2 Amenity Woodland, Adjacent The Geldeston Locks Public House, Locks Lane, Geldeston Introduction Offers are invited to purchase the freehold of this parcel of amenity woodland, measuring approximately 1.04 acre (0.42 hectare), which adjoins The Geldeston Locks Public House and the Broads Authority s 24 hour moorings on the North bank of the River Waveney, approximately 2 miles upstream of Beccles. Location The woodland is located adjoining The Geldeston Locks Public House and accessed via Locks Lane, an unmade track leading from Station Road, Geldeston. Geldeston is located approximately 5 miles East of Bungay and 3 miles west of Beccles. Description The property comprises a rectangular shaped parcel of amenity woodland extending to approximately 1.04 acre (0.42 hectare) in area (STMS), shown edged red on the site plan. The land is low lying and prone to flooding and is bounded on the west side by The Locks Public House and on the south side by 24 hour moorings owned and operated by the Broads Authority. Services It is thought unlikely that there are any services to the land. However we have made no enquiries and if necessary, intending purchasers should make their own enquiries of the relevant authorities as to availability of services. Town and Country Planning The land is to be sold without the benefit of any planning permission. See also provisions regarding Clawback. Fixtures and fittings The property is sold as seen and includes all fixtures, fittings and equipment remaining at the property unless otherwise stated. Tenure and possession The land is offered for sale freehold with vacant possession upon completion. Value added tax Should the sale of the property or any right or entitlement attached or relating thereto become a chargeable supply for the purposes of VAT, such tax will be payable by the purchaser in addition to the purchase price. No election has been made to charge VAT on the property sale. Outgoings None known but intended purchasers should make their own enquiries regarding any drainage rates or other outgoings there may be in respect of the land. Public access The sale will be subject to a condition protecting continued public access on the land. Rights of way The sale is subject to all rights of support, public and private rights of way, water, light, drainage and other easements, quasi-easements and wayleaves, all or any other like rights, whether mentioned in these particulars or not. The sale is subject to an easement dated 8 November 2013 for septic tank drainage granted in favour of The Locks Inn The sale will include a right of access over the vendor s retained land hatched brown on the site plan to and from Locks Lane and such rights of access as the vendor has enjoyed (these are not documented) over the bridge at point X on the plan and over Locks Lane subject to the purchaser contributing towards repair and maintenance of the same according to user. Viewing Viewing is at any reasonable time during daylight hours with particulars in hand. Directions From Beccles town centre proceed north and turn left onto the A146 Norwich Road (towards Norwich). At the second roundabout turn left onto the A143 (towards Bungay) and take the first left into Stockton Road (a single track road). Turn right at the junction with Yarmouth Road and immediately left down Geldeston Hill and southwards along Station Road. As Station Road bends right turn left into Locks Lane and proceed carefully and at your own risk along this unmade track to the woodland which lies immediately beyond The Locks pub. Please note that there is no right of parking at the pub. The postcode for the site is: NR34 0HS Health and safety Care must be taken whilst viewing to avoid accident or injury. Save for death or personal injury caused by their negligence, neither NPS Group nor the vendor can accept any responsibility for any loss or damage, howsoever caused, whilst viewing the property and you are deemed to have accepted the terms of this disclaimer by entering onto the site. Community right to bid nomination South Norfolk Council accepted a nomination identifying the property as a community asset under the Localism Act 2011 and it is listed as such on their register. In accordance with the legislation, on 12 th and 19 th May 2014 the Broads Authority advertised its intention to sell the property and prospective purchasers should note that contracts for sale cannot be exchanged before the end of the 6 month moratorium period which ends on 5 March 2015.
3 Clawback The purchaser will be required to enter into a deed of covenant whereby the purchaser or its successors in title will pay to the vendor or its successors in title 50% of any increase in value above the base value of the land as amenity woodland following the grant of any planning permission for development or use for a more valuable use than the base value. The covenant will run for 79 years from the date of the conveyance and will be payable on implementation of a planning consent or sale of the land with the benefit of the planning permission. Right of pre-emption In the event of the purchaser deciding to sell the land or any part thereof it must first offer to sell the land back to the vendor. Common boundary The common boundary between points A and B on the site plan will belong to the purchaser. The vendor will erect permanent marker posts to mark this boundary on completion of the sale. Measurements All measurements are approximate. These are based on Ordnance Survey and are for reference purposes only. They have been checked and computerised by the agents, and the purchaser(s) shall be deemed to have satisfied themselves as to the description of the property. Any error or mis-statement shall not be under the sale, nor entitle either party to compensation. Plans are for identification only. The plan is based on Ordnance Survey National Grid Edition but excludes information from the Rural Land Register data capture exercise.
