2 OPEN BURNING ORDINANCE The following is a portion of the Open Burning Ordinance # as it relates to the open burning criteria: Section 1: PURPOSE: The purpose of this Ordinance is to prevent public and private nuisances caused by outdoor fires intentionally or carelessly set or maintained. Section 2: DEFINITIONS: For the purposes of this Ordinance, the following words and terms shall have the meanings ascribed to them herein: Bonfire: a large outdoor fire that is lighted in celebration but not including a fire intended for disposal of waste, wood or refuse. Burn Barrel: metal container / drum utilized to burn refuse at a residential or business property. Campfire: means a small outdoor fire intended for recreation or cooking but not including a fire intended for disposal of waste, wood or refuse. Areas identified as uncontained burning areas (See Section 12) Fire Chief: means the Chief of the Lawn or Campbelltown Fire Departments. companies are the two primary responders in South Londonderry Township. Such fire Lebanon County Emergency Management Agency (LEMA): The Agency designated to dispatch emergency personnel such a fire, police and ambulance. Municipality: means the Township of South Londonderry Open Burning: To set and maintain a fire at one location on a property where the products of combustion are emitted directly into the ambient air without passing through a stack or a chimney. This includes burning in a burn barrel (Permit required) Permit: A document given out by Township for permission to authorize Open Burning for a home owner. A copy of the permit and applicable conditions shall be kept at the burn site. Noncombustible Container: Any container specifically designed for the destruction by burning of any combustible material including a steel barrel, a fireplace consisting of at least three (3) sides, a walled fire ring, and outside chimney, grill or other similar devices. Such device shall not to exceed 50 height or 36 in diameter. Refuse: Any waste material, garbage, animal carcasses, and trash or household materials such as plastic.

3 Uncontained Fire: Fire set on open ground on properties of five (5) acres or more. Such fire shall not exceed 5 in diameter. Section 3: ALLOWABLE BURNING: Open Burning shall be allowed for fires solely for the cooking of food for immediate consumption, chimineas, portable and in ground fire pits, highway flares, burning essential to farming operations, a fire constructed by a volunteer fire company for official training purposes, bonfires and camp fires. This type of open burning is permitted within the Mount Gretna Area and is not subject to the Safe Burning Distances under Section 4 and the Permissible Hours under Section 8. Section 4: SAFE BURNING DISTANCES: No fire shall be set within thirty (30 ) feet of any principal structure, fifteen (15 ) feet for accessory structure, twenty (20 ) feet from any property line and within thirty (30 ) feet of public/private roads. However with neighbor approval, the side yard setbacks can be reduced and/or eliminated. Such approval shall be in writing and available for inspection should it be requested by the Code Enforcement Officer or a South Londonderry Township Police Officer and submitted with the open burning permit application. No fire shall be set less than fifty (50) feet from any container used to store flammable materials or petroleum products, including liquid propane or butane fuel tanks. Section 5: APPROPRIATE CONTAINER: Except as to fires solely for the cooking of food for immediate consumption, highway flares, burning essential to farming operations, a fire constructed by a volunteer fire company for official training purposes, bonfires and camp fires all open burning must be confined in a noncombustible container. Section 6: OPEN BURNING ATTENDANCE: Any open burning shall be constantly attended at all times by a responsible adult not less than 18 years of age until the fire is totally extinguished and not permitted to smolder. Fire-extinguishing equipment such as a pressurized garden hose, rakes, shovels etc. shall be available for immediate use. Section 7: PROHIBITED LOCATIONS: No fire shall be set or maintained upon any of the streets, sidewalks, traffic ways, or any public grounds, or public right of ways owned by, or maintained by either the local, or state governments in the Township. Section 8: PERMISSIBLE HOURS: Burning outdoors shall only be permitted from sunrise to sunset Monday through Saturday. Section 9: HAZARDOUS CONDITIONS: No fire shall be set or maintained at any time when drought, wind, or other climatic conditions would pose a hazard to persons or property. Section 10: OPEN BURNING ALLOWED: Tree and Shrub Clippings and leaves are allowed to be burned after the conditions in Sections 4 through 9 are met. Section 11: OPEN BURNING PROHIBITED: Except for farming applications, no industrial or commercial burning of any kind shall be permitted in the Township at anytime. It shall be unlawful to burn any grass clippings, cardboard or paper by products, chemicals, synthetic fibers, food wastes, animal

4 wastes, tires, rubber products, or building supplies at any time. Building supplies shall include, but are not limited to, shingles, Styrofoam, plastics, or insulation. Section 12: MOUNT GRETNA AREA OPEN BURNING PROHIBITION: Regardless if a person or persons meets the conditions in Sections 4 through 11, Open Burning including the burning of leaves shall be prohibited in the area of the Township commonly known as Mount Gretna and as shown on Appendix 1. The Board of Supervisors has determined that due to the area s topography, lack of a public water supply, the proximity of the homes to one another and the surrounding State Game lands with its heavy under brush and tree canopy that open burning shall be prohibited within the Mount Gretna Area of the Township. A property owner within the Mount Gretna Area may burn tree and shrub clippings a maximum of two (2) times per year in a noncombustible container providing that all conditions in Sections 4 through 11 are met and that the South Londonderry Township Police Department and the Lebanon Emergency Management Agency are notified. The Board of Supervisors may also authorize additional burning if severe storms cause excessive debris to be deposited within the Mount Gretna Area. Section 13: UNCONTAINED FIRE: On properties of five (5) acres or more uncontained fires are permitted provided that the conditions in Sections 4 and 6 through 11 are met. On properties of 2-5 acres, adjoining property owner can combine their acreage to create a single location for an uncontained fire provided they have written authorization from each neighbor. Such consent shall be in writing and available for inspection should it be requested by the Code Enforcement Officer or a South Londonderry Township Police Officer and submitted with the open burning permit application. Section 14: MORATORIUM: The Chairman of the Board of Supervisors, or another member of the Board in his/her absence, may establish a moratorium on outdoor burning at any time due to severe drought, or other hazardous climatic conditions. Said moratorium shall remain in effect until the next regularly scheduled meeting of the Board of Supervisors at which time, the Board of Supervisors may extend the moratorium on burning. Section 15: PERMIT REQUIRED: For Properties of five (5) acres or less, open burning shall be allowed after obtaining a permit for one year from the Township Code Enforcement Official for the burning of tree and shrub clippings, leaves and an air curtain destructor and after conditions in Sections 4 through 13 are met. Section 16: PERMIT FEES: Fees for permits shall be as established by the Board of Supervisors and shall accompany all applications for open burning permits. Section 17: VALIDITY: If any clause, section or part of this Ordinance is for any reason found to be unconstitutional, illegal or invalid, such unconstitionality, illegality, or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, sections or parts of this Ordinance. It is hereby declared to be the intent of the Board of Supervisors that this Ordinance would have been adopted had such unconstitutionality, illegality, or invalidity not been included herein. Section 18: PENALTIES: Any person, firm or corporation violating the provisions of this Ordinance upon conviction before a District Magistrate or Court of Common Pleas of Lebanon County

5 shall be subject to pay a fine of not less than $ nor more than $1, and costs of prosecution, and in default thereof imprisonment in Lebanon County Prison for period not to exceed ninety (90) days. Section 19: REPEALER: All ordinances or parts thereof inconsistent herewith are hereby repealed.
