1 The 30A Farmers Market, LLC., at Rosemary Beach, Florida Rules and Guidelines Mission: To provide local food growers and producers an effective direct market sales site and to provide consumers with a source for local, fresh produce and products. Location: Rosemary Beach Town Center. Time: Sundays 9:00am-2:00pm Labor Day-Memorial Day Sundays and Thursdays 9:00am-2:00pm Memorial Day-Labor Day Definitions: that was grown and or raised by the farmer or a representative for the farmer, including, but not limited to, fruits, vegetables, cut greenery, live plants, herbs, flowers, meat, poultry and dairy products. preparation and sale of Cottage Products. These vendors no longer have to find commercial kitchens in order to prepare their products. Products sold at the Market are limited to four categories, listed below as A though D. Each vendor s application for a permit to sell shall state what is grown/ produced/made by the vendor and or supplier, and what products the vendor intends to sell at the Market. A. Fresh Farm products: Includes fresh fruit and vegetables, herbs, nuts, honey, dairy products, eggs, poultry, mushrooms, meats and fish. Also included in this category are fresh grown flowers, nursery stock and plants. B. Value added Farm Products: Includes preserves, jams and jellies, cider, syrups, salsas, dried fruit, flours, salad dressings, nursery stock and plants. C. Dried flowers, Crafted Farm Products: Allowed are fresh bouquets, pumpkins and gourds. D. Processed Foods*: Includes juices, preserved foods, salad dressings, jams, pastries, pasta, granola, cookies, muffins, breads, pies and related take home desserts. All processed foods must have the proper permits and must carry product liability insurances. Copies of proof of insurance must be provided to market manager. If there is any question whatsoever about whether an item may be sold at the market, a brief written proposal should be submitted to the Market Manager for review. Arts and crafts are not permitted for sale at the market. How stall assignments are made Stall assignments are made by market manager based on the following criteria: Available space, number of spaces needed, vendor performance. Initial

3 Performance includes good product quality, good display and signage, ability to follow rules and directions regarding punctuality, clean-up, market fees being paid/current. The manager will make every attempt to keep stall spaces consistent throughout the season. Market space assignments will be adjusted as needed. Market fees, guidelines and rules for participation Market fees $20.00 each market day. A $15.00 annual non-refundable fee is required to accompany all registrations. Booth size is 12 wide by 12 deep. Tent size 10' wide by 10' deep. Additional stall space may be purchased (i.e. a second stall for a total of $20.00). Fees will be collected during the day of market. Advise market manager in advance of market day if you have electrical requirements. The Market Manager reserves the right to terminate a vendor for any reason at any time without refund of fees. Guidelines and Rules for Participation: Please alert the manager of any planned absences so that adjustments (i.e. increasing allowable space, stall layout) may be made in a timely manner. The Market does not provide tables, awnings, tents, or tent weights for vendors. All vendors who wish to erect canopies (including umbrellas) on the market site during a normal period of market operations, including the set up and break down period, are required to have their canopies sufficiently and safely anchored to the ground from the time their canopy is put up to the time it is taken down. Any vendor who fails to properly anchor his or her canopy will not be allowed to sell at the market on that market day, unless that vendor chooses to take down and stow their canopy and sell without it. Punctuality: Hours of the market are 9:00AM-2:00PM. Vendor set up time begins at 7:45AM (and not prior). Vendors must vacate the site by 3:00PM. Please leave ample time for set up, especially considering weather variances and the occasional need to vendor layout. This helps everyone to be more successful for market time. Thank you. initial

4 Vehicles: All vendors must be set up and ready to sell by start time. Vendors with vehicles must arrive 30 minutes to 1 hour before market start time. Vendors with vehicles who arrive less than 30 minutes before the Market opens run the risk of having to load off from the parking area and transport items to the assigned stall. Additionally, vendors are asked to park their vehicles out of the customer parking area to maximize customer spots. Vendors are not allowed to park on West Barrett, South Barrett, Main Street East or on West and East Lawn Green. Vendors are required to stay until closing. Vendors who sell out early must keep their stall set up and post a sign letting customers know they have soldout. Cleanup: Vendors are required to clean up after themselves and to provide receptacles for garbage from consumers. Vendor space must be maintained in a clean, safe and sanitary manner. Vendors are responsible for taking with you any trash or garbage that is generated in or around your booth and sweeping up any product debris left on the ground. No vendor is allowed to dispose of produce waste, overripe or leftover produce or boxes or product in any onsite garbage cans or dumpsters. Do not dump ice, dry ice, or water onto the grass, walkways or streets. Signage: All vendors will post a sign identifying the name of the farm/business represented and where it is located. Signs should not be smaller that 24- inches by 8-inches high. All goods for sale should be clearly marked with their prices. This can be done individually or on a larger sign that is clearly readable. This is a critical component of providing a reputable farmers market, allowing customers to refer to growers and businesses by name. Please have ample signage to allow the community to know you. Space: The vendor sales area must not extend beyond the allotted boundaries of the stall space. Avoid blocking neighboring stalls with large signs etc. initial

5 Pricing and quality of produce/products: Pricing of goods sold at the Market is solely the responsibility of the individual vendor. Vendors are expected to bring good quality produce to market. Vendors are responsible for the safety of their food and cannot sell adulterated food. Scales: Vendors selling produce by weight must provide their own scales. Scales must be legal for trade and are subject to inspection by the Department of Agriculture s Weights and Measures program. All scale displays must be readable and in easy sight to your customers during business transactions. Vendors must monitor and supervise their children at all times during Market day. Set-up and take-down time can be an especially dangerous time for unattended children. The Market can take no responsibility for their safety or whereabouts, or for any damages they may cause or incur. Courtesy/Conduct: Vendors and their representatives are expected to conduct themselves in a respectful, safe and courteous and harmonious manner with customers, market staff and each other. Any language or behavior that jeopardizes the normal operations of the Market will be grounds for termination of the vendor s permit to sell. Complaints of any kind should be written up and given to the market manager/staff. Customer complaints about individual vendors will be discussed with the vendor. If the market receives numerous complaints about a vendor, the market manager will discuss the situation with the vendor and determine if any corrective action is needed. Customers who have a legitimate complaint about the produce/goods they purchase should be given a full monetary refund or replacement of equal value. 6 Vendor Dress: Vendors are required to wear shirts/shoes at their booths during market hours. No Smoking/Drinking. Smoking is not allowed anywhere in the Market sites at any time. Consumption of alcohol or any controlled or illegal substance while at the Market is prohibited. Vendors must be fourteen years of age or older. Younger children are welcome and encouraged to participate, but must be accompanied by an adult responsible for the child s conduct and safety. Taxes, Insurance, Licenses, Permits and special requirements: Vendors are required by state law to collect from customers applicable taxes on tangible property that is sold at the Market. Tax collection and payment is solely the responsibility of the vendor. Produce and Cottage Food products are typically exempt from tax. Handcrafted goods, however, are not exempt and are considered to be tangible property. Vendors should register as dealers (free online registration) so that Sales and Use tax payment can be remitted. Registration is free at: After registration, DOR will mail you quarterly tax forms. Insurance: All vendors must show proof of current automobile insurance for on-site vehicles. Please attach proof of insurance to vendor application. Farmers' Market Liability Insurance is highly recommended. Permits, licenses and insurance: All vendors shall provide at the time of application current copies of any permits, insurance and licenses applicable to the sale of their products. All prepared foods and baked goods vendors must have a current County Health Department Food Worker Cards and applicable operating permits issued by the Walton County Health Dept. and keep a copy of these permits at their market stall at all times. A valid copy of automobile insurance is also required. Initial

8 LIABILITY: Liability is the responsibility of the vendor. 30A Farmers Market, LLC., its members, agents and subcontractors assumes no risk and Rosemary Beach Property Owners Association, Inc., its members, agents and subcontractors and the land owner assumes no risk. By acceptance of this Vendor s Agreement, the vendor expressly releases 30A Farmers Market LLC., its members, agents and subcontractors from any and all liability for damage, injury, and loss to any person or goods which may arise from the land use and occupation of said space by the vendor, and agrees to indemnify, and hold and save the 30A Farmers Market, LLC., its members, agents, and subcontractors harmless of any and all loss or damage thereof and the vendor expressly releases Rosemary Beach Property Owners Association, Inc., its members, agents and subcontractors and the land owner from any and all liability for damage, injury, and loss to any person or goods which may arise from the land use and occupation of said space by the vendor, and agrees to indemnify, and hold and save the Rosemary Beach Property Owners Association, Inc., members, agents, and subcontractors and the land owner harmless of any and all loss or damage thereof. 30A Farmers Market, LLC., its members, agents and subcontractors are hereby released and discharged of any and all liability from loss, injury, or damage to persons or property that may be sustained during vending on any property where 30A Farmers Market, LLC., is operating. Rosemary Beach Property Owners Association, Inc., its members, agents and subcontractors and the land owner are hereby released and discharged of any and all liability from loss, injury, or damage to persons or property that may be sustained during vending on any property where 30A Farmers Market, LLC., is operating.
