11 General Agreement SESAR SWIM Master Class 2014 (1/2) This Agreement sets out the rules of the game. Some of the obligations: The Participant shall: - bear its own cost for its participation to the Master Class; - register truly and fully their SWIM enabled Information Services and Infrastructure in the Registry; - not attempt to gain access to services and/or infrastructure for which the Party is not eligible; - respect intellectual proprietary rights of third parties, and - coordinate any and all communications made on the Master Class, SWIM, SESAR, EUROCONTROL and/or the SJU in advance with EUROCONTROL. EUROCONTROL shall have the right to use the material provided by the Participant in the framework of the Master Class also after the Best-in-Class ceremony for communication purposes and in the framework of global SWIM demonstrations organised in the period The aim being to get Participants on board of the global demonstrations through collaboration with organisers (mainly ANSPs). 11

12 General Agreement SESAR SWIM Master Class 2014 (2/2) SWIM Registry is a prototype, therefore no guarantee that it will: work error free and constitute the definitive Registry for SWIM. Access to applications and/or services and/or infrastructure of a Participant subject of specific agreements between the Participants concerned and is not part of the General Agreement. Intellectual property rights existing prior to the Master Class and/or developed and financed by a Participant in the framework of the Master Class becomes and remains in principle the property of the Participant. No guarantee of minimum services or performance levels related to the functioning of any systems used in the framework of the Master Class No liability for any for services provided between Participants in the context of the Master Class. Duration until 26 November

13 Specific Agreement #1 : NM B2B Web Services Conditions for accessing NM B2B Web Services. Access is normally restricted, BUT for the Master Class the user base allowed to access the NM B2B Web Services has been enlarged. After the Master Class: Standard access and eligibility criteria will apply! EUROCONTROL provides one access to NM B2B Web Services (free of charge). No guarantee of minimum service levels - Priority to operational systems and services. Adherence to Rules for use of Network Management Services (i) NM Data Rules, and (ii) NM Operations Security Rules. All right, title and interest in and to the NM B2B Web Services are and remain with EUROCONTROL. Participant becomes in principle owner of all relevant intellectual property rights in the development made by him in the framework of the Master Class. Access to NM B2B Web Services and NM Products are provided on an "as-is" basis and EUROCONTROL provides no express or implied warranty of any kind. Access until 26 November, may be extended for justified reasons 13

14 Specific Agreement #2 : Jumpstart License Agreement License to: use Jumpstart for testing, research, development and demonstration purposes only; reproduce Jumpstart; modify Jumpstart, and make Derivative/s; communicate/distribute/sub-license Jumpstart NOT for operational purposes! Source Code incl. documentation (tutorials). strictly as is basis and without warranties of any kind. 14
