Scope of the work and other requirements connected to the contract, including the formats of the bids, terms and conditions of the contract etc. are enclosed to this tender invitation as per the following details:- 3.1 Terms and conditions Annexure I 3.2 Proforma of Technical Bid Annexure II 3.3 Proforma of Financial Bid Annexure III 4. The prospective bidders are free to inspect the above NEC ASPILA EX Key Telephone system on any working day from 04/07/2013 to 09/07/2013, between 3.00 P.M. to 4.00 P.M. For this purpose they may contact to S.O. (GA-I), Department of Agriculture & Cooperation, Room No. 15, Krishi Bhawan, New Delhi. 5. The entire tender document including all Annexures, except the Financial Bid in Annexure III will be part of the Technical Bid which also must contain the EMD and all of the requisite documents called for in the tender. Both the Technical Bid and the Financial Bid (in separate envelopes put in one outer envelope) are to be deposited in the Tender Box on or before the schedule time and date. 3 Terms and conditions :- -3- Annexure I 1. The contract shall be effective for one year with effect from date of award of tender, which may be increased upon satisfactory performance of firm by HOD. The decision of HOD in this regard will be final. The firm has to indicate consolidated lumpsum amount for AMC in the proforma enclosed. No demand for revision of rates on any account whatsoever shall be entertained under any circumstances during currency of the rate contract. 2. The quotation shall be accompanied by an earnest money deposit of ` 20,000/- in the form of Demand Draft in favour of P&AO(Sectt.-I), Department of Agriculture and Cooperation (Cheque/cash will not be accepted). The quotations received without earnest money or with cheques/cash shall be summarily rejected and no representation in this regard shall be entertained. The earnest money shall be forefeited if the contractor declared successful declines the offer or does not accept the work for any reason, whatsoever. The earnest money of the firm whose quotation are not approved shall be released only after the award of the contract to the successful tenderer. 3. Only Original Equipment Manufacturer (OEM)/ authorized service provider of (OEM)/ Dealer of OEM for Machines NEC ASPILA EX Key Telephone System having three years experience in the last three Financial Years in Government Sector/PSUs in respect of maintenance of Key Telephone System of different configurations are eligible for applying in tender along with other eligibility condition as mentioned in Terms and Conditions and Technical Bid. Bid will be valid for 60 days from the date of submission of bid. The contract shall ordinarily be awarded to the lowest evaluated technically qualified bidder whose bid has been found to be responsive and who is eligible and qualified to perform the contract satisfactorily as per the terms and conditions incorporated in the bidding document. 4. The tenderer whose quotations is finally accepted, shall have to furnish a performance security 10% of finalized bid in favor of P&AO (Sectt-I.), Department of Agriculture and Cooperation, New Delhi by means of a Fixed Deposit Receipt pledged from any scheduled Bank. The Company shall depute trained engineer(s) only having wide experience of repairing the Key Telephone System on daily basis for preventive checks & maintenances and the complaint received during the day shall be attended to promptly and rectified within two hours. The company should have to send their representatives on holidays in case of emergencies. 6. The contract will be comprehensive in nature and the Department will not make payment for any spare parts. All parts will be replaced free of cost including change of faulty Telephone Instruments, all type of Cables, Line Cord, Coil Cord, Rosette Box, Battery and MDF Box/Crown etc. Only genuine authorized parts shall be allowed to be replaced. 7. The company is liable to replace the defective parts of the machine with original and new parts strictly as per the configuration of the manufacturer and will be guaranteed for a period of one year from the date of replacement. The defective parts will be taken over by the company and the new parts provided will become the property of the Department. month. Company should have to clean all instruments every 8. In the case of major repair where the Key Telephone system or any part of the system has to be taken to Company s workshop, the standby arrangement from the company side will be mandatory without disruption of work of the user. The equipment being taken to the workshop for repair would be at the company s expenses. 9. In case the company is found to be failing in rectifying/making functional the Key Telephone System on the same day, a penalty of Rs. 1,000/- (Rupees One thousand only) per default would be imposed. In case of three successive failures, the contract may be terminated forthwith and the performance security deposit would be forfeited. Under such circumstances only proportionate charges for the period for which the services rendered shall be payable to the contractor only if the services provided by the firm had been satisfactory. 5 The payment will be made on quarterly basis in equal installments only on completion of service to the satisfaction of this Department and other formalities as may be requested by the Department. 11. The interpretation of the contractual terms & conditions and disputes, if any, shall be subject to the sole arbitration of the competent authority in the Department.
