2 ΕΚΘΕΣΗ ΤΗΣ ΕΠΙΤΡΟΠΗΣ ΣΧΕΤΙΚΑ ΜΕ ΤΙΣ ΕΡΓΑΣΙΕΣ ΤΩΝ ΕΠΙΤΡΟΠΩΝ ΚΑΤΑ ΤΗ ΔΙΑΡΚΕΙΑ ΤΟΥ 2014 Σύμφωνα με το άρθρο 10 παράγραφος 2 του κανονισμού (ΕΕ) αριθ. 182/2011 για τη θέσπιση κανόνων και γενικών αρχών σχετικά με τους τρόπους ελέγχου από τα κράτη μέλη της άσκησης των εκτελεστικών αρμοδιοτήτων από την Επιτροπή 1 (ο «κανονισμός επιτροπολογίας»), η Επιτροπή υποβάλλει με το παρόν έγγραφο την ετήσια έκθεση σχετικά με τις εργασίες των επιτροπών για το Η παρούσα έκθεση περιλαμβάνει επισκόπηση των εξελίξεων στο σύστημα επιτροπολογίας το 2014 και σύνοψη των δραστηριοτήτων των επιτροπών. Συνοδεύεται από έγγραφο εργασίας των υπηρεσιών της Επιτροπής το οποίο περιλαμβάνει λεπτομερή στατιστικά στοιχεία για το έργο κάθε επιτροπής. 1. ΕΠΙΣΚΟΠΗΣΗ ΤΩΝ ΕΞΕΛΙΞΕΩΝ ΣΤΟ ΣΥΣΤΗΜΑ ΕΠΙΤΡΟΠΟΛΟΓΙΑΣ ΤΟ Γενικές εξελίξεις Όπως περιγράφεται στην έκθεση του , όλες οι διαδικασίες επιτροπολογίας που προβλέπονται στην «παλαιά» απόφαση επιτροπολογίας 3, με εξαίρεση την κανονιστική διαδικασία με έλεγχο, προσαρμόστηκαν αυτομάτως στις νέες διαδικασίες επιτροπολογίας που προβλέπονται στον κανονισμό «επιτροπολογίας». Συνεπώς, το 2014, οι επιτροπές επιτροπολογίας λειτούργησαν βάσει των διαδικασιών που καθορίζονται στον κανονισμό επιτροπολογίας, δηλ. της συμβουλευτικής διαδικασίας (άρθρο 4 του κανονισμού επιτροπολογίας) και της διαδικασίας εξέτασης (άρθρο 5 του κανονισμού επιτροπολογίας), καθώς και βάσει της κανονιστικής διαδικασίας με έλεγχο που καθορίζεται στο άρθρο 5α της απόφασης επιτροπολογίας. Σύμφωνα με τη δήλωση 4, η οποία πραγματοποιήθηκε κατά την έγκριση του κανονισμού επιτροπολογίας, ότι όλες οι διατάξεις σχετικά με την ΚΔΕ σε υφιστάμενες βασικές πράξεις πρέπει να προσαρμοστούν στα κριτήρια που προβλέπονται στη Συνθήκη, η Επιτροπή εξέδωσε, το 2013, έπειτα από προκαταρκτική εξέταση που διενεργήθηκε το 2012, τρεις προτάσεις 5 για την ευθυγράμμιση 200 συνολικά βασικών πράξεων με τα άρθρα 290 και 291 της ΣΛΕΕ. Κατά τη διάρκεια του Νοεμβρίου 2014, η Επιτροπή κατά την έναρξη της νέας θητείας και στο πλαίσιο αναθεώρησης των εκκρεμών νομοθετικών προτάσεων, αποφάσισε να αποσύρει τις προτάσεις αυτές 6, εν αναμονή της έκβασης των μελλοντικών συζητήσεων μεταξύ των θεσμικών οργάνων στο πλαίσιο της διοργανικής συμφωνίας για τη βελτίωση της νομοθεσίας ΕΕ L 55 της , σ. 13. Έκθεση της Επιτροπής σχετικά με τις εργασίες των επιτροπών κατά τη διάρκεια του 2013, COM (2014) 572 fial. Απόφαση 1999/468/EΚ του Συμβουλίου της 28ης Ιουνίου 1999 (ΕΕ L 184 της , σ. 23), όπως τροποποιήθηκε με την απόφαση 2006/512/EΚ του Συμβουλίου (ΕΕ C 255 της , σ. 4). 3 1.2 Εξέλιξη της νομολογίας Με την απόφασή του στην υπόθεση C-427/12, Επιτροπή κατά Κοινοβουλίου και Συμβουλίου («υπόθεση βιοκτόνων»), στις 18 Μαρτίου 2014, το Δικαστήριο των Ευρωπαϊκών Κοινοτήτων απεφάνθη για πρώτη φορά σχετικά με υπόθεση οριοθέτησης μεταξύ πράξεων κατ εξουσιοδότηση και εκτελεστικών πράξεων. Με την προσφυγή της στην υπόθεση βιοκτόνων, η Ευρωπαϊκή Επιτροπή ζήτησε την ακύρωση διάταξης που προβλέπει την έγκριση μέτρων για τον καθορισμό των τελών που καταβάλλονται στον Ευρωπαϊκό Οργανισμό Χημικών Προϊόντων με εκτελεστικές πράξεις. Η Επιτροπή έκρινε ότι τα εν λόγω τέλη θα πρέπει να καθορίζονται με κατ εξουσιοδότηση πράξεις. Το Δικαστήριο απέρριψε ως αβάσιμη την προσφυγή της Επιτροπής. Μολονότι το Δικαστήριο δεν φάνηκε να αμφισβητεί το γεγονός ότι τα άρθρα 290 και 291 ΣΛΕΕ έχουν έκαστο το δικό του πεδίο εφαρμογής, αναγνώρισε ότι ο νομοθέτης διαθέτει διακριτική ευχέρεια όταν αποφασίζει να παρέχει στην Επιτροπή εξουσιοδότηση σύμφωνα με το άρθρο 290 παράγραφος 1 της ΣΛΕΕ ή εκτελεστική αρμοδιότητα σύμφωνα με το άρθρο 291 παράγραφος 2 της ΣΛΕΕ. Κατά συνέπεια, το Δικαστήριο έκρινε ότι ο δικαστικός έλεγχος περιορίζεται στα πρόδηλα σφάλματα. Στην απόφασή του της 15ης Οκτωβρίου 2014 στην υπόθεση C-65/13, Ευρωπαϊκό Κοινοβούλιο κατά Ευρωπαϊκής Επιτροπής (υπόθεση EURES), το Δικαστήριο απέρριψε την προσφυγή του Κοινοβουλίου, που ζητούσε την ακύρωση της εκτελεστικής απόφασης 2012/733/ΕΕ, εκτιμώντας ότι η Επιτροπή δεν είχε υπερβεί τις εκτελεστικές της αρμοδιότητες. 3

ΕΠΙΣΚΟΠΗΣΗ ΔΡΑΣΤΗΡΙΟΤΗΤΩΝ 2.1 Αριθμός επιτροπών και συνεδριάσεων Είναι σημαντικό να γίνεται διαχωρισμός μεταξύ, αφενός των επιτροπών επιτροπολογίας και αφετέρου άλλων φορέων, ειδικότερα των «ομάδων εμπειρογνωμόνων» που συγκροτούνται από την ίδια την Επιτροπή. Οι φορείς αυτοί παρέχουν τεχνογνωσία στην Επιτροπή 7 κατά τη χάραξη και εφαρμογή πολιτικής, και κατ' εξουσιοδότηση πράξεων, ενώ οι επιτροπές επιτροπολογίας επικουρούν την Επιτροπή στην άσκηση των εκτελεστικών αρμοδιοτήτων που της έχουν ανατεθεί με βασικές νομικές πράξεις. Η παρούσα έκθεση εστιάζεται αποκλειστικά στις επιτροπές επιτροπολογίας. Ο αριθμός των ενεργών επιτροπών επιτροπολογίας την περίοδο από την 1η Ιανουαρίου 2014 έως την 1η Ιανουαρίου 2015 υπολογίστηκε ανά τομέα δραστηριότητας (βλ. Πίνακα I). Για λόγους σύγκρισης, παρατίθενται επίσης τα στοιχεία για το προηγούμενο έτος (κατάσταση στις 31 Δεκεμβρίου 2013). Τα διάφορα τμήματα και συνθέσεις των επιτροπών δεν υπολογίζονται χωριστά δεδομένου ότι υπάγονται στην κύρια επιτροπή. 5 ΣΥΝΟΛΟ: *Συμπεριλαμβανομένης της επιτροπής προσφυγών (για τις ανάγκες του μητρώου επιτροπολογίας, η επιτροπή προσφυγών καταχωρίζεται ως επιτροπή υπό την αρμοδιότητα της SG στην πράξη, η εν λόγω επιτροπή τελεί υπό τη διαχείριση όλων των ενδιαφερόμενων υπηρεσιών). Το 2014, οι επιτροπές επιτροπολογίας ήταν γενικά δυνατό να κατανεμηθούν ανάλογα με το είδος της διαδικασίας βάσει της οποίας λειτούργησαν (συμβουλευτική διαδικασία, διαδικασία εξέτασης, κανονιστική διαδικασία με έλεγχο - βλ. Πίνακα ΙΙ). Ορισμένες επιτροπές που εφάρμοσαν πολλαπλές διαδικασίες έχουν διαχωριστεί από τις επιτροπές που λειτουργούν βάσει ενιαίας διαδικασίας. 6 πραγματοποιήθηκαν, καθώς και ο αριθμός των γραπτών διαδικασιών 8 που χρησιμοποιήθηκαν το 2014 μαρτυρεί επίσης την ένταση των εργασιών εν γένει, τόσο σε επίπεδο τομέα όσο και σε επίπεδο επιμέρους επιτροπών (Πίνακας ΙΙ). 8 Η ψηφοφορία μπορεί να λάβει χώρα είτε σε τακτική συνεδρίαση της επιτροπής, είτε, σε δεόντως αιτιολογημένες περιπτώσεις, με γραπτή διαδικασία, σύμφωνα με το άρθρο 3 παράγραφος 5 του κανονισμού επιτροπολογίας. 6

Τα στοιχεία αυτά ποσοτικοποιούν την απτή «παραγωγή» των επιτροπών (βλ. Πίνακα IV). 9 Σημειωτέον ότι μπορεί να υπάρχουν αναντιστοιχίες μεταξύ του αριθμού των γνωμών και του αριθμού των εκτελεστικών πράξεων/μέτρων στη διάρκεια οποιουδήποτε έτους. Η επιτροπή προσφυγών δεν εξέδωσε γνωμοδότηση σε 11 περιπτώσεις, ενώ σε 2 περιπτώσεις εξέδωσε θετική γνωμοδότηση. Η Επιτροπή αποφάσισε να εγκρίνει όλες αυτές τις εκτελεστικές πράξεις. αυτές επεξηγούνται στην εισαγωγή του συνοδευτικού εγγράφου εργασίας των υπηρεσιών της Επιτροπής. 8

9 2.4 Χρήση της κανονιστικής διαδικασίας με έλεγχο (ΚΔΕ) Όπως αναφέρεται στο τμήμα 1, η ΚΔΕ δεν επηρεάστηκε από τη μεταρρύθμιση της επιτροπολογίας το Η διαδικασία αυτή δεν μπορεί πλέον να χρησιμοποιείται στη νέα νομοθεσία, αλλά εξακολουθεί να εμφανίζεται σε πολλές υφιστάμενες βασικές πράξεις και θα συνεχίσει να εφαρμόζεται έως ότου ευθυγραμμιστούν οι εν λόγω πράξεις. Το 2014, εκδόθηκαν 165 μέτρα σύμφωνα με την ΚΔΕ (βλ. Πίνακα V). Το δικαίωμα της αρνησικυρίας ασκήθηκε σε μία περίπτωση (ΓΔ SANTE). Συγκριτικά, το 2013, το δικαίωμα της αρνησικυρίας ασκήθηκε μία φορά.
