Condominium Association, Inc. The Rules We Live By (and other general information) Valencia is a small resident-owned community. Each of us is responsible for its upkeep and maintenance. Harmonious living in a condominium community requires little more than a thoughtful sensitivity to the needs of others and an awareness of the Rules We Live By. This is our home and we will appreciate everyone treating Valencia as you would your own home. Please use prudent judgment, encourage mutual respect, and put things back the way you found them after using them. We observe specific rules for safety, security and health reasons, and ask that everyone honor them. These pages contain rules and other information governing the most frequent activities at Valencia. Consider them a starting point of being a good neighbor. Community Rules and Regulations ACCESS TO UNITS The Association shall retain a pass key to all units. No unit owner shall alter any lock, or install a new lock which prevents access when the unit is unoccupied, without notifying the Property Manager and providing a new key. Units having outside storage rooms must also provide room key access. ACTION REQUEST If there is a problem that may be the responsibility of Valencia, a written action request must be submitted to the office. The exception to this is pest control which is cared for individually by contacting Bus-Or-Us at 239-775-4949. Appropriate request forms are available outside the office in the clubhouse. One item per request please. BICYCLES Bicycles must be registered with the property manager and display Association stickers for identification. All bikes must be in working order, including but not limited to, having inflated tires. BOARD MEETINGS Board meetings are held on a regular basis at least once a month. Meetings are announced 48 hours prior to the meeting date, and are normally held in the clubhouse. All owners are invited to attend. The Valencia Annual Meeting is held the last Thursday in March each year, at which time elections are held. CHANNEL 96 Cable Channel 96 is the Pelican Bay in-house information station. It is updated on a regular basis providing information on a variety of topics. CLUB HOUSE The clubhouse is located next to the pool. It is open from 7am to 11pm. Private Party use is available through a reservation with the Property Manager. CONSTRUCTION The Board of Directors has established a set of rules regarding interior construction and demolition. The rules are designed to ensure adherence to the Declaration of Condominium and protect the Common Elements. Unit owners who plan to make changes must contact the Property Manager well in advance of construction to receive necessary written approval of the proposed changes. CONTRACTORS, VENDORS AND SERVICE PERSONNEL OWNERS MUST HAVE APPROVAL FROM THE ASSOCIATION BEFORE MAKING ANY MODIFICATION TO THEIR UNIT. Workmen s hours are from 8:00am to 4:30pm, Monday through Saturday.

Contractors, vendors and service personnel shall not park on the grass, block roadways or dispose of any refuse in Valencia dumpsters or recycling bins. All contractors must remove their own debris from the site. On Sundays, contractors will have entry to the property to perform emergency services only. EXERCISE ROOM The hours of use are from 7am to 10pm daily. Children under 14 years of age must be supervised by a parent or designated adult. Proper footwear is required. No hard soles or high heels. Wet bathing suits are not allowed in the exercise room, or clubhouse, excluding the bathroom facilities. Use of equipment is limited to 30 minutes if others are waiting. No equipment is to be removed from the room. The last person leaving the room should turn off the TV and lights. FIRE ALARM If the fire alarm sounds, all persons must vacate the building and call 911. Only the Fire department can turn off and reset the alarm. GUEST PASSES Guest passes may be ordered, paid for and picked up at the Pelican Bay Commons. The charge for a guest pass is $3.00/day plus tax, $3.18, with a two day minimum. The pass entitles the guest to all of the amenities of Pelican Bay (tennis, tram, beach access, dining, and canoes) for the length of their visit indicated on the pass. Pelican Bay guest registration and fees are subject to change, so visit their website for updates. HURRICANE PREPAREDNESS Lanai furniture must be stored inside the unit when unoccupied. Personal plant containers must be removed when not in residence. LEASING OF UNITS All leasing must go through Compass Group Property Management and Pelican Bay Foundation. Unit owners must submit a lease application and receive approval prior to the start of the lease and occupancy by tenants. No unit may be leased more than 3 times a year, nor shall any unit be leased for a period of less than one month. Unit owners must relinquish membership cards to the Foundation when leasing before Lessee will be given a card for their use. During a lease period, Homeowner s have NO use of any of Valencia amenities, including parking their car on the property, pool use, beach or clubhouse use. Each owner should post simple directions in the unit so Lessee s are aware of their assigned parking space and where to register their car upon arrival. MAINTENANCE The interior of each unit is the owners responsibility to maintain, including the doors, screens and windows. MOVING Management must be notified of scheduled moving activity. Moving times should be between 8am and 5pm, Monday through Friday. Elevators MUST be padded before furniture is loaded. Please call management at least 48 hours in advance to have elevator pads installed. NOISE It is expected that everyone will be considerate of fellow residents and keep noise levels at a minimum. The lanais are especially open to noise and hopefully quiet after 10pm and before

8am. Opening and closing doors and sliders carry noise through the buildings. Please be a good neighbor! PARKING All cars must be registered with the Property Manager. Guests and Lessee s must receive a registration card to hang on the rear view mirror. Motorcycles are not permitted on the property at anytime. Each unit has its own assigned parking space which should be used. If a unit is leased, it is the unit owner s responsibility to remove their vehicles from Valencia property for the duration of the lease. Renters are only permitted ONE car. PELICAN BAY POST The Pelican Bay Post is printed monthly during off season and twice a month during season with current information about Pelican Bay. Copies are available at the Commons. PEST CONTROL Pest control services are provided by Valencia. If a problem occurs in a unit, it is the owner s responsibility to call Bugs-Or-Us at 239-775-4949. PETS Only Homeowners may have a pet not to exceed 20 pounds. When pets are outside, they must be on a leash and controlled at all times. Pets are not permitted at the swimming pool. The owner/walker must clean up after the pet. Lessees, guests and/or visitors may NOT bring pets to Valencia. PLUMBING EMERGENCIES In the event of a common element failure that creates a plumbing emergency such as a broken water supply pipe or blocked wastewater line, please notify the Property Manager at 239-598- 2646 or Compass Group at 239-593-1233. If you are experiencing plumbing problems within your unit, please call your own plumber, or contact our Property Manager for a preferred vendor list. POOL RULES Pool and spa hours are sun up to sun set. Use of the pool, spa and other association recreational facilities is limited to unit owners, their house guests and registered tenants. Use of the pool and spa is at your own risk. No lifeguard is provided. Smoking is NOT permitted in or around the pool, spa or clubhouse. Diving or running in the pool area is dangerous and prohibited for safety reasons. Children under 10 must be accompanied by a responsible adult. Children may not use the spa. Only toilet trained children are allowed in the pool. No diapers are permitted. All bathers must shower before entering the pool and spa. Persons swimming laps should be given consideration. Rubber rafts, floats, aquatic toys or similar objects are not permitted in the pool. No bikes, skateboards, roller blades, etc., should be on the pool deck and the pool access walks. Radios, CD players, etc., are not allowed unless used with headphones. Food and drinks are not allowed within 4 feet of the pool and spa. Glassware is not permitted anywhere in the pool area. All refuse must be disposed of in receptacles provided. Animals are not allowed in pool area. A beach towel must be used on pool furniture, and chairs should be returned to their original position after use. Umbrellas should be closed when leaving. There is no use of cell phones at the pool, unless for an emergency. RECYCLING AND TRASH Recycling in Collier County is mandatory under county ordinance. Please separate plastic, glass and papers. Garden units each have their own recycle containers and share trash containers.

Mid-rise buildings have separate recycle containers and garbage chutes on each floor. All garbage must be placed in a sealed or tied plastic bag before disposal in dumpsters. There is a small recycle container underneath the sink on the right-hand side, in the kitchen while in the clubhouse. REGISTRATION All owners, renters and guests must announce their presence to the property manager, advising who is in the unit and the length of stay. All cars must be registered and guest passes displayed when appropriate. Reservations can be made by calling Chelsea at 597-9970 at least three days ahead of desired play time. You must have your ID number as well as the ID of people playing with you. Reservations may be made up to four weeks ahead of time. You may wish to call Chelsea to confirm your assigned play schedule. Only one reservation per day is permitted. To find out if there is court availability please call 597-4497. WORK PERMITS If there is a problem that may be the responsibility of the Association, a written work request must be submitted to the office. Any renovation work should be processed through the Property Manager. Hours of work in any unit are 8:00 am to 4:30 pm Monday through Saturday, except for Holidays, including January 1 st, Memorial Day, July 4 th, Labor Day, Thanksgiving and Christmas. No noisy after hours work is permitted. Work must be done by certified, licensed, and bonded workmen. Homeowners are responsible to contact Collier County to determine if a permit is required.
