ADMINISTRATIVE PROCEDURE TRANSPORTATION OF STUDENTS IN PRIVATE ADMINISTRATIVE PROCEDURE NO.: VI - 7 VEHICLES DRIVEN BY OTHER STUDENTS DATE : FEBRUARY 1996 AMENDED: OCTOBER 11, 2005 AMENDED: MARCH 18, 2008 AMENDED: OCTOBER 6, 2009 AMENDED: FEBRUARY 2, 2010 AMENDED: SEPTEMBER 29, 2014 PURPOSE The fllwing prcedures have been established fr the purpse f prviding cnsistent directives relative t the transprtatin f students in private vehicles driven by ther students. APPLICATION & SCOPE It is understd that the prcedures apply t all apprpriately licensed students wh n ccasin drive and/r are transprted in private vehicles t schl-apprved activities in which they are participants. PRINCIPLES The Haltn Cathlic District Schl Bard (HCDSB) generally requires and prvides Bard-apprved transprtatin t students attending schl-apprved activities. The HCDSB prefers parents t drive their wn children, hwever, it is acknwledged that n ccasin and upn student/parent request it is mre practical fr apprpriately licensed students t transprt themselves and/r ther students t schl-apprved activities in which they are participants. REQUIREMENTS 1. The Ontari Mtrist Prtectin Plan (1990) has replaced the right t sue fr damages with guaranteed cmpensatin fr persnal injury regardless f wh caused the accident except in the event f serius accidents. 2. Accrding t the abve-nted legislatin, lawsuits will still be permitted in such cases, i.e., where an accident has caused death, permanent serius disfigurement r permanent serius impairment f an imprtant bdily functin caused by cntinuing injury which is physical in nature. Amendments t the legislatin (Bill 198) have increased the right f suit t include the right t sue fr pain and suffering, subject t a $30,000.00 deductible. 3. The H.C.D.S.B. prvides Nn-Owned Autmbile Liability Insurance fr claims that exceed the wner s insurance, while the vehicle is being perated n Bard business. Vlunteer drivers are required t carry $1,000,000.00 f liability insurance; therefre, this cverage wuld respnd t liability claims that exceed $1,000,000.00, up t a cmbined limit f $20,000,000.00. PLEASE NOTE: 1. The standard persnal autmbile plicy permits the ccasinal driving f students fr schl activities. Thse wh wish t assist by driving n a regular basis shuld be advised t ntify their insurance agent fr an interpretatin f what cnstitutes ccasinal driving f students, and t ensure that their aut plicy is crrectly rated fr the use f the vehicle. It is recmmended that individuals using persnal vehicles fr Bard business carry a minimum f $1,000,000.00 public liability cverage fr their wn prtectin. REQUIREMENTS cnt d 2. Parents are t be advised t review the recmmendatin t add the Family Prtectin Endrsement (O.E.F. #44, frmerly S.E.F. #44) t their autmbile plicy. This is t prvide cverage fr the remte pssibility when their sns r daughters are being transprted in anther vehicle ther than their parents, which is invlved in a serius accident caused by an underinsured mtrist.

Principals/designates shuld ensure that individuals transprting students t schl activities are aware f the Ontari seat belt legislatin and Distracting Driving Legislatin. Seat belts must be used at all times. The driver is respnsible t see that children frm the age f 5 t 16 years f age are buckled up. Children under the age f twelve (12) shuld be placed in the back seat f the vehicle and prvided with the apprpriate seat belt/restraint system. (Highway Traffic Act) Regulatin 195/05 prhibits transprtatin f students, under eight (8) years f age, in cars, minivans r taxis unless an apprved bster seat is used. Legislatin makes it illegal fr drivers t talk text, type, deal r e-mail using hand held cell phnes and ther hand-held cmmunicatins and entertainment devices. The law als prhibits drivers frm viewing display screens while driving, such as laptps, DVD players that are unrelated t the driving task. 4. Strict adherence t the prvisins/regulatins f the gvernment s graduated license system are t be ensured. Specifically A G2 allws a driver t drive: withut anther experienced driver in the car n all Ontari rads at any time f the day, in mst cases Yu must still: have a zer bld alchl level carry nly as many passengers as there are wrking seatbelts If yu are 19 and under, sme ther restrictins still apply. G2 drivers: 19 and under Between midnight and 5 a.m.: yu can nly drive with ne passenger wh is 19 r under in yur car. This cnditin applies fr the first six mnths f G2. After six mnths, yu can drive with up t three passengers 19 r under between midnight and 5 a.m. This cnditin des nt apply, if: yu have a fully licensed driver in the car (with fur years plus experience driving) yur passengers are immediate family members (e.g., a parent, brther r sister) 5. A passenger list fr each vehicle with a license plate must be cmplete with ne cpy retained in the schl with the Principal/designate and ne cpy in the vehicle. 6. Students and staff must nt be transprted by 9 passenger vans r greater, accrding t OSBIE guidelines. 7. The Student Passenger Frms (A and B) must be cmpleted and signed by the parent/guardian f the student and apprved by the Principal/designate prir t the trip. 8. T be an apprved student vlunteer driver by the principal/designate all f the fllwing cnditins must be present: a registered student in the schl; 18 years f age r a grade 12 student; hlds a valid Ontari Class G2 license; vehicle has the Bard required $1,000,000.00 insurance; the Student Driver Authrizatin frm is cmpleted with signed authrizatin frm the principal/designate

It is understd that the prcedures apply t all students wh n ccasin drive and/r are transprted in private vehicles t schl-apprved activities in which they are participants. STUDENT DRIVER CRITERIA TO BE A TRIP DRIVER: T be an apprved student vlunteer driver by the principal/designate all f the fllwing cnditins must be present: a registered student in the schl; 18 years f age r a grade 12 student; hlds a valid Ontari Class G2 license; vehicle has the Bard required $1,000,000.00 insurance; the Student Driver Authrizatin frm is cmpleted with signed authrizatin frm the principal/designate. GOVERNMENT GRADUATED LICENSE SYSTEM AND PASSENGERS: Strict adherence t the prvisins/regulatins f the gvernment s graduated license system is t be ensured (September 1, 2005). The number f passengers in the vehicle is limited t the fllwing if driven between the hurs f midnight t 5:00 a.m. fr the first six (6) mnths limit f ne (1) passenger aged 19 and under, after the six (6) mnths limit f three (3) passengers aged 19 and under. The passenger limitatins d nt apply if the G2 driver is perating a mtr vehicle after 5:00 a.m. and befre midnight. BOARD S EXCESS LIABILITY INSURANCE: The Haltn Cathlic District Schl Bard prvides Nn-Owned Autmbile Liability Insurance fr claims that exceed the wner s insurance, while the vehicle is being perated n Bard business. Vlunteer drivers are required t carry $1,000,000.00 f liability insurance, therefre, this cverage wuld respnd t liability claims that exceed $1,000,000.00, up t a cmbined limit f $20,000,000.00. STUDENT DRIVERS/OWNERS OF THE VEHICLE ARE ADVISED THAT, IN ORDER TO BRING INTO EFFECT THE BOARD S EXCESS LIABILITY INSURANCE, THEY MUST: a) use a licensed autmbile which carries valid third-party liability insurance as required under legislatin in the Prvince f Ontari; b) vlunteer drivers must carry a minimum f $1,000,000.00 f third-party autmbile liability insurance; c) prvide the Bard prmpt written ntice, with all available particulars, r any accident arising ut f the use f a licensed autmbile during a trip n business f the Bard; d) be aware that the Bard s Excess Liability Insurance cmes int effect nly after the trip drivers insurance has been exhausted; e) be aware that any damage t the vlunteer s vehicle, the cst f insurance deductible, r premium adjustment as the result f an accident while the vehicle is being used n Bard-related business, is nt cvered by the Bard s Excess Autmbile Liability Insurance.

I declare that I am licensed t drive in Ontari and meet r exceed the criteria fr a student vlunteer driver fr the HCDSB s utlined n the previus page. 3. I have been given authrizatin by the wner f the vehicle t transprt students participating in the schl even(s) listed n this frm. 4. I certify t the Principal and the HCDSB that the vehicle and driver indicated are cvered by the minimum amunt f insurance indicated, i.e. $1,000,000.00. INSURANCE CO: POLICY NO. EXPIRY DATE: 4.
