PROPER USE OF EXHIBIT SPACE Sponsors and Exhibitors may not move their assigned exhibit space or place display materials that exceed their allotted booth space or infringe on the booth space of any other Sponsor or Exhibitor. NACBA shall have the right to move and/or remove any displays that violate this prohibition. Sponsors and Exhibitors may not reassign, sublet or allow other companies to use the whole or a part of the space assigned to them. This rule will be STRICTLY ENFORCED. Sponsors and Exhibitors may not display or advertise any goods or services not manufactured, distributed or otherwise provided by the exhibiting company during the normal course of business. Sponsors and Exhibitors shall not cause any apparatus or device to be placed in the exhibit which shall produce any undue noise, interfere with wireless communication or internet connections, create a fire hazard, or in any way interfere with, or be objectionable to, any other Sponsor or Exhibitor and NACBA shall have the right to require the removal of any such apparatus or device. Sponsors and Exhibitors shall not utilize any scheme or device which is illegal, in bad taste, or detracts from the professionalism of the event. Sponsors and Exhibitors shall comply with terms of union contracts with the Hotel, as applicable. 4. BOOTH PLACEMENT Sponsors who have paid their sponsorship deposit by Friday, October 9, 2015, will have first option to select booth space. On Monday, October 12, 2015, exhibitors will be able to register and begin selecting booth space. 5. SHIPPING INFORMATION: Information regarding shipment of materials to the San Francisco Marriott Marquis will be distributed to registered Sponsors and Exhibitors prior to the event. 6. LIABILITY The National Association of Consumer Bankruptcy Attorneys (NACBA) shall not, in any manner or for any cause, be liable or responsible for any damages that may occur to a Sponsor or Exhibitor, or to the Sponsor or Exhibitor s directors, officers, employees, agents, licenses or guests. Any damage to the goods or other property of the Sponsor or Exhibitor that the Sponsor or Exhibitor or the Sponsor or Exhibitor s directors, officers, employees, agents, licensees, or guests or for any loss or injury and all claims for such injuries are hereby waived. Each Sponsor and Exhibitor is responsible for protecting and providing the security for its exhibit, demonstration, goods, materials and/or equipment during conference times. Each Sponsor and Exhibitor is responsible for taking all measures necessary to protect other parties and property from any harm, which might result from or be caused by its exhibit, demonstration, goods, materials, and/ or equipment. Each Sponsor and Exhibitor shall be solely liable for any and all damages, costs or expenses which the Sponsor or Exhibitor may incur, suffer, or be required to pay by reason of injury to persons or loss of or injury to property which may be caused by or result from any act of omission on the part of the Sponsor or Exhibitor, or caused by or result from any demonstrations or exhibit of the Sponsor or Exhibitor. 16 Each Sponsor or Exhibitor assumes the entire responsibility and liability for losses, damages, and claims arising out of exhibitor/sponsor s activities on the premises of the San Francisco Marriott Marquis ( Hotel ) and will indemnify, defend, and hold harmless the Hotel, its owner, and its management company, as well as their respective agents, servants, and employees from any and all such losses, damages, and claims. Sponsor or Exhibitor hereby indemnifies and holds NACBA and Hotel and its owners, its operator, and each of their respective parents, subsidiaries, affiliates, officers, directors, shareholders, employees, and agents, free, clear and harmless from any and all liability, judgments, claims cost, expenses (including attorneys fees), government charges or fines, and demands of any kind, including damages for personal injury or property damage or both, arising out of or caused by its transportation, installation, removal, maintenance, occupancy or use of the exhibition premises or a part thereof, excluding any such liability caused by the negligence of the Hotel and its employees and agents. 7. INSURANCE Sponsor or Exhibitor acknowledges that neither the Hotel, its owners, its operator, nor NACBA, maintain insurance covering Sponsor or Exhibitor s property and that it is the sole responsibility of Sponsor or Exhibitor to obtain business interruption and property damage insurance insuring any losses by Sponsor or Exhibitor. 8. HOST HOTEL Sponsor or Exhibitor agrees to comply with requirements of the hotel regarding use of the exhibit space. 9. CANCELLATION AND RELOCATION The National Association of Consumer Bankruptcy Attorneys (NACBA) reserves the right to cancel or relocate the event. If NACBA cancels or relocates the event due to circumstances within NACBA s control, the liability shall be limited to a refund of payment for rental costs paid by the Sponsor or Exhibitor in accordance with the payment section of the agreement. In the event that NACBA has no control over the cancellation or relocation of the exhibition, NACBA has no liability of any kind but may, in its discretion, refund any payments for rental costs paid by the Sponsor or Exhibitor. In any event, NACBA s maximum and sole liability, if any, to the Sponsor or Exhibitor in the event of cancellation or relocation shall be for the return of the rental fee, or a portion of the fee, as NACBA, in its discretion, determines. 10. COMPANY REPRESENTATIVES AT ANNUAL CONVENTION In order to create a registration and nametag for each of your representatives at the Annual Convention, we need to receive no later than Friday, April 22, 2016, a list of your authorized representatives at the Annual Convention. 17 11. PAYMENT AND REFUND POLICY Payment for exhibit space is due in full at the time of registration. Deposits will not be accepted. 18 ANNOUNCING NACBA S MEMBERS-ONLY SUMMIT AT SEA Get ready to set sail on the maiden voyage of NACBA s Members-Only Summit at Sea. This first-ever members-only cruise will disembark on Friday, October 7, 2016 from Miami, FL and return on Monday, October 10 th. Exhibitor space aboard the ship will be limited and will most likely sell out quickly. Space for exhibitors will be sold on a first-come, first-served basis. The best way to ensure you do not miss out on what will undoubtedly be a very successful and fun event, is to book your space now and take advantage of the early booking savings! There will be plenty of opportunities to network with NACBA members throughout the cruise. 19 EXHIBITOR RAFFLE 101 We will once again host two completely different raffles, both designed to encourage attendees to spend more time in the Exhibit Area. The first is a Grand Prize Raffle. In order for attendees to participate, they must go through the Exhibit Area and have their raffle card stamped by each Sponsor and Exhibitor. (We provide the card and stampers.) They then turn in their completed raffle card and the names are drawn at the end of the program with great fanfare. The prizes are significant. As you can imagine, this drives heavy traffic through the Exhibit Area. There is no separate charge to exhibitors and sponsors to be included in this (unless you choose to be a Grand Prize Raffle Sponsor. The second is an Exhibitor-Run Raffle. Each Sponsor and Exhibitor has the option of raffling off items during the Annual Convention whatever they want and whenever they want. Participating Sponsors and Exhibitors are listed on big boards at the Exhibit Area. This is a fun way to draw attendees to your booth (don t forget to collect their business cards!). There is no separate charge to exhibitors and sponsors to be included in this. However, you must indicate on the Registration Forms whether you will be participating in the Sponsor/Exhibitor raffle in order to be included on the big board of participants and you may not add in your name on the board at the event.
