THE DANISH LABOUR MARKET MODEL Stephan Agger Head of EU & International Affairs LO-DK Danish Confederation of Trade Unions
THE DANISH LABOUR MARKET MODEL A few Characterisitics Collective agreements the primary instrument for regulation No general labour statute No statutory minimum wage Very consensus based system Strong rights to take industrial action
THE FOUNDATION OF THE DANISH LABOUR MARKET MODEL. Let's turn back the time to After a seven month long major dispute - the employers had locked out more than half of the unionised workers - the two sides made peace and signed the September Compromise. In 1910 parliament passed the law on the industrial Court. Consensus that terms of employment and wages were not a matter for law but for negotiations between workers and employers. This consensus is still valid
SEPTEMBER COMPROMISE REPLACED BY THE GENERAL AGREEMENT Key points of GA- Constitution of the labour market Wages and working conditions are set in collective agreements Duty to keep the peace during the agreement period Mutual recognition The employer exercises the managerial right in cooperation with the elected shop steward The right to industrial action with a view to obtaining collective agreements including secondary action (sympathy strikes)
A COLLECTIVE AGREEMENT CONSISTS OF RULES REGARDING: Wages and working hours The length of working hours and overtime if any Holidays Shop stewards Conditions in case of illness and maternity/paternity leave Dismissal Rules on maternity/paternity leave Pension
COLLECTIVE AGREEMENTS DO NOT ENTER INTO FORCE AUTOMATICALLY Employers must accede to them This can be done in 2 ways: 1. The employer joins an employers' organisation which has a collective agreement with a trade union. 2. The (non-affiliated) employer joins the collective agreement for that occupational field by an adaptation agreement.
Industrial claims Basis: collective agreement System of Industrial Relations The Industrial Court Industrial arbitration The Dismissals Board LO Congress
