3 Welcome to the Musicians Union Music Education Hub Pack. This has been produced to provide practical assistance and resources to the Hubs as well as showing how we support musicians and teachers who work for music services and partner organisations. The MU has over 30,000 members and of these approximately two thirds work in music education as part of their portfolio careers. Our principle role is to support and advise our members in all aspects of their careers and to offer training opportunities to help professionalise the music education workforce. As partners of the Hubs will be key employers and engagers of musicians in education, the MU is keen to play its part in helping the Hubs succeed. The pack is intended for directors and senior managers of lead Hub organisations. It will also be a useful resource for all strategic and partner organisations as well as school leadership who are involved in contracting musicians working in education We understand that many musicians who teach tend to work in isolation and are at risk of being unaware of what Hubs are or what they might mean for them. The MU has a unique role to play in addressing this potential gap in understanding and so we will be organising a series of regional days What Hubs mean for you and how to develop your career. We hope that Hub leaders will be involved in these days and signpost musicians working in education to these events. Musicians who work with children and young people in local areas and are independent of organisations (Music Services, schools, etc.) have a critical role to play in helping the Hubs to succeed and we can help ensure they are aware of what Hubs are and how to engage with them. Finally we would like to take this opportunity to urge you to make sure that instrumental teachers are represented on your local advisory or stakeholder groups as they are a valuable resource and essential part of the workforce. 4 The Hub Experience Professional support and mentoring opportunities Josip is a peripatetic brass teacher. He has recently graduated from University and has been thrown in at the deep end having received very little training in instrumental teaching whilst studying. He is teaching a broad mix of students in one-to-one, small group and full classroom settings across all brass instruments as well as helping out with the school band. His local Hub has an extensive partnership base drawing together a broad range of formal and informal music education providers and with strong links to both primary and secondary schools in the area. Regular CPD programmes are arranged through the local Hub, focusing on many aspects of educational and instrumental pedagogy and music education theory drawing on all the available expertise. An effective mentoring/buddying programme has also been arranged through the Hub, which matched Josip with an experienced teacher for his first year, providing solid academic and practical advice. His joint Musicians Union (MU) and the National Union of Teachers (NUT) membership helped him access advice and guidance from both organisations. One step leads to another The new Hub has allowed me to engage with exceptional professional development, and mentoring at the highest level, providing me the opportunity to develop my skills to become a more effective teacher and learner. I look forward to the introduction of the new Music Educator Qualification being developed by Creative and Cultural Skills and Arts Council England. Anton is an 11 year old drummer. He started just over two years ago after his school hosted a one day Samba workshop that was arranged through the local Hub. After the workshop he started playing percussion in his full class band. He was so happy to get a drum kit for Christmas as he can now practise all the time. I can play so many different types of music, and in class we still learn the theory stuff so I can also read the notes, but I can also listen and repeat or respond to the music. Outside school Anton plays with some of his older friends in his local youth club pop band, next month they are going to play at the Youth Club Disco and in July they will be performing in the Music For Youth National Festival in Birmingham. When he is older he hopes to play in a band in pubs and restaurants and make some money. As a student he will be able to join the MU for 20 and as a member he will benefit from 10 million Public Liability Insurance cover and access to legal and contract advice.

5 The Hub Experience Extensive resources inspire music making Julie is an experienced Primary School teacher, but she had always found it daunting to deliver the music element of the National Curriculum in Key Stages 1 and 2. Since the implementation of the National Music Plan for Music, Julie has found that the personal support and resources available to her have increased dramatically. The most significant development was that all her class had the opportunity to learn an instrument for the whole year with two specialist music teachers arranged through the local Hub. Julie s Head Teacher encouraged her to get involved with the teachers and time was set aside for her to meet and plan how they would work together. Julie was able to tell the teachers useful things about the children in her class, for example those who lacked confidence but enjoyed working in a group. Once the sessions began Julie was amazed to see how quickly the children learned. Julie says: The specialist music teachers told me about a Continuing Professional Development (CPD) programme run by Music for Youth, the MU and the National Union of Teachers (NUT). The programme showed me so many ways to work with my class in a fun and easy way. There are some great online resources and my confidence has grown so much. I was amazed at how the music teaching helped the children in other areas of their learning. I am now the music co-ordinator in our school and the whole school is now getting involved in music making. Child s Play Mark and Sinae have a nine-month-old daughter Geneviene. Mark and Sinae enjoy listening to music and going to concerts but were both put off pursuing music education due to limited music experiences when they were young. They strongly believe in the power of music to enhance learning and want to make sure that their daughter takes part in as much quality music making as possible. A quick internet search took them straight to their local Hub website where they were excited to find a range of Early Years classes for their daughter. Mark says: We now take Geneviene to creative sing and play classes three times a week. This inspired me to learn the piano, something I had always wished I d done. I found a local piano teacher on MusicTeachers.co.uk. I m now taking regular piano lessons and I enjoy playing music with my daughter.

6 Employment Status Lewis has taught part time for two years for a Music Service (who are the lead Hub organisation). He loves the work and looks forward to the contact he gets with other instrumental teachers he meets in the schools he works in. In a conversation with one teacher he learns that the teacher has been contracted on a different employment contract to his. This means, for example, that the other teacher would be paid if they could not come into work because they were ill. Lewis had never been ill on a teaching day but he was concerned that he would lose income if he were ever sick. As a member of the Musicians Union he approached his representative and asked them to explain why his contract appeared to be different. The MU rep explained to him that if he were to become sick he would be entitled to Statutory Sick Pay. They also explained to him that because he had satisfactorily passed his probationary period, he had an entitlement to other employment benefits such as holiday pay, access to a pension scheme and Paternity Pay as his other colleagues did. Lewis checked this out with the Music Service and in turn the Music Service recognised how important it was for teachers to understand the benefits attached to their contracts and so they produced a staff handbook setting these out and all the other policies for all teachers. Please note that in establishing the employment status of an individual a variety of factors are relevant. Examples can be found at: Below is a brief explanation of each employment status. An Employee is a person employed under a contract of employment There are two elements to a contract of employment: mutuality of obligation and control which can help determine your employment status. They will have a written contract called contract of service. The employer will decide how and when they do the work, and they will deduct tax and National Insurance. A Worker who is not an employee and is said to be engaged under a contract of its own kind A worker is anyone who works for an employer under a contract of employment; this could come from you or from another organisation. They should still have a written contract and although they may not be on the permanent workforce they should be on the PAYE system with their tax and National Insurance being deducted. If they are not an employee or worker then they will be self-employed They will be on a contract called a contract for service. This means that they will determine how and when they do the work (within reason). They will pay their own tax and National Insurance contributions. In effect they run their own business and take financial responsibility if it is successful or not; they may have several employers at one time. Under the 1978 categorisation of earners regulations teachers are an employed earner for National Insurance purposes. Provided that the teacher is engaged for more than three days in three consecutive months and the engagement is not in a public lecture, then Class 1 National Insurance will need to be deducted. 7 Health and Safety Jane teaches flute at the local secondary school on a contract she received through the local Hub. She has been teaching after school on a Tuesday for two terms in the same room without a problem. However, last Tuesday, the room was double booked so she was moved to the drama hut on the other side of the playground. There was only one light in the room which was very dim and there didn t seem to be any heating. She reluctantly continued with the lesson, but that evening she ed her manager about the situation and asked him if there was anything she could do. The next day her manager called Jane to say he had contacted the school to explain that it was not acceptable for teachers to work under those conditions; the school apologised and assured her manager that in future they would ensure that all visiting music teachers would be given a suitable teaching room to teach in. Jane also went on a Health and Safety training day organised by the Musicians Union, so she knew what her obligations were as well as those of the school and her employer. A music teacher, whether employed by a school, Music Service, or a Hub, or as a self employed person, must take responsibility for their own health and safety while on the school s premises and they must ensure that they comply with the school s Health & Safety procedures while they are on-site. However this does not negate the school or employer s responsibility to them under the Health & Safety at Work Act. The Health & Safety at Work Act 1974 places overall responsibility for health and safety with the employer. For more information go to -

8 Child Protection Jenny runs an after school percussion group arranged through the local Hub. With an age range of 13 to 16, everyone gets on well. However, Jenny had noticed a change in behaviour in one of the pupils named Kim. Kim was getting angry when things went wrong, she was also losing weight. One evening, Jenny asked Kim to stay behind after class to see if she could find out the cause of this change. Kim eventually admitted that her mother had been drinking a lot lately and had lashed out at her on occasion. Kim asked Jenny not to tell anyone as she was afraid people would make fun of her. However, Jenny explained she couldn t keep the matter to herself and why she was obliged to pass the information on to the appropriate authority, which she did. Jenny had not come up against this sort of situation before but fortunately had taken part in a Child Protection Awareness Training workshop organised and delivered by the Musicians Union through the Hub a few weeks earlier. The workshop included information on current legislation and the group undertook several exercises about how to deal with a range of situations. Due to this training, Jenny was able to respond to Kim s situation and was confident in her subsequent actions. To help clarify what she had learnt in the workshop, Jenny went on to take the online Child Protection in Music course - Safeguarding Teachers As well as having the right training and information about safeguarding children, music teachers working with individuals or small groups of pupils may also find themselves in vulnerable situations where their professional conduct is questioned, and so it is important for them to have the relevant information about being in such situations. 9 Rates of Pay David was a sought after instrumental teacher specialising in teaching large groups and worked three days in schools under a contract from the Music Service. The remainder of the week he worked directly in schools as a freelance workshop leader. David had built up a good reputation and had over 15 years of teaching experience. He was paid 23 per hour by the Music Service and whilst he enjoyed the work that he did, and the good relationship he had with the other music teachers, David felt that the hard work and expertise he put into his teaching was worth more than the rate the Music Service was currently paying him. As an MU member he called his Regional Office for advice and learnt that the minimum rate the MU recommended was 30 per hour. After the conversation he had with the MU, David decided to negotiate a better rate of pay with the Music Service as financially he would be better off working directly for the schools who did not want to lose him. The Music Service recognised they were running the risk of losing an experienced and excellent teacher and spoke to David about an increase in his hourly rate as well as using him as a mentor for new teachers entering the profession. The MU recommends minimum rates for self employed teachers and has standard contracts for members who work privately and in schools:- Teaching Rate ( ) per hour / per 30 minutes / per 20 minutes Group Teaching and Directing Ensembles Rate to be negotiated and increased pro rata when preparation time is needed and/or large groups (whole Class) involved. It is important for all Safety Representatives to attend one of these courses, in order to gain confidence in and full knowledge of musicians rights and how to apply them in the workplace. NB Teachers do not have to be members of the Musicians Union to receive the training.

The Art of Teaching The Art of Teaching Project, sharing good practice amongst instrumental and vocal teachers Learn to Play Day Saturday 16 March 2013 The first National Learn to Play Day took place on March 31 st Organised by the charity Music for All and with support from the Musicians Union and MusicTeachers.co.uk, the day offered FREE musical instrument taster lessons to the public. Nearly 70 music shops in the UK took part and gave close to 10,000 lessons to both brand new and returning musicians. Following its successes the next day will be planned for Saturday 16 March 2013.
