Long Cove Marina and Yacht Club Rules and Regulations

1. Good Neighbor The Member covenants and agrees not to do or cause anything to be done which may injure, damage, or endanger persons or property in or about, or adjacent to, the leased vessel slip and/or while on LCMYC premises. Member knows, understands, and acknowledges the risks and hazards associated with using said vessel slip and the LCMYC and the Member agrees to indemnify and save harmless the LCMYC, its successors and assigns, from any claim of any person, including Member, for injury to life, person, or property resulting from or in any way related to the Member s use and occupation of said leased vessel slip and/or the Long Cove Marina and Yacht Club. 2. Clean Dock Member shall maintain Member s Craft/Vessel and the Designated Vessel Slip (including any dock box, any appurtenant utility connections) in a safe and clean condition, and shall keep the Marina deck free and clear of obstructions that could pose any danger to others using such Marina dock. Without limiting the foregoing, Member shall: Not leave trash, engine parts, flammable materials and/or any other type of debris on the dock area or Long Cove Marina and Yacht property at any time. Secure and safely route all utility hoses and cables so as not to pose any hazard across any area of the dock or along any fender. Secure any dock box so as not to blow open during high winds, and shall be solely responsible for any damage caused by an improperly secured dock box. Not discharge or otherwise dispose of black water (water containing sewage), grey water (household waste water), trash, fuel oil, or any other contaminant in or on the Marina property, or into the water surrounding the Marina property. The Long Cove Marina and Yacht Club DOES NOT collect motor oil and dumping oil into the lake or trash receptacles is illegal. Comply with all applicable local, state, and federal environmental and other rules, regulations, and laws. Promptly, at its sole cost and expense, cause to be repaired in a good and workmanlike manner any damage caused by Member to the Designated Vessel Slip, or the appurtenances thereto, or to the Marina property. Member shall not modify or alter any portion of the Designated Vessel Slip or any of Marina deck or facilities appurtenant to the Designated Vessel Slip without the prior written consent of LCMYC, which consent may be withheld or denied in LCMYC s sole discretion.

3. Emergency Access Any emergency response organization, including but not limited to, police, fire, EMS, and representatives of the Long Cove Marina and Yacht Club shall have the authority to board the any vessel or camper, as required to carry out their official duties. The owner shall be liable for any costs incurred in carrying out such emergency duties. 4. PETS Members are responsible for the actions of their pet(s) at all times. Members agree to abide by the following rules: a. Members agree that their pet(s) will not disturb the rights, comforts and conveniences of neighbors or other Members/Residents. This applies whether the pet(s) is inside or outside of Member s dwelling. b. Pet(s) may not cause damage to the property. c. Members shall not permit pet(s) in swimming pool areas, laundry rooms, offices, community room, other recreational facilities (if any), and other dwelling units. d. Members will have a sanitary waste remover, commonly called a Pooper-Scooper or Pet Scooper, with them at all times while walking the pet(s) outside the unit, and agrees to remove and properly dispose of any pet waste. e. Members shall be responsible for the immediate removal of waste in the dwelling or on the grounds and repair of any damage. There will be a fifty ($50.00) charge assessed for each occurrence of LCMYC Management clean-up of pet waste. f. Pet(s) shall be kept on a leash and under Member s supervision when outside the vessel slip. Owner/Management shall impose reasonable charges for picking up and/or keeping unleashed pets. Members agree to comply with all applicable governmental laws and regulations (Leash Laws). 5. QUIET HOURS 11:00 pm. and 8:00 am must be respected. Please limit driving vehicles and golf carts during these times. 6. PARKING Member agrees to park in the designated parking spot in the campground area. Parking is limited to 2 vehicles per site in off peak days and months. Peak days, weekends, holidays, seasons shall limit parking to 1 vehicle per site. Additional parking may be used in designated other areas of the Marina property at the sole discretion and direction of LCMYC management and/or its agents. All vehicles and plate numbers must be listed on agreement. Parking on the road or grass at your site is not allowed.

7. ADDITIONAL STRUCTURES Any additional structures, canopies, or tarps, storage buildings or tents will not be allowed without the approval of LCMYC management or its agents. Approval is based on the sole discretion and direction of the LCMYC management. Only a small deck steps to campers or small storage unit will be allowed and shall be approved by LCMYC. All sites must be kept neat and tidy. LCMYC will be responsible for lawn maintenance, which will typically be done, weekly in the warm season. However, it is the member s responsibility to have all items removed from lawn. Violation to this policy may result in eviction with no refund. Please note that if you install any kind of structure, deck, porch or other attachment to your site, you will be responsible for moving said structure(s) upon your departure. Failure to remove said structure(s) may result in forfeiture of any deposits or rents until such structures are adequately removed by LCMYC. Said structure(s) shall be removed and the site left in its original condition. 8. GOLF CARTS/ATV S ATV s are not allowed on resort property. Electric golf carts preferred, if you have a gas golf cart they must be preapproved. Do not take golf carts into neighboring subdivision. Drivers must be 18 years or older on golf carts. LCMYC bears no responsibility for accidents or damage due to golf cart driving or ownership. 9. CAMPFIRES Campfires are to be in designated fire rings only. Please be aware of county burn bans. Make sure to extinguish all fires before going to sleep or leaving camp site. Cutting down of any trees is not allowed. 10. TRASH Dispose of in dumpsters on-site. Placement of hazardous materials in a dumpster shall be cause for removal from the campground and Marina property. 11. FISHING Members may fish off of Dock #1. Please respect boat slip members. Do not clean fish directly on docks or sidewalks. Dispose of cleanings in garbage bag, tie shut and place in dumpster. 12. SMOKING Smoking is not allowed in any indoor LCMYC facilities or at pool area. Properly dispose of cigarette ash and butts. 13. MAXIMUM NUMBER OF PEOPLE Each site has a maximum occupancy limit of 6 people. Any party falsely representing the number of people occupying their site or exceeding the number paid for may be subject to immediate eviction without refund. Over occupancy is considered a serious violation.

14. RELEASE OF LIABILITY The Owners shall not be liable for damage to member s property of any type, for any reason or cause whatsoever. Member agrees to indemnify and save and hold harmless the Owners and LCMYC from any loss, liability, damage or cost owners may incur due to occupancy of the property. Member is responsible for any damage done to LCMYC property. Member agrees to pay all cost related to fixing any damage. Any disputes arising under this Agreement shall be mediated subject to the laws of the state of North Carolina. 15. WEATHER & WINTER CONDITIONS There will be no refunds due to inclement weather or power outages. We are open year round and you agree that weather conditions may adversely affect your stay here at LCMYC. LCMYC is not responsible for any damage done by weather, wind, trees, acts of god or any other unforeseen and unknown condition which may adversely affect your site or possessions. You are to fill water tanks, unhook hose and turn off water. Member is responsible for water hydrant if it would freeze during winter use. Member agrees to pay full replacement cost and labor to fix hydrant and/or any associated problems. 16. USE Rental shall be used so as to comply with state, county, and municipal laws and ordinances. Member shall not use rental or permit it to be used for any disorderly or unlawful purpose or in any manner so as to interfere with other resident s quiet enjoyment of their residence. Any misuse described above shall result in termination of Rental Agreement and no refund of any payments will be issued. 17. INSURANCE The member agrees to carry their own comprehensive, liability insurance and vehicle registration on their camper and their vessel during the term of this agreement. We encourage all members to purchase traveler insurance. All members are required to provide Long Cove Marina & Yacht Club with proof of insurance with named as an additional insured. 18. TITLE AND REGISTRATION All members are required to provide proof of title and registration to be held on file at the office. Please email this information to Info@longcoveyachtclub.com or stop by the office and provide a physical copy to be held in your file. 19. FIREARMS NO firearms, fireworks, or other incendiary devices are permitted. Members violating this will be evicted and no refunds will be given.

20. AMENITIES ACCESS Each site will be given access to certain other areas of the marina property with a key card, membership card, decal, and placard or in some cases a wristband. These access identifiers must be readily displayed when using the marina amenities, especially during peak usage times. These access identifiers are your responsibility, if you lose one you will be charged $50.00 for replacement. These identifiers ensure to the extent possible that the LCMYC maintains a club membership atmosphere at all times. 21. WATER SAFETY a. Children under 13 years are required to wear a life vest while on docks or swimming in lake. b. Children under 16 years are also required to be accompanied by an adult (over age 21) while on docks or swimming in lake. c. No lifeguards at lake. d. Jumping off sundecks is prohibited and can result in termination of rental agreement. e. Please respect boat slip members that also use these docks. 22. POOL FACILITIES The pool and bathhouse are provided for your use. Member must follow all posted instructions & hours for this area. No swimming allowed without a lifeguard on duty. Rules: * No glass containers or glassware of any kind within the fenced pool area. * Members only will be allowed in the pool. * All members and guests must sign in prior to entering the pool area. * Guest fees are $5 per person, each day of pool access. * Guest fees apply to all persons entering pool area, including non-swimmers. * Guest fees are applicable to any non-member, including out of state guests.. * Children under five are free. * Proper swimwear required. * Obey the life guards. Swim only when lifeguards are on duty. * All children age 12 and under must be accompanied and supervised at all times by an guardian who is at least 16 years of age. * Members and Guests may use the bath house/shower area. * Showers are available in the bath house area. Bring your own soap and towel.

* A fifteen minute "safety break" will be called every hour. Only swimmers 16 and older are permitted in the pool during the "safety break". The choice to not call a break will be at the lifeguard s discretion. * Food is allowed in the designated eating areas only. * Clean up after yourself at all times. Trash receptacles are provided in the pool area. * No cooking is allowed within the fenced area. Use the picnic area for cooking. * Small ice chests are permitted in the pool area. Large ice chests shall remain in the picnic area only. * No loud or obnoxious music is allowed in the pool area. * Responsible drinking of alcohol is permitted within the pool area. No drinking of of alcohol or any kind of beverage in the water. * Smoking is permitted in the pool area. No smoking in the water. * Long Cove Marina & Yacht club is not responsible for theft or loss of your personal items. * Personal items left in the pool area will be disposed of. We are not a lost and found department. * Foul language, obnoxious or drunken behavior and offensive conduct will not be permitted. * Long Cove management and personnel reserves the right to evict any person from the pool area for violation of any of the above regulations at its sole definition and discretion. * Long Cove management and personnel reserves the right to indefinitely ban any person from accessing the pool area for violating any of the above regulations or for general bad behavior. * Occasionally the pool may close for maintenance or other reasons. Though we will do our very best to notify members of any pool closing, we reserve the right to close the pool without notice. 23. ALOCOHOL Please keep in mind that your behavior sets an example for our young people. Please be responsible when drinking in the pool area, campground area, picnic area, or any other area of the LCMYC property. Misbehavior of any sort, especially due to consumption of alcohol will be grounds for immediate removal from the property. We will strictly enforce these regulations.

24. DISMISSAL Long Cove management and personnel reserves the right to evict any person from the property for violation of any of the above regulations at its sole definition and discretion. Long Cove management and personnel reserves the right to indefinitely ban any person from accessing the property for violating any of the above regulations or for general bad behavior at its sole discretion. 25.
