1 CIMB Bank Berhad s Terms and Conditions governing the Sign up for CIMB Enrich Platinum MasterCard and spend a minimum of RM500 to get 1,500 Welcome Bonus Miles Campaign Terms and Conditions The Campaign Period (1) The CIMB Bank Berhad s Terms and Conditions governing the Sign up for CIMB Enrich Platinum MasterCard and spend a minimum of RM500 to get 1,500 Welcome Bonus Miles Campaign ( the Campaign ) is organised by CIMB Bank Berhad ( CIMB ) and will be held from 5 October 2016 until 31 December 2016 (both dates inclusive) ( Campaign Period ).CIMB reserves the right upon giving notice of not less than fourteen (14) calendar days to change the duration and/or the commencement and/or expiry dates of the Campaign Period. Eligibility (2) Subject to the terms and conditions herein, the Campaign is open to any individual who applied for a principal CIMB Enrich Platinum MasterCard credit cards ( Card ) during the Campaign Period except for the persons mentioned in Clause 3 (hereinafter referred to as Applicant ). (3) The following persons are NOT eligible to participate in the Campaign:- (a) existing CIMB cardholders ; (b) CIMB cardholders who had cancelled his/her card within six (6) months before the application date for CIMB Enrich Platinum MasterCard under the Campaign; (c) permanent and/or temporary staff or employees of CIMB (including its subsidiaries and related companies); and (d) individual below the age of 18 years. Participation Criteria (4) The Applicant who fulfills the campaign criteria below ( Eligible Cardholder ) shall be entitled to receive 1,500 Welcome Bonus Miles ( Welcome Bonus Miles ) : (a) submit the application for the Card within the Campaign Period; (b) the application for the Card is successfully approved by CIMB no later than 31 January 2017 ; and (c) spend a cumulative of at least RM500 on retail spending (as defined in Clause 6) using the Card (including retail spending charged to supplementary Card(s))within sixty (60) days from the Card approval date. For avoidance of doubt, conditional approval of the Card application granted by CIMB shall not be deemed the Card has been successfully approved. The Eligible Cardholder will be able to check the card approval date from the card mailer when the Eligible Cardholder receives the Card. (5) Retail spending transaction shall mean total retail purchases locally and overseas including online purchases for goods and services incurred for personal consumption and shall not include betting or gaming transactions. For the avoidance of doubt, the following transactions are also herein expressly excluded and shall not be treated as retail spending transactions: i) Quasi Cash transactions (example: betting and/or gaming transactions); ii) Monthly instalments under any instalment payment facility provided by CIMB; iii) Standing instructions/ auto-payment service; iv) Payment of annual fees or service charges, delivery charges, cash payments, card replacement fee, government service tax, dispute charges, fraud charges or any other fees, charges or penalties whether imposed by CIMB or otherwise; v) Transactions for payments made towards insurance premiums and/or takaful contributions of any kind whatsoever; and vi) Cash advance/withdrawal/deposit transactions. Any determination by CIMB as to what constitutes a retail spending transaction shall be conclusive and shall not be challenged in any manner whatsoever, save for manifest error. Foreign currency retail spending transactions shall be converted to Ringgit Malaysia (RM) for the purpose of calculation of retail spending and shall be based on CIMB s prevailing exchange rate.

2 (6) Retail spending transaction is calculated as the total consolidated (principal and supplementary/ies) Card spending. If the Eligible Cardholder has multiple supplementary Cards, the retail spending transactions made on all Cards by the principal and supplementary cardholders shall be consolidated and not be viewed individually. Example: Cardholder A has 1 principal Card and 2 supplementary Cards. All transactions on any of those Cards will be consolidated to tabulate the minimum spend of RM500 for the Campaign. (7) The tracking of the retail spending transactions is based on the transaction dates and/or time (Malaysian Time) as captured by CIMB transaction records during the Campaign Period. (8) CIMB shall not be responsible for any failure and/or delay in the transmission of evidence of sales transactions by MasterCard, merchant establishments or any other party. (9) Only the principal Eligible Cardholder is entitled to receive the Welcome Bonus Miles. (10) The Welcome Bonus Miles will be credited into the Eligible Cardholder s Card within six (6) weeks after sixty (60) days from the Card approval date and will be reflected in the Eligible Cardholder s Card statement as BONUS MILES. (11) By participating in the Campaign, the Eligible Cardholder who applies for the Card during the Campaign Period hereby gives his/her express consent for CIMB to share their information with third parties solely for the purposes of fulfilling the reward of Welcome Bonus Miles under the Campaign. (12) The Campaign will supersede other welcome bonus campaign and each Eligible Cardholder shall only be entitled to receive the Welcome Bonus Miles on a one off basis. General Terms and Conditions (13) By participating in the Campaign, the Eligible Cardholder is deemed to have read, understood and agreed to be bound by the Terms and Conditions stated herein and agree that any and all decisions fairly and reasonably made by CIMB in relation to every aspect of the Campaign shall be final and conclusive. (14) The Eligible Cardholders must not be in breach of the Cardholders Terms and Conditions and or CIMB Enrich MasterCard Co-Brand Card Plan Terms & Conditions and other terms and conditions governing the Card otherwise the Eligible Cardholders will be disqualified from participating in this Campaign and shall not be entitled to receive the Welcome Bonus Miles. (15) CIMB reserves the right upon giving prior notice of fourteen (14) calendar days to substitute the Welcome Bonus Miles under the Campaign with any other item(s) of similar cost. The Welcome Bonus Miles is not exchangeable for physical cash or credit of any kind. (16) CIMB shall not be liable to any Eligible Cardholder or any party for any loss or damage of whatsoever nature suffered (including but not limited to, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party) howsoever arising, in relation to the participation or non-participation in the Campaign or receipt, redemption or use of the Welcome Bonus Miles unless the same arises from and is caused directly by CIMB s gross negligence or wilful default. (17) CIMB reserves the right to cancel, terminate or suspend the Campaign upon giving prior notice of fourteen (14) calendar days. For the avoidance of doubt, cancellation, termination or suspension by CIMB of the Campaign shall not entitle Eligible Cardholders or any other persons whatsoever to any claim or compensation against CIMB for any losses or damages suffered or incurred as a direct or indirect result of the act of cancellation, termination or suspension.

3 (18) CIMB reserves the right upon giving prior notice of twenty one (21) calendar days to vary (whether by addition, deletion, modification, amendment or otherwise howsoever) ( the Amendment ) any of the Terms and Conditions herein. Notification to Eligible Cardholders in respect of the Amendment shall be effected at CIMB s absolute discretion through any one of the following means of communication, namely, by posting a notice regarding the Amendment at each of CIMB s branches or via CIMB s website or by any other means of notification which CIMB may select and the Amendment shall be deemed as binding on the Eligible Cardholder as from the date of notification of the Amendment or from such other date as may be specified by CIMB in the notification. Eligible Cardholders acknowledge and agree to access CIMB s website at regular intervals to view the Terms and Conditions and to ensure that they are kept up-to-date with any changes or variations to the Terms and Conditions. (19) The Terms and Conditions herein as amended from time to time shall prevail over any provisions or representations contained in any other promotional and/or advertising material in relation to the Campaign. The terms and conditions herein shall apply to and be read together with the provisions of the CIMB s Cardholder Terms & Conditions and the CIMB Enrich MasterCard Co-Brand Card Plan Terms & Conditions. (20) CIMB may at its sole and absolute discretion disqualify and/or reject any Eligible Cardholder that it determines or reasonably suspects to be tampering with the process or the operation of the Campaign, or to be acting in breach or potential breach of the Terms and Conditions herein. (21) CIMB shall not be liable or held responsible to the Eligible Cardholders in any manner whatsoever if CIMB is unable to perform any of its obligations stipulated herein where such inability is due directly or indirectly to any act of God, industrial dispute, war, strike, riot, technical or system failures or anything beyond CIMB s reasonable control. (22) In the event of any inconsistency(ies), conflict(s), ambiguity(ies) or discrepancy(ies) between the Bahasa Malaysia and English version of the Terms and Conditions herein, the English version of these Terms and Conditions shall prevail. Notwithstanding the aforementioned where request has been made by the Eligible Cardholder and noted and acknowledged by CIMB in its records that the Bahasa Malaysia version of the terms and conditions shall govern the Eligible Cardholder s Card, then the Bahasa Malaysia version of the Terms and Conditions herein shall prevail. 4 Terma-terma and Syarat-syarat CIMB Bank Berhad yang mengawal Kempen Mendaftar untuk CIMB Enrich Platinum MasterCard dan membelanjakan minimum RM500 untuk mendapatkan 1,500 Welcome Bonus Miles Terma-terma dan Syarat-syarat Tempoh Kempen (1) Terma-terma dan Syarat-syarat CIMB Bank Berhad yang mengawal Kempen Mendaftar untuk CIMB Enrich Platinum MasterCard dan membelanjakan minimum RM500 untuk mendapatkan 6,000 Welcome Bonus Miles ( Kempen ) adalah dianjurkan oleh CIMB Bank Berhad ( CIMB ) dan akan berlangsung dari 5 Oktober 2016 hingga 31 Disember 2016 (termasuk kedua-dua tarikh) ( Tempoh Kempen ). CIMB menyimpan haknya apabila memberikan notis yang tidak kurang daripada empat belas (14) hari kalendar untuk menukar tempoh dan/atau permulaan dan/atau tarikh tamat Tempoh Kempen. Kelayakan (2) Tertakluk kepada terma-terma dan syarat-syarat di sini, Kempen ini adalah terbuka kepada mana-mana individu yang memohon untuk kad kredit CIMB Enrich Platinum MasterCard utama ( Kad ) semasa Tempoh Kempen kecuali orang disebut dalam Klausa 3 (selepas ini dirujuk sebagai Pemohon ). (3) Orang berikut adalah TIDAK layak untuk menyertai Kempen ini:- (a) pemegang kad CIMB sedia ada; dan (b) pemegang kad CIMB sedia ada yang telah membatalkan kad CIMB mereka dalam tempoh enam (6) bulan sebelum tarikh permohonon kad kredit CIMB Enrich Platinum MasterCard dalam Kempen ini. (c) (d) kakitangan atau pekerja-pekerja CIMB yang tetap dan/atau sambilan (termasuk subsidiari-subsidiari dan syarikat-syarikat berkenaannya); dan (e) individu di bawah umur 18 tahun. Kriteria Penyertaan (4) Pemohon yang memenuhi kriteria kempen di bawah ( Pemegang Kad Layak ) akan mendapat 1,500 Welcome Bonus Miles ( Welcome Bonus Miles ): (a) menyerahkan permohonan untuk Kad semasa Tempoh Kempen; (b) permohonan untuk Kad berjaya diluluskan oleh CIMB tidak lewat daripada 31 Januari 2017 ; dan (c) membelanjakan sekurang-kurangnya RM500 secara terkumpul untuk perbelanjaan runcit (sebagaimana yang ditakrifkan dalam Klausa 6) menggunakan Kad (termasuk perbelanjaan runcit yang dicajkan kepada Kad(kad-kad) tambahan dalam tempoh enam puluh (60) hari dari tarikh kelulusan Kad. Untuk mengelakkan keraguan, kelulusan bersyarat permohonan Kad yang diberikan oleh CIMB tidak harus dianggap sebagai Kad telah berjaya diluluskan. Pemegang Kad Layak boleh menyemak tarikh kelulusan kad dari kiriman kad apabila Pemegang Kad Layak menerima Kad. (5) Transaksi perbelanjaan runcit bermakna jumlah transaksi pembelian runcit dalam negara dan luar negara termasuk pembelian dalam talian untuk barangan dan perkhidmatan tertanggung untuk penggunaan peribadi dan tidak termasuk transaksi pertaruhan atau perjudian. Bagi mengelakkan keraguan, transaksi-transaksi berikut adalah secara ekspres dikecualikan dan tidak akan dianggap sebagai transaksi perbelanjaan runcit:- (i) Transaksi Tunai Kuasi (contohnya: transaksi pertaruhan dan/atau perjudian); (ii) Ansuran bulanan di bawah kemudahan pembayaran ansuran yang disediakan oleh CIMB; (iii) Arahan tetap/perkhidmatan pembayaran auto; (iv) Pembayaran yuran tahunan atau caj perkhidmatan, caj penghantaran, pembayaran tunai, fi penggantian kad, cukai perkhidmatan kerajaan, caj pertikaian, caj penipuan atau yuran-yuran, caj-caj atau penalti-penalti yang lain sama ada dikenakan oleh CIMB atau sebaliknya; (v) Transaksi untuk pembayaran terhadap premium insuran dan/atau sumbangan takaful dalam apa jua jenis sekalipun; dan (vi) Transaksi pendahuluan/pengeluaran/deposit tunai. Apa-apa penentuan oleh CIMB tentang apa merupakan transaksi perbelanjaan runcit adalah konklusif dan tidak boleh dicabar dalam apa cara sekalipun kecuali untuk kesalahan yang nyata. Mata wang asing transaksi

5 perbelanjaan runcit akan ditukarkan kepada Ringgit Malaysia (RM) untuk tujuan pengiraan perbelanjaan runcit dan hendaklah berdasarkan kadar pertukaran semasa CIMB. (6) Transaksi perbelanjaan runcit adalah dikira berdasarkan kepada jumlah penyatuan perbelanjaan Kad (utama dan tambahan). Jika Pemegang Kad Layak mempunyai beberapa Kad tambahan, transaksi perbelanjaan runcit yang dilakukan ke atas semua Kad oleh pemegang-pemegang kad utama dan tambahan hendaklah disatukan dan tidak akan dilihat secara individu. Contoh: Pemegang kad A mempunyai 1 Kad utama dan 2 Kad tambahan. Semua transaksi yang dilakukan pada manamana Kad tersebut akan disatukan untuk memenuhi perbelanjaan minimum RM500 untuk Kempen ini. (7) Pengesanan transaksi-transaksi perbelanjaan runcit adalah berdasarkan tarikh dan/atau masa transaksi (waktu Malaysia) yang direkod dalam rekod transaksi CIMB semasa Tempoh Kempen. (8) CIMB tidak akan bertanggungjawab untuk apa-apa kegagalan dan/atau kelewatan dalam penghantaran bukti transaksi jualan oleh MasterCard, pertubuhan pedagang atau mana-mana pihak lain. (9) Hanya Pemegang Kad Layak utama layak untuk mendapat Welcome Bonus Miles. (10) Welcome Bonus Miles akan dikreditkan ke dalam Kad Pemegang Kad Layak dalam tempoh enam (6) minggu selepas enam puluh (60) hari dari tarikh kelulusan Kad dan akan ditunjukkan dalam penyata Kad Pemegang Kad Layak sebagai BONUS MILES. (11) Dengan menyertai Kempen ini, Pemegang Kad Layak yang memohon untuk Kad semasa Tempoh Kempen dengan ini memberikan kebenaran nyata kepada CIMB untuk berkongsi maklumat mereka dengan pihak ketiga semata-mata untuk tujuan memenuhi pemberian Welcome Bonus Miles di bawah Kempen ini. (12) Kempen ini akan mengatasi kempen welcome bonus lain dan setiap Pemegang Kad Layak hanya layak untuk menerima Welcome Bonus Miles satu kali sahaja. Terma-terma dan Syarat-syarat Am (13) Dengan menyertai Kempen, Pemegang Kad Layak dianggap telah membaca, memahami dan bersetuju untuk terikat oleh Terma-terma dan Syarat-syarat yang dinyatakan di sini dan bersetuju bahawa apa-apa dan semua keputusan yang dibuat secara adil dan munasabah oleh CIMB berkenaan dengan setiap aspek Kempen adalah muktamad dan konklusif. (14) Pemegang Kad Layak mestilah tidak melanggari Terma-terma dan Syarat-syarat Pemegang Kad dan/atau Terma-terma & Syarat-syarat CIMB Enrich MasterCard Co-Brand Card Plan dan terma-terma dan syarat-syarat lain yang mengawal Kad jika tidak Pemegang Kad Layak akan disingkirkan daripada penyertaan Kempen ini dan tidak berhak untuk menerima Welcome Bonus Miles. (15) CIMB berhak dengan memberikan notis terlebih dahulu selama empat belas (14) hari kalendar untuk menggantikan Welcome Bonus Miles di bawah Kempen dengan apa-apa item lain yang mempunyai kos yang setara. Welcome Bonus Miles tidak boleh ditukarkan kepada tunai fizikal atau kredit dalam apa jua jenis. (16) CIMB tidak akan dipertanggungjawabkan kepada mana-mana Pemegang Kad Layak atau mana-mana pihak untuk apa-apa kehilangan atau kerugian dalam apa jua sifat yang dialami (termasuk tetapi tidak terhad kepada, kehilangan pendapatan, keuntungan atau nama baik, secara langsung atau tidak langsung, sampingan, akibat, teladan, punitif atau ganti rugi khas mana-mana pihak) dengan apa jua cara sekalipun timbul, berkenaan dengan penyertaan atau bukan penyertaan dalam Kempen atau penerimaan, penebusan dan penggunaan Welcome Bonus Miles melainkan jika ianya timbul daripada dan disebabkan secara langsung oleh kecuaian melampau atau keingkaran sengaja CIMB.

6 (17) CIMB berhak untuk menamatkan, membatalkan atau menggantungkan Kempen ini selepas memberikan notis terlebih dahulu selama empat belas (14) hari kalendar. Bagi mengelakkan keraguan, penamatan, pembatalan atau penggantungan Kempen oleh CIMB tidak akan memberikan hak kepada Pemegang Kad Layak atau manamana orang lain untuk apa-apa tuntutan atau pampasan terhadap CIMB bagi apa-apa kerugian atau kerosakan yang dialami atau ditanggung secara langsung atau tidak langsung akibat daripada tindakan penamatan, pembatalan atau penggantungan. (18) CIMB berhak dengan memberikan notis terlebih dahulu selama dua puluh satu (21) hari kalendar untuk mengubah (sama ada melalui penambahan, pemotongan, pengubahsuaian, pindaan atau selainnya walau bagaimana sekalipun) ( Pindaan ) mana-mana Terma-terma dan Syarat-syarat di sini. Pemberitahuan kepada Pemegang Kad Layak berkenaan dengan Pindaan akan dilaksanakan di atas budi bicara mutlak CIMB melalui salah satu kaedah komunikasi berikut, iaitu, memaparkan notis berkenaan dengan Pindaan di setiap cawangan CIMB atau melalui laman web CIMB atau dengan apa-apa kaedah pemberitahuan lain di mana CIMB boleh pilih dan Pindaan haruslah dianggap sebagai terikat ke atas Pemegang Kad Layak dari tarikh pemberitahuan Pindaan atau dari tarikh lain yang mungkin dinyatakan oleh CIMB dalam pemberitahuan. Pemegang Kad Layak mengakui dan bersetuju untuk mengakses laman web CIMB secara berkala untuk melihat Terma-terma dan Syarat-syarat dan memastikan mereka mengikuti perkembangan terkini apa-apa pertukaran atau perubahan Terma-terma dan Syarat-syarat. (19) Terma-terma dan Syarat-syarat di sini yang mungkin dipinda dari semasa ke semasa akan mengatasi manamana peruntukan atau representasi yang terkandung dalam mana-mana bahan promosi dan/atau pengiklanan lain yang berkenaan dengan Kempen. Terma-terma dan syarat-syarat di sini akan digunakan dan dibaca bersama-sama dengan peruntukan-peruntukan dalam Terma-terma dan Syarat-syarat Pemegang Kad CIMB dan Terma-terma dan Syarat-syarat CIMB Enrich MasterCard Co-Brand Card Plan. (20) CIMB boleh berdasarkan budi bicara tunggal dan mutlaknya membatalkan dan/atau menolak mana-mana Pemegang Kad Layak yang ditentukan atau disyaki olehnya telah mengganggu proses atau operasi Kempen, atau bertindak memungkiri atau berpotensi memungkiri Terma-terma dan Syarat-syarat di sini. (21) CIMB tidak akan dipertanggungjawabkan atau bertanggungjawab kepada Pemegang Kad Layak dalam apa jua cara sekalipun sekiranya CIMB tidak dapat melaksanakan apa-apa kewajipannya yang ditetapkan di sini di mana ketidakupayaan tersebut adalah disebabkan secara langsung atau tidak langsung oleh apa-apa bencana alam ( Act of God ), pertikaian industri, peperangan, mogok, rusuhan, kegagalan teknikal atau sistem atau apa-apa keadaan yang berada di luar kawalan munasabah CIMB. (22) Sekiranya terdapat apa-apa ketidakselarasan, konflik, kesamaran atau percanggahan antara versi Bahasa Malaysia dan Bahasa Inggeris Terma-terma dan Syarat-syarat, versi Bahasa Inggeris Terma-terma dan Syaratsyarat akan mengatasi yang lain. Walau apa pun yang disebutkan di atas, jika permintaan telah dibuat oleh Pemegang Kad Layak dan telah dicatat dan diakui oleh CIMB dalam rekodnya versi Bahasa Malaysia Termaterma dan Syarat-syarat akan mengawal Kad Pemegang Kad Layak, maka versi Bahasa Malaysia Terma-terma dan Syarat-syarat akan mengatasi yang lain. (23) Untuk makluman balas dan/atau aduan berkenaan dengan Kempen, Pemegang Kad Layak boleh menghubungi Unit Resolusi Pelanggan CIMB yang mempunyai alamat, nombor telefon dan faksimili yang berikut (atau mempunyai alamat, nombor telefon dan faksimili lain di mana CIMB boleh mengubah melalui pemberitahuan kepada Pemegang Kad Layak): Unit Resolusi Pelanggan, Tingkat 17, Menara Bumiputra-Commerce, 11 Jalan Raja Laut, Kuala Lumpur Tel: /Faks: / CRU@cimb.com.
