The Fayetteville Observer Founded in 1816, The Fayetteville Observer is North Carolina s oldest newspaper. The history of the newspaper s longtime family ownership at Fayetteville Publishing Co. dates to 1923. As it has throughout its history, Fayetteville Publishing Co. remains committed to the 10-county Cape Fear region of southeastern North Carolina. In addition to serving the community with a leading newspaper, in 1995 the company became one of the first newspapers in the state with its own website, now fayobserver.com. Since then, Fayetteville Publishing Co. has also broadened its portfolio of products to include a monthly military lifestyle magazine, Elite; a bi-weekly Spanish-language community newspaper, Acento Latino; a community newspaper in Hope Mills, The Sandspur; a weekly publication serving the military, Fort Bragg Life; and three weekly shoppers, Carolina Trader Autos, based locally, and Iwanna publications based in Asheville and Greenville, S.C. 1 Personnel Publisher... Carolyn McLaurin 2 Commission / Terms of Payment 2.1 Net Rates All rates contained herein are net and non-commissionable. Please refer to the national rate card for commissionable rates. 2.2 Cash With Order All advertising is accepted on a cash-withorder basis unless credit is established with the business office. 2.3 Payment Due Dates Credit account balances are due and payable within 25 days of the invoice date and are considered past due after that date. Invoices not paid within 25 days of the billing date are subject to a 1.5% service charge, which constitutes an annual percentage rate of 18%. In the event an account becomes past due, Publisher reserves the right to suspend credit, refuse advertising copy and/or cancel any contractual agreements. Advertiser agrees to indemnify Fayetteville Publishing Company for all expenses incurred in connection with the collection of amounts payable, including court costs and legal fees. 2.4 Error Notification Deadlines Invoices are considered accurate unless notification is received within 15 days following the invoice date. 2.5 Tax Liability In the event any federal, state or local taxes are imposed on the printing of advertising material or on the sale of advertising space, such taxes will be charged to and paid for by the advertiser. 2.6 Representatives We accept advertising from any recognized agency or representative. The Fayetteville Observer does not have an exclusive relationship with any national representative. 3 General Advertising Policies Fayetteville Publishing Co. (FPC) reserves the right to adjust rates without notice to any non-contract advertiser. 3.1 Terms & Conditions All rates herein apply to advertisers of any single firm or individual selling directly to the public from a fixed and permanent location in the state of North Carolina. Advertising regarding property, products or services located outside the state of North Carolina will be charged at the national rate. The existence of a local representative will not alter the meaning of this condition; however, real estate development and construction companies headquartered in our circulation area may advertise their own developments at local rates regardless of the location of the development. and published with the understanding that all rates, policies and guidelines contained herein are acceptable to the advertiser. 3.3 Non-Controllable Liability FPC assumes no liability in the event of any act of God, the public enemy or governmental authority, labor dispute, war (declared or not), civil disobedience, riot or other occurrences beyond its control that in any way restricts or prohibits the distribution of content through any FPC channel. Contracts will be suspended during the period of inability to perform and the terms will be extended for a like period. Neither party shall have liability to the other party, because of suspension. 3.4 Rights Concerning Assigning Rates All rates are for single advertisers only and may not be assigned or transferred to any other party. 3.5 Ad Acceptance Policy FPC reserves the right, in its sole discretion, to reject, cancel, edit or alter any advertisement to conform with any standards, policies or guidelines now in effect, even if the advertisement was originally accepted for publication by a FPC employee. Any advertisement that is brokered or considered in conflict or competition with local advertising sales efforts may be rejected. Fraudulent or misleading advertising will not be knowingly accepted. 3.6 Positioning Policy Requests for position will be honored with placement as close to the desired position as possible. Placement cannot be guaranteed unless the advertiser agrees in advance to pay a guaranteed position surcharge. Advertisements cannot be accepted with position as a condition of payment. Failure to accommodate a position request will in no way constitute reason for non-payment. 3.7 Ownership Of Copy All advertising which represents the creative effort of FPC including illustrations, artwork, typography or materials, including any copyright interest, remains the sole property of FPC. 3.8 Error Policy In the event of FPC error in an advertisement, the affected portion will be rerun at no charge for only one incorrect insertion in cases where the error affects the value of the ad. In no case will any adjustment exceed the cost of the ad. FPC assumes no liability for any loss or damage arising to the advertiser or any other party, other than the cost of the advertisement, by reason of non-publication, delay or interruption in publication, for incidental, consequential, punitive or lost-profit damages. 3.9 Agencies Jointly and Sequentially Liable FPC cannot accept insertion orders from advertising agencies acting solely as agents for an advertiser or that limit the agency s financial responsibility for payment of advertising ordered. The Advertiser and the agency are held jointly and sequentially liable for payment and all terms of any contractual agreements. This is not withstanding any disclaimers that might be included on an insertion order. 3.10 Insertion Orders Insertion orders submitted by advertisers and agencies with incorrect rates or conditions in conflict with FPC policies will be regarded only as containing clerical errors. The advertising called for in such insertion orders will be published in accordance with newspaper policies and billed at the current applicable rates. 3.11 Cancellation/Short Rate Any cancellation of contracts must be made in writing giving a thirty (30) day notice. Advertiser may cancel their contract prior to the effective date of any rate revision, for each classification in which rate revisions are made. If Advertiser continues to place ads after the new rates go into effect, Advertiser thereby accepts the new rates under all terms of the agreement. If Advertiser cancels their contract for any reason other than rate revision and thereby fails to meet the minimum space order under the contract, the cost of all advertising space under the agreement, retroactive to the first placement of ads under the contract, may be charged at the schedule of rates in force at the time. 3.12 Newspaper s Liability The Advertiser agrees to indemnify and hold harmless FPC, its affiliates, publisher, directors, officers, employees, agents, successors, assigns, licensees and distributors against any and all damages, costs, liability, loss, claims or judgments (including the partner s payment of FPC s attorney s fees through one or more levels of appeal incurred by FPC) paid or incurred in connection with claims, including but not limited to copyright, trademark, libel, plagiarism, unfair competition, unfair trade practices, violation of rights or claims of privacy, brought by any party arising from the publication of correct or incorrect advertisements. 3.13 State Laws Preside The conditions, rates, policies and guidelines in this rate card are governed by, and construed and interpreted in accordance with the laws of the state of North Carolina without regard to its conflicts or choice of law. In the event of any dispute arising hereunder, the parties agree to submit to the jurisdiction and venue of the appropriate state or federal courts located in Cumberland County, North Carolina. 3.2 Publication Construes Acceptance All advertising is accepted 2 THE FAYETTEVILLE OBSERVER 2012-2013 ADVERTISING RATES

Qualified Prospects All ads include one spot color. See section 11.3 Color Rates in this rate card for available free spot colors. 4.3 Market Access Business Builder Allows you the chance to build your business by increasing your impressions affordably. Option 2 50% Discount Any full-rate, full-run ad scheduled in The Fayetteville Observer on Saturday and/or Sunday that repeats without copy or size change on the following Monday and/or Tuesday is applicable. Color charges also receive repeat ad discounts. All discounts are off the earned rate, and no other discounts may be combined with this program. Options 1 and 2 may not be used in combination. 4.5 Guaranteed Position The placement position of an ad can be guaranteed when an advertiser agrees in advance to a 25% per-inch surcharge. Certain restrictions may apply. See your account executive for details. 4.6 Depth Requirements Advertisements more than 18 inches in depth will be billed at a premium of 21 inches. Advertisements more than 8 inches in depth in tabloid publications will be billed at a premium of 10.5 inches. The depth of all ads will be measured to the nearest 1/2 inch with a minimum depth of 1 inch. The minimum depth for a double-truck ad is 10 1/2 inches. Classified in-column ads must be at least 4 lines. Classified display ads must be at least one column wide and 2 inches deep. Depth of all display classified ads will be measured to the nearest quarter inch in lines. 5 SPECIAL RATES 5.1 Courtesy rates 501 Status Organizations & Churches, Government, Courtesy $38.75 $45.75 Courtesy rate may be extended to other publications and sections based on current contract. Contact your advertising account executive for details. 5.2 Standby Rates Available only to clients under contract and applicable only to previously run ads with no copy changes. Standby ads run only when needed. Rates are 50% off contract rates. Standby ads do not count toward fulfillment of contracts. Standby ads are only available in quarter-, half- and full-page increments. 5.3 Public Service Announcements (PSA) Ads used to promote nonrevenue generating community events to general readership are permitted at the Publisher s discretion. Organizations must be 501(c)(3). All PSAs will include The Fayetteville Observer logo. PSAs will run as space is available. 6 Bonus circulation 6.1 Bonus Circulation: Easter Monday (Apr. 9, 2012), Memorial Day (May 28, 2012), Independence Day (July 4, 2012), Labor Day (Sept. 3, 2012), Veterans Day (Nov. 12, 2012), Thanksgiving Day (Nov. 22, 2012), Day after Thanksgiving (Nov. 23, 2012), Christmas Day (Dec. 25, 2012). 6.2 Circulation Dates With Rates: President s Day (Feb. 20, 2012), Easter Monday (Apr. 9, 2012), Memorial Day (May 28, 2012), Independence Day (July 4, 2012), Labor Day (Sept. 3, 2012), Thanksgiving Day (Nov. 22, 2012), Day after Thanksgiving (Nov. 23, 2012), Christmas Eve (Dec. 24, 2012), New Year s Eve (Dec. 31, 2012), Martin Luther King Jr. Day (Jan. 21, 2013). & 13 Weeks/90 Days $27.55 13 Weeks/45 Days $28.00 4 Weeks/30 Days $30.00 Ads must be published every day on the 13 weeks/90 days and 4 weeks/30 day agreements. Banner advertising is available in the follow ad sizes: 728x90, 300x600 and 300x250. Ads can be targeted to section channels or run throughout the site. Prices based on cost per thousand. Option 1 Any full-rate, full-run ad scheduled in The Fayetteville Observer may be repeated within a six-day period. Run schedules that include weekend or holidays will be charged for highest value run date first. The first ad runs at full price, the second ad runs at a 15% discount, the third ad runs at a 25% discount, the fourth and fifth ads run at 50% discount and the sixth and seventh ads run for free. All discounts are off the earned rate, and no other discounts may be combined with this program. No changes in size, content or color can be made to discounted ads. 8.6 Repeat Ad Discount (Applies to Bulk Rates Only) 10% Discount Any full-rate ad that repeats without copy or size changes within six days is applicable. Minimum size ad is 20 column inches. 50% Discount Any full-rate ad run on Saturday or Sunday that repeats without copy or size change on the following Monday and/or Tuesday is applicable. Color charges also receive repeat ad discounts. Minimum size ad is 20 column inches. 8.7 Blind Box Ads You may request that responses to your Classified ad be directed to a box number, c/o Fayetteville Publishing Company. On Wednesdays, there is an option to purchase additional preprints. The Observer s Wednesday preprint distribution list is Post Office certified. Preprint advertising is also available in the Paraglide every Thursday. All costs shown below are estimates and will be verified by The Observer upon receipt and inspection of the actual preprint at or before deadline. The direct distribution rate is the applicable Standard A carrier route pre-sort postal rate, plus $30 per thousand processing and transportation charge. Minimum charge $100. 9.7 Brokered Preprint Policy The Fayetteville Observer cannot accept preprints brokered by a third party to local businesses at insert rates. 9.8 Reservation and Shipping Instructions In order to efficiently process preprint advertising, reservations and cancellations must be received at least 10 working days prior to insertion. Prepaid shipments of preprints will be accepted Monday through Friday, 7 a.m. to 6 p.m. The shipment must arrive at least seven days prior to insertion. Ask your advertising account executive about adding one of these spot colors to your ad today. 9.3 Preprint Page Measurements All binding of preprints must fold on the longest part of the insert. To confirm specifications and placement of the fold, call your account executive prior to delivery. Preprint measurements are defined as single-sheet, flexi, tabloid and broadsheet. Original artwork, including color preproduction work, is done at $35.00 per hour. 15.2 Proofs An ad proof is available prior to publication provided the copy is received prior to deadline. Proofs are furnished only for the correction of typographical errors, not deviation from original copy or design. If Advertiser changes original copy, layout or illustrations, there will be an additional design charge. The Fayetteville Observer reserves the right to omit all late copy when not received in time to conform to our schedules. Advertiser is responsible for any errors in late advertisements. 16.2 Proof Requirements The Advertiser agrees to submit complete advertising copy by the established deadline schedule. A proof cannot be supplied when the Advertiser submits advertising copy after such deadline and the Advertiser is responsible for any errors in the late copy. 16.3 Advertiser s Proof Responsibility When a proof is supplied, the Advertiser assumes full responsibility for errors in type and illustration not marked on the proof when the published advertisement corresponds to the returned proof. Extensive revisions of the original copy will be made only when they can be completed without delaying publication and the Advertiser may be charged the production expense. 16.4 Cancelled Ad Policy Any advertisement submitted, scheduled, produced and then cancelled after deadline without another publication date will be billed the production expense and the applicable rate for the scheduled space. 16.5 Ads That Look Like Editorial Advertisements designed to look like news articles must contain the words Paid Advertisement at the top or bottom of the ad in at least 10-point type. 16.6 Double Truck Gutters The gutter of a double-truck advertisement is considered and billed as a column. 16.7 Political Advertisements Political advertising may be published under the same conditions as any other advertising; however, all ads must be paid by check when copy is submitted. All political ads must include a paid for by... acknowledgment. Local, state and federal laws also govern political advertising. Advertiser is responsible for compliance with current laws. No political advertising will be accepted in Paraglide. 16.8 Copyright / Trademark Responsibility / Model Releases It is the sole responsibility of the Advertiser to obtain the copyright, model releases and trademark licenses necessary for publication of all copy including type, photography and illustration submitted by the Advertiser. 16.9 Ownership of Advertising Advertiser grants The Fayetteville Observer a nonexclusive license to publish all camera-ready advertisements provided to us.
