1 COUNTRY PARK at BOCA RATON HOA RULES & REGULATIONS OF THE ARCHITECTURAL CONTROL BOARD This is a VALID Country Park Document. Keep this with your homeowner papers and documents. ARCHITECTURAL CONTROL BOARD The Architectural Control Board consists of 3 voting members appointed as a standing committee of the Association. It shall have the power to promulgate such rules and regulations as it deems necessary to carry out the provisions and intent of this document. ALL owners and leasees shall abide by all the rules and regulations at all times as they are adopted from time to time by the Architectural Control Board (ACB). Approval or non-approval of any modification, alteration or improvement is in the sole discretion of the Architectural Control Board. However, at any time, an appeal may be made to the Board of Directors in writing. In order to change or amend any rule or regulation or adopt new rules and regulations, the same must be approved by a majority of the Architectural Control Board. No vote of the membership is required. In the event of any conflict or inconsistency between this ACB Rules and Regulations and the Declaration of Covenants and Restrictions for Country Park at Boca Raton, the provisions of this ACB Rules and Regulations shall supersede, govern and control. Section 1 - Changes ARTICLE I ARCHITECTURAL CONTROL No owner shall make or permit any structural or exterior modification or alteration of any building except with prior written consent of the Architectural Control Board, and such consent may be withheld if, in the sole discretion of the party denying same, it appears that such structural modifications or alteration would affect or in any manner endanger other dwelling units. No building shall be demolished or removed without prior written consent of the Architectural Control Board. It shall be a condition precedent to the granting of the consent of the Architectural Control Board to the making of such additions, alterations or improvements that the owner furnished satisfactory evidence that the proposed addition, alteration or improvement complies with all laws, rules, ordinances and regulations of all governmental authorities having jurisdiction. Any change in the exterior appearance of any building, including any changes in the paint, coating, stain or other exterior colors or finishing materials on such building, shall be deemed an alteration requiring the approval of the Architectural Control Board.

2 Each building, fence or other structure or improvement of any nature, together with the landscaping, shall be erected, placed or altered upon the premises only in accordance with the plans and specifications and plot plan so approved. Refusal of approval of plans, specifications and plot plan or any of them may be based on any grounds, which in the sole and uncontrolled discretion of said Architectural Control Board deems sufficient. Section 2 Procedures An Architectural Committee Review form must be filled out for any modification or improvement PRIOR to commencement of any work. Enclosures MUST consist of: - Architectural form completely filled out with ALL copies attached. - Copy of survey, making out the location of the modification/improvement. - A detailed diagram and description (size, height, color, materials used, etc.) - License and insurance of vendor The above items must be included or the form will be returned for insufficient information. Section 3 Violations The Management Company performs a weekly inspection. Below are the procedures for a cited violation. ARB Violation An ARB violation letter will be sent if an unsubmitted modification/improvement is cited. Enclosed will be an ARB form that must be filled out and returned to the Management Company. If the form is not received, violation notices will proceed. Violation Notices You will receive 2 violation letters regarding any violations on your property. The 3 rd letter for the same violation will require your appearance in front of the Grievance Committee. They will recommend to the Board of Directors what action is to be taken or if fining should commence. Section 1 Fences ARTICLE II GENERAL EXTERIOR MODIFICATIONS Rear yard fencing of white PVC or galvanized chain link or color coated chain link not to exceed six (6) feet in height, installed no further forward than the front dwelling line on the lot or adjoining lots and not encroaching on common areas. If easement areas are fenced in, such easements remain, and the owner must maintain the surrounding areas,

3 i.e., trimming grass, etc. Green vinyl or green aluminum privacy slats are permitted in a chain link fence but must be properly maintained. Section 2 Wood Fences No wood fences are permitted. Section 3 Hedges Hedges within the rear or side yard setbacks must be no more than six (6) feet in height and must not obstruct the view of vehicles or pedestrians. Hedges must be trimmed vertically away from common areas. Section 4 Wood Decks Rear yard wood decks with or without privacy fence are permitted. Fence to be no higher than three (3) feet from the deck level. Landscaping may be required due to elevation. Section 5 Doors Front screen doors and garage doors may be installed. Sliding glass doors, French doors, etc., may be installed. Jalousie doors are not permitted. Section 6 Windows Additional windows must be of the same style and window frames of the same color as existing windows on home. Crank-out/awning-type windows are not permitted. Section 7 Utility Sheds Utility sheds are permitted but must be bolted on to a concrete slab and bolted to the house. Sheds must be of neutral-colored aluminum parts or color-coordinated with existing home. Section 8 Driveways Enlargement of driveways are permitted for the parking of additional vehicles but must not encroach an easement area or utility companies may remove the improvement from the easement at their discretion. ARC application must be filed and property survey must accompany the application. Section 9 Patios Patios are permitted or block or poured concrete or other appropriate decking materials for recreational purposes only and not for storage and not encroaching on any easements.

4 Section 10 Signs Store-bought owner or Realtor For Sale signs are permitted only and must be located in the front yards only. Section 11 Mailboxes Change of mailboxes or receptacles are permitted. mailboxes. House numbers should be on Section 12 Play Structures All fixed games and play structures must be located behind the residences. Section 13 Temporary Structures No structure of a temporary character, trailer, tent, mobile home or recreational vehicle shall be permitted on any lot. Section 14 Flags No flags may be erected, except and owner may display the flags of the United States and State of Florida on appropriate holidays from a temporary flagpole attached to his unit. No flagpole may be erected on the ground. Section 15 Garbage and Trash Disposal All garbage, trash or rubbish must be hidden from view at all times except for disposal collection. Trash must be in container with secure lid. Section 16 Trucks, Boats, Etc. No trucks, commercial vehicles, campers, mobile homes, motor homes, boats, house or boat trailer, or trailer of every other description are permitted on property overnight. Section 17 Nuisances No owner, lessee or their guests/visitors shall make or permit any disturbance that will interfere with the rights, comforts or convenience of others. No noxious or offensive activity shall be carried on upon any lot.

5 ARTICLE III GENERAL RESTRICTIONS 1. No gas tank, gas cylinder or gas container shall be permitted to be placed on or about the outside of any house. 2. The maximum speed limit within the community is 25 MPH. 3. No vehicles may be parked on any portion of any grass area or sidewalk within the community. Parking is limited to paved areas only. All vehicles must be properly licensed and in operable condition. Unlicensed or inoperable vehicles are not permitted anywhere in the community, except that these vehicles may be kept inside a garage and not visible from the outside. Except in cases of emergency repair, no mechanical repairs or maintenance of a vehicle is permitted in the community except inside the garage and not visible from the outside. 4. Hurricane shutters are permitted. ARC must be submitted 5. No painting of houses without prior written approval and you must use approved colors. 6. Cars on blocks or jacks or junk cars are not permitted. 7. No structures on common areas. 8. No obstruction to visibility at street intersections shall be permitted. 9. No artificial grass, plants or other artificial vegetation shall be placed or maintained upon exterior of any lot. 10. No window or wall air conditioning units are permitted. 11. No block or poured concrete walls are permitted. 12. All dogs must be on a leash when outside the home. It is the Law that you MUST clean up after your dog. PBC Ordinance 98-22, sections 4 & Toy, bikes, trash containers, basketball stands and the like are not permitted to obstruct any portion of the roads or sidewalks within the community. 14. No property or unit may be used for any business or any type of commercial activity. Each unit may only be occupied as a single family residence. If you rent your unit, you MUST send a copy of the lease to the management company and supply contact phone numbers for your tenants. You MUST also inform the management company of your current mailing address. 15. Recreation Facilities - are for the exclusive us of residents and their guests and can be used from 8:00 AM to dusk. See Pool Rules for further information 16. Tennis Courts Gates must be kept locked at all times. Bikes roller blades and skates are strictly prohibited in pool area or on tennis courts. Tennis courts are to be used for tennis and basketball ONLY. 17. Fishing, boating, swimming, wind surfing and all other water sports are prohibited in or on any lake within the community. 18. Trash containers must be kept out of view except that they may be placed outdoors after sundown of the evening prior to scheduled pickup and must be removed from view by 9:00 PM on the day of pickup. 19. All Federal, State and Local laws, ordinances and regulations governing the area must be obeyed. No improper or offensive actions or activities will be

6 tolerated. No activity which interferes with the peaceful possessions of any unit or the property of the Association shall be permitted. 20. No Owner, tenant or guest shall create or permit any disturbance or activity that will interfere with the rights, comforts or convenience of others. 21. FEEDING THE DUCKS IS STRICTLY PROHIBITED. 22. The Association has the right to impose a fine of $ per day for each violation. ARTICLE IV LAWN MAINTENANCE All lawns, landscaping, walkways, fences and exteriors of units shall be properly maintained. If landscaping, walkways, fences and exteriors are not maintained class the Association can do any necessary maintenance after proper notification to the owner, and the cost plus a reasonable fee plus expenses and attorney s fees can be assessed against the lot and such entry will not be deemed a trespass. No weeds, underbrush, or unsightly growths shall be permitted to grow or remain upon any lot and no refuse pile or unsightly objects shall be allowed to be placed anywhere thereon. In the event that an owner fails to keep the premises free of the above, the property may be entered upon and remove same and all costs plus a reasonable fee plus expenses and attorney s fees can be assessed against the lot and such entry will not be deemed a trespass. Any unit owner who allows their lawns to be more than 6 inches in height, or allows their lawn to become infested with weeds, or fails to properly fertilize, trim or irrigate their landscaping, shall be deemed to have failed to maintain their property. Hedges on both sides and rear of the home cannot exceed 6 feet in height. If you have a corner lot, your hedges CANNOT obstruct the view of oncoming traffic; block the view of stop signs and speed bump signs. In these instances, hedges cannot be taller than 4 feet in height. Your hedges cannot encroach on the common areas and walkways. Irrigation - For those who live on a lake and irrigate from the lake, the only approved irrigation floatation device is a duck. No plastic bottles, jugs or containers, PVC T pipes or any other floating object are allowed in the lake. Approved irrigation floatation ducks can be purchased at an irrigation supply store or irrigation department of a hardware store.
