1 TERMS AND CONDITIONS CIMB October Spend & Get Cash Back Campaign 1. The CIMB October Spend & Get Cash Back Campaign 2015 ( the Campaign ) is organised by CIMB Bank Berhad (13491-P) ( CIMB Bank ). The Campaign Period 2. The Campaign shall run from 1 October 2015 to 31 October 2015, both dates inclusive ( the Campaign Period ). 3. CIMB Bank reserves the right upon giving notice of not less than twenty one (21) calendar days to change the duration and/or the commencement and/or expiry dates of the Campaign Period. Eligibility 4. This Campaign is open to CIMB Bank principal credit cardholders that (i) hold credit card(s) issued by CIMB Bank in Malaysia and (ii) who receives a short message service ( SMS ) and/or a electronic direct mailer ( EDM ) from CIMB Bank about this Campaign as an invitation to participate in this Campaign ( Eligible Participants ). The CIMB Bank credit card accounts for the Eligible Participants are hereinafter collectively referred to as the Eligible Credit Card Accounts. 5. The following categories of persons are not eligible to participate in this Campaign:- i) Permanent, contract and/or temporary staff or employees of CIMB Bank (including its subsidiaries and related companies) and their immediate family members (i.e. spouses, children, parents, brothers and sisters); and/or ii) Representative and/or agents (including advertising and promotion agents) of CIMB Bank, VISA Worldwide Pte. Limited, a company registered in Singapore, having its office at 30, Raffles Place, #10-00, Chevron House, Singapore ( VISA ) and MasterCard Worldwide, a company organized under the State of Delaware, having its office and principal place of business at 2000 Purchase Street, Purchase, New York, NY , United States of America ( MasterCard ) (including their respective subsidiaries and related companies). Campaign Mechanics and Conditions 6. In the SMS and/or EDM from CIMB Bank, the Eligible Participants will be informed, of the requirements to participate in the Campaign:- i) the minimum cumulative spending requirement ( Spend Requirement ) that is required by the Eligible Participants on their Eligible Credit Card Accounts during the Campaign Period to be eligible for the cash rebate ( Cash Rebate ); ii) the exact Cash Rebate that the Eligible Participants can receive if the minimum spending requirement is met during the Campaign Period; and

2 iii) where the Eligible Participant can obtain the terms and conditions of the Campaign. 7. In order to enjoy the Cash Rebate specified in the SMS and/or EDM, the Eligible Participants must meet the Spend Requirement as specified in the SMS and/or EDM by making Eligible Retail spending transactions on their Eligible Credit Card Accounts during the Campaign Period. 8. Eligible Retail spending transactions for this Campaign will be the local, overseas and online retail spending approved by CIMB Bank and charged to any Eligible Credit Card Accounts during the Campaign period. Foreign currency retail spending transactions shall be converted to Ringgit Malaysia (RM) for purpose of calculation of retail spending and shall be based on CIMB Bank s prevailing exchange rate. 9. Eligible Retail spending transactions shall mean purchase transactions for goods and services incurred for personal consumption and shall not include betting or gaming transactions. For the avoidance of doubt, the following transactions are expressly excluded and shall not be treated as Eligible Retail spending transactions:- i) transactions made on CIMB Bank s Platinum Business Card, Islamic Credit Card and CIMB partner Card; ii) Quasi Cash transactions (example: betting and/or gaming transactions); iii) Monthly instalments under any instalment payment facility provided by CIMB Bank; iv) Standing instructions/ auto-payment service; v) Payment of annual fees or service charges, delivery charges, cash payments, card replacement fee, government service tax, dispute charges, fraud charges or any other fees, charges or penalties whether imposed by CIMB Bank or otherwise; vi) Transactions for payments made towards insurance premiums and/or takaful contributions of any kind whatsoever; and vii) Cash advance/withdrawal/deposit transactions; viii) Retail spending transactions which are subsequently cancelled or refunded, disputed, unauthorised or fraudulent transactions. Any determination by CIMB Bank as to what constitutes retail spending transactions shall be conclusive and shall not be challenged in any manner whatsoever unless the same appears as grossly unfair or unjust. 10. Eligible Retail spending transactions is calculated on the total consolidated (principal and supplementary/ies) Eligible Participants spending. If the cardholder has multiple credit card accounts, the Eligible Retail spending transactions made on all Eligible Credit Card Accounts by the principal and supplementary credit cardholders shall be consolidated and not be viewed individually to meet the Spend Requirement within the Campaign Period. Example: Cardholder A has a CIMB World MasterCard credit card, a CIMB Visa Infinite credit card and 2 supplementary CIMB Visa Platinum credit cards. All Eligible Retail spending transactions on any of those CIMB credit cards will be consolidated and not viewed individually to meet the respective spending of this Campaign.

3 11. The tracking of the Eligible Retail spending transactions is based on the transaction dates and/or time (Malaysian Time) as captured by CIMB Bank transaction records during the Campaign Period. 12. CIMB Bank shall not be responsible for any failure and/or delay in the transmission of evidence of sales transactions by Visa, MasterCard, merchant establishments or any other party unless the same is due to the gross negligence or default of CIMB Bank. Cash Rebate Fulfillment Criteria Process 13. Upon successfully meeting the Spend Requirement, the Eligible Participants will be rewarded with the Cash Rebate as explained in the SMS and/or EDM sent to them. 14. The Cash Rebate will be credited into the principal Eligible Participant s CIMB credit card account within six (6) to eight (8) weeks from the end of the Campaign Period. The Cash Rebate will be credited to the Eligible Participant s principal CIMB credit card account with the highest limit. 15. Only the principal Eligible Cardholder/Participant shall be eligible to the Cash Rebate under this Campaign. 16. At the time of the receipt of the Cash Rebate(s) by the Eligible Participants, the principal CIMB credit card account(s) of the Eligible Participants MUST NOT be delinquent, and/or be invalid or cancelled within CIMB s definition, otherwise the Eligible Participant will be disqualified from participating or from receiving the Cash Rebate(s). 17. The Eligible Participant(s) who are entitled to receive the Cash Rebate(s) shall receive a notification via SMS from CIMB Bank that the Cash Rebate(s) has been credited to his/her respective CIMB credit card account. The Cash Rebate(s) amount will also be reflected in the Eligible Participant s subsequent credit card monthly statement after the crediting of the Cash Rebate. General Terms and Conditions 18. CIMB Bank shall be entitled to amend, vary, delete or add ( the Amendment ) to any of these Terms and Conditions or any part thereof and/or substitute or replace the prizes offered under this Campaign with a similar valued prize and/or to extend, modify, shorten, discontinue, cancel, terminate or suspend the Campaign by giving prior notice of twenty one (21) calendar days to the Participants. No compensation in cash or any kind shall be given to the Eligible Participants for any losses or damages suffered or incurred by the Eligible Participants as a direct or an indirect result of such variation, deletion, addition or alteration of these Terms and Conditions and/or the extension, modification, cancellation, suspension or termination of this Campaign unless the same is due to the gross negligent and default of CIMB Bank.

Notification to the Eligible Participants in respect of the Amendment shall be effected at CIMB Bank s absolute discretion through any one of the following means of communication, namely, by ordinary mail to the Eligible Participants last known address or by posting a notice regarding the Amendment at each of CIMB Bank s branches where detail provisions regarding the Amendment may be provided in the notice itself or may be provided to the Eligible Participant upon request or by effecting an advertisement regarding the Amendment in one newspaper of CIMB Bank s choice, or via CIMB Bank s website or via electronic mail or by any other means of notice which CIMB Bank may select and the Amendment shall be deemed as binding on the Eligible Cardholder as from the date of notification of the Amendment or from such other date as may be specified by CIMB Bank in the notification. 20. CIMB Bank shall not be liable to any Eligible Participant or any party for any loss or damage of whatsoever nature suffered by the Eligible Participant or any party (including but not limited to, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party) howsoever arising, in relation to the participation or non-participation in the Campaign unless the same is due to the gross negligent and default of CIMB Bank. 21. These Terms and Conditions (as the same may be amended from time to time pursuant to Clause 18) shall be read in conjunction with the prevailing terms and conditions in CIMB Bank card and/or account agreement and/or relevant products and shall prevail over any inconsistent terms, conditions, provisions or representations contained in any other promotional materials advertising the Campaign. 22. If there is any inconsistency (ies), conflict(s), ambiguity (ies) or discrepancy (ies) between the Bahasa Malaysia and English version or other language version of these Terms and Conditions herein, the English version of these Terms and Conditions shall prevail. Notwithstanding the aforementioned where request is made by the Eligible Cardholders and noted and acknowledged by CIMB Bank in its records that the Bahasa Malaysia version of the terms and conditions shall govern the operation of the Campaign, then the Bahasa Malaysia version of the Terms and Conditions shall prevail. 23. 5 Terma-terma dan Syarat-syarat Kempen CIMB October Spend & Get Cash Back 1. Kempen CIMB October Spend & Get Cash Back 2015 ( Kempen ) adalah dianjurkan oleh CIMB Bank Berhad (13491-P) ( Bank CIMB ). Tempoh Kempen 2. Kempen akan bermula dari 1 Oktober 2015 ke 31 Oktober 2015, termasuk kedua-dua tarikh ( Tempoh Kempen ). 3. CIMB menyimpan haknya apabila memberikan notis tidak kurang daripada dua puluh satu (21) hari kalendar untuk menukar tempoh dan/atau permulaan dan/atau tarikh tamat Tempoh Kempen. Kelayakan 4. Kempen ini adalah terbuka kepada semua pemegang kad kredit prinsipal Bank CIMB yang (i) memegang kad kredit yang dikeluarkan oleh Bank CIMB di Malaysia dan (ii) menerima satu servis mesej singkat ( SMS ) dan/atau mel langsung elektronik ( MLE ) dari Bank CIMB berkenaan Kempen ini sebagai jemputan untuk menyertai Kempen ini ( Peserta Yang Layak ). Akaun kad kredit Bank CIMB untuk Peserta Yang Layak adalah secara kolektif dirujuk sebagai Akaun Kad Kredit Yang Layak. 5. Kategori orang yang berikut adalah tidak layak untuk menyertai Kempen ini: i) Kakitangan atau pekerja-pekerja tetap dan/atau sambilan Bank CIMB (termasuk subsidiarinya dan syarikat-syarikat berkenaan) dan ahli-ahli keluarga terdekat mereka (iaitu pasangan, anak, ibubapa, abang dan kakak); dan/atau ii) Wakil dan/atau agen-agen (termasuk agen-agen pengiklanan dan promosi) Bank CIMB, VISA Worldwide Pte. Limited, sebuah syarikat yang didaftarkan di Singapura, dengan alamat di 30, Raffles Place, #10-00, Chevron House, Singapore ( Visa ) dan MasterCard Worldwide, sebuah syarikat yang ditubuhkan di bawah State of Delaware, dengan pejabat dan tempat perniagaan utama di 2000 Purchase Street, Purchase, New York, NY , United States of America ( MasterCard ) (termasuk subsidiari mereka dan syarikat berkenaan masing-masing). Syarat-syarat dan Mekanik Kempen 6. Di dalam SMS dan/atau MLE dari Bank CIMB, Peserta Yang Layak akan dimaklumkan keperluan untuk dipenuhi untuk menyertai Kempen:-

6 i) keperluan perbelanjaan kumulatif minimum ( Keperluan Perbelanjaan ) yang diperlukan oleh Peserta Yang Layak pada Akaun Kad Kredit Yang Layak semasa Tempoh Kempen untuk layak kepada rebat tunai ( Rebat Tunai ); ii) Rebat Tunai yang tepat yang Peserta Yang Layak boleh menerima sekiranya keperluan perbelanjaan minimum dipenuhi semasa Tempoh Kempen; dan iii) di mana Peserta Yang Layak boleh mendapatkan terma-terma dan syarat-syarat Kempen. 7. Untuk menikmati Rebat Tunai yang dispesifikasikan di dalam SMS dan/atau MLE, Peserta Yang Layak mesti memenuhi Keperluan Perbelanjaan yang dispesifikasikan di dalam SMS dan/atau MLE dengan melaksanakan transaksi perbelanjaan Runcit yang Layak pada Akaun Kad Kredit Yang Layak mereka semasa Tempoh Kempen. 8. Transaksi perbelanjaan Runcit yang Layak untuk Kempen ini adalah perbelanjaan runcit tempatan, luar negara dan dalam talian yang diluluskan oleh Bank CIMB dan dicajkan kepada mana-mana Akaun Kad Kredit Yang Layak semasa Tempoh Kempen. Transaksi perbelanjaan runcit mata wang asing akan ditukarkan kepada Ringgit Malaysia (RM) untuk tujuan pengiraan perbelanjaan runcit dan akan berdasarkan kepada kadar pertukaran semasa Bank CIMB. 9. Transaksi perbelanjaan Runcit yang Layak bermakna transaksi pembelian untuk barangan dan servis tertanggung untuk penggunaan peribadi dan bukan untuk transaksi pertaruhan atau perjudian. Bagi mengelakkan was-was, transaksi-transaksi berikut adalah secara ekspres dikecualikan dan tidak akan dianggap sebagai transaksi perbelanjaan Runcit yang Layak:- (i) transaksi yang dibuat pada Kad Perniagaan Platinum Business Bank CIMB, Kad Kredit Islamic dan Kad perkongsian CIMB; (ii) Transaksi Tunai Kuasi (contohnya: transaksi pertaruhan dan/atau perjudian); (iii) Ansuran bulanan di bawah kemudahan pembayaran ansuran yang disediakan oleh CIMB; (iv) Perkhidmatan arahan tetap arahan /auto-pembayaran; (v) Pembayaran yuran tahunan atau caj perkhidmatan, caj penghantaran, pembayaran tunai, fi penggantian kad, cukai perkhidmatan kerajaan, caj pertikaian, caj fraud atau yuran-yuran, caj-caj atau penalti-penalti yang lain samada dikenakan oleh Bank CIMB atau sebaliknya; (vi) Transaksi untuk pembayaran yang dibuat terhadap premium insurans dan / atau sumbangan takaful dalam apa jua sekalipun; (vii) Transaksi pendahuluan/pengeluaran/deposit tunai; dan (viii) Transaksi perbelanjaan runcit yang kemudiannya dibatalkan atau dipulangkan, dipertikaikan, tidak dibenarkan atau penipuan. Apa-apa penentuan oleh Bank CIMB sebagai apa transaksi perbelanjaan runcit adalah konklusif dan tidak boleh dicabar dalam mana-mana cara sekalipun kecuali yang sama dilihat sebagai terlalu tidak adil. 10. Transaksi perbelanjaan Runcit yang Layak adalah dikira berdasarkan kepada jumlah penyatuan (prinsipal dan tambahan) perbelanjaan Peserta Yang Layak. Sekiranya pemegang kad

7 mempunyai beberapa akaun kad kredit, transaksi perbelanjaan Runcit yang Layak yang dibuat pada semua Akaun Kad Kredit Yang Layak oleh pemegang kad kredit prinsipal dan tambahan akan disatukan dan tidak akan dilihat secara individu untuk memenuhi "Keperluan Perbelanjaan" dalam Tempoh Kempen. Contoh: Pemegang kad A mempunyai satu kad kredit CIMB World MasterCard, satu kad kredit CIMB Visa Infinite dan 2 kad kredit tambahan CIMB Visa Platinum. Semua transaksi perbelanjaan Runcit yang Layak pada mana-mana kad kredit CIMB akan disatukan dan tidak akan dilihat secara individu untuk memenuhi perbelanjaan masing-masing Kempen ini. 11. Pengesanan transaksi perbelanjaan Runcit yang Layak adalah berdasarkan pada tarikh transaksi dan/atau waktu (Waktu Malaysia) seperti yang ditangkap oleh rekod transaksi Bank CIMB semasa Tempoh Kempen. 12. Bank CIMB tidak akan bertanggungjawab untuk sebarang kegagalan dan / atau kelewatan dalam penghantaran bukti transaksi jualan oleh Visa, MasterCard, pertubuhan peniaga atau manamana pihak yang lain melainkan yang sama berlaku akibat kecuaian melampau atau keingkaran Bank CIMB. Proses Kriteria Pemenuhan Rebat Tunai 13. Setelah berjaya memenuhi "Keperluan Perbelanjaan", Peserta Yang Layak akan diberi ganjaran Rebat Tunai seperti yang dijelaskan dalam SMS dan/atau MLE yang dihantar kepada mereka. 14. Rebat Tunai akan dikreditkan ke dalam akaun kad kredit prinsipal CIMB Peserta Yang Layak dalam tempoh enam (6) hingga lapan (8) minggu dari pengakhiran Tempoh Kempen. Rebat Tunai akan dikreditkan ke akaun kad kredit prinsipal CIMB Peserta Yang Layak yang mempunyai had paling tinggi. 15. Hanya Pemegang Kad / Peserta Yang Layak prinsipal yang layak untuk Rebat Tunai di bawah Kempen ini. 16. Pada masa penerimaan Rebat Tunai oleh Peserta Yang Layak, akaun kad kredit prinsipal CIMB Peserta Yang Layak TIDAK BOLEH bermasalah, dan/atau tidak sah atau dibatalkan dalam definisi CIMB, sekiranya tidak, Peserta Yang Layak akan disingkirkan daripada menyertai atau menerima Rebat Tunai. 17. Peserta Yang Layak yang berhak untuk menerima Rebat Tunai akan menerima notifikasi melalui SMS daripada Bank CIMB bahawa Rebat Tunai telah dikreditkan ke dalam akaun kad kredit CIMB masing-masing. Amaun Rebat Tunai juga akan dapat dilihat dalam penyata kad kredit bulanan berikutnya Peserta Yang Layak selepas pengkreditan Rebat Tunai. Terma-terma dan Syarat-syarat Umum 18. Bank CIMB berhak untuk meminda, mengubah, memotong atau menambah ("Pindaan") manamana Terma dan Syarat ini atau mana-mana bahagiannya dan/atau menggantikan hadiah yang ditawarkan di bawah Kempen ini dengan hadiah yang sama nilai dan/atau untuk melanjutkan,

8 mengubah suai, memendekkan, menghentikan, membatalkan, menamatkan atau menggantung Kempen ini dengan memberi notis dua puluh satu (21) hari kalendar terlebih dahulu kepada Peserta. Tiada pampasan dalam bentuk wang tunai atau sebarang bentuk lain akan diberikan kepada Peserta yang Layak untuk sebarang kerugian atau kerosakan yang dialami atau ditanggung oleh Peserta Yang Layak terhadap keputusan secara langsung atau tidak langsung dalam apa-apa perubahan, pembatalan, penambahan atau perubahan dalam Terma dan Syarat ini dan/atau lanjutan, pengubahsuaian, pembatalan, penggantungan atau penamatan Kempen ini melainkan yang sama berlaku akibat kecuaian melampau dan keingkaran Bank CIMB. 19. Pemberitahuan kepada Peserta Yang Layak berkenaan Pindaan hendaklah dilaksanakan mengikut budi bicara mutlak Bank CIMB melalui mana-mana satu daripada cara komunikasi berikut, iaitu, melalui pos biasa ke alamat terakhir Peserta Yang Layak yang diketahui atau dengan menampal notis mengenai Pindaan di setiap cawangan Bank CIMB di mana peruntukan terperinci mengenai Pindaan adalah di dalam notis itu sendiri atau diberikan kepada Peserta Yang Layak atas permintaan atau dengan menyiarkan iklan mengenai Pindaan dalam satu akhbar pilihan Bank CIMB, atau melalui laman web Bank CIMB atau melalui mel elektronik atau dengan cara notis lain yang Bank CIMB boleh pilih dan Pindaan akan dianggap sebagai mengikat Pemegang Kad Layak dari tarikh pemberitahuan Pindaan atau dari tarikh lain sebagaimana yang ditentukan oleh Bank CIMB dalam pemberitahuan. 20. Bank CIMB tidak akan bertanggungjawab kepada Peserta Yang Layak atau mana-mana pihak untuk apa-apa kehilangan atau kerosakkan dalam apa jua yang dialami oleh Pemegang Kad Yang Layak atau mana-mana pihak (termasuk tetapi tidak terhad kepada kehilangan pendapatan, keuntungan atau nama baik, langsung atau tidak langsung, sampingan, akibat, teladan, punitif atau ganti rugi khas mana-mana pihak) yang tertimbul berkenaan dengan penyertaan atau bukan penyertaan di dalam Kempen ini melainkan yang sama berlaku akibat kecuaian melampau dan keingkaran Bank CIMB. 21. Terma dan Syarat (di mana yang sama mungkin dipinda dari masa ke semasa selaras dengan Klausa 18) hendaklah dibaca bersama dengan terma dan syarat semasa kad Bank CIMB dan/atau perjanjian akaun dan/atau produk yang berkaitan dan akan mengatasi sebarang terma, syarat, peruntukan atau representasi yang terkandung dalam sebarang bahan promosi lain yang mengiklankan Kempen ini. 22. Sekiranya terdapat apa-apa ketidakselarasan, konflik, kesamaran atau percanggahan di antara versi Bahasa Malaysia dan Bahasa Inggeris atau bahasa lain Terma dan Syarat ini, versi Bahasa Inggeris Terma dan Syarat ini akan diguna pakai. Walau apa pun yang dinyatakan di atas, apabila permintaan dibuat oleh Pemegang Kad Yang Layak dan dicatat dan diakui oleh Bank CIMB dalam rekodnya bahawa versi Bahasa Malaysia terma dan syarat ini mengawal operasi Kempen ini, maka versi Bahasa Malaysia Terma dan Syarat hendaklah diguna pakai. 23. Untuk maklum balas dan/atau aduan berkenaan dengan Kempen ini, Pemegang Kad Yang Layak boleh menghubungi Unit Resolusi Pelanggan Bank CIMB yang mempunyai alamat, nombor telefon dan faksimili berikut (atau mempunyai alamat, nombor telefon dan faksimili lain di mana Bank CIMB boleh menukar dengan memberikan notifikasi kepada Pemegang Kad Yang Layak): Unit Resolusi Pelanggan, Tingkat 19, Menara Bumiputra-Commerce, 11 Jalan Raja Laut, Kuala Lumpur Tel: / Faks: 603
