Tender documents can be down loaded from the web site of the Institute www.iiitmk.ac.in. Cost of Tender Form / Bid Submission Fee is Rs. 500.00 + VAT 12.50%. The cost of tender documents may be paid as Demand Draft drawn in favour of the Director, Indian Institute of Information Technology and Management - Kerala, Technopark Campus, Karyavattom, Thiruvananthapuram. This amount is not refundable under any circumstances. The tender documents can be obtained from the office of the IIITM-K, Technopark Campus, Karyavattom, Thiruvananthapuram on payment of cost of tender form on any working day during office hours from 20.01.16 10.00 a.m to 29.01.2016 3.00 p.m. The tenders of those contractors/firms who have not paid the cost of tender documents will be rejected Tenders sealed and endorsed as such with name of work, tender no. clearly written and addressed to the Director, IIITMK, Technopark Campus, Karyavattom, Thiruvananthapuram should be delivered at the office of the Director, IIITMK, Technopark Campus, Karyavattom, Thiruvananthapuram on or before 3.00 p.m on 29.01.2016. Tenders are accepted through India by hand or Registered post or Speed post only. Tenders received late will be summarily rejected. The Director, IIITMK, Technopark Campus, Karyavattom, Thiruvananthapuram reserves the right to reject all or any of the tenders and to accept in whole or part of any of the tenders without assigning any reason. ELIGIBILITY CRITERIA Contractors who are having valid licence issued from Kerala PWD /CPWD/Railways/MES to carry out this type of works. Kerala PWD Class C and above EMD/SECURITY DEPOSIT /RETENTION MONEY Earnest Money Deposit is Rs. 3,500.00 (Rs. Three thousand five hundred only) and is to be produced in any one of the following form 1. Demand draft from a Scheduled Bank/Nationalised Bank drawn in favour of the Director, IIITM-K, Thiruvananthapuram. 2. Deposit receipt from a Scheduled Bank/Nationalised Bank pledged in favour of the Director, IIITM-K, Thiruvananthapuram. 3. National savings/kissan Vikas Patra /Treasury savings certificate duly pledged in favour of the Director, IIITM-K, Thiruvananthapuram. 4. Bank Guarantee from a Nationalised bank E.M.D of the unsuccessful tenders will be refunded without any interest within the firm period of 60 days from the date of opening of the bid. E.M.D may be forfeited in the following cases. 1. If a bidder withdraws his bid during the period of validity specified. 2. If the successful bidder fails to sign the contract document or fails to furnish the required security deposit within the time limit SECURITY DEPOSIT The successful tenderer will deposit an amount equal to 5% of contract value as specified in the selection notice in the form of Bank Guarantee from a Nationalised bank which will remain valid till 28 days from completion of defect liability period of 12 months from the date of completion of the work. All the deposits of E.M.D., SECURITY DEPOSIT AND RETENTION MONEY will not bear any interest whatsoever. 1. Income-tax and works contract tax at the rate prevailing at the time of payment will be deducted from each running bill and final bill. 2. All statutory payments in connection with the employment of the workmen for this work will be borne by the contractor.
PRELIMINARY AGREEMENT A preliminary agreement in the Proforma attached is to be executed on Kerala stamp paper worth Rs.100/- and submitted along with the tender PERIOD OF VALIDITY OF TENDER The tender shall remain valid for acceptance for a period of 60 days from the date of opening of the tenders. TIME OF COMPLETION The work covered by the contract shall be commenced and executed in accordance with the drawings and specifications within 7 days from the date of award of work INSPECTION OF SITE Every tenderer is expected to visit site of the proposed work and acquaint himself of the site conditions before quoting for the work ALL INCLUSIVE RATES The contractor s rate must be firm and include the cost of transportation to site all taxes such as VAT, WWF, IT Service Tax etc QUANTITIES The quantities set out in the bill of quantities are the estimated quantities of the work. They are not to be taken as the actual and correct quantities of the works to be executed by the contractor in fulfillment of his obligations under the contract. Only approved quality materials shall be allowed for the work. The samples of all materials shall be got approved before supplying for the work. AGREEMENT The successful tenderer will be required to sign an agreement in Stamped paper worth Rs.100.00 in the form approved by the Owner for the fulfilment of the contract. But the written acceptance of the tender by the Owner will constitute a binding agreement between the Owner and the person so tendering whether such formal contract is or is not subsequently entered into. OTHER CONDITIONS OF CONTRACT All existing conditions of contract pertaining to electrical works related to Kerala Public Works Department Manual are applicable for this tender. DIRECTOR
PROFORMA OF PRELIMINARY AGREEMENT (To be executed on stamp paper of value Rs.100/- and submitted along with tender). Preliminary agreement entered into on this day of January 2014 between the Director, Indian Institute of Information Technology and Management - Kerala, Technopark Campus, Karyavattom, Thiruvananthapuram (IIITM-K) (Hereinafter called OWNER on one part and,..,,.. (Name and address of the Contractor) (Hereinafter called the CONTRACTOR) on the other part for the execution of the work Converting existing Canteen to Information Security Laboratory - Electrification works notified in Tender No. IIITM-K/0328/16 dated 20 January 2016. And whereas the notice inviting tenders it is stated as follows. Before commencing the work of within a week of the date when the acceptance of tender has been intimated to him, the tenderer shall deposit an additional sum of 5% of the contract value subject to a maximum of Rs. 1, 00,000/- which together with the amount of earnest money deposited shall treated as security for the proper fulfillment of the same and he shall execute an agreement for the work in the schedule form of agreement. If he fails to do this or fail to maintain a specified rate of progress, the security deposit shall be forfeited to IIITM-K and fresh tenders shall be called for or the matter otherwise disposed. If as a result of such measures due to the default of the tender to pay the requisite deposit sign contracts to take possession of the work any loss to the IIITM-K results, the same will be recovered from him as arrears of revenue but should it be a saving to IIITM-K the original contractor shall have no claim whatever to the difference. Recoveries to this or any other account will be made from the sum that may be due to contractor on this or any other contracts or under the Revenue Recovery Act or otherwise as the IIITM-K may decide. Now therefore these present witnesses and it is mutually agreed as follows: 1.The terms and condition for the said contract having been stipulated in the said tender form to which the contractor has agreed, a copy of which is appended, and which forms part of this agreement, it is agreed that the terms and conditions stipulated there in shall bind the parties to this agreement, except to the extent to which they are abrogated or altered by express terms and conditions herein, agreed to and in which respect the express provisions herein shall supersede those of the said tender form. 2. The Contractor hereby agree and undertake to perform and fulfill all the operation and obligations connected with the execution of the said contract work viz. Converting existing Canteen to Information Security Laboratory - Electrification works. If the Contractor does not come forward to execute the agreement after the said work is awarded and letter of acceptance issued in his favour or commits breach of any of the Conditions of the Contract as stipulated in clause 1.06 of the Notice inviting Tenders as
quoted above within the period stipulated, IIITM-K may rearrange the works otherwise or get it done otherwise at the risk and cost of the contractor and the loss so sustained by IIITM-K can be realizing from the contractor under the Revenue Recovery Act as if arrears of land revenue as assessed, quantified and fixed by an adjudicating authority consisting of IIITM-K or any other officer or officers authorised by IIITM-K taking into consideration the prevailing rates and after giving due notice to the Contractor. The decision taken by such authorised officer or officers shall be final and conclusive and shall be binding on the contractor. 4. The contractor further agrees that any amount found due to IIITM-K under or by virtue of this agreement shall be recoverable from the Contractor from his E.M.D. and his properties, movable and immovable as arrears of land revenue under the provision of the Revenue Recovery Act for the time being in force or in any other manner as IIITM-K may deem fit in this regard.
