3 Particulars of Sale Location The land is located approximately 2.5 miles to the South West of the Carlisle and 10 miles to the North East of the town of Wigton. Directions From the centre of Carlisle follow the A595 West, then turn left onto the B5299 (Dalston Road), follow Dalston Road for approximately 2.5 miles and the land lies on the left hand side of the road on either side of the access road to the market garden. The land is currently down to grass and the boundaries are a combination of stockproof fencing and hedgerows. On the Eastern edge of the field are small woodland enclosures of mature broadleaf trees. The land is down to grass, with the boundaries being a combination of hedgerows and stockproof fencing. There is a muck heap located in the field, which will be left for the successful Buyer. Interested purchasers are advised to make their own enquires with regard to the mains supply. Access Access to both lots can be gained directly from Dalston Road. A neighbouring occupier has a right of access across the entrance to Lot 1. The cost of maintaining the access is spilt 50:50 with the neighbouring occupier. The gates which are currently installed are the result of an informal arrangement between the previous occupants and the neighbouring land owner as such this informal right of access will not be conveyed to the successful purchaser. 5 Development Clawback Both lots will be offered for sale subject to a clawback in favour of the current Seller arising from the future development of the land or any part thereof within a period of 80 years from the date of completion. The amount of the clawback to be paid by the Buyer (or any subsequent owner or security interest holder) following the grant of planning consent for any development or change of use will be 50% of the uplift in value, to be the difference between the value of the land or the relevant part with planning consent and the aggregate of the then agricultural value with actual costs relating to obtaining of planning consent. Tenure The property is offered for sale with vacant possession given on completion. Basic Payment Scheme The land is registered for Basic Payment Scheme purposes, however there is no Basic Payment Scheme Entitlements included in the sale. Environmental Schemes The land is currently not entered into any Environmental Stewardship agreement. Sporting & Mineral Rights In so far as they are owned by the Seller the sporting rights are included in the sale. The mineral rights are excluded from the sale, in that they are not owned by the Seller. Burdens The property is sold subject to all rights including rights of way, whether public or private rights of light, support, drainage, water and electricity supplies and other rights, obligations and easements, quasi easements and restrictive covenants and all existing and proposed wayleaves for masts, pylons, stays, cables, drains and water, gas and other pipes, whether or not constituted in the title deeds or referred to in these particulars. 6 Method of Sale The property is offered for sale by Public Auction as a Whole or in Two Lots on Wednesday, 25th May, 2016 at 1.30pm, in Ring 1 at Borderway Mart, Rosehill, Carlisle. The Sellers reserve the right to exclude any of the property shown, sell the property before hand or to generally amend the particulars. A copy of the Legal Pack is available by contacting the Seller s Solicitor. Prospective Buyers should bring two forms of identification to the Auction in the even that they are successful, one being photographic id, ie driving licence or passport and the other being a utility bill showing their address. These documents are required by law for Money Laundering Regulations. Definitions of Guide Price and Reserve Price Guide Price: An indication of the Sellers s current minimum acceptable price at Auction. The guide price or range of guide prices is given to assist prospective Buyers in deciding whether or not to pursue a purchase. It is usual, but not always the case that a provisional reserve range is agreed between the Seller and the Auctioneer at the start of marketing. As the reserve is not fixed at this stage and can be adjusted by the Seller at any time up to the day of the Auction in light of interest shown during the marketing period, a guide price is issued. This guide price can be shown in the form of a minimum and maximum price range within which an acceptable sale price (reserve) would fall, or as a price figure within 10% of which the minimum acceptable price (reserve) would fall. A guide price is different to a reserve price (see definition below). Both the guide price and reserve price can be subject to change up to and including the day of the Auction. Reserve Price: The Seller s minimum acceptable price at Auction and the figure below which the Auctioneer cannot sell. The reserve price is not disclosed and remains confidential between the Seller and Auctioneer.
