Specifically the Rules of Criminal Procedure require the prosecutor to disclose and permit defense counsel to inspect and reproduce all evidence which relates to the case. Rule 9.01, R. Crim. P. Reproduction may be satisfied by any method that provides to the other party an exact reproduction of that item, including E-mail, E facsimile transmission, or similar method if that method is available to both parties. Rule 9.03, Subd. 10
The county Attorney s s office must exchange information with opposing counsel. Currently we do this via mail, drop box or courier. Virtually all reports and non-physical evidence is received by the County Attorney Office electronically through a secure drive. Law Enforcement places their reports and other evidence such as audio recordings, pictures and video s s on a drive and notify us that it is available. Our office then retrieves it.
