2 SERENITY ON THE RIVER RULES AND REGULATIONS DOCUMENTATION 1. The Rules and Regulations of Serenity on the River Condominium are based on and rely upon the following documents: a) The Condominium act of the State of Florida, Chapter 718, Statutes of the State of Florida, 2005, as amended. b) The Declaration of Serenity on the River Condominium as amended. c) The By-Laws of Serenity on the River Condominium as amended. COMPLIANCE All unit owners, their tenants, families, guests, employees and any other persons who may in any manner use the building or the grounds shall be bound by and shall comply strictly with the provisions of the Declaration, the By-Laws, and the House Rules as set forth hereinafter, and all agreements, decisions and determinations of the Association as lawfully made or amended from time to time. Failure to comply with any of the aforementioned documents shall be grounds for assessment of penalties up to and including $ per day and for an action to recover sums due for negligence or damage or for injunctive relief by the Association, or in a proper case, by an aggrieved unit owner. COMPLAINTS AND NOTICES Complaints regarding the management of the condominium units and grounds or regarding actions of other owners shall be made in writing to the Association. In the event of a complaint filed against a unit owner, our management company will notify the unit owner, against whom the complaint has been filed, requesting said unit owner to correct the situation. If the unit owner fails to comply, the management company will notify the offending unit owner to appear before members of the Board of Directors. Decisions may be appealed by either party to the Board of Directors of the Association. The decision of the Board of Directors shall be final and binding upon all parties EXPENSE OF ENFORCEMENT Every unit owner shall pay to the management company promptly on demand all fines, penalties, costs and expenses including reasonable attorneys' fees incurred by or on behalf of the Association in collecting any delinquent assessments against such unit thereof for enforcing any provisions of the Act, the Declaration, the By-Laws or the House Rules against such owner or any occupant of such unit. REVOCABILITY OF APPROVAL Any consent or approval given under these rules and regulations by the Association shall be revocable by the Board of Directors. AMENDMENTS These rules and regulations may be modified, added to, amended or repealed at any time by the Board of Directors. BALCONIES 1. Watering of plants, sweeping and mopping of balconies shall be done so as not to bother persons residing in lower or adjacent units. 2. Waterproof containers shall be placed under all flower pots. 3. No plants, pots or any other loose objects shall be kept or maintained on the ledge of any unscreened balcony. Hanging plants should be secured within the balcony area. 4. No clothes, sheets, blankets, laundry, or any kind of articles shall be hung or exposed on any part of the Common Elements, Limited Common Elements, or any part of the exterior of a Building. There shall be no conversation from the balcony to any individual not within the unit. 5. No storage in balcony. Example: brooms, mops, coolers, boxes, kennels, cages, tool boxes, building material, hanging clothes, toys or bicycles. 6. CHAPTER 28-SECTION 5 OF THE DADE COUNTY FIRE CODE SPECIFICALLY PROHIBITS OUTDOOR COOKING ON BALCONIES IN MULTIPLE STORY BUILDINGS, EITHER BY COAL, GAS, ELECTRICITY OR ANY OTHER MEANS. ANYONE VIOLATING THIS LAW IS SUBJECT TO A $ FINE TO BE IMPOSED BY THE DADE COUNTY FIRE DEPARTMENT. COMMON ELEMENTS & MOVING-IN 1. The Common Elements and Limited Common Elements shall be kept free and clear of rubbish, debris and other unsightly materials and shall not be obstructed, littered, defaced or misused in any manner. This provision includes leaving furniture, boxes or trash bags outside of unit doors and any other place that is not the trash containers or inside the chute. 2. It is forbidden for any tenant to walk in the common areas in bathing attire or barefoot -i.e. halls, lobby, elevators, etc. 3. Residents are not allowed to move in or out on Sundays or any Legal Holiday. Moving Hours are Monday to Saturday from 9:00 am to 5:00pm. It is important that residents ONLY use the SERVICE elevator on the middle-section of the building for deliveries or moving in and to clean up the elevator, hallways and/or common areas once they have finished moving.
3 PARKING AND PARKING STALLS 1. Assigned parking stalls are for the exclusive use of individual unit owners or tenant at the time. They may not be occupied or used by others except with the permission of the owners and notice to management. 2. Cars should be centered between the lines and against the forward bumper. They shall not protrude beyond the stalls in such a manner as to block the ingress and egress of others. 3. Vehicles must be parked head-in only. 4. Parking areas shall not be used for any mechanical work on vehicles except in an emergency. 5. Tenants shall park in the stall assigned. 6. Maintain a 10 mph speed limit while in the condominium common areas or roads. 7. Parking is strictly prohibited in front of the entrances to the building or on the fire lane against the side. a. The Association reserves the right to remove any vehicle so parked at the expense of the owner of the vehicle. This is pursuant to the provisions of Chapter of the Florida Statutes. b. With reference to cars parked in any other unauthorized place, the Association reserves the right to remove same in the manner as above provided. Management is expressly authorized and directed to cause such vehicle to be removed. If Management is not available, any member of the Board of Directors may authorize such tow-away. 8. Owner of units, lessees, their employees, servants, agents visitors and licensees and the owner's family will obey the parking regulations and any other traffic regulations promulgated in the future for the safety, comfort and convenience of the owners. 9. All vehicles parked inside the property must have a valid Decal or Temporary Permit provided by the building office. 10. Violations of any of these rules may result in vehicles towed away at owner's expense. 11. Only guests of unit owners or lessees may park in the spaces marked "Visitors". PETS 1. Pets are defined as: Cats, Dogs and Tropical Fish 2. TENANTS & GUEST ARE NOT PERMITTED TO HAVE PETS 3. No pet should exceed 40 lbs. in weight at mature growth. 4. No more than one (1) pet is allowed per unit, tropical fish excluded. 5. No pets should be left alone outside on the balcony or patio. 6. No excessive noises/barking will be tolerated including vicious, unpleasant or disturbing 7. All dogs must be leashed at all times. 8. Owners must clean-up after their pet in case of an accident or mess. POOL AND POOL AREA 1. Pool Hours are from 10 am to 8 pm 2. Children under 12 years of age are not permitted to use the pool unless they are accompanied by an adult (a person at least 18 years of age). Small children should be protected by wearing a life vest, water wings, "bubbles" or other approved life-saving devices. 3. No surfboard or floats are permitted in the pool or pool area. 4. Excessive noise, playing ball or horseplay in the pool or pool area is prohibited. 5. No food is permitted inside the pool. 6. Beverages are permitted in the pool in unbreakable containers. No glass containers are allowed in the pool area. We ask that you please dispose of all trash inside the waste receptacle provided in the pool area. 7. Only bathing attire is allowed in the pool. Please use the restroom to change as decency and common courtesy to other families. 8. All posted rules and regulations in the pool area are to be strictly observed. Please Note: Only 2 guests per unit are permitted in the pool area. 9. The swimming pool and pool area is to be used solely for condominium residents and their invited guests. Those who swim in the pool and utilize the other recreational facilities, shall do so at their own risk, and the Association shall not be liable for any personal injury, loss of life, property loss or damages in any way caused or arising from the use of the recreational facilities. 10. People who use the pool must changed in the bathrooms before entering the lobby. No bathing attire or walking barefoot is permitted in the hallways. 11. Life preservers are for emergency use only and are not to be removed from the pool area or used for play. 12. All persons shall comply with the requests of the Management Company and members of the Board of Directors respecting matters of personal conduct at or around the pool and recreational area. THE MANAGEMENT COMPANY OR MEMBERS OF THE BOARD OF DIRECTORS ARE AUTHORIZED TO REMOVE FROM THE POOL AREA ANY VIOLATORS OF THESE RULES AT ANY TIME.
4 QUIET HOURS (Metro-Dade Ordinance ) 1. Owners and occupants are requested to observe the following quiet hours during the following periods: 11:00 P.M. to 7:00 A.M. the next day 2. All occupants shall exercise extreme care about making noise or in the use of musical instruments, radios, televisions, amplifiers, house parties or arguments that may disturb other occupants. 3. During the quiet hours, there shall be no noise audible outside one's apartment. 4. In the parking areas: reunions, drinking alcohol, excessive noise, loud talking, slamming of doors, racing of engines and the use of horns may result in fines as defined in the above ordinance. RECREATION ROOM 1. The use of the recreation room may be reserved for special occasions for unit owners/tenants residing on the premises. 2. The recreation room must be reserved 15 days in advance through the Management Company. Please call to request the necessary reservation form or stop by the office during normal business hours. 3. Qualified residents shall have the right and privilege to use the recreation room for private functions. A deposit of $ must be made to Serenity on the River and forwarded to the Management Company (15 days in advance) which will be refunded if, in the opinion of the Board of Directors, the room has been properly cleaned and no damage has been caused by the resident or guests. If the room has not been properly cleaned, the Association will have the room cleaned and assess the unit owner for costs. 4. The cost of rental is $50.00 per day (non-refundable; paid in advance money order) for tenants and no charge for current owners. 5. Any damages in addition to the deposit will be charged to the unit owner. 6. If the recreation room is reserved for functions for minors, a chaperon must be present at all times as well as a person on duty in the parking lot to direct invitees where to park. The Association will not be responsible for vehicles towed due to illegally parked. 7. The recreation room may be used for 5 hours maximum and no later than midnight. Guests are welcome in the club room, but not in the lobby, patio or pool area. Music must be kept at a reasonable level. REFUSE DISPOSAL 1. All waste material and refuse shall be placed in plastic bags and tied before being placed in the trash chute. 2. If cartons or other containers are too large to be placed in the chute, then it is the owner's or tenant's responsibility to remove said cartons or other containers and place them in the ground floor (1st Floor) exterior waste bins. Please be sure to break down boxes and/or items that are big. 3. No inflammable or volatile material shall be thrown down the chute. 4. Electric lights should be turned off when leaving the room. 5. All furniture or bulky items are the responsibility of its owner to remove from the premises. Please do not leave them in the hallways, trash rooms or on the first floor as the waste pick up company WILL NOT TAKE THEM and YOU WILL BE FINED. SALE OR LEASE OF UNITS IN SERENITY ON THE RIVER 1. If you are planning to sell or rent your unit. You MUST contact the Management Company and notify them of your intentions. 2. They will provide you with the proper form and instructions as to screening procedures. 3. UNDER NO CIRCUMSTANCES WILL A NEW OWNER OR TENANT MOVE INTO A UNIT PRIOR TO BOARD APPROVAL. 4. Any individual or guest of a unit owner or tenant who is in a unit for more than 15 days must be screened. 5. The maximum number of residents per unit is as follows: One bedroom, 2 residents; 2 bedrooms, 4 residents. 6. All leases shall be for a period of one year from date of original agreement. 7. All new tenants (owners or lease) must be screened irrespective of terms of lease, sale or transfer and subject to approval. STORAGE AREA 1. You may stop by the management office to place an item in storage. Please be sure to complete the form provided and label all items with your name and unit number. 2. Access to the storage will only be allowed during normal office hours. 3. No Owner or Tenant may keep a copy of the storage key. 4. Storage of items will only be performed based on availability of rooms. 5. Nothing of a volatile, inflammable or odorous nature will be permitted in any storage area. 6. The safety of the storage area is the full responsibility of the owner and the Association will not be responsible for loss or damage of any property therein due to theft, wind, flood, fire, mysterious disappearance or any other cause whatsoever.
5 MISCELLANEOUS PROVISIONS BUILDING OFFICE: Please report any maintenance issues, such as lights out, spilled water, backed-up chutes, violators, disorderly conduct, etc. to the building office. Hours of Operation are: Monday thru Friday from 9 am to 4 pm and Saturdays from 9 am to 2pm. You may also wish to contact them by PHONE: (305) ; FAX: (305) or via [email protected] TILE: No floor tile is permitted above the first floor without proper and approved insulation under it. Approval must be obtained from the Management Company/Board before commencing an installation through an Architectural Modification Form. INDIVIDUAL UNIT AIR CONDITIONING SERVICE: It is the unit owner responsibility to maintain the unit's air conditioning. Whenever needing access to the roof to service your unit's air conditioning, please contact Management to make an appointment. Please be sure to have a valid copy of the necessary License and Certificate of Insurance so your technician may gain roof access. Whenever changing your air conditioning to a new unit, you must submit a permit from the City of Miami Permit Office before doing the change. SATELLITE DISH / ANTENNAS: May only be located inside property balcony on a tripod. Dish should not be set outside the limit of the balcony railing. No satellite dish antenna can be installed on the roof. WATER SHUTT OFF: Request for water shut off due to a repair in your unit must be requested at least 72 hrs. in advance to the Management company with a description of the work to be done. Request will be available by the 15 th day (except Saturdays, Sundays and Legal Holidays) of each month, unless it is an emergency. All plumbing work MUST BEGIN at 9:00 AM in order to restore the water as soon as possible and NO LATER than 12 Noon. The use of a licensed plumber is mandatory and proof of such must be provided. CONSTRUCTION & UNIT UPGRADES: Unit owners planning to make upgrades to their unit, must contact the Management Company, and request an Architectural/Modification Form. After filling out this form with the description of the work to be done, it must be delivered to the management for the approval by the Board of Directors prior to commencement of any work. It is the responsibility of the unit owner to make sure that ALL DEBRIS IS REMOVED FROM THE CONDOMINIUM BY THE CONTRACTOR, and hallways and elevators left clean daily while the construction is being done. Construction and up-grades are ONLY to be done during the hours of Monday through Saturday from 8am to 5pm. UNIT DOORS: It is the responsibility of each owner to maintain the entrance door to their unit. This includes broken doors, door knobs that are missing or falling, paint that is chipping or pealing. Please contact the building office to obtain the appropriate color code. ELEVATORS: There is to be no running in the halls, nor playing with the elevators. Do not hold the elevator open unnecessarily when moving or chatting since this may cause the elevator to break down. ONLY use the SERVICE ELEVATOR (Mid-Section) for Moving and Deliveries. PLAYING: There shall be no riding of bicycles, skateboarding or playing ball in the parking lot; as this poses a liability to the Association and it is very dangerous.
