INTRODUCTION: EMPLOYER CATEGORY The Ontari Immigrant Nminee Prgram (OINP) ffers an pprtunity fr emplyers t recruit and retain highly skilled freign wrkers and qualifying internatinal students fr permanent, full-time jbs. Eligible emplyers must submit a Pre-screen Applicatin t OINP t have the psitin they want t fill apprved. If the Pre-screen Applicatin is apprved, the freign wrker r qualifying internatinal student that the emplyer wants t recruit, the prspective nminee, must submit a Nminee Applicatin within 60 calendar days f the apprval f the Pre-screen Applicatin. The Pre-screen Applicatin is free. OINP n lnger accepts incmplete Emplyer Pre-Screen and Nminee applicatins, and will return them t applicants. Applicants submitting applicatins in persn must nte that receptin staff are nt authrized t prvide applicatin advice r review the cmpleteness f applicatins. 1. ELIGIBILITY T be eligible t apply, the emplyer must meet the emplyer criteria and must be seeking apprval fr a psitin that meets the psitin criteria. 1.1 EMPLOYER CRITERIA Emplyers must have been in active business (crpratins, limited partnerships and sle prprietrships) fr at least 3 years. Emplyers must have business premises in Ontari where the prspective nminee will wrk. Emplyers must be in cmpliance with all prvincial labur laws, including but nt limited t emplyment standards, health and safety, and labur relatins legislatin. Emplyers inside f the Greater Trnt Area must have: a minimum f $1,000,000 in grss annual revenue fr the mst recent fiscal year, 1

five permanent full-time emplyees wh are Canadian citizens r permanent residents (per psitin t be filled each nminatin year) at the lcatin where prspective nminee will wrk. Emplyers utside f the Greater Trnt Area must have: a minimum f $500,000 in grss annual revenue fr the mst previus fiscal year, three permanent, full-time emplyees wh are Canadian citizens r permanent residents (per psitin t be filled each nminatin year) at the lcatin where prspective nminee will wrk. 1.2 POSITION CRITERIA T be cnsidered fr apprval by OINP, the psitin t be filled must: Be a permanent and full-time psitin must cnsist f a minimum f 1,560 hurs f paid emplyment in a 12-mnth perid Be in a skilled ccupatin (Natinal Occupatin Classificatin Cde 0, A r B) 1 Meet wage criteria 2 prevailing wage level - if the psitin is ging t be ffered t a prspective nminee applying under the Freign Wrker Stream; r entry-level wage level if the psitin is ging t be ffered t a prspective nminee applying under the Internatinal Student with a Jb Offer stream. if the prspective nminee is already wrking in the psitin t be apprved, the emplyer is required t pay a wage equal t r greater than the wage apprved fr that psitin. 1 Fr infrmatin the Natinal Occupatin Classificatin, and fr infrmatin n hw t find the NOC Cde fr the psitin t be filled, see the Appendix: Finding the Psitin NOC Cde n Page 20 f this Applicatin Guide. 2 Infrmatin abut wage levels in different ccupatins can be fund n the Gvernment f Canada Jb Bank (http://jbbank.gc.ca), selecting Explre Careers: Wages. Jb Bank identifies prevailing wage as median wage and entry-level wage as lw wage. 2

Nte that emplyers must demnstrate sufficient prf f recruitment effrts if the prspective nminee is an individual wh currently lives abrad, is visiting Canada, r is wrking in a prvince r territry ther than Ontari (see prf f recruitment effrts in Sectin 2.3 Supprting Dcuments fr mre details n this requirement). IMPORTANT: POSITIONS THAT ARE NOT ELIGIBLE The fllwing are nt cnsidered permanent, full-time emplyees even if they wrk 1,560 hurs in a 12-mnth perid: seasnal, r part-time emplyees regardless f their wrking hurs; subcntractrs r agency wrkers; and, emplyees wh d nt wrk n the cmpany s premises, such as emplyees wh wrk frm hme, r emplyees wh wrk in a virtual lcatin, and serve the emplyer by telecmmuting. 1.3 MULTIPLE POSITIONS Emplyers inside the GTA can request ne psitin fr every 5 full-time emplyees. Emplyers utside f the GTA can request ne psitin fr every 3 full-time emplyees. Fr reference: Cmpanies inside f the Greater Trnt Area: 1 psitin requested = 5 existing full-time, permanent emplyees. 2 psitins requested = 10 existing full-time, permanent emplyees. 3 psitins requested = 15 existing full-time, permanent emplyees. Cmpanies utside f the Greater Trnt Area: 3

1 psitin requested = 3 existing full-time, permanent emplyees. 2 psitins requested = 6 existing full-time, permanent emplyees. 3 psitins requested = 9 existing full-time, permanent emplyees. Emplyers can request up t a maximum f 20 psitins per calendar year. Requests fr mre than 20 psitins will be reviewed by OINP n a case-by-case basis. Emplyers must cmplete nly ne Pre-screen Applicatin frm even when seeking apprval fr multiple psitins. All psitins must be listed n a single applicatin. See Sectin 3, Part C fr mre infrmatin. 2. PREPARING THE APPLICATION 2.1 OBTAINING THE FORMS The Emplyer Pre-screen Applicatin frm is available fr free dwnlad n OINP website. Emplyer Pre-screen Applicatin frm (Required) Authrizing r Cancelling a Representative frm (Optinal) Detailed instructins fr cmpleting the Emplyer Pre-screen Applicatin frms can be fund in Sectin 3.1: Cmpleting the Pre-screen Applicatin. Emplyers wh have applied t OINP and were apprved in the previus 12 mnths may use the Emplyer Pre-screen Applicatin fr Previusly Apprved Emplyers (see Sectin 3.3 fr detailed instructins). 2.2 AUTHORIZING A REPRESENTATIVE Emplyers are nt bliged t hire a representative. Hwever, if the emplyer receives help frm an individual in applying fr OINP and the emplyer wishes t authrize this individual t act n their behalf with OINP, the emplyer must submit the Authrizing r Cancelling a Representative frm with their applicatin. 4

An emplyer may nly have ne representative at a time, and this representative may nly be appinted thrugh the Authrizing r Cancelling a Representative frm. If a new representative is appinted, a new Authrizing r Cancelling a Representative frm must and submitted. The previus representative will n lnger be authrized t cnduct business n behalf f the emplyer, r receive infrmatin abut the applicatin. Paid Authrized Representatives are defined by the Immigratin and Refugee Prtectin Act (IRPA). Paid authrized representatives are: Immigratin cnsultants wh are members in gd standing f the Immigratin Cnsultants f Canada Regulatry Cuncil (ICCRC); Lawyers wh are members in gd standing f a Canadian prvincial r territrial law sciety, alng with students-at-law under their supervisin; r, Ntaries wh are members in gd standing f the Chambre des ntaires du Quebec. If an applicant authrizes a paid representative wh des nt qualify as a paid authrized representative, the applicant will be cntacted by OINP and advised that the individual must be remved r replaced as the representative. If the applicant designates a new authrized representative, any cmmunicatins will be frwarded t the new representative. Otherwise, prcessing f the applicant s file will cntinue withut representatin. See Sectin 3.2 fr mre infrmatin n cmpleting the Authrizing r Cancelling a Representative frm. 5

2.3 SUPPORTING DOCUMENTS The cmpleted Emplyer Pre-screen Applicatin frm must be accmpanied by a number f supprting dcuments which will help establish that the emplyer meets OINP eligibility criteria. Emplyers can use this checklist t ensure that they have all f the supprting dcuments required. IMPORTANT: DOCUMENT TRANSLATION If a supprting dcument is nt in English r French, the applicant must prvide a cpy f the dcument and a cmplete, certified translatin f the dcument. If the applicant is applying frm within Ontari, the translatins must be cmpleted by a certified translatr accredited by the Assciatin f Translatrs and Interpreters f Ontari (ATIO). Fr mre infrmatin n certified translatrs in Ontari, visit http://www.ati.n.ca/ If the applicant is applying frm utside Ontari, the translatin can be cmpleted by any translatr. Hwever, the translatin must be ntarized. OINP reserves the right t require applicants t submit translatins cmpleted by a certified translatr accredited by ATIO if the ntarized translatin is deemed insufficient by fficers assessing the applicatin. Applicatins with translatins that are nt cmplete, certified r ntarized are cnsidered incmplete and will nt be prcessed. Translatins that are cmpleted by the applicant, the applicant s representative, r ther individuals with persnal ties t the applicant are nt acceptable in any case even if these individuals are certified translatrs. CRITERIA SUPPORTING DOCUMENTS CHECK Minimum # f Cpy f: Emplyees Inside GTA: Five (5) permanent full-time emplyees Outside GTA: Three (3) permanent full-time emplyees Revenue Canada T4 Summary fr previus fiscal year. Cmpanies with 10 full-time emplyees* r less (regardless f being inside r utside the GTA r the number f psitins requiring apprval) must prvide a list f the current permanent full-time emplyee psitins as per the template prvided in the applicatin frm (See Sectin 3.1: Part A). 6

CRITERIA SUPPORTING DOCUMENTS CHECK Nte that nly Canadian citizens r Permanent Residents can be cnsidered part f the Emplyer's permanent, full-time staff. Nte: Emplyers may submit ther evidence t supprt the number f emplyees with their cmpany (i.e. Ceridian r ADP reprt) in lieu f a T4 Summary. Minimum grss annual revenue f $1,000,000 (inside f the GTA) and three years f cntinuus business peratin in Canada. Minimum grss annual revenue f $500,000 (utside f the GTA) and three years f cntinuus business peratin in Canada. Prf f premises in Ontari Prf f premises refers t the lcatin where prspective nminee will actually wrk. The emplyer s head ffice r ther reginal ffice is nt cnsidered prf f premises unless the prspective nminee will wrk at that lcatin. Nt affect the settlement f any labur dispute r affect the emplyment f a persn invlved in such a dispute, r adversely affect emplyment r Cpy f: Revenue Canada Schedules 125 (Incme Statement Infrmatin) and 141 (Accunting Practitiner Infrmatin) fr the past three years; OR Cmpany s financial statements fr the past three fiscal years, signed by a Certified Accuntant (C.A.), Certified Management Accuntant (C.M.A.) r Certified General Accuntant (C.G.A.) Cpy f: Deed t the prperty cmprising the premise; shwing the emplyer as wner, plus the latest tax dcument listing the cmpany address; OR A valid lease r ffer f lease, r license, r valid ntice f license registered n title; and landlrd/licensr s name, address and telephne number. Prf f recruitment effrts: Suggested dcuments that can be included: cpy f all advertising effrts made t recruit a Canadian citizen r Permanent Resident fr the psitin, 7

CRITERIA SUPPORTING DOCUMENTS CHECK training pprtunities fr Canadian citizens r permanent residents f Ontari. Applies nly t emplyers recruiting an individual wh currently lives abrad, is visiting Ontari r is visiting/wrking in a prvince r territry ther than Ontari. A summary f recruitment effrts including the number f individuals that applied, the number interviewed and the specific reasns why they did nt hire a Canadian citizen r permanent resident fr the psitin if ne applies. OINP will assess the requirement that cmpanies must be in cmpliance with all prvincial labur laws using infrmatin shared by the Ontari Ministry f Labur. Hwever, emplyers may be requested t prvide additinal supprting dcuments t demnstrate cmpliance. Officers assessing the applicatin may request ther dcuments nt listed abve if they deem that these dcuments are necessary t assess the applicatin. Failure t prvide the requested dcuments in the timelines requested by fficers will result in the refusal f the applicatin. IMPORTANT: PRIVACY AND CONFIDENTIALITY Althugh the emplyer may cnsider sme infrmatin in the applicatin frm r the supprting dcuments submitted t OINP t be prprietary r cnfidential, any such material may be disclsed t a third party, in accrdance with the emplyer s cnsent, and where required by law r if required by a curt r tribunal. 8

3. COMPLETING THE APPLICATION 3.1 COMPLETING THE PRE-SCREEN APPLICATION FORM The fllwing refers t the Emplyer Pre-screen Applicatin fr emplyers wh have nt been previusly apprved by OINP within the last year. Fr infrmatin n cmpleting the Emplyer Pre-screen Applicatin fr Previusly-Apprved Emplyers, see Sectin 3.3. Please print clearly. All fields in the frm must be cmpleted. If questins are nt applicable, mark the space with N/A. Part A: Cmpany Infrmatin Prvide the fllwing: Organizatin ID fr OINP e-filing System (nly required if a previusly apprved emplyer, please write N/A in the field if nt applicable); Name f cmpany; Full mailing address f cmpany (P.O. Bxes are nt accepted); Year f incrpratin, jurisdictin f incrpratin and the incrpratin number: Fr a cmpany incrprated, cntinued r amalgamated in Ontari, the Incrpratin Number appears n the tp-right crner f the crpratin s Certificate f Incrpratin/Cntinuatin r Amalgamatin r in the cmpany s Letters f Patent; Fr a cmpany incrprated, cntinued r amalgamated in a jurisdictin ther than Ontari, this number appears in the tp-right crner f the Extra Prvincial License issued t the cmpany. If the cmpany des nt require a license, the number is assigned upn filing the Initial Return/Ntice f Change by an Extra-Prvincial Crpratin (Frm 2) with Service Ontari. Year and grss revenues fr the previus fiscal year; Number f permanent, full-time emplyees wh are Canadian citizens r permanent residents at the lcatin f emplyment f the prspective nminee. Temprary freign wrkers cannt be cunted as permanent, fulltime emplyees; 9

Part B: Cmpany Signing Officer Infrmatin A signing fficer is an fficer f the cmpany with authrity t bind the rganizatin t a legal agreement r cntract. Signing fficers may be cntacted by the fficer assessing the applicatin. If the signing fficer is nt directly invlved in the applicatin, the Authrizing r Cancelling a Representative frm must be included with the Pre-screen Applicatin s that the fficer assessing the applicatin can cntact the apprpriate individual. Prvide the fllwing infrmatin fr the cmpany signing fficer: Last name (family name), first name (given name) and middle name(s) Business telephne number Cell phne number (ptinal) Fax number (ptinal) Email address (business) IMPORTANT: COMMUNICATING WITH OINP Emplyers are strngly encuraged t prvide a valid business email address t facilitate cmmunicatin regarding the applicatin. Cmpany signing fficers can designate a representative that OINP will cntact with regards t the applicatin by cmpleting the Authrizing r Cancelling a Representative frm. See Sectin 3.2 fr mre infrmatin abut this frm. Part E: Learning Abut the Ontari Immigrant Nminee Prgram OINP is interested in hw the emplyer r their cmpany learned abut the prgram. This infrmatin will be used slely fr Prgram evaluatin purpses. The emplyer shuld check nly ne bx. Part F: Applicatin Checklist Check the apprpriate bxes t indicate that all f the required supprting dcuments have been included in the applicatin package. Part G: Authrizatin and Certificatin Emplyers shuld carefully read and understand the authrizatins and certificatins set ut in this applicatin. If the emplyer des nt agree with any f these, r is nt prepared t abide by them, they shuld nt submit an applicatin. AFTER SUBMISSION OINP aims t cmplete assessment f emplyer applicatins within 90 calendar days f receipt f a cmplete applicatin. 15

Emplyers will receive an acknwledgment letter t indicate that their applicatin has been received if the applicatin is cmplete. Case-specific status inquiries must be made in writing and addressed t OINP at ntarinminee@ntari.ca r sent by mail t the address abve. Enquiries made within 90 calendar days f the date the applicatin was received by OINP will nt be answered as this perid is the usual prcessing perid fr applicatins and Prgram resurces will be cncentrated n cmpleting applicatin evaluatins. 5. AFTER APPROVAL 5.1 APPROVAL OF OINP APPLICATION Emplyers whse Pre-screen Applicatin is apprved will receive a package f nminee materials which will allw them t prceed t the next step f the applicatin prcess. This package cnsists f: Emplyer Pre-screen Apprval letter This letter advises the emplyer that the applicatin has been apprved by OINP fr the psitin(s) indicated in the letter. It is pssible that an emplyer may be apprved fr sme, but nt all, f the psitins requested. Pre-screen Psitin frm This is the fficial dcument that identifies the psitin that the emplyer is entitled t fill. A psitin frm will be issued fr each apprved psitin, and the frm will include: Pre-screen File Number Psitin Title NOC Cde Date f Emplyer Pre-screen Apprval Expiry Date 16

This frm must be cmpleted by bth the emplyer and the prspective nminee and must cntain riginal signatures frm bth parties. This frm must be included in the nminee applicatin. Applicatin package fr each prspective nminee The emplyer is respnsible fr ensuring that all f the infrmatin is crrect in the material they will submit. The Pre-screen Apprval letter is an essential dcument. If this dcument is lst, stlen r destryed, please cntact OINP immediately. Nminee applicatins will nt be prcessed withut the riginal Pre-screen Apprval letter. Prspective nminee applicatins must be received within 60 calendar days f the issue date f the Pre-screen Psitin frm. If the nminee applicatin is nt received within 60 days f the date f issue f the Pre-screen Psitin frm, then the apprved psitin is n lnger eligible fr submissin t the Prgram and the emplyer will be required t reapply. 5.2 PROVIDE A JOB OFFER TO PROSPECTIVE NOMINEE The apprved emplyer must prvide the prspective nminee with an riginal signed and dated jb ffer. The jb ffer must meet the fllwing requirements: Printed n cmpany letterhead and identify cmpany address, telephne/fax numbers, email, and website addresses; Identify the respnsible Officer/Supervisr and include his/her signature; Stamped with the cmpany s crprate seal (if applicable); AND indicate the fllwing: Occupatin title Wage fr full-time, permanent psitin being ffered Duties and respnsibilities Number f hurs per week and a number f weeks f wrk per year Number f days/weeks f vacatin Wrkplace lcatin Emplyment start date, and an indicatin that the ffer being made is fr a permanent, full-time psitin 17

This frm must be signed by the Emplyer and the prspective nminee, and must accmpany the nminee applicatin package (therwise, the nminee applicatin will nt be prcessed).
