1 UNIVERSITY OF WASHINGTON SHORT TERM RESIDENTIAL LEASE UNDER 12 MONTHS & UNDER $10, THIS AGREEMENT is by and between the BOARD OF REGENTS OF THE UNIVERSITY OF WASHINGTON, an agency of the State of Washington ("University") as tenant and, a (circle one) corporation/individual/llc/partnership ("Landlord"), and is dated,, RESIDENCE. The University agrees to lease from Landlord a (describe dwelling) residence ( Residence ) located at (Address) (City) (County) (State) (Zip). 2. USE OF RESIDENCE. The purpose of this Lease is housing for the University's. 3. TERM. The term of this Lease shall be from, 200_ to 200_. 4. RENT. The University shall pay Landlord as rent, the sum of $ per month in advance at Landlord s address set forth in paragraph 7. Rent shall be paid for each month during the term indicated in Section 3 above. Rent for a partial month shall be prorated. Total rent paid under the terms of this Lease (monthly rent amount x total number of months) shall not exceed $10,000. The University agrees that at the end of this Lease the Landlord may assess a cleaning fee (not to exceed $ ) in the event the Residence is returned to Landlord in an unclean condition. The determination of the condition of cleanliness shall be at the Landlord s reasonable discretion, based on written move-in and move-out inspections.
2 6. UTILITIES. The parties indicated below (check each one) shall timely pay for the services and utilities supplied to the Residence: Landlord University Electric Gas Water Sewer Trash Garden Service (Other) 7. ADDRESSES. TENANT: LANDLORD: University of Washington Real Estate Office Fifth Avenue, Suite 400 Seattle, Washington Phone: (206) FAX: (206) USE OF RESIDENCE. The University shall enjoy exclusive and sole use of the Residence. The University shall comply with all laws, rules, orders, regulations or requirements relating to use and occupancy of the Residence, and shall not allow waste or nuisance to be committed on the Residence. At the expiration or earlier termination of this Lease the University agrees to deliver possession of the Residence in as good condition as when received from Landlord excepting (i) ordinary wear and tear, and (ii) damage caused by fire, act of war, terrorism or other casualty. 9. POSSESSION. In the event of Landlord's inability to deliver possession of the Residence at the commencement of the Lease term, the University shall not be liable for any rent until such time as Landlord actually delivers possession. Prior to Lease commencement, and from time to time during the term of the Lease at University s request, Landlord shall provide University with keys sufficient for University s purposes in the Residence at no additional cost. 10. QUIET ENJOYMENT. Landlord covenants that as of the date of commencement of the term of this Lease, Landlord will have good right to lease the Residence for the purpose and uses stated herein and the University shall have and quietly enjoy the Residence for the term of this Lease. During any period of interruption of University s quite enjoyment, the then current Rent shall be reduced in proportion that University s use and enjoyment of the Residence is impaired. 11. REPAIRS AND GOOD ORDER. All repairs necessary to keep the Residence in a good and tenantable condition and in compliance with all laws, rules and regulations shall be done under Landlord's direction at Landlord's expense. The University shall reimburse Landlord for the reasonable cost of repairing damage to the Residence caused by the University, its officers, employees, and agents except to the extent otherwise covered by Landlord s insurance.
3 12. LANDLORD'S ACCESS. Landlord may enter the Residence for the purpose of showing the Residence to prospective tenants for a period of days prior to expiration of the Lease term, upon 24-hour notice to the University or such other period as is required under local laws governing residential tenancies. Landlord shall minimize the disruption to University occasioned by Landlord s access. 13. DAMAGE OR DESTRUCTION. In the event of damage to the Residence by fire or other casualty, such damage shall be repaired by and at the expense of Landlord, commencing as soon as possible after the occurrence of such damage. Until such repairs are complete, rent shall be abated in proportion that University s use and enjoyment of the Residence is reduced as a result of such damage. University, at its option, may elect to terminate the lease in the case of damage that materially interferes with principal use of the Residence. 14. INDEMNIFICATION. Each party shall defend, indemnify and hold the other harmless from and against any damage, loss or liability from injuries to persons or property arising from negligent acts or omissions of their respective agents, officers and employees acting in the scope of their employment. 15. LANDLORD S INSURANCE. Landlord shall maintain a policy of general liability insurance with a combined single limit of not less than $1,000,000 per occurrence and $2,000,000 aggregate for bodily injury and property damage, insuring Landlord against liability arising out of the ownership, use, occupancy or maintenance of the Residence. Landlord s insurance shall be issued by insurance companies authorized to do business in the State in which the Residence is located. 16. DEFAULT. Neither party shall be in default in the performance of any of its obligations contained in this Lease unless and until that party shall have failed to perform or to commence performance of such obligation within the lesser of the statutory timeframes for obligations of Landlord, or ten (10) days. 17 SUCCESSORS AND ASSIGNS. This Lease shall be binding upon and inure to the benefit of the legal representatives, successors, heirs and assigns of the parties. 18. HOLD OVER. If the University continues to occupy the Residence after expiration of the Lease term, such occupancy shall constitute a month-to-month tenancy subject to all of the terms of this Lease at the then current rental rate, and may be terminated as provided by the laws of the State of Washington. 19. NON-WAIVER. The failure of either Landlord or the University to insist upon strict performance of any of the covenants and agreements of this Lease shall not be construed as a waiver thereof. Waiver of a particular breach or default shall not be deemed to be a waiver of any subsequent breach or default. 20. NOTICES. Notices to tenant under this Lease shall be in writing and delivered in person or sent by regular mail to the University at the above address and to the tenant at the Residence, US postage prepaid. Notice shall be effective as of actual delivery in the case of delivery in person, or three business days after postmark time and date, if sent by US mail. Notices to Landlord under this Lease shall be in writing and delivered US postage prepaid at the above address. 21. ATTORNEYS' FEES. In the event any action, suit or proceeding is commenced under or in connection with this Lease, the losing party shall pay to the prevailing party all of its reasonable attorneys' fees and costs incurred in connection therewith.
