Introduction Pursuant to state law and the University Administrative Policy Statement on Exemptions from the State Personnel System, the following campus policy specifies the method and manner by which positions at the University of Colorado Denver (UC Denver) will be exempted and how such exempt positions will be periodically reviewed to ensure that they continue to meet exemption criteria. The statute and policy define the exemption criteria and require annual reporting to the State Personnel Director. B. Table of Contents A. Introduction B. Table of Contents C. Exemption Process D. Process for New or Vacant Positions The following steps apply to the exemption of new or vacant non-faculty positions from the State Personnel System: a. For new, newly exempted or modified positions, the department, school or college will a job description, organizational chart and the proposed salary range to Human Resources. It is recommended that the appointing authority contact Human Resources to discuss the new or vacant position before completing the job description. b. The job description will be reviewed by Human Resources to determine if the position meets the exemption criteria as outlined in campus and university policies and state statute. 1
2 c. Human Resources will notify the appointing authority of the preliminary approval and appoint a member of the Human Resources staff to the search committee. d. Unless there is a current, signed job description already on file in Human Resources, the official job description must be signed by the appropriate Vice Chancellor, Associate Vice Chancellor, Assistant Vice Chancellor or Dean and the Human Resources Director. The original will be maintained in Human Resources and a copy will be returned to the department, school or college. e. The department must create or make any modifications to existing positions in Manage Positions in HRMS for approval by Human Resources. f. Human Resources will prepare periodic exemption reports for the Chancellor s approval. No vacant positions will be reviewed by Human Resources for exemption without the formal request and job description from the department, school or college. 2. Process for Encumbered Classified Positions a. The employee must initiate the inquiry about such exemption in writing to Human Resources (mail or ). b. Human Resources will provide information about the differences between classified and exempt employment, invite the employee to ask any additional questions and advise him/her to provide a written request that his/her position be reviewed for exemption, if that is how s/he elects to proceed. The department, school or college will a job description, organizational chart and the proposed salary range to Human Resources. It is recommended that the appointing authority contact the campus Human Resources Director or HR Consultant to discuss the position before completing the job description. c. The job description will be reviewed by Human Resources to determine if the position meets the exemption criteria as outlined in campus and university policies and state statute. d. Human Resources will notify the appointing authority of the preliminary approval. e. The official job description must be signed by the appropriate Vice Chancellor, Associate Vice Chancellor, Assistant Vice Chancellor or Dean and the Human Resources Director. The original will be maintained in Human Resources and a copy will be returned to the department, school or college. f. The department must create or make any modifications to existing positions in Manage Positions in HRMS for approval by Human Resources. g. Human Resources will prepare periodic exemption reports for the Chancellor s approval. h. The exemption of an encumbered classified position will not result in any change to the affected employee s salary unless a promotion or other established compensation adjustment would have otherwise resulted in such a change. i. The employee will confirm his/her intent to accept exempt employment by signing a waiver of State Personnel System rights and privileges and an exempt professional letter of offer which shall include the at-will employment provisions. D. Additional Definitions The University Administrative Policy Statement outlines positions that shall be designated as exempt from the state personnel system, including the definition of professional assignments. When reviewing positions for exemption, UC Denver will reference the following additional definitions to exemption related terms and concepts. 1. Academic/Academic Support/Administrative Academic and academic support positions have duties that directly relate to student services, the curriculum, faculty, teaching, research, and service. In contrast, a position that provides administrative services to a campus or university system such as budget, accounting, facilities, public safety, public relations, human resources, institutional research, etc., are not designated as academic or academic support. 2

Officers Campus officers include the Chancellor and those individuals designated by the Board of Regents, President or Chancellor, per Regent Policy, and who typically hold the title or interim title of Vice Chancellor, Associate Vice Chancellor, Dean, Assistant Vice Chancellor or Chief Planning Officer. 3. Executive Assistants These positions serve as assistants to campus officers. The actual duties and responsibilities may vary. As officers analyze, evaluate and develop strategies, goals and policies, the executive assistants are expected to maintain personal and confidential information with the officers. Executive assistants perform administrative and technical duties in support of the officer s area of responsibility. 4. Deans The dean of each college or school serves as the principal academic and administrative officer for the college or school. 5. Directors Directors are responsible for the ongoing management of academic support, administrative or student services functions. These assignments include the development of strategies and processes that contribute to the University and/or campus mission, the analysis and management of fiscal and human resources required and accountability for services provided. E. Job Descriptions Exempt job descriptions must include the following elements. A template is available through Human Resources. 1. Working Title 2. Department, College or School 3. Ineligible Campus Classified Job Classes With the unusual exception of positions which serve as Executive Assistants to Officers of the University or that are entirely grant funded, properly classified positions in the following job classes are not eligible for exemption from the State Personnel System. Many positions in the professional job classes not listed here must also remain in the State Personnel System, based in their individual duties and/or reporting relationships, i.e., such positions are not automatically exempt from the State Personnel System and must be individually exempted, per campus and University policies and state statute. 3
