1 LOCAL AUTHORITY POLLUTION PREENTION AND CONTROL PERMIT Yeovil Motor Company REFERENCE NUMBER : PPC/54 POLLUTION PREENTION AND CONTROL ACT 1999 POLLUTION PREENTION & CONTROL (ENGLAND AND WALES) REGULATIONS 2000(as amended) South Somerset District Council ( the Council ) in accordance with Section 10(2) of the Pollution Prevention and Control (England and Wales) Regulations 2000(as amended) ( the Regulations ), hereby permits: Yeovil Motor Company Ltd Whose principal place of business is: Reckleford Yeovil Somerset BA21 4EH to operate an installation involving the activity of unloading of petrol from mobile containers at a service station ( the Permitted Installation ) prescribed in paragraph (d) of Part B of Section 1.2 of Schedule 1 to the 2000 Regulations, at the premises occupied by the Operator at Yeovil Motor Company Reckleford Yeovil Somerset BA21 4EH Ordnance Survey Reference This permit is subject to the conditions specified in this document consisting of 9 pages and plans A & B and Appendix 1and 2. 2 SCOPE The permit applies to the installation which comprises not just any relevant unit carrying out a Part B activity listed in Schedule 1 to the Regulations, but also directly associated activities which have a technical connection with that activity and which could have an effect on pollution. All conditions within the permit relate to the control of emissions to atmosphere. Pollution Prevention and Control Act Pollution Prevention and Control (England and Wales) Regulations 2000(as amended) 3. Secretary of State s Guidance General Guidance Manual on Policy and Procedures for A2 and B installations. RESIDUAL DUTY There is implied in every permit a condition that, in operating the installation or mobile plant, the operator shall use the best available techniques (BAT) for preventing or, where that is not practicable, reducing emissions from the installation or mobile plant. BAT is defined in the regulations. This definition is reproduced in the supplementary notes supplied with this permit. INSATALLATION DESCRIPTION The general location of the Authorised Process is marked in red on the attached plan PPC/054/A (page 5). The Installation boundary is marked in red on the attached plan PPC/054/B (page 6). The activity regulated by this permit is the unloading of petrol from mobile containers at a service station. A full description of the process is given in Appendix 1 (page 7) of this document. PERMIT CONDITIONS 15/12/ of 9 PPC-054
3 All conditions shall have immediate effect unless stated otherwise. Construction 1. The connection points on the tank filling pipes and vapour return pipe shall be fitted with secure seals to reduce vapour leaks when not in active use. Apertures on storage tanks for the use of dipsticks shall be securely sealed when not in use. 2. The fittings for delivery and vapour return pipes shall be different to prevent mis-connection. 3. Petrol storage tank vent pipes shall be fitted with a pressure vacuum relief valve to minimise vapour loss during unloading and storage. The pressure vacuum relief valve shall be sized and weighted so as to prevent vapour loss, except when storage tanks are subject to potentially hazardous pressurisation. Deliveries 4. apours displaced by the delivery of petrol into the storage tanks shall be returned through a vapour tight connection line to the mobile container delivering the petrol. Unloading operations may not take place unless the vapour recovery line is in place and properly functioning. 5. When connecting hoses prior to delivery, the vapour return hose shall be connected before any delivery hose. The vapour return hose shall be connected at the road tanker end first and then at the storage tank end. 6. On completion of unloading the vapour hose shall not be disconnected until the delivery hose has been discharged and disconnected. The delivery hose shall be disconnected at the road tanker end first. The vapour return hose shall be disconnected at the storage tank end first. 7. The number of tanker compartments being discharged simultaneously shall not exceed Adjacent to each vapour return connection point for the storage tank, there shall be a clearly legible and durable notice, instructing Connect vapour return lines before off-loading or similar wording. The sign shall also state that no more then 2 compartments may be unloaded simultaneously in accordance with condition 7 above. 9. If dip testing of storage tanks or road tanker compartments is performed before delivery, the dip openings shall be securely sealed prior to delivery taking place. Road tanker compartment dip testing shall not be performed whilst the vapour hose is connected. 10. The delivery operation shall be carried out by a competent person who shall remain near the tanker and keep a constant watch on hoses and connections during unloading. A competent person is a person who has received training in the unloading of or supervising the unloading of petrol into storage tanks. The competent person shall also be aware of action to be taken in the event of a leak of vapour and shall have been trained in accordance with Section 26 of the Road Traffic (Carriage of Dangerous Substances in Road Tankers and Tank Containers) Regulations /12/ of 9 PPC-054
4 11. All road tanker compartment vent and discharge valves shall be closed on completion of the delivery. 12. All connection points shall be securely sealed after delivery. 13. If storage tanks or road tanker compartments are dipped after delivery, the dip openings shall be securely sealed after dip testing. 14. Manhole entry points to storage tanks should be kept securely sealed except when maintenance and testing are carried out which require entry to the tank. Testing 15. Petrol delivery and vapour return lines on petrol storage tanks shall be inspected and checked for correct functioning every 12 months. 16. Pressure vacuum relief valves shall be checked for correct functioning, including seating and corrosion at least once every 3 years. Records 17. The operator shall maintain for a minimum of two years, at the premises, records incorporating details of the following: (a) (b) (c) All maintenance, examination, testing, installation and repair work carried out. Training given to operating staff at the service station. Any suspected or actual vapour leaks together with action taken to deal with any leak. General 18. ent pipes shall not discharge less than 3 metres above the ground, nor within 3 metres of any opening windows or ventilation air inlets. 19. The Operator shall implement a schedule of preventative maintenance. A copy of the schedule shall be kept at the process site, and maintenance visits and activities shall be recorded as part of the record keeping required by condition At all times while this permit is in force, a copy of the permit shall be kept posted at process site in such position so as to be conveniently read by persons having duties which are, or may be, affected by the matters set out in the permit. 15/12/ of 9 PPC-054

7 APPENDIX 1 DESCRIPTION OF INSTALLATION The general location of the Authorised Process is marked in red on the attached plan PPC/054/A, (Page 5), and the specific location PPC/054/B, (Page 6). The Authorised Process is the unloading of petrol into 4 underground storage tanks from mobile delivery vehicles, where the total quantity to be unloaded in any 12 month period is likely to be at a rate greater than 100,000 litres. A maximum of 2 vehicle compartments discharge into the storage tanks at any one time and emission control during unloading is via a vapour balancing system connected to the road tanker 15/12/ of 9 PPC-054
8 APPENDIX 2 SUPPLEMENTARY NOTES These notes do not comprise part of Permit LAPPC/PG1/1(1) but contain guidance relevant to the Permit. Policy and Procedures Guidance Manual The Secretary of State has published a General Guidance Manual on Policy and Procedures for A2 and B Installations (Publication Reference PB8094: ISBN ). This is available from Defra Publications, Amdahl 6000, London, SW1A 2XX (Tel ), price 18, or may be downloaded free of charge from the Defra website at: Inspections Regular inspections will be taken by officers of the Council to check and ensure full compliance with the Permit, and may be without prior notice. Residual Duty The residual duty covers all air pollution matters not covered by the specific conditions in the Permit, for instance, the ready availability of essential spares. Health and Safety This Permit is given in relation to the requirements of the Pollution Prevention and Control Act It must not be taken to replace any workplace responsibilities the operator has under Health and Safety legislation. Whenever emission limits quoted in this Permit conflict with occupational exposure limits set under the Health and Safety at Work Act 1974 to secure the health, safety or welfare of persons at work, the tighter limit should prevail. Installations must be operated in such a way as to protect persons at work as well as the environment. In achieving conditions in this Permit the operator must not adopt any course of action that would put at risk the health, safety or welfare of persons at work. Should a conflict exist or arise between the requirements of this permit and health and safety obligations then it is the responsibility of the operator to notify the Council of this without delay. The Council will then review the permit conditions. Other Statutory Requirements This Permit does not detract from any other statutory requirement, such as the need to obtain planning permission, hazardous substances consent, discharge consent or building regulation approval.. The Permit is issued under Section 2 of the 1999 Act. The Permit does not authorise a contravention of any other enactment or any order made, granted or issued under any enactment, nor does is authorise a contravention of any rule or breach of any agreement. The Operator is advised to consult the planning department at Customer Services (Planning), Council Offices, Brympton Way, Yeovil, Somerset, BA20 2HT Tel:(01935) regarding changes that may be required as a result of this Permit (e.g. chimney heights) as they may require planning permission. 15/12/ of 9 PPC-054
9 Change of Permit Holder Regulation 18 of the 2000 Regulations allows the holder of an Permit to transfer all or part of it to a person who proposes to carry on operating the installation in the holder s place, subject to the payment of any fee prescribed by the Secretary of State and an application in writing to the regulator from both the current operator and the proposed transferee. Should the regulator consider that the proposed transferee would not ensure compliance with the conditions of the transferred permit then the regulator will not effect transfer of the permit. The change in permit holder will only take effect from the date of endorsement of the existing permit or date of the new permit. ariation of Permit Under Section 17 of the 2000 Regulations, the Council has powers to vary the Permit. Operators will be liable to enforcement action if they make a change to the operation of an installation without approval. The operator shall notify the regulator in writing at least 14 days prior to making any change, including a description of the change proposed, or Under Section 17 of the 2000 Regulations, provision is given for holders of a Permit to apply to make changes to the process. If this procedure is needed, contact the Pollution Team of the Council s Environment and Health Service for an information pack and forms. Additionally, the Council has the statutory duty of reviewing the Permit from time to time. Noise This Permit does not include reference to noise. Statutory noise nuisance is regulated separately under the provisions of Part III of the Environmental Protection Act Appeals An Appeal can be made against the conditions in this Permit to the Secretary of State within 6 months of the date of issue.
