To achieve this joint venture, BAS, which has a pending application with the U.S. Federal Depository Insurance orporation (FDI), is proposing certain changes to the administration s bill now before the Fono allowing the government to set up a harter Bank, says Avamua Dave Haleck, chairman of the BAS board in a letter to Gov. Lolo atalasi oliga after a meeting last month....the work completed to date by the board and executive team of BAS and ASG has placed us jointly in a very strong position to open a new bank in a reasonably short time frame, Avamua wrote. We have already dedicated significant resources to the project. Working together, we can accomplish our mutual goal very soon. BAS would be in a very strong position to meet the ultimate objective of gaining FDI insurance in a few years, he said. (Faaauau itulau 16) The Port of Pago Pago on onday this week saw two container vessels arrive, relieving some of the community s concerns of food and dry goods shortages. The Singapore registered Papuan hief is one of the two vessels that docked at the main wharf on onday, while the other container ship was the ape Avatele from the U.S. mainland. Shortages of goods and supplies from the U.S. have occurred because of the West oast dockworkers slow down. A six-year agreement covering nearly 20,000 dockworkers at 29 West oast ports expired July 1, The sides have been negotiating since ay. Samoa News has been affected by the slow down with its U.S. supplies to publish a paper not making the boat. On behalf of the board, hamber chairman David Robinson this week provided written testimony on the hamber s view and concerns to Rep. Larry Sanitoa, the committee chairman. In his testimony, Robinson wrote that since Bank of Hawaii s announcement two years ago to eventually close down its local operations, in the meantime scaling back its services, while ANZ - Guam, American Samoa branch the other bank in the territory does not offer the full suite of banking services, the community has suffered, which has led to considerable difficulty in growing the local economy. He said that it s quite right that the administration has taken the lead in addressing banking issues affecting the local residents and the economy, in view of the fact that the privately owned ommunity Bank of American Samoa, is still awaiting federal regulatory approval to open for business. According to the board chairman, the hamber sees a number of positives with the administration s decision to set up a charter bank. For example, the bank will offer a full suite of bank services; enable the economy to further progress; and there will be support from Utah-based Zions Bank as a correspondent bank. However, there are a number of issues that are of concern and warrant further evaluation and explanation, he said. Gov. Lolo atalasi oliga has said that if all goes well as planned which includes passage of the bill to establish the charter bank and the companion bill to establish within the Treasury Department an Office of Finance, the local regulatory arm of the banking industry the charter bank should be operational in June this year. Robinson says the board s concern is whether the plan for operations in June allows enough time for all the issues to be considered and provides time for a seamless transition from BoH with a well supported 5-year plan. Another issue raised by Robinson is the $10 million in capital to be raised from the issuance of a bond, through the American Samoa Economic Development Authority. Who is going to buy the bond and is it a revenue bond not generation obligation? he asked and noted that another board concern is how will any operating losses be funded? Further, Would a better option be for the government to stand behind the ommunity Bank or provide a favorable enrollment to encourage another private bank with financial stability for internally guaranteeing deposits? (See separate story in today s edition on the ommunity Bank s proposal to the governor.) As previously reported by Samoa News, officials of ASG told senators last week who were highly concerned that the harter Bank will not be insured by the U.S. Federal Depository Insurance orporation but will look at acquiring its own interest for assets and deposits. (A charter bank is a financial institution whose primary roles are to accept and safeguard monetary deposits from individuals and organizations, and to lend money out. The details vary from country to country, or state to state, but usually a chartered bank in operation has obtained government permission on some level to do business in the banking sector, according to investopedia.com.) In the board statement to the House committee, Robinson noted that BoH has no intention of reversing its decision to close down local operations, although the Honolulu-based financial institution has made a commitment to remain until a new bank opens here. There is... no doubt that for the good of the economy and the community we need a second bank but it would seem advisable to devote more time to evaluating whether the establishment of a government owned harter Bank is in fact the best option for our banking needs going forward, he added. [courtesy photo] Senior police detective Paselio formally charged over nightclub incident by Joyetter Fegaimaali i-luamanu, Samoa News Reporter Several months have passed since the incident involving two police detectives which led to damages in a Pago Pago night club, but now the Attorney General s office has charged Vice and Narcotics Senior Police Detective Ioane Johnny Paselio with two counts of third degree assault, property damage, possession of a prohibited weapon, possession of arms without a license and public peace disturbance all misdemeanors. ourt filings say that, if convicted on all charges, the officer is looking at five years in jail. According to the government s case, on October 19, 2014 around 3a.m. police received a call about an incident at the night club in Pago Pago involving off duty police officers Paselio and Geoffrey Tagaloa. Police responded to the call and observed the unmarked police vehicle assigned to the Vice and Narcotics Division parked at the night club s parking lot, with Paselio standing in front of the vehicle looking towards the night club while Tagaloa was walking back and forth up the stairs to the main entrance. ourt filings say that police observed a shattered window and a group of men across from the club. The on duty police officers apprehended Paselio and Tagaloa, and transported them to the entral Police Station while witnesses at the club were told to go to the entral Police Station. Several witnesses told the police that Tagaloa was swearing at the waitresses and so when the doorman (who s the victim in this case) approached Tagaloa, it s alleged that Paselio intervened and punched the victim. The owner of the nightclub told the police that when the defendant was intervening, he was allegedly swearing and speaking in a loud manner and when he walked out of the club he punched the front glass window breaking it. The owner stated that defendant walked to the unmarked police vehicle and picked up a piece of wood. The victim in this matter told police that he was not the only one the defendant had punched. ourt filings say that defendant, after punching the door man, exited the club, punched the door man s brother and then turned around and punched the night club s window. Two witnesses told the police that they saw the defendant pull out a gun and threaten to shoot the doorman in this matter. It s alleged that on the night in question the police impounded the vehicle and when they searched the car, nothing was recovered. ourt filings further state that the value of the broken window was estimated at $800. ourt documents also indicate that a letter from the custodian of evidence for firearms at the Department of Public Safety says that the defendant does not have a license to carry firearms in the territory. 4 Page 4 samoa news, Wednesday, February 4, 2015 Tri-arine: some equipment has arrived; limited production to start soon by Fili Sagapolutele, Samoa News orrespondent Some critical equipment for Tri arine International s cannery has finally arrived in the territory and is now being unloaded after shipping delays occurred due to the dockworkers labor slow down at U.S. West oast seaports including those in Washington state, whose Legislature is urging President Barack Obama and the U.S. ongress to intervene. On the local front, the governor s executive assistant Iulogologo Joseph Pereira said yesterday that Gov. Lolo atalasi oliga has reached out to Interior Department s Assistant Secretary for Insular Areas, as well as ongresswoman Aumua Amata to intervene on our behalf with the Longshoreman Strike strangling shipping services to American Samoa, causing shortages of food and dry goods. On Tuesday this week the container vessel ape Avatele arrived at the Port of Pago Pago with containers of food items, supplies and other goods for stores to restocks shelves already empty. It also brought supplies for companies, including Tri arine whose cannery operations at Samoa Tuna Processors Inc., has been delayed due to needing required equipment. Responding to Samoa News questions, Tri arine chief operating officer Joe Hamby said, the stevedoring situation [on the West oast] is hurting a lot of people and companies. Samoa Tuna Processors is no exception. He confirmed yesterday that the vessel ape Avatele arrived onday carrying some critical equipment that had been delayed for some time on the West oast. We will be unloading these containers as quickly as possible and installing some key pieces of equipment to allow us to begin limited production the second half of this month. He says the local facility currently has about 300 employees on the payroll and they have hired an additional 62 employees. Some of those new employees are undergoing training and others are on standby pending the start of production, Hamby said through Tri arine s public relation s office. The ramped up schedule will be very deliberate and will depend on the process of installing and commissioning the production equipment, training employees, and market demand, he said. Asked about the impact if any Tri arine is faced with when it comes to its exports out of Pago Pago due to the shipping delays, Hamby replied, with regard to finished goods shipped to our customers, we are hopeful the regular twice monthly schedule of vessels from American Samoa to the US West oast will resume very soon and avoid any delays. However, if the current situation persists or worsens, there will be delays in those shipments. Starist s corporate spokesperson in Pittsburgh didn t immediately respond to requests for comments or answers to questions regarding the shipping delay s impact to its local operations. hamber of ommerce chairman David Robinson said over the weekend that exports from the canneries will be affected if consignments cannot be off loaded at West oast ports and this could lead to a decline in production and a resultant lay off of some of the [local] work force, causing more hardship in the community. Tri arine is home-based in Washington state, whose Legislature has called on President Obama, the Executive Branch agencies and ongress to take all steps necessary to assist the Pacific aritime Association and the International Longshore and Warehouse Union (ILWU) to reach a fair and equitable resolution of their negotiations and adopt a contract that will promote the competitiveness of the state s busy seaports, according to a copy of the resolution received by Samoa News. According to the proposed bill, the current law under ASA is vague and provides minimal direction on the sponsorship of aliens by corporations and this has led to the sponsorship of aliens by corporations in a manner that is inconsistent with the revised constitution of American Samoa. The territory would benefit from specific language to more effectively control and limit the sponsorship of aliens by corporations, the bill says. Amendments to the bill are as follows: Any corporation authorized by statute to do business in American Samoa, and certified by the Attorney General to sponsor aliens is pursuant to the following general requirements: an established record of financial responsibility; proof of timely payment of local taxes, fees and other government assessments; in the case of a new corporation, proof of an established business plan for operations in American Samoa; and good corporate citizenship. These general requirements may be expanded or elaborated upon from time to time through the promulgation of regulations by the Attorney General. Revisions would also include that No corporation may sponsor an alien who has any control or interest in the sponsoring corporation. Such persons who are deemed to have control or interest in a corporation shall include but not be limited to alien incorporators, investors, shareholders, directors and officers of any corporation incorporated under the laws of American Samoa. The bill also deletes the part which says Sponsorship of persons may be transferred from one employer to another, provided the board is satisfied of the need, and of the lack of permanent residents for such employment. The bill now goes to the Senate for their approval and if approved, it will then go to the Governor for his signature. BOND BILL BEFORE THE LAWAERS The bill to better facilitate the sale of bonds by the American Samoa Economic Development Authority was introduced in both the Senate and House late last week. The measure says that amendments were made in the 33rd legislature which originally created ASEDA to modernize and update the law after there were developments in the way the United States financial markets managed risk in the wake of the Global Financial risis, and further amendment is necessary to bring greater comfort to potential investors of ASEDA bonds. According to the administration bill, the proposed amendments provide investors further assurances that he government will not interrupt any pledged revenue streams supporting bond payments, but should that happen, then adequate provision shall be made by law for the protection of the holders of the bonds. Further the bill says that because of the urgency in ASEDA moving towards with issuing bonds in the month of April it is necessary for this act have an immediate effective date. The measure says that this will create another section which would indicate the contract with bondholders. The American Samoa Government pledges to and agrees with the holders of any bonds, including refunding bonds, issued under the provision of this chapter, that the ASG will not alter, impair, or limit the revenues pledged toward the repayment of the bonds until the bonds, together with applicable interest, are fully paid and discharged. AUA REP ASS FOR FONO SESSIONS TO BE AIRED ON TV AND RADIO Faimealelei Anthony Allen says there have been many requests by members of the public, especially the elderly and disabled population, to have Fono sessions aired on TV or the radio stations, as they want to hear what is going on in the Fono. He said it s his understanding this was done in the past and it s something the Fono should look at reviving. House Speaker Savali Talavou Ale responded that it s something that he will look into, as it s not a new request but it s worth looking into for the elderly population. He further stated that there is also a need for funding allocated for these airings, unless the radio stations will do it for free as a community service.

7 by Joyetter Feagaimaali i-luamanu Samoa News Reporter OTHER PLEADS GUILT TO HARGE A mother who attempted to smuggle a quantity of methamphetamine into the Tafuna orrectional Facility where her husband is incarcerated will be sentenced next month after admitting her crime to the court. The drugs were contained in cut up straws and hidden inside a bar of soap brought into the jail. Sula Tui was charged with unlawful possession of the controlled substance, methamphetamine and unlawful possession of controlled substance methamphetamine with intent to distribute. In a plea agreement with the government, the defendant has pled guilty to unlawful possession of controlled substance of methamphetamine and in return the government moves to dismiss the intent to distribute count. The drugs, say court records, were for defendant s husband, Samuel Wright who was arrested for his role in the armed robbery of the Faga alu Gold onda store last year. According to the government s case, detectives were informed that correction officers may have found what appeared to be meth in a package of soap, along with a fluid lighter inside a toothpaste package. They were found during the search of a package that was dropped off by the defendant for her husband. The correction officers told the investigators that defendant left the jail while they searched through the package she dropped off. Police found two cut up straws with both sides sealed, containing a crystalline substance. ourt filings say they went to defendant s residence in Faga alu but she was not there. Police contacted her and she agreed that she would go to the entral Police Station, which she did. It s alleged that defendant arrived at the police station with her two children. She told police her husband called her from jail to pick a package from his friend, which she did, and then dropped it off at the prison for him, according to court filings. Police asked the defendant if she had knowledge there was ice in the package she was picking up, and she said yes. An indictment charges Officer Joel Edouard with assault, attempted assault and official misconduct, all misdemeanors. He was released without bail after a brief appearance in state court in Brooklyn. A video appears to show one of the officers hitting the teen with his gun as the suspect tries to surrender. Video in the Edouard case shows officers struggling on the ground with a man they stopped on suspicion of drinking alcohol in public and possessing marijuana on July 23 in Brooklyn. The officer is seen in the footage briefly walking away from the struggle before returning and stomping on the man s head, even after the man was face down and being handcuffed, prosecutors said. Edouard, 39, was ordered to return to court on arch 24. If convicted, the suspended officer faces up to a year behind bars.

Simpkins, a former senior federal contracting officer for the Navy, could not be reached for comment, nor could his defense lawyer. With the arrest of Paul Simpkins, who was recently among the Defense Department s high ranking civilians, we have uncovered yet another tentacle of this pervasive bribery scheme, said U.S. Attorney Laura Duffy, whose office wants Simpkins sent to San Diego to face charges. The more we learn about the extent of the greed and corruption, the more determined we are to eviscerate it. Avamua recalled in the letter that BAS has been taking an interest in ASG s activity with the introduction of legislation to set up the harter Bank, saying that while the move will impact BAS s own activities, we can fully understand why our government would see a need to take matters into its own hands as our own progress in seeking regulatory approval to establish BAS has dragged on for longer than anyone expected. However, he says the harter Bank concept further restricts our ability to progress our application further due to the harter Bank effectively becoming a competitor and he emphasized that federal regulators have been very clear in expressing concerns regarding the ability of BAS to be competitive in a two-bank market and therefore the establishment of a third bank would inevitably increase this concern. He said it is BAS understanding that the harter Bank will be accessing the existing Bank of Hawaii premises in Utulei and Tafuna. Avamua said these premises were identified for the BAS operations, and they are now left with no easily identifiable and suitable premises from which to operate. Further, the inevitably of the establishment of a harter Bank would require the banking business of ASG and all semiautonomous agencies to be conducted with harter Bank. Other completed work includes access to the Automated learing House for all US and international transactions; formation of a robust Business Strategy document; a detailed set of budgets and forecasts covering the initial seven years of operation; establishment of all required Policies and Procedures, specifically designed for the American Samoa market; and completion of a detailed market assessment, including a consumer and commercial market survey. (AP) Rhode Island s gardeners, boxers and shameless swearers beware: you could be breaking the law and not even know it. A law restricting the amount of seaweed Barrington residents can take from the public beach to use as fertilizer has been on the books for nearly 200 years. Since at least 1798 it s been illegal to arrange to meet another person and engage in a fight a deed punishable by jail time of up to 10 years. And drivers who pass another vehicle on the left are still supposed to give a timely, audible signal an easing of the original 1916 law specifying that a bell or horn should be used. A Rhode Island lawmaker wants to repeal these outdated laws and many others a process that would happen every year if his proposal is passed. Some of the laws aren t just archaic, they re unconstitutional and problematic, said House ajority Whip John Edwards. Officials in the town of Smithfield decided in 2013 to enforce a law banning the distribution of anonymous negative campaign literature, despite a decision by the U.S. Supreme ourt that struck down a similar law in Ohio and upheld the right to anonymous free speech. The Rhode Island chapter of the American ivil Liberties Union sued the state and the town. In October, a federal judge declared that the 91-year-old state law was unconstitutional. The state and the town paid a total of about $4,500 for the ALU s legal fees, according to ALU Executive Director Steven Brown. The proposal would create a joint committee within the General Assembly to review laws and recommend which ones are no longer needed. The legislature would consider the suggestions at the start of each new year, said Edwards, a Democrat. Edwards got the idea from ansas, which in 2011 established an office to identify laws and regulations that are out of date, unreasonable and burdensome. The office has proposed repealing about 175 statutes and roughly 75 have been abolished so far, said John ilburn, a spokesman for the ansas Department of Administration. The office takes suggestions for laws to be stricken. A recurring request is to repeal the ban on marijuana, but that s not something the office has been willing to advocate for, ilburn said. One of this year s recommendations is to repeal a statute enacted in 1917 that requires the ansas Department of Transportation to review plans for large bridge projects. ilburn said it s unnecessary because licensed engineers now design the bridges. Tennessee created an Office of the Repealer in 2013 to cut the size of state government. Rhode Island State Librarian Thomas R. Evans compiled a list of the state s strange but true laws that are still in effect. Several involve livestock. One bars the sale of spirituous or intoxicating liquors near outdoor religious meetings. The House Judiciary ommittee recommended further studying the possibility of creating the joint committee of the repealer. A similar bill failed to gain traction in the previous two sessions. We re adding, adding, adding new laws every year. It s time to start reducing the laws that people have to comply with, Edwards said. They re just burdensome. One law still on the books in Rhode Island would be of particular note to anyone who gets busted for an antiquated offense (feeding garbage to swine without a permit, for example): Every person guilty of profane swearing and cursing shall be fined up to $5.

(AP) A construction worker saved a child from a domestic dispute that ended Tuesday when a man shot and killed his wife and turned the gun on himself, police said. At least two construction workers heard the screams of a child coming from a house under renovation in a neighborhood near downtown Scottsdale, police Sgt. Ben Hoster said. One of the workers ran into the home and found a husband and wife fighting over a gun, he said. The worker wrestled the gun from the husband and took the wife and child outside, Hoster said. The husband later emerged from the home with a handgun and told the worker to take the child away from the scene, he said. The worker complied, and the husband shot and killed his wife then himself, Hoster said. He is a hero for saving that kid s life, Hoster said of the worker. The two dead were identified Tuesday night as Douglas Drewer, 46, and Sarah Drewer, 33. Police had recently dealt with domestic issues at the couple s home. They served an order of protection on the husband Friday, took away several guns and ordered him to stay away from the wife and the home, Hoster said. (AP) A packed commuter train slammed into a sport utility vehicle on the tracks at a crossing on Tuesday night, killing seven people, injuring several others and sending hundreds of passengers scrambling to get to safety as the front of the train and the SUV burst into flames. The impact was so forceful the electrified third rail came up and pierced the train, authorities said. Among those killed was the SUV s driver, who authorities said had gotten out of her vehicle momentarily after the crossing s safety gates came down around her. The National Transportation Safety Board said a team was being sent to investigate. etro-north is the nation s second-busiest railroad, after the Long Island Rail Road. It was formed in 1983 and serves about 280,000 riders a day in New ork and onnecticut.
