Limited Warranty Statement Maxtr's warranty bligatins are limited t the terms set frth belw: Maxtr warrants t the riginal cnsumer purchaser that new Maxtr disk drives will be free frm defects in material and wrkmanship fr the Standard Warranty Perid. The start f the warranty perid is the date f the last prductin fr that drive, plus three mnths. If a drive is purchased frm Maxtr r Maxtr's authrized reseller after the last prductin date fr that drive, and prf f purchase can be prvided, then the start f the warranty perid is the dcumented date f such purchase. Fr replacement disk drives the warranty n the replacement drive is the remainder f the warranty n the riginal drive r 90 days, whichever is lnger. Fr disk drives btained under the Maxtr Upgrade Prgram, the warranty perid is the remainder f the warranty perid, as defined abve, fr that drive. If the custmer discvers a defect, Maxtr will, at its ptin, repair r replace the disk drive at n charge t the custmer, prvided it is returned during the warranty perid, with transprtatin charges prepaid, t Maxtr in Irving, TX.; Bray, Ireland r Singapre. Drives must be prperly packaged in Maxtr packaging r Maxtr apprved packaging t btain warranty service. Fr warranty service, cntact Maxtr at MAXTOR (IN USA) t btain a "Return Material Authrizatin (RMA) number." A cpy f the receipt r a bill f sale bearing the apprpriate Maxtr serial number and mdel number may be required fr warranty service. Return Material Authrizatin N Prduct may be returned directly t WDC withut first cntacting WDC fr a Return Material Authrizatin ("RMA") number. If it is determined that the Prduct may be defective, yu will be given

3 an RMA number and instructins fr Prduct return. An unauthrized return, i.e. ne fr which an RMA number has nt been issued, will be returned t yu at yur expense. Authrized returns are t be shipped prepaid and insured t the address n the RMA in anapprved shipping cntainer. Yur riginal bx and packaging materials shuld be kept fr string r shipping yur Prduct. Limited Warranty WDC's limited warranty prvides that, subject t the fllwing limitatins, each Prduct will be free frm defects in material and wrkmanship and will cnfrm t WDC's specificatin fr the particular Prduct. Duratin f Warranty The limited warranty extends nly fr the perid f time set frth in the Prduct dcumentatin. Yur Use f the Prduct WDC will have n liability fr any Prduct returned if WDC determines that: The prduct was stlen frm WDC. WDC may elect which remedy r cmbinatin f remedies t prvide in its sle discretin. WDC shall have a reasnable time after determining that a defective Prduct exists t repair r replace a defective Prduct. WDC's replacement Prduct under its limited warranty will be manufactured frm new and serviceable used parts. WDC's warranty applies t repaired r replaced Prducts fr the

4 balance f the applicable perid f the riginal warranty r ninety days frm the date f shipment f a repaired r replaced Prduct, whichever is lnger. Limitatin f Damages WDC's entire liability fr any defective Prduct shall in n event exceed the purchase price fr the defective Prduct.
