Fa asala was facing charges of embezzlement, stealing and responsibility for the conduct of another to commit forgery which are all felonies, however he pled guilty to misdemeanor stealing, which was amended from felony stealing, while the remaining charges were dismissed as part of the government s plea agreement. Court filings say that the defendant stole money and postage stamps from the Post office from January to September 2009 in the amount of of $2,977.06, which he paid back. The defendant is represented by Mark Ude while prosecuting is Assistant Attorney General Camille Philippe. During sentencing earlier this week, Fa asala who s now serving as a pastor, said he s learned his actions aren t a good example for federal employees. He also noted this has reached the United States via the media. Mark Ude representing the defendant informed the court that Fa asala is remorseful of his actions and it s taught him a huge lesson. Ude then stated that it s clear that Fa asala did what he did for other people who needed help, he did not benefit from this incident. Kruse pointed out to Fa asala that helping others should be done with your own property not government property. According to the government s case the investigation was first conducted by the Federal government and later referred to the Attorney General s office for local prosecution. In the report that was handed to the AG s office, it is alleged that the defendant stole money and postage stamps from the Post office from January to September On Sept. 11, 2009 Special Agent Kevin Shimoda with the Office of the Inspector General initiated the investigation and a Letter of Demand for Indebtedness for Employee Accountable Credit Shortage. This letter notified the defendant the Postal Service was intent on collecting $2, and the Postal Service has already received the payment in the amount of $2, from the defendant. Chief Justice Michael Kruse accepted the plea agreement and scheduled sentencing for Fa asala on November 21, LEROY FAANITIU CHARGED IN RECEIVING STOLEN ITEMS A man who s facing one count of receiving stolen property in an incident which occurred in 2011 is being held behind bars on bail of $10,000. Leroy Fa aanitiu is represented by the Public Defender s office while prosecuting this case is Assistant Attorney General Julie Pasquale. The defendant made his initial appearance in the District Court this week. According to the government s case, police were informed that the defendant had in his possession an Ipod, CD s and game console which belonged to a woman whose home was robbed. Police approached the defendant at his residence and discovered the stolen items, which were later returned to the victim. The defendant informed police that he was unaware the items were stolen. COURT LENIENT WITH SECOND TIME OFFENDER The mother of a second time offender begged to please give her son a second chance, however the court pointed out that the defendant, Unaloto Mo omia, was involved in a previous stealing case. Mo omia had been convicted of second degree burglary for breaking into a garage and stealing a mountain bike. The defendant apologized for his actions and also pleaded with the court for leniency. Chief Justice Michael Kruse sentenced Mo omia to serve seven years in jail and pay a fine of $1,000. However, the court moved to suspend sentencing and placed the defendant on probation under condition that he serves 28 months. The court fashioned sentencing for Mo omia, noting that after serving six months in jail with credit for time served, the next six months he is to serve is under the guidance of Chief Probation Officer Tauili ili Silivelio Iosefo for community service, from Monday to Friday 7:30a.m. to 4p.m.; and after the first three months with the probation office the court will consider a motion for work release from detention, if he s gainfully employed. Kruse also ordered that the balance of detention will be stayed if he s gainfully employed, however if he s not employed he ll return to the Tafuna Correctional Facility.

3 Compiled by Samoa News staff HEAD OF LOCAL ARMY RECRUITING STATION HAS BIG PLANS FOR AS US Army Sergeant First Class (SFC) Miguel Diaz is the new head of the local US Army Recruiting Station, located on the second floor of the Laufou Shopping Center in Nuuuli. SFC Diaz, originally from Puerto Rico, has been in the Army for 12 years and is an infantryman turned recruiter. When asked if he enjoys being in the military, Diaz said, I love it. Being from an island himself, he said he is adapting well to life in the territory and enjoys being here. Diaz will be heading up the local Army recruiting station for the next three years and says he has a lot of plans as far as giving back to the community and implementing outreach programs that involve participation from everyone, not just the age group they are targeting for recruitment. He referred to the low ASVAB scores in the territory and said he is actively seeking interested teachers or any other individuals who are willing to tutor local students prior to taking the test. Some of his plans include hosting an Army Day for the public and holding swearing-in ceremonies for new enlistees during half-time of local sporting events, particularly football. SFC Diaz s team includes SFC Fenumiai, SFC Uiagalelei, SFC Shimasaki, and SSG Laban-Ilalio. More information on the many opportunities available in the US Army can be obtained by calling or visiting their office in Nu uuli. HAZARD MITIGATION COUNCIL APPOINTED A new Territorial Hazard Mitigation Council (THMC) is in place after being appointed by Gov. Lolo Matalasi Moliga, who says the board is responsible for overseeing and monitoring all mitigation activities for the territory. Among its many duties and responsibilities as cited by Lolo, is for the Council to assist the governor and ASG in identifying mitigation issues and opportunities facing American Samoa for the purpose of developing a comprehensive hazard mitigation strategy. Additionally, the board is to prepare strategies, policies and reports on hazard mitigation issues including policy recommendations to the governor, Fono and key agencies involved in mitigation related areas. Moreover, they are to ensure that territorial agencies collaborate and cooperate fully to develop and execute sustainable hazard mitigation actions that will reduce the risk posed by all hazards to the territory; and coordinate with and support territorial agencies efforts in obtaining and administering federal and other grants including post-disaster mitigation available through the federal Robert T. Stafford Disaster and Emergency Assistance Act, for the purpose of promoting hazard mitigation opportunities within the territory. The eleven members of the Council are: the Governor s Authorized Representative (GAR); two legislative members each appointed by the Senate President and House Speaker; Samoan Affairs Secretary or designee; Commerce director, Port Administration director, Public Works director, ASEPA executive director; head of the local Historical Preservation Office; executive director of ASPA; ASTCA s executive director; Chamber of Commerce chairman; and director of the local Homeland Security Department. The term for each member is 2-years, according to the memorandum, which further states that the Council is the authority for the American Samoa Hazard Mitigation Plan, mandated by the federal Disaster Mitigation Act of 2000 and the Robert T. Stafford Disaster Relief and Emergency Assistance Act. The new Council comes at a time when lawmakers have called for the new Lolo Administration to provide an update of the territory s hazard mitigation plan to address several hazard mitigation areas territory-wide, especially in Tualauta County. SUGGESTION TO INCLUDE DOE IN NCD BATTLE Some participants of the Medical Symposium held last weekend called for participation of the Education Department and all schools in American Samoa s fight against non-communicable diseases, especially diabetes, to ensure that young students are aware of the health risk involved in unhealthy living. Speakers who presented on diabetes reiterated during the symposium the need for residents to take good care of themselves, starting at a young age by maintaining a healthy diet and life style. Data revealed during the hearing, was explained by an off-island delegate as startling and frightening. Some delegates questioned why there was no full-participation of DOE at the symposium, to ensure the right message is delivered to students and others in the education system. Dr. Bethal Muasau with OBGYN at LBJ Medical Center, said DOE should be playing a big part in the fight against diabetes because we re looking at our children as they are the ones in the future to deal with diabetes for themselves and their families. Also to be targeted for battling NCDs are members of the Legislature, as part of an entire community collaborative effort, she said, and noted that some DOH staff have talked about prevention. Since prevention is key to the problem there is a need to have primary health care, to prevent a person from becoming diabetic. Esther Bruce, who is detailed by the Pacific Island Health Officers Association (PIHOA) to the local Health Department, said she has been hearing a lot about youth and eduction and suggested the revival of our presence in schools so that the kids, even teachers, the cafeteria [personnel], and [school] staff are bombarded with our message here because if they can t come to us, I don t see why we can t go to them. She says such a move would require grant funding, and that s also a way to beef up the nursing staff and beef up more medical resources. 4 Page 4 samoa news, Saturday, October 26, 2013 It s all downhill from Here! Howdy to friends & fans of the Hawk on this fine Saturday morning in Wonderland. Here we go with another Gut Wrenching episode of yours truly; The Hawk. Like it or not, those who are able to read this week s issue of the Samoa News, and of course Hawkeye, have definitely made it over the hump known as another week in history. The week also joins The Past in that it is all behind us, and like it or not, we must accept it for what it is! History is an unlimited measurement of the past. Once something slips in to history, it should never be referred to as The Past. What s past is past, and that s it! No need to attempt apologies for anything in the past as it is past. The same goes for History except for the fact that we as Homo-sapiens are permitted to discuss Historical Events such as the Birth of Hawkeye. We can always cut the conversations short by saying to each other: What a bunch of bull-s#it. Hawkeye is finished with his copy of the Book by Bill ORiley; Killing Jesus. If you have not purchased a copy of this fine piece of literature, Hawkeye will recommend that you rush right out and do so- either that or order the book online from the comfort of your dwelling. While the book could be considered by members of the organized religious groups as controversial, it certainly contains its share of merits such as is required of a New York Times Best Sellers! In this era of question marks when it comes to religious history, representing doubts as to whether or not certain things actually happened, and when, Hawkeye will suggest once again a good through read of this fine book. Even though Hawkeye has finished the book, he likes to get up in the wee hours of the morning and brush through its pages just to make sure he hasn t missed anything. So, referring to aforementioned sections of this text, Hawkeye will make his copy a piece of History in The dwellings Library! Hawkeye and Sweet Leanor do possess an extensive library in their Hooch, as both are bent on improving their knowledge of both historical and recent past events. Hawkeye recalls when there were arguments in the first Baptist Church of the Delta Pennsylvania Adult Sunday school Class over the translation of the Scriptures. Hawkeye made the mistake of asking why we needed to translate something that was written in plain English! {Hawkeye was a Visitor of the Adult class while being a member of the Jr. Sunday school Class.} This was supposed to have been a big deal for a junior member to be invited to a session of the Adult Classes which often as not ended up in physical altercations of one sort or another. One day the Adult Sunday school Teacher said; ya have ta read the bible between the lines! This is how Hawkeye learned to write between the lines as in Hawkeye, Ya have got ta read between the lines for it to make any sense! Over! Hawkeye has much respect for the written word, especially if it is written by Bill ORiley! Humm. The reasoning has certainly changed since the Scriptures were handed down. Some of the scriptures were passed on orally, while other parts were written. The Dead Sea scrolls have certainly put a lot of doubts to rest as to how it actually happened. Hawkeye often wondered why he never read in the good book about Nero watching Rome Burn while he played Dueling Banjo s on the Violin! Hawkeye often wonders if Nero s Violin was a Stradivarius. This is a top of the line musical instrument. Getting back to History, the Violin that was played while the Titanic Sank is now being auctioned off and is expected to go in excess of $300,000 to $350,000. This violin has only two strings left, however this is to be considered nebulous. Bringing back History for a short story, Hawkeye has learned that the last Hymn that was actually played by the Orchestra as the Un- Sinkable Titanic went to her watery grave was: Nearer My God To Thee. Now this is History Folks! The history of the Titanic s untimely sinking rocked the world as was known to Homo-sapiens of the era. The iceberg that jumped out in front of Titanic s Bow as she ploughed her way through the cold waters of the North Atlantic in the general direction of New York Harbor caused everyone on board to have a bad hair day. This not only made news around the world, but still makes news every time the mention of Titanic escapes across the lips of scholars that have been studying the sinking of the Old Girl for the past 80 some years! Hawkeye will now attempt to get this on his bucket list: Go visit the HMS Titanic two miles straight down from where she sank! From Sweet Leanor and Hawkeye until next week, Tofa Soifua (Disclaimer~ The opinions presented in this column are not necessarily those held by Samoa News) Cars pass under a tsunami advisory following an earthquake on Route 45 in Kamaishi city, Iwate Prefecture, northeastern Japan, early Saturday, Oct. 26, The earthquake of magnitude 7.3 struck early Saturday off Japan s east coast, the U.S. Geological Survey said, triggering small tsunamis but causing no apparent damage. Japan s Meteorological Agency said the quake was an aftershock of the magnitude 9.0 earthquake and tsunami that struck the same area in 2011, killing about 19,000 people and devastating the Fukushima Dai-Ichi nuclear power plant. 6 Page 6 samoa news, Saturday, October 26, 2013 Le Fatuga song competition officially starts on Tuesday by B. Chen, Samoa News Correspondent The Department of Youth and Women s Affairs (DYWA) will be kicking off its Youth Groups Fatuga Project Song Competition on Tuesday, Oct. 29 and it will be aired live on KVZK TV from the Governor H. Rex Lee Auditorium in Utulei. The Le Fatuga Project kicked off over a month ago with a sample song competition display and several workshops conducted by selected scholars led by Pulefa asisina P. Tuiasosopo, Malaeti a Siota Malu, and Teleiai Ausage who, according to DYWA deputy director Tapumanaia Galu Satele, discussed, taught and explained the research of original compositions of Samoan songs and the Samoan language or words appropriate for original songs. The project is a collaboration between DYWA, the Humanities Council and corporate sponsor Bluesky Communications. The objective is to revisit and help our young people gain an appreciation for original Samoan songs and learn how to compose and create their own, Tapumanaia explained. There are 12 groups already registered for the singing competition and the groups will be given the chance to compose their own original songs performed by up to 15 members. Songs are limited to ten minutes and groups are only allowed to use the fala, pake (wooden drum), or Samoan selo (plastic bucket with string attached to the middle). Viewers will get a chance to watch the show and participate in the selection of the winners through Bluesky text voting. There will be three judges for this competition and they will make up 60% of the scoring, while the other 40% will come from the text votes. Our goal is to give the community a show they can enjoy and at the same time provide these youth groups a chance to utilize the knowledge they learned from our selected scholars, Tapumanaia said. Tune in Tuesday Night at 6p.m. to see the show and listen to the performances of original songs by the first four groups that will be introduced. The original songs can be based on any theme that they choose, although the theme should include advice for the youth of American Samoa. DYWA acting director Pa u Roy Ausage said the project is also an opportunity for youth to learn, know, and understand the aspects of the Samoan language and its contribution to self development. This objective aligns and supports the theme of the ASHC in the development of the individual. No one was injured in the fire that broke out about 8:15 p.m. at the iconic department store on 34th Street, fire department spokesman Jim Long said. The fire was extinguished in about an hour. Fire marshals are investigating the cause, Long said. Macy s spokeswoman Elina Kazan said customers were allowed back in to gather their personal belongings after the scene was cleared. Long said 25 units and 106 firefighters responded. He said sprinklers in the building kept the blaze from spreading. Witnesses told local media they saw heavy smoke on the Seventh Avenue side of the building, which covers an entire city block and has 10 ½ levels. Dozens of onlookers gathered near the store to watch the spectacle. The store, in Manhattan s Herald Square, has over 1 million square-feet of retail space. Ex-Marine sentenced to more than 5 years for fraud SAN DIEGO (AP) A former Marine has been sentenced to more than five years in prison for accepting $150,000 from military contractors while he was deployed in Iraq. U.S. District Judge Janis L. Sammartino sentenced former Staff Sgt. Gilbert Mendez on Friday in federal court in San Diego. Mendez pleaded guilty on Dec. 6, 2012, to conspiring to defraud the United States by accepting hundreds of thousands of dollars in payments from defense contractors. The foreign contractors received millions of dollars in military contracts at Camp Fallujah, Iraq. Mendez also must pay $150,000 in restitution to the Defense Department. At least 7 hurt at Howard homecoming concert in DC WASHINGTON (AP) D.C. police say at least seven people have been injured when crowds rushed the gates during a homecoming concert at Howard University. Police spokeswoman Gwendolyn Crump says two officers were among those hurt and suffered minor injuries Friday afternoon. She says police now have the situation under control. Crump says one person had a broken leg but she did not have details about the other injuries. Fire officials say they were called to the Howard campus around 4 p.m. The university is holding an outdoor concert known as Yardfest. It is scheduled to include performances by artists including Big Sean, Juicy J and Bone Thugs-n-Harmony. Continued from page 4 Newtown residents relieved by the school s demolition NEWTOWN, Conn. (AP) Neighbors of the elementary school where 20 children and six adults were shot dead last year expressed relief as workers tore down parts of it on Friday. Demolition of the Sandy Hook Elementary School, which began in earnest on Thursday, is expected to take several weeks. Bill Clark, who lives across the street, said he believes it s going to take a long time for the community to heal after the December shooting massacre, committed by a gunman who had killed his mother at home before going to the school and who later killed himself as police closed in. We re a very strong community, and we re going to overcome this, Clark said. We re going to move on, and they re going to put up another beautiful school and we re going to move on. A task force of 28 Newtown elected officials voted unanimously in May to raze the school and build a new one on the property where it s located. Newtown has accepted a $50 million state grant for the project, and a new school is expected to open by December Students have been attending classes in a neighboring town. Iowa college says squirrel VANdalized prof s bicycle ESTHERVILLE, Iowa (AP) A squirrel roaming a community college in northern Iowa has become the No. 1 suspect in a vandalized bicycle incident. Officials at Iowa Lakes Community College in Estherville say the rodent chewed through two tires, a bicycle seat, a headlight and a taillight in the span of two days beginning Wednesday. The Sioux City Journal reports the bicycle owner, an associate math professor, reported the incidents to Estherville police. Another professor later came forward with a photo that shows the squirrel attacking the bike. A school spokeswoman says the photo helps solve the mystery of how the bicycle was vandalized without witnesses seeing a suspect. The professor has since parked his bicycle indoors. C Y M K C M Y K On Wednesday, October 23, 2013 the Flaming Sword of Samoa presented a wonderful showcase of talent with fire-knife dancers of all ages taking the stage at Tafuna High School gymnasium. According to organizers, the purpose of the show, as well as goal of the Flaming Sword of Samoa group, is to promote the art of fire-knife dancing here in the territory, where it all began. It was the artistry of HC Olo Letuli, who first added flames to the knife dance, and it was he who left a rich legacy of Polynesian entertainment which was taken up by members of his family, including several of his children and grandchildren, nieces and nephews. The evening s entertainment included a performance by 5th grader, Dayton Solitamali i Iaulualo from Hawai i, the 2013 World Junior Fire Knife Dance Champion, along with several other outstanding dancers. The evening s entertainment, which was free and open to the public, included a siva Samoa by the ASCC Samoan Club. The event was proudly sponsored and supported by the American Samoa Visitors Bureau and Pacific Energy, Ltd. along with the Flaming Sword of Samoa and Toa o le Afi groups. The event successfully recruited more dancers, who were able to register at the front desk to join the Flaming Sword of Samoa & Toa O Le Afi schools, where they are offered free lessons by these organizations to keep the exciting art alive. Vui Florence Saulo Phone: , [email protected] Faipule pushes for paved road connecting Tafuna & Malaeimi Cites road congestion and access to tsunami free zones Joyetter Feagaimaali i-luamanu, Samoa News Reporter Tualauta Faipule Florence Vaili Saulo is appealing to Governor Lolo Matalasi Moliga, to direct his attention to the recent passage of a House Resolution requesting his assistance in moving forward with plans to pave and seal the road connecting Tafuna and Malaeimi. Her letter cites traffic congestion and better tsunami free-zone access as two of the main reasons for paving the connecting road, as well as providing a much appreciated sigh of relief to the commuting public. Saulo s recent letter pointed out that the introduction and passage of the important Resolution is another example of progress and the many good things that branches of Government can accomplish when working together. She further noted that the Lolo and Lemanu administration has taken a giant leap with the immediate improvement of the existing infrastructure. In less than a year, a significant portion of our highways have been improved and upgraded, with more work still to come, she stated, adding that in that same spirit of improving our island roads the resolution was introduced. The resolution, according to the faipule, states that a significant number of Tualauta residents from the villages west of Malaeimi use the Malaeimi public highway every morning to transport their school children to the various schools in the Tafuna/Ottoville area. These parents have to encircle the Nu uuli/tafuna vicinity by going through the Airport road intersection, turning into Tafuna and again through the Faga ima and Fonoti intersection in order to reach Kanana Fou, and the Catholic schools at Fatu o Aiga. It is the same for our residents who are employed by the many businesses located in that same area, she wrote. (Continued on page 14) E te fia Poka? NYC officials: Baby, two boys die after Bronx fire NEW YORK (AP) New York police say three boys are dead after a fire broke out Friday night in a Bronx apartment building a few blocks from Yankee Stadium. Police identified the three as 5-year-old Elijah Artis, 2-year-old Jeremiah Artis, and 4-month-old Michael Turner. They were pronounced dead at a hospital. Police said a 25-year-old woman, 4-yearold girl and 4-month-old girl were treated for smoke inhalation and are in stable condition. Fire officials said the fire started in a secondfloor apartment of the six-story building. The Daily News reported witnesses seeing the children s mother leap from a window with a child in her arms. The building s owner couldn t be reached for comment. The building is about 10 blocks from the site of a 2007 fire that killed 10 people, including 8 children. Judge who changed baby s name could be disciplined NASHVILLE, Tenn. (AP) An East Tennessee magistrate who ordered a baby s name changed from Messiah to Martin has been charged with violating the state s Code of Judicial Conduct. Child Support Magistrate Lu Ann Ballew ordered the name change during a paternity hearing in Newport on Aug. 8. At the time, the parents were disputing the 8-month-old baby s surname. Mother, Jaleesa Martin, hoped to keep the name she had given the boy Messiah Deshawn Martin and father, Jawaan McCullough, wanted the baby to bear his last name. Ballew surprised both parents by ordering the baby s name be changed to Martin Deshawn McCullough, saying the name Messiah was not in the baby s best interest. Her written order said Messiah is a title that is held only by Jesus Christ. Labeling this child Messiah places an undue burden on him that as a human being, he cannot fulfill, the order said. That decision was overturned in Cocke County Chancery Court the following month, with the judge saying that Ballew s ruling violated the U.S. Constitution. Continued from page 7 Renewed fighting breaks out in east Congo GOMA, Congo (AP) The Congolese government and M23 rebels say that violence has resumed between the two sides in the country s volatile east. Congolese army spokesman Lt. Col. Olivier Hamuli confirmed that heavy fighting broke out Friday around 4 a.m. in Kanyamahoro. Each side accused the other of sabotaging the peace process after days of highlevel peace talks in the Ugandan capital failed to yield a breakthrough. Talks have repeatedly stalled in recent months amid sporadic clashes between Congolese forces and M23 rebels in eastern Congo. U.N. envoys have said that this time there were disagreements over amnesty, disarmament, integration and security arrangements for the M23 rebels. M23 launched its rebellion against the government last year and briefly seized the city of Goma. Report: 14 Iranian border guards killed in clashes TEHRAN, Iran (AP) Iran s official news agency says armed men have killed 14 border guards in clashes near the frontier with Pakistan. IRNA said authorities were investigating to determine whether the attackers were drug smugglers or armed opposition groups, both of which have occasionally ambushed Iranian troops. The clashes took place Friday night in a mountainous region outside Saravan, a town in southeast Iran on the border with Pakistan. IRNA said five other Iranian guards were wounded in the attack. Iran lies on a major drug route between Afghanistan and Europe, as well as the Persian Gulf states. Ethnic Baluch armed groups also operate in the area. Son of SF gardener in hit and run also arrested SAN FRANCISCO (AP) The son of a San Francisco gardener accused in a fatal hit and run has himself been arrested on suspicion of hit and run. Police spokesman Albie Esparza says 19-year-old Jonathan Burnoski, the son of Thomas Burnoski, had just left his father s arraignment hearing Wednesday when the right rear side of his car made contact with a bicyclist. Esparza says the younger Burnoski continued driving and was later detained at his home. The cyclist suffered only minor cuts. The San Francisco Chronicle reports that he was booked on suspicion of hit and run but had not been charged as of Friday. He was free on $15,000 bail. The elder Burnoski is accused of running over Christine Svanemyr as she relaxed in the grass with her baby and dog. (Continued on page 15) RIDGECREST, Calif. (AP) A gunman fatally shot a woman, injured a man and then led police on a wild chase through the Mojave Desert with two hostages in his trunk on Friday before he was killed in a shootout. Sergio Munoz, 39, who has a lengthy criminal record dating back at least two decades, began his rampage before dawn when he attacked the couple at the small house where he had been staying. Later, he called an officer on his cellphone and said he wanted to deliver a package to police and kill officers but, because he would be outgunned, he would wreak havoc elsewhere, Kern County Sheriff Donny Youngblood said at a press conference. Police now believe the package was the hostages, Youngblood said. Nearly two hours later, a sheriff s deputy spotted Munoz s car and a pursuit began over roughly 30 miles of highway, through arid stretches of desert about 150 miles north of Los Angeles. He ran traffic off the road, firing at least 10 times at passing vehicles with a shotgun and a handgun. No motorists were hurt, Youngblood said. At one point during the chase, which lasted more than 40 minutes, Munoz pulled over and the car s trunk popped open, revealing a man and woman inside, the sheriff said. Munoz then got back in the car and sped off. At some point, Munoz told pursuing officers, I m going to shoot them, Youngblood said. In the end, Munoz pulled over again on U.S. 395, turned in his seat and began shooting into the trunk. As many as seven officers opened fire and killed him. The hostages were flown to a hospital and were listed in critical condition, but expected to survive. Authorities didn t say what triggered the rampage, but there were signs that Munoz s life had been unraveling. Ridgecrest police said Munoz had lost his job recently. The sister of the man wounded in the pre-dawn shooting said Munoz was a heroin dealer that had been staying at her brother s house for about two weeks. Dawn Meier told The Associated Press her brother, Thaddeus Meier, told her Munoz was a good friend he wanted to help out so let him crash, but that Munoz had been using and dealing black tar heroin. She had moved out of the house a week ago to join her boyfriend, who lived next door, after he insisted she get her 7-monthold son away from the drug-related traffic. Her boyfriend, Derrick Holland, said that on Thursday he heard Munoz complaining in the yard about how his life was falling apart and he was losing everything due to drugs. Early Friday morning, Munoz showed up and told Thaddeus Meier, We re going to reduce all of the snitches in town, Dawn Meier said her brother recounted from the hospital. When her brother declined, Munoz shot him at least twice, then shot and killed his girlfriend. Munoz is a felon with convictions dating back to 1994, when he was sentenced to more than two years in prison for receiving stolen property. In May, he was arrested for possessing ammunition as a felon, but the felony charge was dismissed. Munoz was most recently arrested Sunday for investigation of possessing controlled substance paraphernalia and a felony charge of possessing ammunition as a felon. Dawn Meier said police found a syringe at the home where the slaying would happen five days later. There was some information that Munoz was using Facebook during the pursuit, but it wasn t immediately clear what the postings were, Youngblood said. Investigators recovered the shotgun and a handgun. A crime scene was set up along U.S. 395 at Kramer Junction, where two police helicopters landed amid numerous law enforcement vehicles. The highway was closed from Kramer Junction for 10 miles north because of the investigation. Schools in Ridgecrest were placed on lockdown as a precaution but were later reopened. The city of about 27,000 people is adjacent to the vast Naval Air Weapons Station China Lake, which sprawls over more than 1,700 square miles of desert. U.S. 395 runs through the western Mojave, below the eastern flank of the Sierra Nevada. Ridgecrest Mayor Dan Clark called the incident disturbing, especially because the small city is relatively crime free.

They will compete for the title of Miss Universe Saturday Nov. 9, 2013, in Moscow. (AP Photo/Richard Salyer) Faipule pushes for paved road Continued from page 9 Rep Saulo said with the new road, a significant portion of the vehicles that jam the area from the Airport road intersection to Manumalo Baptist School, and sometimes to the ASCC, can be removed from that equation as they would turn off into the Kanana Fou and Fatu o Aiga area through the proposed road. She stated this would provide residents with direct access to their immediate destinations rather than having them join the traffic blockage in Nu uuli and Tafuna and it would help avoid a lot of bad mornings for members of the public. THE SAFETY FACTOR OF THE MALAEIMI CONNECTION ROAD Another issue the faipule pointed out was the public safety factor this connecting road holds. The Office of Homeland Security, TEMCO, has designated the area beginning at the Aveina Store in Nu uuli, heading westward to the ASCC as a tsunami free zone. This means that when the island is on tsunami warning, residents from the low-lying areas of Tafuna, Iliili and Nu uuli will have to evacuate to higher grounds in the Malaeimi valley or higher. The new road, once opened, would provide a more direct and shorter route for the residents of Tafuna-Faga ima, Kokoland, Ottoville and parts of Nu uuli to these tsunami free zones. Because tsunamis hit within minutes of an earthquake or natural disaster, this road literally becomes the lifeline that a lot of our residents will depend upon, and minutes can mean the difference between life and death. Saulo said this road has actually been in existence for many years, but the existing surface is made up of boulders, river rocks, and lava rocks bulging from all sides and directions; to try and dodge one means running into another; and this is not to mention the puddles and debris that collect on the roadway during and after heavy rainstorms. There is no question that we need to open this road, the faipule said, and noted she has made this road project one of her priorities with her first term, given her strong belief that it s a result that is much needed. I realize that in the past there were attempts made to open it however for one reason or another, the Government and those families whose lands are involved just could not see eye to eye on some issues. She stated that while differences can arise in such matters, especially those that obligate family lands for public use, she s also cognizant of the fact that we cannot let that become a cause for abandoning this very important project. The Government must find common ground with these families for the public good. I for one am willing to work with your Office and the various Executive agencies in order to get this project going, and therefore pledge my support. COMMUNITY BRIEFS Continued from page 3 Meanwhile, Dr. Iuvale Vimoto with the Manu a Dispensary requested that DOH and LBJ bring to the Manu a Island group the same presentation that was made during the symposium, so that residents there are also fully aware of the importance to combat NCDs. FEDERAL CASE OF NHHC PARTNERS SET FOR NEXT MONTH A status hearing is set for next month at the federal court in San Francisco in the U.S. Justice Department s case against Quin Ngoc Rudin, aka Dean Rubin, aka David Rubin, who is one of the partners of the Native Hawaiian Holding Company, which is currently in a dispute with the local government over funds awarded to the organization under the National Emergency Grant program. The status hearing was to have been held late last month, but attorneys on both side filed a joint motion for continuation which was granted by U.S. District Court Judge Jon S. Tigar. The new court hearing is set for Nov. 22, at which time a trial date will be set or a change of plea will occur, according to court records. Attorneys sought a continuance, because the parties in this case are in ongoing discussions about the the appropriate resolution of the case and the defense counsel needs additional time to revive the voluminous discovery and conduct necessary investigation. A federal indictment early this year alleged that Rudin defrauded Cisco Systems Inc. and its subsidiary Cisco Systems Capital Corporation and Altura Pharmaceuticals, Inc. - through his own company called CGC Digital. Rudin, who entered a not guilty plea, is charged with wire fraud and aggravated identity theft. 15 NEWS IN BRIEF Ohio boy, 5, dies in hit-and-run on the way to school CLEVELAND (AP) A driver fatally struck a 5-yearold boy walking to school before dawn Friday and drove off, police said in making an appeal for any eyewitness tips. Israel Thornton was hit Friday around 7:15 a.m. and died at MetroHealth Medical Center. Cleveland police said the motorist left the scene, just north of the Cleveland Metroparks Zoo, driving a vehicle believed to be a lightcolored SUV or van. The license plate is not known. Police appealed for any information from eyewitnesses and said they would check for clues on a nearby business camera surveillance system. Family members sue over fatal Bay Area limo fire FRESNO, Calif. (AP) Family members of the five nurses who died in a limousine fire on a San Francisco Bay Area bridge have filed a wrongful death lawsuit against several companies, including those that maintained the limousine and customized it. The lawsuits filed on Thursday claim the companies were responsible for design and manufacturing defects with the 1999 Lincoln Town Car that caused the May 4 fire on the San Mateo-Hayward Bridge. The fire trapped nine women celebrating a friend s recent wedding, killing five of them. The limousine s driver survived. The California Highway Patrol has said the blaze was caused by a catastrophic failure of the rear suspension system. The air suspension failure allowed the spinning driveshaft to contact the floor pan, causing friction that ignited carpets and set the vehicle on fire, authorities have said. Prosecutors concluded no criminal charges were warranted. Lawyer says sheriff is bully in Florida bullying case LAKELAND, Fla. (AP) An attorney for a 12-year-old Florida girl charged in the bullying of a classmate who committed suicide says the sheriff who filed the charges is the bully in the case. Jose Baez said Friday that Polk County Sheriff Grady Judd has been making the media rounds after filing the charge at the expense of his client. Baez says his client, who is charged with stalking, is a child and that he s not going to allow the judicial system to bully her. Baez is best known for representing Casey Anthony during her 2011 murder trial. Judd told Orlando television station WFTV that the evidence against Baez s client is clear. The Lakeland girl and a 14-year-old schoolmate were arrested last week. Judd says they were primarily responsible for bullying 12-year-old Rebecca Sedwick. 2 killed, dog injured, by a drunken driver MENLO PARK, Calif. (AP) Authorities say a man and woman were killed and their dog was injured when they were struck during an evening walk by an alleged drunken driver in Menlo Park. Police Commander Dave Bertini says the couple, both in their 50s, were likely killed instantly in the crash on Thursday evening. After hitting them, the car jumped the landscaped center divide, clipped a car traveling in the other direction and came to a rest against a tree. Police arrested 54-year-old Marjorie Reitzell on suspicion of gross vehicular manslaughter and felony DUI. The Redwood City resident was still in her car when officers arrived at the scene. She complained of minor injuries. The dog s condition was unknown. Bertini says the Peninsula Humane Society arrived at the scene quickly and took the animal to a vet for treatment. Chan wrote, directed and stars in Chinese Zodiac, an action comedy which centers on a team attempting to steal some of the 12 bronze statues looted from a Chinese palace in Since the movie was released in China last year, two of the real statues were returned to China by Francois Pinault, head of Gucci s parent company. The 59-year-old Hong Kong star praised their return, saying he hopes all such looted artifacts can be returned from Western museums. Chan says he isn t quitting anytime soon. He completed filming on another installment in his Police Story franchise and is discussing another movie alongside Rush Hour co-star Chris Tucker. TRUTH of DOKDO! < < Government of Venezuela creates happiness agency CARACAS, Venezuela (AP) Americans may insist on the right to pursue happiness, but Venezuela now has a formal government agency in charge of enforcing it. President Nicolas Maduro says the new Vice Ministry of Supreme Social Happiness will coordinate all the mission programs created by the late President Hugo Chavez to alleviate poverty. Wags had a field day Friday, waxing sarcastic on Twitter about how happy they felt less than 24 hours after the announcement. Oil-rich Venezuela is chronically short of basic goods and medical supplies. Annual inflation is running officially at near 50 percent and the U.S. dollar now fetches more than seven times the official rate on the black market. In downtown Caracas, fruit vendor Victor Rey said he s now waiting for Maduro to create a vice ministry of beer. That would make me, and all the drunks, happy, he said. A TV journalist whose show was recently forced off the air after he refused to censor political opponents of the ruling socialists, Leopoldo Castillo, called Maduro s announcement an international embarrassment. Housewife Liliana Alfonzo, 31, said that instead of a Supreme Happiness agency she d prefer being able to get milk and toilet paper, which disappear off store shelves minutes after arriving at stores. It s a Calvary getting the ingredients for any meal, she said. Maduro blames the shortages on speculation and hoarding, but merchants say they would go broke if they adhered to government price controls. Chavez spent billions on social programs, from benefits for single mothers to handouts of apartments and major appliances. Maduro was elected April 14 as Chavez s chosen successor. 16 Page 16 samoa news, Saturday, October 26, 2013 Bangladesh politics focused on 2 moms, and 2 sons DHAKA, Bangladesh (AP) The future of Bangladesh depends on two men who don t live there, both heirs apparent to the South Asian nation s most powerful political dynasties. One is a technology consultant who lives in the U.S. with his American wife and young daughter. The other is reportedly studying for a law degree in London, living in selfimposed exile because he faces corruption charges at home. The consultant has been traveling the small towns of Bangladesh in recent weeks, stumping for his mother s re-election. The law student is meeting with powerful political aides in Saudi Arabia, helping plan his family s return to power. But give them a few years, and political observers here say either could become prime minister of Bangladesh, which has been ruled by their two families since the country s 1971 independence from Pakistan. Sajeeb Wazed Joy, 42, the son of Prime Minister Sheikh Hasina, and Tarique Rahman, the 46-year-old son of opposition leader Khaleda Zia, have emerged as the country s most powerful political heirs. Their influence is huge, said Hassan Shahriar, a political analyst in Bangladesh. It s almost impossible to rise to the top coming from outside these families in the current context. With national parliamentary elections due by early next year, Joy and Rahman are key figures in early campaigning for their mothers, and are earning serious publicity for themselves. By all indications, the men are headed for powerful roles in the country s two major political parties Hasina s Bangladesh Awami League and Zia s Bangladesh Nationalist Party. The seeming inevitability of the sons rise rankles some in Bangladesh, who see it as fundamentally undemocratic. This is not a kingdom, why would they come after their mothers? asks college student Mazharul Islam. Are there no other people with brains and guts to rule us? This is ridiculous. But political dynasties are a fact of life in South Asia. Families of independence leaders, first presidents or descendants of longtime leaders often have immense influence in politics. In Bangladesh, Hasina and Zia have headed their parties for decades without any open challenges. Look at India, Sri Lanka or Pakistan, Shahriar said. Bangladesh is no different. Cronies surround these families, back them and strengthen their hands to get slices of power. In Bangladesh a nation struggling to overcome extreme poverty, vicious politics and a recent string of horrific accidents linked to the garment industry photos of Joy and Rahman regularly feature on party posters along with their mothers. In recent weeks, Joy has toured the country, earning a rock-star welcome in towns where supporters lined up along highways and chanted party slogans. Scrums of reporters followed his motorcade. You are the future (of the country). You are the future leaders of this nation. I will always be with you, Joy, who lives in the U.S. state of Virginia, told a crowd of cheering students during the tour, aimed at boosting support for his mother. One day he will be prime minister. Why not? said Mahbubul Haque Shakil, an aide to Hasina. This is a democracy. If people want, he will surely be. Rahman, though he lives in Britain, plays a major role in deciding who will get nominations for the country s 300 parliamentary constituencies. Rahman whose mother was prime minister from 2001 to 2006 before becoming an opposition leader has campaigned for her in the past and reportedly handpicked several Cabinet members. Rahman left the country in 2008 with permission from a court on medical ground after his mother s five-year term expired amid chaos on the streets over elections. A caretaker government backed by the military arrested him and allegedly tortured him in custody. He holds the title of senior vice president of Bangladesh Nationalist Party. His rise comes despite allegations of corruption that could lead to his arrest if he returns to Bangladesh. A special court indicted Rahman in absentia along with one of his businessman friends in Prosecutors say Rahman and his friend received $2.73 million in bribes while his mother was prime minister. Another court issued an arrest warrant against Rahman accusing him of masterminding grenade attacks on a rally of Hasina when she was the opposition leader in At least 24 people died in that attack in Dhaka and Hasina narrowly escaped unhurt. Hasina s party says the attack was designed to eliminate political opponents. Zia s opposition party has denied all charges against Rahman, saying they are aimed at destroying her family s reputation. If Zia returns to power, it would pave the way for her son s return to Bangladesh. For now, he is working closely with his mother, but from a distance. He recently addressed some party meetings in London and visited Saudi Arabia to attend another. It s just a matter of time. He will return as a hero, said Jamilur Qadir, one of his supporters. He is the son of a former president. He is the son of a mother who did a lot for the nation as prime minister. I am sure he will come out clean and change things with good judgment. Zia entered the political fray after her husband, President Ziaur Rahman, was killed in a coup in Hasina, the elder daughter of independence leader Sheikh Mujibur Rahman, entered politics several years after her father and most of her family were assassinated in a 1975 coup. Together, the women overthrew former president and military dictator H.M. Ershad and restored democracy in Each has served as prime minister since then. Now, the two are bitter rivals with their eyes toward the future both their country s and their sons. Dynasties are not necessarily bad, the political analyst Shahriar said as long as good leadership emerges. In any case, other candidates for power have little hope of rising to the top. There are talented people, they have potential, Shahriar said. But they don t have family connections.
