Otherwise the subscriber shall pay the price shown in the column O 2 TV separate. C. D. E. F. G. H. I. J. K. L. A. PRICES and CONDITIONS of basic services 7. Common provisions for O 2 TV tariffs and channel portfolio packages The digital O 2 TV service (with the exception of the O 2 TV Business tariff) is designed specifically for a personal use of the Subscriber. Commercial or business use and any public use of the digital O 2 TV service (with the exception of the O 2 T Business tariff) is expressly banned. If the Subscriber uses the digital O 2 TV service for a public broadcasting and they do not have the O 2 TV Business tariff arranged, their tariff will automatically get changed to the O 2 TV Business tariff. The broadcasting hours of Hustler TV, Daring! TV, Dorcel TV, SuperOne, EroXXX, XMO and Dusk are each day from 22:00 to 05:00 resp. from 22:00 to 06:00 (TV Leo). All channels within the Private plus complementary offer contain erotic and sexual materials. The Subscriber agrees that he/she does not find the materials offensive, disturbing or harmful and that the order is made voluntarily and also that he/she will not give this material (or allow access to it) to minors or other people who may find the sexual content offensive, disturbing or harmful. If a subscriber contract for the O 2 TV service is terminated earlier than the Subscriber has made all payments for the hardware all outstanding payments will become due and the Subscriber will be obliged to pay the service charges to O 2 immediately. If the Subscriber fails to pay any of the payments for hardware all outstanding payments will become due and the Subscriber will be obliged to pay the service charges to O 2 immediately. When requested by the Subscriber O 2 will make it possible for the Subscriber, during the effective period of the contract of O 2 TV, to pay the outstanding amount of fees for the hardware. The price for relocation within a building, moving and transfer of the O 2 Internet connection service is included in the monthly price for tariff services. The O 2 TV digital television service can be set up only if the subscriber line has sufficient capacity. Subscribers asking for the installation of the Service may be asked by O 2 to deposit a certain amount of cash for buying goods within the Special offer or another discount event. This deposit will be automatically returned to the subscriber as long as: all the invoices for services delivered in three (3) consecutive months following the payment of the deposit are paid in correct amount and time, the subscriber has no outstanding debt and his/her service has not been reduced or suspended (due to payment delinquency) over the recent 12 months. Subscribers buying services whose value exceeds CZK 500 may be asked to deposit an extraordinary amount of cash of the maximum of 5 times the debt + price of services purchased in the monitored period. This does not apply to amounts below CZK 500. The extra deposit will be returned following the relevant terms & conditions specified when placing the request for the deposit. In the case there is reasonable suspicion that the Subscriber may not fulfil his commitments under the Contract and the General Terms and Conditions (in particular when recorded in the SOLUS register or a similar register or misusing services), O 2 shall have the right to ask the subscriber to deposit a reasonable amount of cash up to CZK 10,000. The deposit will be returned based on a written request of the subscriber at the earliest 12 months from the completion of the Specifications; all this is conditioned by the Subscriber s clean payment history (no overdue payments, no outstanding debt, no reduced / suspended service due to payment delinquency in the recent 12-month period). All deposits will be returned by the end of the contract period unless used for the settlement of the Subscriber s debt to O 2. HD is the name of a television broadcasting format (HD stands for High Definition). A TV set with full HD or HD ready uses an HDMI cable to connect to a set-top-box. The user guide is available at www.o2tv.cz. The superb quality of the HD technology depends on the adequate quality of the PBX line. Details on service availability can be found at the website of O 2 www.o2tv.cz Misuse of a benefit - granted as part of a marketing campaign - means, but not only, the exploitation of benefit primarily in order to gain financial or non-financial profit for the subscriber or a third party at the cost of O 2 or the usage of benefit in access of the defined limit. In such a case, O 2 may apply standard per-unit rates. Misuse of benefit/s is prohibited. M. For current subscribers with tariff activated to 8th May 2011 are applied prices and conditions stated in list of O 2 Internet connection from 1st May 2013. From 8 February 2014 the subscribers (consumers) who terminate the Special offer service earlier than set in the contract by notice or after a mutual agreement between the parties may be charged by O 2 at 20% of monthly fee (according to current monthly fee incl. VAT) remaining till the end of the agreed end of contract. The subsribers (non-consumers) who terminate the Special offer service earlier that set in the contract by notice o rafter a mutual agreement between the parties, O 2 is entitled to charge the subscriber lump sum compensation for early termination of service equal to the sum of the monthly fees (according to current monthly fee incl. VAT) remaining till the end of the agreed end of contract. If the subscriber using both O 2 TV (digital) and O 2 Internet connection on the same access line (including on the xdsl technological platform provided by another operator) asks for the change of the internet provider while preserving the O 2 TV (digital) service, O 2 may agree with the subscriber on the interruption of the O 2 TV (digital) service for a time interval needed for the de-installation of the service from the current provider and the installation of the service to the new provider. During the interruption, no charges will be applied. Once the change has been implemented, the service will be fully restored in the original setup. Any TV program package from the additional O 2 TV channel offer can be ordered for a minimum period of 30 days. In case of submit an application for cancellation TV program package from the additional O 2 TV channel offer before this deadline, the package will be canceled after its expiration. The subscriber is entitled to a discount of CZK 50 incl.vat for fourth and every other even additional package ordered from an additional channel offer to O 2 TV Flexi tariff. Each subscriber, who between October 1, 2014 and February 28, 2015, paid the price more than CZK 400 incl. VAT (CZK 330,58 exl. VAT) / billing period for O 2 TV digital television service provided via fixed line and established an O 2 TV provided by other devices service complementary service in the same period, can use an O 2 TV provided by other devices service complementary service within this price, when paying the price more than CZK 400 incl. VAT (CZK 330,58 exl. VAT) / billing period for O 2 TV digital television service provided via fixed line. The subscribers, who activated O 2 TV Start tariff before February 8, 2015, from April 4, 2015 the O 2 TV Start tariff terms will be changed on O 2 TV Flexi tariff terms with Styl and Dokumenty packages for CZK 199 incl. VAT (CZK 164,46 excl. VAT) / billing period. If the subcriber, at his own request after the date of change in the previous sentence, change the service setting on other than O 2 TV Flexi with Styl and Dokumenty packages, will pay a standard list price for this contracted services. The change of tariff is possible on a request of the subscriber at the earliest 30 days from the last change of tariff. U. Each Subscriber (a natural person registered by their birth certificate number) who activates the add-on bundle Kino with the O 2 TV M or O 2 TV L tariffs from January 1, 2017 until March 31, 2017, will pay CZK 200 with VAT (CZK 165.29 without VAT)/billing period for the Kino bundle for the subsidized period. 2. HBO GO A. Each subscriber, who between July 1, 2015 and June 30, 2017, uses packages such as Kino, the O 2 TV XL tariff or O 2 TV Air XL tariff with their tariff offer, have the opportunity to use a HBO GO service for the monthly price of the O 2 TV (digital) service. HBO GO as a service is not subject to separate charges. C. D. E. HBO GO enables the user to access the HBO TV channel and watch by streaming various movies and film series from the HBO production on an electronic device such as PC, laptop, tablet or smartphone. The HBO GO can be used on up to 4 electronic devices. The maximum of simultaneously watched TV programs is two. Users can use the O 2 TV service via the set-top-box while watching another TV program on the TV screen. Terms and conditions of HBO GO including data connection parameters can be found at www.hbogo.cz (section called Conditions of the use of HBO GO ). Access to Internet is not part of the HBO GO service. Users who wish to use HBO GO must be registered at www.hbogo.cz through a validation code. After re-starting the set-top-box, users can get this validation code from the O 2 TV menu on the TV screen (section Archive, item HBO GO). 3. Special offer - O 2 TV M, L, XL tariffs separately for a beneficial price A. C. D. E. F. G. Each current Subscriber (a natural person registered with their birth certificate number), who, between January 1 and 31, 2017, uses this Special offer and newly activates O 2 TV digital television service without O 2 Internet connection with M, L or XL tariff with 12months-commitment, gets the following bonus: The participant will pay a special fee of CZK 399 with VAT (CZK 329.75 without VAT)/billing period for the use of the O 2 TV M tariff, CZK 499 with VAT (412.40 without VAT)/billing period for the use of the O 2 TV L tariff, CZK 849 with VAT (701.65 without VAT)/billing period for the use of the O 2 TV XL tariff for the time when the Special Offer is valid. The monthly price of the service includes a monthly price for the add-on O 2 TV provided on other devices service. The Subscriber can buy a Basic DSL WiFi modem for the price of CZK 500 with VAT (CZK 413.22 without VAT) at the same time when they activate digital O 2 TV. The Special Offer is conditioned by the commitment to use the service continuously and to pay for it properly and on time for the period of 12 months. Once the period of 12 months runs out the commitment is automatically prolonged by the same period (automatic prolonging). Nevertheless the Subscriber has the right to decline this automatic prolonging at any point in the future. If the Subscriber refuses the automatic prolonging, they lose their right to claim the benefit provided by this Special Offer when the commitment period runs out and their tariff is automatically changed to a corresponding tariff without a commitment. The Subscriber is entitled to the automatic prolonging of the Special offer only in case that they have covered all the due commitments on the Connection Line where the service is provided. Offer based on these conditions cannot be used by Subscribers who cannot have the service set up for technical reasons at the time when the request for service activation is submitted. The providing of benefits based on this Special Offer based on these conditions is conditioned by the request for service activation being submitted properly and on time at O 2 in the period specified in Article A. If the Subscriber cancels the O 2 Internet Connection service during the subsidized period, they lose their right to claim benefits provided as part of the digital O 2 TV service based on this offer. The O 2 Multi service cannot be used to cover the price of the set-top-box. The offer based on these conditions cannot be used by subscribers if the service activation cannot be carried out at their location for technical reasons at the time when they submit the request for service activation. One of the conditions for the awarding of benefits and discounts arising from the offer is that the request for service installation must be submitted to O 2 in time and in a correct manner meeting the deadline specified in point A. The monthly price of the service includes a monthly price for the add-on O 2 TV provided on other devices service. The Special Offer O 2 Internet Bundle is conditioned by the commitment to use both services continuously and to pay for them properly and on time for the period of 12 months. In the case of the establishment of O 2 TV M, O 2 TV L or O 2 TV XL tariffs to the current service O 2 Internet connection with the commitment will be a renewed the commitment of O 2 Internet connection service at the date of this Special Offer. All the Subscribers to the O 2 TV M tariff are entitled to a benefit in the form of a discount worth CZK 375 with VAT (CZK 209.92 without VAT) to purchase a WiFi repeater TPLink WA850RE between January 1 and 31, 2017. The discount may be utilized via a discount code that can be requested at brand shops, on a customer care line, or at www.o2.cz. A Subscriber can apply only one discount during the advantageous period. 11. Internet Bundle + TV with tablet A. This benefit is designed for the subscribers (natural persons registered based on their birth certificate number) who based on being approached by O 2 newly set up the O 2 digital TV services with the O 2 TV M, O 2 TV L, and O 2 TV XL tariffs and an O 2 Internet Connection with the Internet Optimal Plus or Internet Aktiv Plus tariffs from December 1 until 9, 2016, or until the stocks of tablet are sold out; they will commit to use both the services with the arranged tariffs without any interruptions and to pay for these services properly and on time for the period of 12 months, they will purchase a set-top box based on standard terms and conditions and they will activate electronic billing with billing being sent to their email address. O 2 will approach those people interested in a service who will use the Call Me Back button at www.o2.cz and who will submit their contact phone number or who will check the availability of the Internet Connection or O 2 digital TV services and who will fill in all the requested details. C. D. E. F. G. H. I. J. An Alcatel PIXI 3 7 WiFi tablet worth CZK 1,595 with VAT (CZK 1,318.18 without VAT) will be sent to the subscriber who meets all the terms and conditions based on articles A, H, I, J, and K within 21 days from activating the services based on article A at the earliest; the tablet will be sent via a courier service to the Subscriber s address where we will send the self-installing package as well. The tablet will be sent to the subscriber based on the condition that at the time the tablet is sent the subscriber properly uses services based on point A and they have not submitted a request to have them cancelled or to withdraw from the contract for these services. There are only 600 pieces of the Alcatel PIXI 3 7 WiFi tablets in stock, once the stock is used up the Alcatel PIXI 4 7 WiFi of the same value will be sent out. If the courier service does not manage to get hold of the customer, the subscriber has the right to request the tablet no later than two months from the end of the offer. The courier service will hand over the tablet based on the presentation of two identification documents, one of these must be the identification card and the other one can be any document with a photograph issued by the state or a birth certificate. The handing over of the tablet is conditioned by the subscriber s agreement to have a copy of their identification card archived and to pay CZK 1 with VAT (CZK 0.83 without VAT) from the standard price of the tablet. The tablet cannot be handed over to a subscriber who has submitted a request to cancel the services, a request to lower the service tariff to the Start tariff, or who has submitted a request to withdraw from the services. The subscriber can receive the tablet only in person, they cannot be represented by a different person. If the subscriber receives the tablet in agreement with article C and they meet the condition to have a subsidized price acknowledged based on articles E and G, they pay a subsidized price for the tablet, which is by CZK 1,594 with VAT (CZK 1,317.26 without VAT) lower than the standard price of the tablet. The subscriber is only entitled to the subsidized price if they fulfil the commitment to use both the services with the originally agreed on or a higher internet tariff without any interruptions and to pay for these services properly and on time for a period of 12 months. If a subscriber who received a tablet infringes their commitment to use both the services without any interruptions and with the internet tariff agreed on when the services were activated and to pay for these services properly and on time for a period of 12 months, they lose their right to the subsidized price of the purchased tablet and they are obliged to subsequently pay O 2 the amount corresponding to the price subsidy of CZK 1,594 with VAT (CZK 1,317.26) that was provided to them when they bought the tablet. The subscriber does not lose their right to claim the subsidized price if they increase the tariff of services. If the data in the subscriber s identification card does not correspond to the data that the subscriber shared with O 2 when ordering the service according to article A, the subscriber loses their right to claim the benefit. The offer subject to the terms and conditions cannot be delivered for Subscribers whose technical conditions disallow the installation of the service at time of application. A gaming mouse RAZER worth CZK 2,000 with VAT (CZK 1,652.89 without VAT) will be sent to the subscriber who meets all the terms and conditions based on articles A, H, I, J, and K within 21 days from activating the service based on article A at the earliest; the gaming mouse will be sent via a courier service to the Subscriber s address where we will send the self-installing package as well. The Subscriber of the services must have available for set-top-box an internet connection with minimal speed of 6 Mbit/s, for electronic devices with minimal speed of 0,5 Mbit/s. O 2 is not responsible for subscribers hardware and software equipment. Ensuring of internet connection is not part of O 2 TV Air and O 2 TV provided by other devices. Detailed conditions of O 2 TV Air and O 2 TV provided by other devices are described in the commercial terms and conditions of the O 2 Videotéka and O 2 TV Air services, which are available at www.o2tv.cz. O 2 provides the subscriber a virtual storage space for recording of television broadcasts acquired by the subscriber for his personal use. The subscriber can enter a recording through the O 2 TV menu or web site https://www.o2tv.cz/program/ or O 2 TV application. The subscriber can record multiple programs at once. Programs on adult channels, HDTV channel, ČT regional channel cannot be recorded. All recordings are accessible via TV menu. O 2 is not responsible for recordings content acquired by subscriber. O 2 is authorized unilaterally to change a storage capacity, storing recordings time or TV program extent. These changes cannot be considered as a worsening of terms. I. The fees for the O 2 TV Sport Na den can be settled using an online payment or a text message. Subscribers to electronic communications services provided by O 2 can carry out the payment using the O 2 Active portal and the sum for services is then included in the billing for electronic communications services or deducted from their credit. Subscribers to voice services of electronic communications of other mobile providers pay for the service via Premium SMS messages. A customer can use a payment via a Premium SMS message only if they have this service activated by their mobile provider. If a customer uses a prepaid SIM card, they need to have sufficient credit. Airtoy a.s. arranges the Premium SMS service for O 2 Czech Republic a.s. technically. More information at www.platmobilem.cz. Complaints about payments carried out via Premium SMS messages are dealt with at 602 777 555, Mon-Fri, 9 to 5; in case of payments via O 2 Active the complaint is submitted in the same way as complaints about billings for electronic communications services. It is also possible to use a payment card or a Master Pass button to pay for the service. The customer is then redirected to a payment gate where they enter their payment details.
