1 TERMS OF REFERENCE 29 June 2015 Cuntry: Djibuti Duty statin: Djibuti Descriptin f the assignment: Cnsultancy Review Missin Team Leader Demcracy and Plitical Gvernance Thematic Area Perid f assignment/services: Take part in the APRM Review Missin t Djibuti including (i) preparatry wrk, (ii) participatin in the review missin frm 5 t 19 August 2015 and (iii) 3 days pst review wrk, at the place f habitual residence 1. BACKGROUND The APRM is a self-mnitring mechanism t encurage the adptin f plicies, standards and practices that lead t plitical stability, high ecnmic grwth, sustainable develpment and accelerated reginal ecnmic integratin thrugh the exchange f experiences and reinfrcement f best practices including identifying deficiencies and assessing the needs fr capacity building f the participating cuntries. T date thirty-five Member States f the African Unin have vluntarily acceded t the APRM. The APRM prceeds in five phases: Phase 1 is a preparatry step at bth the natinal and cntinental level. During this phase, the natinal Fcal Pint establishes the Natinal Gvernance Cmmissin (NGC) and the sensitisatin and awareness campaign begins. Once these prerequisites are in place, the cuntry cmmences the natinal self-assessment stage. During this stage, the cuntry is als required t develp a Preliminary Natinal Prgram f Actin (NPOA) t address existing capacity cnstraints. On its part, the cntinental APR Secretariat cmpiles basic infrmatin n the cuntry called the Backgrund Paper that is used t augment, cmpare and cntrast with the natinal self-assessment that the cuntry prepares. These three (3) dcuments namely (i) the self-assessment reprt n gvernance, (ii) the preliminary NPOA and (iii) the backgrund paper cnstitute the basis key issues paper that will be prepared ahead f the cuntry review missin. The Panel submits the cuntry review reprt and recmmendatins t the Frum f Heads f State fr actin. Phase 4 ends with Chairman f the Frum cmmunicating the decisins f Heads f State and Gvernment t the cuntry under peer review. OBJECTIVES OF THE REVIEW MISSION AND THE CONSULTANCY These are the Terms f Reference fr the Independent Experts participating in the APRM Cuntry Review Missin (CRM) t Djibuti scheduled fr 5 t 19 August The specific Objectives f the CRM are t visit Djibuti and carry ut the widest pssible range f cnsultatins with the Gvernment fficials, fficials, plitical parties, parliamentarians, academia, trade unins, faith based rganizatins, business, prfessinal bdies and thers. The CRM is cmprised f the fllwing: the APR Panel Member leading the prcess; Designated fficials frm the APR Secretariat; Experts frm strategic partners including the African Develpment Bank (AfDB), the UNDP Reginal Bureau fr Africa and the United Natins Ecnmic Cmmissin fr Africa (UNECA); and Independent experts fr each thematic area (Demcracy and Gd Plitical Gvernance, Ecnmic Gvernance and Management, Crprate Gvernance and Sci-Ecnmic Develpment). The DPG independent expert/missin cnsultant is t cntribute t and wrk n the fllwing specific bjectives: 1. Cnstitutinal Demcracy and the Rule f Law 2. The Separatin f Pwers 3. Preventin and reductin f intra and inter-state cnflicts 4. Prmtin and prtectin f civil and plitical rights. 5. Ensuring accuntable, efficient and effective public service delivery at the natinal and decentralized levels 6. Prmtin and prtectin f the rights f wmen 7. Prmtin and prtectin f the rights f children and yung persns 8. Prmtin and prtectin f the rights f vulnerable grups 2

SCOPE OF WORK, DELIVERABLES AND TIMEFRAME SCOPE OF WORK The thematic team leaders are expected t: Lead and crdinate deliberatins and drafting the cuntry review rept sectin fr the thematic area; Familiarize themselves with the APRM dcuments and specific infrmatin develped fr Djibuti, in particular the Backgrund Paper, the Self-assessment reprt; and the draft Prgramme f Actin; Draft a set f Key Issues in the thematic area as emerging frm the abve dcuments; Participate in the cuntry review visit; Capture the unflding f the cuntry review visit as necessary and draft a summary f findings relating t their thematic area; Draft the review reprt fr Djibuti fr their specific thematic grup Cntribute t the drafting and finalizatin f the APRM Cuntry Review Reprt fr Djibuti. DELIVERABLES 1.0 Familiarizatin with the APRM dcuments and specific infrmatin develped fr Djibuti. The Expert is expected t familiarize himself/herself with the Base Dcuments f the APRM and the APR Questinnaire. The expert will als be prvided with the Backgrund Paper n Djibuti and cpies f the Cuntry self-assessment and draft Natinal Prgramme f Actin as necessary. 2.0 Identificatin f the Issues a) Identificatin f the Issues shuld be infrmed by the fllwing: Issues addressed in the Self-Assessment but needing reinfrcement Issues that have been understated r inadequately addressed Issues that have been identified in the past but cntinue t have serius implementatin prblems Issues missed cmpletely in the self-assessment reprt. Areas f discrepancy r divergence (frm crss-checking with the Backgrund paper). b) The structure shuld fllw the Objectives under each f the APRM thematic areas as utlined in the APRM Questinnaire. Crss-cutting r issues f an verarching nature have t be separately addressed. c) The Beneficiaries f the final Issues Paper are the fllwing: - The APRM Secretariat - The APRM Panel - The Cuntry underging the assessment, if necessary d) Priritizatin f Issues: Sme effrt shuld be made t priritize the issues, and this may be aided by perusing the draft Prgramme f Actin. 3
4 3.0 Participatin and Rapprteuring the Djibuti Cuntry Review Visit a) The expert will be expected t participate in the cuntry review visit and capture the unflding f the visit, which will infrm the final cuntry reprt. b) The expert will be expected t capture and explre the specific issues that have been identified in his/her thematic area and t feed this int his/her sectin f the final cuntry reprt. c) The expert will be expected t participate in breakaway sessins r bilateral meetings fcusing n his/her specific thematic area and t keep a recrd f these sessins. This may include meetings and wrkshps utside f the capital. d) The expert may als be required t investigate further specific issues fr the thematic area either befre, during r after the visit. e) Further, the expert is required t participate in every briefing meeting f the team relating t the review. A briefing sessin will be held at the end f every day during the review missin. 4.0 Incrprating the Unflding and Outcme f the Cuntry Review Visit t the Reprt; a) Fllwing the cnclusin f the review visit, the expert will incrprate the relevant details f the unflding and utcme f the cuntry review visit t the reprt. This sectin f the reprt shuld be circulated t the members f the team fr cmment, revisin and finalizatin. 5.0 Finalizatin f the Cuntry Review Reprt a) The Thematic Team Leader is then required t finalize his/her thematic sectin f the cuntry review reprt based n cmments r input received frm the team and the APR Panel. The Team Leader will ensure that crrect feedback is given t thematic team members, and will incrprate all team member changes in the final draft fr the thematic sectin. b) The thematic sectin f the reprt is t be satisfactry and acceptable t the APR Panel Frmat fr drafting the Cuntry Review Reprt 6.1 A standard template fr all cuntry reprts is necessary t ensure cmparability. The beneficiaries f the reprt are: Djibuti, the APR Frum, Glbal partners, the public, etc. 6.2 The cntent f the Reprt shuld be sufficiently cmprehensive as the end-users, the Heads f States and Gvernment, wuld nt have t review related dcuments. In particular the Reprt shuld encmpass a synthesis f the entire prcess (i.e. frm accessin stage t cmpletin), and the substance f the thematic findings (flwing alng thematic lines and by bjectives and recmmendatins). An executive summary f abut 10 t 15 pages shuld be included in the reprt. 6.3 The reprt shall prvide Djibuti s psitin with regard t the Standards and Cdes, as well as the Objectives f the APRM under each thematic area. 6.4 Each reprt will fllw this frmat: a) Standards and Cdes Status as bserved frm the Backgrund Infrmatin (per Standard r Cde). 4
5 An verview f the reprting in the self-assessment, capturing any further supplemental r divergent infrmatin. The findings f the review team with regard t the issues identified under the Standards and Cdes. Recmmendatins and suggested actin steps. b) Objectives: The reprt will then g n t elabrate n each f the Objectives, fllwing the abve frmat. a) Over-arching r crss-cutting issues shuld be captured in a separate sectin at the end f the reprt. b) In additin, the Expert will be required t draft an Executive Summary fr his/her thematic area, prviding a synpsis f the reprt in the freging frmat. 7.0 Divisin f Labur Each thematic team leader is principally expected t draft a reprt fr his thematic area, and t supervise the wrk f all review missin participants wrking within his/her thematic area. The Team leader is expected t cntribute and/r supervise the cnslidatin and cllatin f the verall reprt as necessary. It is imperative that the team leader takes nte f all details pertaining t the events and wrk f the missin that he/she tk part in. TIME FRAME The time frame fr the assignment will be 25 days, distributed as fllws: Deliverable schedule TWO DAYS (2) prir t the missin fr familiarizatin with the backgrund dcuments and drafting the Issues Paper fr his/her thematic area. FIFTEEN (15) days fr actual participatin in the Cuntry Review Missin frm 5 t 19 August 2015; THREE DAYS (3) days pst review perid, at the place f habitual residence, fr finalizing the thematic sectin f the reprt and incrprating any Panel cmments; FIVE Days (5) revising the first draft f the thematic sectin reprt at a meeting f team leaders, APRM Secretariat crdinatrs and the Lead Panel member fr Djibuti. The task t be cmpleted ver 3 days. The deadline fr this task 5
6 4 Draft 2 f thematic sectin will be agreed t with the APR Secretariat. Thematic team leaders will als lead in drafting sectins f the crss- cutting issues chapter r ther sectins f the reprt. Revisin f draft 1 f the reprt ver 5 days at the APRM Secretariat premises, incrprating Panel and APRM Secretariat cmments. Als t prvide feedback t the Gvernment f Djibuti n the changes needed fr the preliminary Natinal Prgramme f Actin (NPOA). The deadline fr this task will be agreed t with the APR Secretariat 4. REQUIREMENTS FOR EXPERIENCE AND QUALIFICATIONS Qualificatins & Experience: Educatin: Master s degree in Law and/r Plitical Sciences r related fields with at least ten years related experience. Experience: Have at least 10 years prgressively respnsible in the areas f demcratic institutin building, cnstitutinal refrms, Human Rights, at natinal, r internatinal levels in varius capacities; Demnstrate effective ability fr teamwrk, as well as the ability t wrk independently; Extensive knwledge f the Cnstitutive Act f the African Unin as well as the verall bjectives f the APRM, particularly in the thematic area f Demcracy and Plitical Gvernance and its interactins with the ther areas; Brad knwledge f internatinal relatins and develpment issues in Africa and in general glbal terms Have knwledge f Djibuti Have prduced publicatins r research relevant t Demcracy and Plitical Gvernance Have prject management experience and able t respect deadlines Experience leading a team Experience in an APRM cuntry review missin Language: The applicant must be able t cmmunicate and write in French. Knwledge f English r ther AU languages may be an added advantage. 5. DURATION OF MISSION AND PAYMENT SCHEDULE The assignment f the Cuntry Review Missin will be undertaken fr 25 days. Cnsultants shall be paid upn satisfactry cmpletin f the assignment. 6. REMUNERATION APRM Review Missin Cnsultants are paid a daily hnrarium f $550 per head. 7. EVALUATION CRITERIA 6
