9 AB STRACTS Stra teg ies for the Prov ision of Public Goods in Rura l Ch ina A Com para tive Ana lysis ( 23) Ye Chunhu i ( China Academy for Rural Development, Zhejiang University, Hangzhou ) L uo R enfu (Center for Chinese Agricultural Policy, Chinese Academ y of Sciences, Beijing ) Abstract: On the basis of a nationally rep resentative data, which covered 6 p rovinces and 2459 villages in China, the p resent paper describes the public goods p rovision in rural area by local governm ents, village au2 thorities and enterp rises. A lso this paper exam ines the determ inants of public goods p rovision and differences of strategies by different public goods p roviders in rural China. U sing a m ultivariate analysis model, we find that enterp rises, especially state owned electricity enterp rises, could p lay an active role in rural public p rovision. W e also find that the strategies for the p rovision of rural public goods by enterp rises are differ from local gov2 ernments strategies. If p roper incentive and restraint mechanism could be set up, the enterp rises will p lay a more important role in p rovision of public goods and in new rural construction. NPO and governm ent are comp lementary in public service. B ased on resource dependence theory, this paper analyzes the interactive mechanism on the NPO and government. And concludes that it s a non - equi2 librium relationship between NPO and government. be based on the public service. The mainstream of China s constitutional studies holds that constitutional interp retation should have equal norm ative validity to or higher normative validity than law s. This op inion, however, has in2 ternal contradiction that can t be justified, because constitutional interp retation is merely an action to supp le2 ment norm s and does not have the p roperty of form ing norm s, as constitutional amendment or legislation. Con2 stitutional interp retation is generally attached to constitutional review, so the validity of constitutional interp re2 tation is generally covered by the validity of constitutional judgment and m anifested as the validity of the reason of judgment. In China, constitutional interp retation can be independent in constitutional supervision, but only by com bining w ith the source constitutional norm can constitutional interp retation be meaningful and valid. validity of constitutional interp retation should be the extension of the validity of constitutional norm and has nei2 ther independence nor normative validity.
