to repay the bond, another $2.5 million for the income tax account leaving only $5 million for government operations, and this is something that the Senate needs to revisit, he said. agalei, who is a former ASG Treasurer, during the Togiola Administration, told his colleagues that the reason the Economic Development Account was never funded is because there was no money for the account. Galeai and other senators agreed to first getting a financial report on corporate taxes to find out the status of collection, before the committee takes any further action on this measure. Uti recommended that the committee also revisit the $1 million allocated for refund checks and change it to $5 million to ensure there are sufficient funds for tax refunds. The committee also plans to request from the Treasury a detailed report of companies not paying their taxes to the government, and how ASG plans to collect outstanding corporate taxes. BAGROUND In October 2008, then Gov. Togiola Tulafono signed into law a bill which he had submitted to the Fono, to establish an Economic Development Fund in the amount of $10 million, meant to assist the DBAS achieve its purpose of promoting private enterprise and developing the local economy. Togiola said at the time that the measure would promote private enterprise and develop American Samoa s economy, thus benefiting the general public. Samoa News should point out that the bonds to be issued by ASEDA will pay off ASG s outstanding debts and provide revenue to fund projects such as major road repairs. It will also mean additional money for the new anu a passenger vessel and $10 million seed money for the government owned harter Bank. This and other issues dealing with road repairs were raised Tuesday during a Senate Public Works ommittee hearing called by committee chairman Sen. Alo Faauuga, after hearing concerns from senators on the terrible road conditions, and problems with getting school repairs done. Sen. agalei Logovi i said during an Education ommittee hearing last week that he had received reports from Tafuna High School about problems getting repairs done, due to the lack of available funds. The school maintenance division was transferred last year from the Education Department to Public Works, and the School aintenance account is funded with 1% of the fuel excise tax. Vaeao pointed out that many schools are complaining of repairs which need to be done, to which Voigt replied that additional funds are needed. Laolagi pointed out there are specific funds earmarked for school repairs, but schools have been told by the Public Works crew that there is no money to purchase necessary materials and supplies. He also recalled during last year s budget hearings, where several lawmakers voiced concern over the use of money earmarked for school maintenance being allocated for personnel costs. He recommended that Voigt look into the law for the school maintenance fund, which is to be used to purchase materials and supplies for school repairs not to pay employees. Laolagi said there is no need to hire more employees when there are no materials and supplies to carry out repair work. agalei asked if Public Works has a list of schools requiring maintenance work, saying that Tafuna High School has requested repairs to be done, but school officials were told by Public Works that money is needed to purchase materials and supplies. agalei asked Voigt as to why there is a problem with carrying out school repairs. The main issue is, money and Public Works spreads out funds available to cover as much of the priority repairs as possible, said Voigt, who reminded senators there are 28 public schools with some 300 buildings, and requests are prioritized based on urgent need. If a school is heading into a accreditation period, that school gets priority, and this is the same situation with Tafuna High School, which just recently completed its accreditation visit, for which they were given priority. We prioritize repairs to address critical needs, she reiterated and said she believed there was a second order for Tafuna High to continue repairs on a building which houses Special Education. She also believes that this is the first major repair work done to the high school for a very long time. While the committee is awaiting an official Treasury Department report on the revenue collected and how much money is left in the School aintenance account, agalei revealed that he had already contacted Treasury and learned that there is about $600,000 in the account balance. agalei asked how the school maintenance payroll is funded, and Voigt responded that they are paid through a school maintenance fund, because no budget was allocated when the school maintenance division was transferred to DPW. agalei quickly pointed out, that is a violation of the law which clearly states that this account is for purchase of materials and supplies, and not for personnel. BAGROUND F 2015 budget hearings last year revealed that $644,156 of the School aintenance fund is designated to pay just over 35 employees salaries and only $378,000 will go to the actual supplies and maintenance for all the public schools. It should also be noted that the division called School Facility aintenance, divides the public schools into 6 School aintenance Districts, inclusive of anu a, each with a supervisor, who is responsible along with the district team to respond expeditiously to any calls from public schools throughout the territory. The idea is to have a technical team of certified plumbers, electricians and other personnel available to be dispatched immediately to any request from each district, the governor s executive assistant Iulogologo Joseph Pereira told Samoa News in He said that under the setup of this network with DPW, the maintenance crew will also continue to visit school campuses every day to ensure there are no other problems, which will be later identified as worst. The senator also suggested to the DO Director that they need to levy a tax against the denominations conducting BINGO. He pointed out that there are many denominations and associations who conduct BINGO, yet they only pay $5 for a permit, and that needs to change. Given that the government needs the money, now would be a good time to make those changes, Senator Uti said, adding that these (BINGO) people collect a profit of close to $20,000 per game. Senator Tuiasina Esera then asked the DO Director to look into how the sewing shops are conducting their business, and also who they are employing mostly Filipinos. He explained that when you go to a store your money is placed inside a cash register, but not at the sewing shops. He said that their money goes into their pockets and he s certain that these people don t pay taxes. He also urged Lafaele to look at the money transfer services on island, where there s a lot of money leaving the island. It s unpleasant to see Asians sending money, a lot of money, off island money they are making on island, yet their profits are not spent on island, they send it to their homeland. Tuiasina told Lafaele to look into this matter, because the government should be collecting some money from these money transfer services. Senator agalei Logovi i asked the DO Director why the administration cannot increase the fees slowly or increase the fee from $25 to $50, because the he believes the proposed fees are too high and with the new fees, the business community will pass them on to the people, who are already suffering financially due to the high cost of living. Lafaele responded that this is not something they thought about overnight, rather it s been 30 years that the current fees have been in place. Secondly, he said, the proposed fees were based on the work done to obtain a business license. He said the cost of materials and equipment for business licenses and the services provided by government personnel for the business community are among the reasons the Lolo and Lemanu Administration is hiking the cost of a business license. He said the DO office buys the paper for the business license applications, and then after the application is filled out, someone will review it and then it goes on the director s desk, for his review, taking up his time. From there, it goes to the revenue office for their review as part of the process, also taking into account the labor and the materials used. Further, he said, there is the printing of the business license and then there are several agencies of the government needed to conduct an assessment at the place of business prior to issuing the license. The total for the government s services or labor, is the reason for the increase in the business license fees, he said again. He reiterated that this was not something they thought of overnight, but that they looked into this thoroughly, prior to proposing the fees. In a statement issued yesterday afternoon, the Treasurer points out that the tax system will not allow the processing of a tax return with a Social Security number that has been previously used by another taxpayer. According to the Treasurer, this causes undue work for the tax office, and delays returns for everyone involved. Tax payers are reminded of the rules to claim a dependent: The first is Relationship it must be the taxpayer s child or step child, whether by blood or adoption, a foster child, sibling or step sibling, or a descendant of one of these. The second is Residence that dependent must have the same principal residence as the taxpayer for more than half of the tax year. Exceptions apply in certain cases for children of divorced or separated parents, kidnapped children, temporary absences, and for children who were born or died during the year. Age is another factor the child must be under the age of 19 at the end of the tax year or under the age of 24 if a full time student for at least five months of the year; or if the child is permanently and totally disabled at any time during the year. Hundreds of sick people were identified on Friday, Saturday and Sunday as health teams went door-to-door in an operation that also aimed to remind people how to prevent Ebola. Retired N detective drowns while saving boy in Puerto Rico WASHINGTONVILLE, N.. (AP) A retired detective with the New ork Police Department has drowned after saving a 12-year-old boy struggling in the surf off a beach in Puerto Rico. The New ork Post reports that 44-year-old Jose Rosario was vacationing with his family when he saw the boy struggling Saturday in rough waters off Playa de Jobos, on the island s northern coast 65 miles west of San Juan. Relatives say Rosario got the boy onto a rock but then was swept out to sea by a wave. Rosario s body was recovered onday. The Times Herald-Record of iddletown reports that Rosario and his family lived for more than a decade in Washingtonville, 55 miles north of New ork ity. German policeman guilty of murder in cannibalism killing BERLIN (AP) A German police officer was convicted of murder on Wednesday for killing a man he met in an Internet chat forum devoted to cannibalism. A regional court in the eastern city of Dresden sentenced Detlev G., whose last name hasn t been released, to eight years and six months in prison, court spokesman Ralf Hoegner said. Judges concluded that the policeman killed a 59-year-old businessman from Hannover in November 2013 to fulfill his sexual desires, Hoegner said. Prosecutors said the Polish-born victim had fantasized about being eaten, but there was no evidence the suspect did so. The defendant, who worked as a handwriting expert, denied murder and said the victim killed himself. The killing took place at a small hotel south of Dresden owned by the defendant, who filmed himself dismembering the corpse. He later deleted the video, but police were able to reconstruct it. PERSONNEL REPORT ASG personnel workforce summary payroll report, ending Feb. 28, shows the government s total workforce of 4,665 with total payroll costs of just over $3.9 million (or $3,997,329.06). Breakdown shows that: 1,840 are paid by grants, which total $1.47 million 2,531 are paid by local money, with a total cost of $2.28 million 294 are paid by the Enterprise Fund, with a total cost of $239,500 As expected, the summary shows that the Department of Education has the highest number of employees at 1,639 with a total payroll cost at $1.49 million. Of that $1.49 million, $791,803 comes from federal grants (covering 890 employees) and $701,479 is under local revenue (covering 749 employees). Following DOE is the Health Department with 411 employees and a total personnel cost of just over $267,000.
