1 THE UNIVERSITY CLUB 331 WEST COLLEGE AVENUE, STATE COLLEGE, PA TELEPHONE: LEASE AGREEMENT THIS IS A RESIDENTIAL LEASE. IT IS A LEGALLY BINDING CONTRACT BETWEEN THE LANDLORD (THE UNIVERSITY CLUB) AND THE TENANT. THIS RESIDENTIAL LEASE CONTAINS WAIVERS OF YOUR RIGHTS AS A TENANT. DO NOT SIGN THIS LEASE UNTIL YOU UNDERSTAND ALL OF THE AGREEMENTS IN THIS LEASE. Name of the Landlord: THE UNIVERSITY CLUB and its affiliates Name of the Tenant: By signing this lease agreement, I agree to abide by all of the Club by-laws, rules and regulations, and policies as established by the Board of Directors. 1. LEASED PREMISES: The leased premise is room # located at 331 West College Avenue, State College, Pa STARTING AND ENDING DATES OF THE LEASE AGREEMENT: This lease starts on (month/day/year) at 12:00 noon. This lease ends on (month/day/year) at 12:00 noon. 3. RENT: Tenant agrees to pay ($ total dollar amount of rent only) as a basic rent for the term of this Lease, plus security deposit. 4. The amount of rent is (term of lease) equal payments of ($ amount of monthly rent), due on the following schedule: a. First month s rent: ($ amount of monthly rent) Due prior to receiving your keys. b. Security Deposit: ($ amount of deposit) Due at the signing of the lease. c. (Number of remaining payments) additional payments of: ($ amount of monthly rent) due on the First of each month. Your first payment is due on (month/day/year). Your last payment is due on (month/day/year). THIS LEASE DOES NOT AUTOMATICALLY RENEW. Tenant agrees to pay the monthly rent in advance on or before the first day of each month. Landlord does not have to ask tenant to pay the rent. Tenant agrees to pay rent by depositing the check in the first floor mail slot. If paying by first class mail, the envelope must be postmarked no later than the fifth (5) day of the month. Cash payments must be given to the manager or other designated person, tenant will be given a receipt. Credit Card payment are payable online through our secure website. Tenant agrees to pay a LATE CHARGE of $15.00 per day, retroactive to the first day of the month if tenant does not pay the rent on time. If tenant mails the rent to the Landlord, the date of payment will be the date the letter is postmarked. A $30 returned check fee will be assessed on any returned checks and will be immediately due payable to the University Club. All rents and fees are nonnegotiable and must be paid or post marked by the due date to avoid additional fees or eviction proceedings.
2 5. SECURITY DEPOSIT TENANT agrees to pay a security deposit at the time the lease is signed and prior to the Landlord giving possession of the leased room to the Tenant. a. Landlord can take money from the security deposit to pay for any damages caused by the Tenant, tenant s family and tenant s guests. b. Tenant may not use the security deposit as payment of monthly rent or last month s rent. c. After taking out for damages and unpaid rent, Landlord agrees to refund to tenant any security deposit money which remains. Tenant agrees to give Landlord a written forwarding address when Tenant leaves and the lease ends. Landlord will send the remaining security deposit money to Tenant no later than 30 days after the Tenant vacates and the lease ends. Tenant will also receive a written list of damages and amounts of money taken from the security deposit, if any. d. Landlord may in the absence of any at fault party back charge all tenants Security Deposits for any damage of the property, if the damage is believed to have been cause by tenant or tenants guests. 6. DAMAGE TO PROPERTY Tenant agrees to notify Landlord immediately if the leased room is damaged by any cause. Tenant agrees to notify Landlord if there is any condition in the leased room that could damage the leased room or harm Tenant or others. If Tenant cannot live in the leased room because it is damaged or destroyed, Tenant may: a. Live in another room in the building, if available, until the leased room can be repaired. b. End the lease and leave the leased room. Tenant agrees that if the leased room is damaged or destroyed and Tenant ends the lease, Landlord has no further responsibility to the Tenant. 7. INSURANCE Landlord agrees to have insurance on the building where the leased premises is located. Tenant s own property is not insured by Landlord s insurance. Tenant is responsible for Tenant s own property that is located in or on the leased premises. Tenant must have renters insurance for Tenant s own property. 8. ASSIGNMENTS OR SUBLEASES BY TENANT. Assignment is the legal term for a transfer of the lease from the Tenant to another person. The other person becomes the Landlord s new tenant and takes over the lease. A sublease is a separate lease between the Tenant and another person who leases from the Tenant. Tenant agrees to not assign or to sublet without permission in writing from the Landlord. Tenant must fill out a Sub Lease Agreement. Subtenant shall not use the Room for any purpose other than as allowed in the Lease. Sub-Landlord must remove all personal property for the duration of the Subtenants stay and place said belongings in storage in approved storage areas. Tenant agrees that it is a violation of the lease if he assigns or subleases without the written consent of the Landlord.

RESPONSIBILITY FOR DAMAGE TO PROPERTY OR INJURY TO PEOPLE Landlord is responsible for all damage to property or injury to people caused by Landlord s intentional or negligent acts at the leased premises. Tenant is responsible for all damage to the leased premises and injury to people caused by tenant, tenant s family or guests. Tenant agrees that Landlord is not responsible to Tenant, Tenant s family or guests for damage or injury caused by water, snow or ice that comes on the leased premises unless Landlord was negligent. 10. USE OF LEASED PREMISES Tenant agrees to use the leased premises only as a residence. Tenant agrees to obey all federal, state, and local laws and regulations when using the leased premises. Tenant agrees not to store any flammable, hazardous, or toxic chemicals or substances in or around the leased premises. Tenant agrees not to do any activities in or around the leased premises which could harm anyone or damage any property. Tenant agrees not to allow more than one (1) person (the person signing the lease) to occupy the leased room without the written permission of the Landlord, this includes overnight guests. 11. RULES, REGULATIONS, AND POLICIES Tenant agrees to obey all rules and regulations of The University Club and by-laws (Policies Packet). If Tenant violates any rules or regulations of the club, Tenant violates this lease. The Landlord may amend these rules and regulations during the lease term by giving Tenant a revised written copy by mail or delivery to the leased premises. 1. The University Club is strictly a NON SMOKING facility, any damage, litter or hazard created by smoking is a violation of this Lease agreement. 2. The Basement area is off limits to all non-resident and resident members of the University Club until further notice. By signing this lease and agreeing to our Policies, you are becoming a Resident Member and are entitled to all of the amenities afforded our Social and Resident Members of the University Club. If for any reason you violate any of the terms of this lease including non-payment of rents or the policies you have received, you will forfeit your Resident Membership and suffer a 30 day membership revocation until such time as the Executive Board reestablishes your membership rights. During this evaluation period, you may be subject to eviction and removal from the premises should any additional violations occur. 12. LANDLORD S RIGHT TO MORTGAGE THE LEASED PREMISES Subordinate and subordination are legal terms that mean that this lease does not have any effect upon the rights of the Landlord s mortgage company. In other words, Tenant s rights under this lease are subordinate to Landlord s mortgage company. If Landlord does not make the mortgage payments, the mortgage company may have the right to end the Landlord s ownership of the leased premises. If the mortgage company sells the leased premises at a mortgage foreclosure sale, the lease may end. Tenant agrees that Landlord has the right to mortgage the leased premises. If Landlord has a mortgage on the leased premises now, or if Landlord obtains a mortgage in the future, Tenant agrees that this lease is subordinate to the Landlord s mortgage.
4 13. GOVERNMENTAL POWER OF EMINENT DOMAIN Eminent domain is the legal name for the right of a government agency as state, county, or local to take private property for public use. If all or any part of the leased premises is taken by eminent domain, this lease will end automatically. Landlord and Tenant agree to release each other from any responsibility and the lease has ended. 14. CARE OF LEASED PREMISES Tenant is responsible for, and will take good care of, the leased premises and all of the property in and around the leased premises. Tenant agrees to pay for any damage caused by Tenant, Tenant s family and Tenant s guests. Tenant agrees to turn over possession of the leased premises to Landlord when the lease ends. 15. LANDLORD S RIGHT TO ENTER LEASED PREMISES Tenant agrees that Landlord and Landlord s representatives have the right to enter the leased premises at any time without notice. Landlord and Landlord s representatives have the right to inspect, to make repairs, to do maintenance, and to show the leased premises to others at any time as deemed necessary. The Social Membership of the University Club will have the right to enter all ground floor areas during scheduled activities, and living room and dining room areas between the hours of noon till 11pm daily. 16. UTILITY SERVICES: Landlord agrees to pay the charges for utilities and services supplied to the premises as follows: Electric, Water and Sewage Service, Wireless internet, Cable TV, Landline Telephone, Natural Gas, Lawn Maintenance, Snow and Leaf Removal, Heat, Laundry Facility, Pest Control (Unless Tenant is responsible). a. Tenant agrees to pay any Telephone charges in their name, parking fees, and pest control fees if Tenant is responsible. b. Landlord has the right to turn off temporarily any utility or other service to the leased premises in order to make repairs or to do maintenance. 17. VIOLATIONS OF THIS LEASE AND OTHER DOCUMENTS When either Landlord or Tenant does not do something that they have agreed to do, it is a violation of this lease. If Tenant violates lease, Landlord also can sue Tenant for other expenses and may sue to evict Tenant. If Tenant violates this lease, Landlord may sue Tenant in court: a. To collect overdue rent, late charges, and money damages caused by Tenant s violation of the lease. b. If tenant leaves (abandons) the leased premises without the Landlord s permission before the end of the lease. c. Does not leave the leased premises at the end of the lease eviction. d. To collect for unpaid rent until the end of the lease or until another person takes possession of the leased room. e. Does not do all of the things that Tenant agreed to do in this lease. Tenant agrees that Landlord may receive reasonable attorney s fees as part of a court judgment in a lawsuit against Tenant for violation of the agreements of this lease.
5 18. Landlord and Tenant agree that the additional agreements, including rules and regulations and the University Club By-laws, are part of this agreement. BY SIGNING THIS LEASE AGREEMENT, THE TENANT AGREES THAT THE TENANT HAS READ AND UNDERSTANDS ALL OF THE AGREEMENTS IN THIS LEASE. LANDLORD S SIGNATURE DATE TENANT S SIGNATURE DATE
