1 PRASAR BHARATI (INDIA S PUBLIC SERVICE BROADCASTER) DOORDARSHAN NEWS: TOWER-B, DOORDARSHAN BHAWAN, NEW DELHI AN INVITATION FOR TENDER For Development of Mobile Applications of Doordarshan Channels Tender No. DDN/5(115)/10(11)/ G (E) Dear Sir, Please furnish your quotation for the services mentioned in the enclosed quotation form. Your quotation should fulfill the following conditions: - Quotation should be sent in an envelope sealed with wax. The cover should be super scribed with following details:- 1. Services/Material for which the tenders are enclosed. 2. Reference to the letter of enquiry. 3. Tender fee Rs. 500/-(Rs. Five hundred only). 4. Opening date of quotation at 1600 hrs. 5. EMD of Rs. 40,000/- (Rs. Forty thousand only) enclosed. The quotation will be in two parts: Part I: One sealed envelope would be submitted which should contain only revenue sharing ratio between the firm and the Doordarshan. The envelope cover should be clearly marked "Price Bid". Part II: Another sealed envelope should be submitted which should contain: (A) EMD in a separate envelope as per clause. (B) The details of planning, conceptualization, designing and hosting of mobile apps for various OS used by leading mobile manufacturers will be presented in this part. The execution plan along with timeline may also be part of the technical details. This envelope should be marked as "TECHNICAL BID". The Technical Bid will be opened on the date of opening of the tender if the EMD has been submitted in a separate envelope and in proper order as required above. The technical evaluation committee appointed by the DDG (E), DD News, and New Delhi will evaluate the various clauses in Technical Bids and give recommendation based on their interpretation. The decision of DDG (E) NEWS, regarding interpretation of various clauses in Technical Bid tendered by the Tenderer shall be Page 1 of 6

2 final. The opening of the prices bid will be initiated separately to the shortlisted entities after technical evaluation. Pre-Bid Conference will be held on the date of at 1500 hrs at Room No. 218, II floor of Tower B, Doordarshan Bhawan, Copernicus Marg New Delhi. Attendance at the Pre-Bid Meeting is not mandatory. A maximum of two duly authorised Project representatives/ Key Personnel per entity may attend the Pre- Bid Conference. Entity (ies) must intimate DD News by Fax or , whether or not they intend to attend the Pre-Bid Conference, prior to the Scheduled dates mentioned. If attending, then the names and details of such representatives must be forwarded to DD News. On the basis of Pre-Bid Conference, DD News may issue clarifications and amendments to the Tender document by the stipulated date after the date of the Pre-Bid Conference or any extended date as DD News may consider necessary. The envelope should be addressed to the Assistant Engineer, DD News so as to reach him up to 1500 Hrs. on or before The quotation will be opened on same day at 1600 hrs in presence of those tenderer or their authorized agents who may choose to attend. Quotations received without proper wax sealing are liable to be rejected. Any additional charges if claimed after opening the tender will not be admissible. 1. Scope/Background and Objective: Doordarshan News; a national public broadcaster; India s only multilingual & terrestrial 24-hr News Channel is willing to engage a firm/agency to plan, conceptualize, design, develop, customize and host mobile application for Doordarshan channels to make it available on various mobile platforms on revenue sharing basis. The purpose of the tender is to design and develop and host mobile applications (Mobile Apps) for Doordarshan channel including DD News 2. Eligibility Criteria: The entity/firm, in order to be eligible to provide the aforesaid services, must be in their own capacity or in a consortium, has successfully completed designing and developing mobile apps & services for leading broadcasters in previous years. The bidder should essentially submit the list of the broadcasters to whom the quoted software/apps has been developed & supplied. The tenders without the proper user list shall liable to be rejected out rightly. 3. Scope of the work 3.1 Conceptualize Design, Develop, Customize and host mobile phone and desktop applications, for Doordarshan Channels starting with DD News, suitable with support for Android, Blackberry, Windows, Symbion and ios etc as per the required specifications of the Doordarshan. 3 Development of mobile applications for other channels will be on the same terms and conditions as laid out in this agreement upon written instructions and acceptance by parties. 3.2 The mobile apps will be hosted in the tenderer s servers and CDN. The required storage and the servers for Video on demand also will be provided and maintained by the tenderer. 3.3 Define the necessary backend xml feed format as needed for the client. 3.4 Support Clients team to integrate with the CMS and successfully launch the app. 3.5 Reporting Within forty five (45)) days after the end of each month, the tenderer will furnish Client with usage reports in the form generally made available to Clients at that time. Such reports will contain at a minimum, on a per clip basis for all Client Content and Monetized Content: (i) the total views and revenue generated for the month; (ii) the daily views, and revenue generated; and (iii) the total views and revenue generated. 3.6 Intellectual Property Rights and rights of content editing Intellectual Property Rights and rights of content editing will wholly vest with Doordarshan and the successful agency will not transfer or sell any part of Doordarshan s content to any third party without prior written permission of Doordarshan. 4. COMPLIANCE: A point-by-point compliance statement from the principal manufacturer in respect of all the points laid down in these specifications is to be enclosed along with the offer in the format given below. Mere signature on the copy of the specifications shall not be accepted as a compliance statement. The figures so mentioned should be supported by record of these in the technical literature enclosed with the tender and reference to the page number of enclosed literature for all features and technical specifications should be mentioned in the relevant column. Offers without the compliance statement or with incomplete compliance statement will liable to be rejected with the sole responsibility of the bidder. Any deviation from the specification detailed in the compliance statement is to be highlighted separately Arbitration: All disputes, differences or question including the subject matter of the contract on the rights and liabilities of the parties, hereunder of whatsoever arise between parties except those, the decision thereof is herein before otherwise expressly provided for shall be referred to the sole arbitration of the DDG (E) DD News, New Delhi or any person nominated by Page 4 of 6

5 him and his decision shall be final and binding on the parties. The provisions of Arbitration and Conciliation Act, 1996 or any statutory modifications or reenactment thereof and the rules made there under for the time being in force shall apply to such arbitration. The arbitration proceedings shall be held in New Delhi. 10. Presentation/Demonstration: If necessary, the firm may be asked for presentation/demonstration of the offered execution plan as part of the technical evaluation. In such case the firm will have to make suitable arrangement for the demonstration of the offered system at Doordarshan Bhawan, New Delhi, on notice of 15 days. Accordingly the firm should be in readiness for demonstration on a notice of 15 days. 11. Evaluation & Advertisement Revenue: As the firm is required to develop and host all mobile applications with no upfront cost to be paid by Doordarshan. The firm will also update and modify the mobile applications as and when requested by Doordarshan in writing. However, the cost will be recovered over the period of time through advertisements where the firm will have the right to sell advertisements on mobile applications developed by them for Doordarshan channels with approvals of Doordarshan. The total revenues earned every month during the contract period shall be shared between Doordarshan & the firm in the mutually agreed ratio throughout the term of the agreement. The technically qualified firm who will offer maximum share to Doordarshan will be awarded the contract of developing the mobile apps. The firm will recover its cost from its share of revenue from sale of advertisements. Additionally, Doordarshan also agrees to provide three months free period from the date of launch of each mobile application to help the firm to recover part initial development cost. 12. Security Deposit/Performance Bank Guarantee: The successful bidder has to submit performance bank guarantee of Rs. One lakh within seven days after issuance of letter of award/work order/purchase order/job order. 13. Liquidated Damages: If the firm is unable to complete the execution the work within the stipulated time limit, the indenter may at his own discretion allow such additional time as he may consider justified with or without liquidated demurrages and without altering any other terms and conditions of the order. In the event of the failure of the bidder to complete the supply of stores/work of the within the stipulated time or extended time, the DDG(E) DD News, New Delhi shall have the right to impose a liquidated half percent (0.5%) per week or the part thereof of the performance bank guarantee. The contractor's liability for delay however shall not exceed 10% of the performance bank guarantee. 14. Adherence of Advertising Codes: the firm agrees to abide by the existing and amended from time to time the Cable TV Network Rules Advertising Code of the country necessary for such applications. Any violation reported will need to be attended immediately. Page 5 of 6

6 15. Adherence of Public Service Broadcasting Ethics: The firm will ensure that the ethics and requirements of public service broadcasting are kept while inserting advertisements. The firm will therefore also ensure that advertisements are not inserted in between clips of national importance and on live telecast of national importance like Republic Day Parade, Independence Day, Republic Day Function, Swearing-in-Ceremonies, Gandhi Jayanti, Death Anniversaries of important personalities, Address to the Nation and other similar important events. 16. Geographical Blocking of the Content: The firm will be under obligation to geo block the content as per the direction of the Doordarshan. Such details will however be provided to the firm in advance through or through written communication. 17. DDG (E) News, New Delhi reserves to himself the right to accept/reject any or all tenders without assigning any reason whatsoever. 18.
