Germany, Spain, UK, France, Italy and Sweden all have more wind farm installations. Poland has fallen behind those countries that have significant potential to exploit wind energy, because we commenced investment in the sector quite late and development has been erratic. Wojciech Cetnarski President of the Polish Wind Energy Association (PWEA) There have been years with record-breaking capacity growth, followed by insignificant ones. In the year 2016 growth will be close to MW. It stems from the fact that Poland has never clearly declared its intention to develop wind energy in the long term, therefore the regulatory framework lacks stability and predictability - yet the potential for the wind power in Poland is still huge. Since the adoption of the Energy Law that introduced the green certificates (GC) scheme the Law has been amended more than a dozen times. A crucial amendment was announced in Everyone expected an adjustment to the green certificates scheme; however, after several years of governmental and parliamentary works it was announced that the GCs will be phased out and we will receive an entirely new regulation introducing contracts for differences (CfD) granted under an auction scheme. Such instability of a support scheme does not foster dynamic wind energy development. Therefore, the industry s potential (estimated at 8-9 thousand MW) will not be sufficiently exploited in the 2020 perspective. Poland will face issues with fulfilling its commitments under the climate package to be settled in We will have to demonstrate 15% of energy from renewable sources in overall energy volume, including 19% of electricity. In my opinion we will also fail to achieve the assumed figures for renewable heat and transport fuels. 6 Advisory called statistical transfers. It may entail substantial amounts, ranging from several hundred million to PLN 1.5 billion. In the most pessimistic scenario the figure may exceed PLN 2 billion. For several years we could observe increased interest in our country among wind energy equipment manufacturers and wind energy investors. Poland attracted two companies producing rotor blades. We have turbine automation designers and producers as well as steel tower suppliers. The offshore component manufacture sector is very well developed. One of the flagship investments of the sector is the offshore foundation plant in Szczecin. This large industry is working for the wind energy sector, however offshore products are export-only. Considering wind farms commissioned within the last few years the share of Polish enterprises, contractors, and business partners manufacturing wind turbine components has reached 30-40%. The figure may increase substantially if only Poland opens politically to further wind energy development. Investors need a clear declaration that we are interested in the sector, for only then may we expect them to create new jobs in Poland. The Polish green certificate-based wind energy market was perceived by foreign investors as high-risk, because the scheme was inefficiently managed and created risks the investors are very sensitive to. For instance, one allowed a vast oversupply of certificates to develop, which could have been avoided by skilful adjustment of the certificate demand policy. Facing a change to the support scheme, effective last year with the adoption of the new Renewable Energy Sources Act introducing the auction-based CfD scheme, investors interest increased, for such a scheme is considered more predictable. This was a new opening for the sector despite ongoing issues with the green certificates scheme, since the new scheme carries much less risk. However, soon after the adoption of the RES Act, following political changes the new government has announced that it will postpone the effective date of the new scheme, with the intention to modify the original assumptions. This yet again results in market uncertainty, with Poland being perceived as an unstable and unpredictable country. The market is waiting whether the changes will become effective on 1 July or be postponed yet again. Only after the investors become acquainted with the new ideas developed by the government will they decide to commit their resources to the new legal environment - or to move on to investment in other markets. Wojciech Cetnarski, President of the Polish Wind Energy Association (PWEA) Last year the renewable energy sector worldwide attracted USD 329 billion of investments, of which approximately USD 1.8 billion was received by the Polish energy sector. These figures clearly demonstrate that our market is not a leading one. Investors simply choose countries that might ensure less profit, but at a lower risk. In Poland one of the substantial issues is its unstable legal environment. Poland has to plan a transition from a coal-based energy system to a system with much less coal share. Coal, which has been the foundation of our energy sector, is slowly starting to end. Lignite deposits will be depleted within the next years. Public consent to the construction of further open-pit mines is rather unlike. As regards hard coal, given the market prices the operation of most Polish mines will soon become unprofitable. Therefore, in 10 to 15 years we will face a substantial coal gap. If we do not switch our energy sector to renewables, primarily wind and PV, we will have to import large quantities of coal. Considering various plans being developed in the Polish energy sector, the share of wind may reach 20% by 2030 (32-42 TWh depending on electricity production in Poland in 2030), whereas the system will remain very efficient, safe, stable and inexpensive. Year by year wind farms produce an increasing volume of electricity. For example, last year the production figures exceeded 10 TWh. Within the next 5-10 years the support period for many wind farms already in operation will start to expire, hence the cost of energy will decrease. Every year more and more turbines will enter such a mode. Last year saw the installation of approximately 1200 MW of new wind installations. The exact figure is unknown yet, for there is no coherent scheme for the collection of such data in Poland. However, it has to be emphasized that the year was very good, much better than This was caused, among others, by everyone s willingness to complete investments under the old support scheme, for the new is still a riddle for investors. It is very likely that no investment will be commissioned this year; some commenced projects may be finished by 1 July. Their capacity is estimated at MW. This is really nothing. We have to wait for the situation to change under the auction scheme. Unless the planned amendment introduces adjustments to the support scheme, in 2017 the situation should improve, and be much better in It shall be remembered that the auction scheme is a specific mechanism for awarding public aid. The complete fiasco of the recent Spanish auction clearly demonstrates this. This leads to difficulties in acquiring bank financing and investors for such projects. A prerequisite for participation in an auction is the possession of a building permit and the payment of a relatively low deposit, hence the risk of loss of the deposit is insufficient to deter risky bids. RES auctions will be subject to underbidding risk. The deadline for commissioning of a project is four years from the end date of an auction. During that period it is unknown if the projects will be completed in line with declarations. Therefore, if an auction is settled at the end of 2016, we will know the actual completion rate at the end of I hope that the amendment to the RES Act will rectify these and other imperfections, and the vast potential of wind energy in Poland will not be wasted. n 6 Wind Energy Poland 2016

7 Hubert Wysoczański, Karol Lasocki K&L Gates Last year Poland added a record 1.3GW of new wind capacity and became the second biggest wind installer in the EU. The rapid growth was spurred by the expected transition from the green certificates system to the auction system, which was due to take place on 1st January Due to a last-minute change by the newly elected parliament, the auction system has been postponed for 6 months, until 1st July This happened not because of any technical issues, as the Energy Regulatory Office is ready to hold the tender, but mostly due to the failure of the former government to present the new support system for approval to the EU Commission before the auction system kicks in. Speculation is now rife whether approval will come soon enough to avoid further postponement of the auctions. The Commission may also demand some changes to the scheme and condition its approval on their implementation. Nevertheless, the auction system should enter into force by the end of this year, since the EU state aid rules for energy generally mandate that from 2017 state aid needs to be granted in competitive tenders. Meanwhile, a new development has shaken the industry. On 19th February a draft bill on wind farm investments was presented by MPs of the ruling Law and Justice Party. It aims to tightly regulate the location of wind farms near housing and environmental protection areas. The draft provides for a minimum distance of ten times the turbine height (with blade) between a wind turbine and the nearest settlement. With turbine heights of up to 200 meters, this would mean a permitted distance of approximately 2 km - certainly not a well thought-out rule for a densely populated country like Poland. A similar 10H rule was introduced in Bavaria in 2014, which turned out to be a death blow to the state s once flourishing wind industry. Advisory A year of change for the industry between auctions and the minimum distance rule There are big hopes but also many unknowns for the final four years of the Polish 2020 perspective. Auctions should bring stability but new obstacles are appearing on the horizon. Hubert Wysoczański WEP Karol Lasocki, WEP The draft law also aims at introducing new substantial financial burdens, such as a real estate tax calculated on the basis of an entire wind turbine (currently the value of mechanical parts does not constitute the basis for taxation) and an additional biannual fee calculated as 1% of the value of the entire wind power plant investment. This new fee is a payment for an inspection and an additional exploitation permit issued every two years by the Office of Technical Inspection for each wind turbine. The building permits currently held by investors that do not meet the distance requirements are to be valid for three years - by that time the turbines must be built and fully permitted for use. If no building permit has been issued for the investment by the time the new law enters into force, the WZ location decisions and local zoning plans (MPZP) that do not conform to the proposed minimum distance, will not be honored. On a more positive note, the wind industry has welcomed the fact that 1st January 2016 was kept as the effective date for the provisions decreasing support for co-firing (factor 0.5) and for large hydro (no support). These changes to the green certificates system are helping to neutralize the oversupply on the green certificates market. The first indications are that trading prices of certificates are showing a slight increase from the December 2015 level. Prices of green certificates are expected to rise in the next few years. 8 Advisory Further Onshore Wind Development Under Question In mid-february the Ministry of Energy officially confirmed that it will work on a complex amendment of the RES Act. dr Christian Schnell Partner, Radca prawny, Solivan The aim in general is to provide a more balanced RES energy mix, as onshore wind has dominated the new installed capacity in Poland since In 2015, Poland installed more onshore wind farm capacity than both France or the UK. The statement did confirm the policy approach to preferential support technologies which create additional value for Poland, i.e. promoting technologies which are produced in Poland and creating new jobs. This is a clear statement in favour of biomass firing and, even more, dedicated co-firing installations which shall promote the use of Polish coal for the next decades. Furthermore, the Ministry made a clear statement that private prosumers should not receive feed-in tariffs ( FiT ). So, the original support system proposed by the Ministry of Economy in 2014 to support private prosumers with direct investment support and additional net-metering might be again introduced in the amended RES Act. However, entrepreneurial prosumers should receive a FiT, as the Ministry indicates. Additionally, the Ministry of Energy emphasis that energy cooperatives in rural areas should be promoted. So, the RES Act amendment will be implemented jointly with the so-called Smart Metering Act to provide a technical basis for energy cooperatives. Even more, at the end of February several members of parliament from PiS parliamentarian group submitted a draft Wind Turbine Investment Act to Parliament. Already in 2012, PiS parliamentarian group filed a draft of an amendment act of building law and planning and zoning law to the Polish Parliament (Parliamentary printed paper 758), but this draft did not proceed further. It was expected that relevant changes to planning and zoning law, building law, technical supervision law, etc. to regulate wind farm investments would be proceeded jointly with the amendment of the RES Act and will change relevant existing acts. However, the aim of the Wind Turbine Investment Act ( WTI Act ) differs from printed paper 758, as it is not only changes relevant existing acts, inter alia, the RES Act, but also constitutes a special act. Under the WTI Act, the minimum distance between wind turbines between residential and protected landscape areas, etc. is 10H, i.e. 10 times tip height the Bavarian approach. The WTI Act also provides that wind turbines are to be located on the basis of a master plan, which also defines the maximum tip height. Existing master plans stay in force, however, if the location of the wind turbine does not comply with the minimum distance criteria, a building permit cannot be issued. Building permits issued on the basis of a master plan before the WTI Act enters into force, which do not comply with the minimum distance criteria, have to receive use permit before the lapse of the three-year transition period. Furthermore, under the WTI Act, zoning decisions (so-called WZ decisions) as alternative planning title to locate wind turbines will become invalid for wind turbines which do not comply with the minimum distance criteria if the WTI Act enters into force, unless the building permit which basis on the zoning decision was issued before the WTI Act enters into force. In case the wind turbine location complies with the minimum distance criteria, a building permit based on a zoning decision has to be issued before the lapse of the one-year transition period. Building permits issued on the basis of a zoning decision before the WTI Act enters into force, even if not complying with the minimum distance criteria, have to receive use permit before the lapse of the three-year transition period. Operating wind turbines will not be shut down if they do not meet the minimum distance criteria (this was one of the requirements of printed paper 758), and re-powering is not permitted. Within a year operating turbines must be certified by the technical supervisory authorities UDT. Every two years, or at the end of repair or modernization works, a new UDT certification will be required a so-called exploitation decision (in parallel to the use permit according to construction law), and without such exploitation decision no premium green certificates or contract for difference - shall be granted. Additionally, under the WTI Act, UDT certification fees for one certification should not exceed 1 percent (sic!) of the construction costs (i.e. the CAPEX for wind turbine and related construction works), whereas the Ministry of Energy shall enact further specific regulation. As new wind farms with state-of-the-art turbines would start for a contract for difference substantially below PLN 300 per MWh, a new co-firing large combustion plant requires around PLN 400 per MWh for its green electricity to crosssubsidy wholesale prices for its black energy at currently PLN 150 per MWh. So, in case state of the art wind turbines cannot be constructed due to severe distance rules, co-firing might take over its place at the technology-neutral auction system. Useless to say, that this approach would be very hard to notify at EU Commission, and in case biomass plants with more than 50 MW and co-firing plants shall be introduced into the auction system, a long-lasting notification procedure of the new auction system is more than likely and auctions will rather not take place before n 8 Wind Energy Poland 2016

9 Advisory Polish Guarantees of Origin bring additional financial revenues There is a space for mutual benefits both for energy producers and consumers. Domino Głowacka Polish Wind Energy Association Grzegorz Pyryt Axpo Polska Sp. z o.o It is the market of guarantees of origin already popular in Western Europe, and only emerging in Poland. It gives RES energy producers an opportunity for additional financial revenues, and socially responsible companies can benefit in terms of brand image. An environmentally-friendly image is gaining in importance in brand perception. As many as 38 companies from the prestigious Fortune 500 ranking have pledged to cover 100% of their energy needs from renewable sources. Of course it is not purely altruistic. A shift towards carbon efficiency is becoming a global trend, and companies who follow it know that it will improve their perception in the market and may lead to higher profits. Guarantees of Origin The most effective and Europe s most common way of switching to green energy are guarantees of origin. These official documents confirm that the energy comes from renewable sources. The enormous potential of guarantees of origin (GO) lies on the one hand in their simplicity, and on the other in the benefits they bring to companies purchasing them. They do not need their own RES installation. It is sufficient to buy a certain number of guarantees. Companies who buy those instruments reduce their carbon footprint and decrease their negative impact on the environment. They can also use carbon efficiency in their brand communication by declaring that they use renewable energy sources. That way they can strengthen their environmentally-friendly image. Moreover, investors and business partners have a more positive attitude towards companies who implement Corporate Social Responsibility (CSR) policies. Such issues may affect the choice of trading partners. This is particularly important for companies providing services to the RES sector. Guarantees of origin are taken into account both in reports on sustainable development (Greenhouse Gas Protocol) and in building certification (LEED). Guarantees of Origin in Europe and in Poland In Europe, guarantees of origin are used by organizations from various sectors of the economy, from multinational companies such as Philips, Mondelez, IKEA, to mobile network operators, stadiums, ceeenergyawards.com 9

10 Advisory or the Dutch railways, currently covering 50% of their demand for electricity from wind energy, with a goal of reaching 100% by In Poland there is still a common misconception that Poles do not care about environmental protection. However, this is contradicted by results of numerous studies. Issues related to corporate social responsibility and environmental activities are increasingly important not only for the young generation (the so-called Millennials), but for the entire society. According to TNS survey for Greenpeace, as many as 92% of Poles want more energy to come from renewable sources. Guarantees of origin were introduced in Poland based on the Act on Renewable Sources of Energy. The purchase of guarantees is voluntary, and their market launch was not supported by an information campaign. That is why the instrument was not popular among energy producers or consumers. There is a guaranteed fixed profit on each megawatthour sold. Participation in the program makes it easier to find a final customer for the issued Guarantees. Benefits for Guarantee Buyers Under the Program Apart from promoting renewable energy sources, the Polish Guarantees of Origin Program also supports companies following the sustainable growth principles by giving them access to renewable energy sources and the possibility to enjoy the benefits of the program, including marketing support and easier access to EU funding. Companies buying the guarantees of Benefits for Consumers Thanks to the Polish Guarantees of Origin marking, consumers can easily distinguish and more effectively support companies and brands who use renewable energy sources. The Polish Guarantees of Origin Program also covers the entire range of additional activities, such as various social campaigns promoting the Program and the entire RES market. One of the campaigns carried out was Solution Wind project, organized in five European countries, initiated by the European Wind Energy Association (EWEA) in relation to COP21 climate conference. Additional activities include actions in the urban space, promoting knowledge and acceptance for wind energy among local communities, as well as educational actions, such as this year s PWEA contest for the best Master thesis related to renewables. A number of companies have already joined the Polish Guarantees of Origin The next step is to register the guarantees on the sales platform: Axpo Green Platform ( This relieves the producers from the need to look for customers for their guarantees of origin, but at the same time does not limit the possibility for such search. It is worth noting that signing up for Axpo Green Platform is free of charge, and in case of expiration or withdrawal of the guarantee, the producers does not pay any fees. 11 Tilting at windmills Advisory It now seems that 2016 will be a breakthrough year for the wind industry. However, not the kind of breakthrough we were all expecting. Wojciech Sztuba, Ph.D. Managing partner, TPA Horwath Poland Despite various obstacles over the last decade, wind power could have boasted in excess of 5.2 GW on-shore capacity, with 2015 a record year, seeing the completion of investments of nearly 1.3 GW. However, such success is not due to great market conditions, but the departure of the green energy support system from the tradable green certificates scheme in favour of an auction model, already confirmed by the legislator in The new system, as more competitive and not as easy for projects with lower productivity, motivated many investors to bring forward completion dates of projects so that they still enter into use before the end of 2015 under the old tradable green certificate system. Chapter 4 of the RES Act governing the auction model was to enter into force on 1 January The first auction was to be held pursuant to these in the initial months of the year, the parameters of which were already published in Implementing Regulations. According to these, contracts for the construction of approx MW of capacity from new wind sources of more than 1 MW were to be entered into. Right from the outset it was clear that this was not a tell-tale sign of a bull market, but a profoundly more subdued, yet stable growth of this subsector. Wojciech Sztuba And yet today we find ourselves in the most unexpected circumstances. The primary reason given here is lack of stability found in wind generation as compared to biogas power plants, which are a controllable and stable source with a number of advantages stretching outside of the power generation industry, such as disposal of environmentally hazardous liquid manure. On top of that we have the recent private members bill on investments within the scope of wind power generation, pursuant to which, inter alia, an approx. 2 kilometre band is to be introduced around residential buildings where the construction of wind turbines would be prohibited. Together, these paint a picture of a cohesive political front opposing further development of wind power generation in Poland. However, the most sinister part of the said bill, one which not only targets future, but primarily facilities already in place, is the proposed broadening of the current construction law definition of a building for real property tax purposes. Since 2005, there have been no doubts as to the electrical and technical part of the wind turbine, i.e. the nacelle and the rotor, constituting more than 80% of the investment, not being part of the building subject to the said tax. Through this principle the industry was given an opportunity to grow, as we are talking about a 2 per cent tax on the gross book value of tangible assets. If we were to assume a tax charged subject to a 2 per cent rate practically on the balance sheet total of an enterprise year in year out, this would be a death blow for most active wind farms. The draft bill on investments within the scope of wind power generation contains just such a regulation, which is a threat to the existence of current projects and will prove an effective stumbling block in the construction of new ones. In the past, a certain dose of aversion to wind power was evident from the industrial power generation, as well as the power transmission and distribution sectors, to a large extent burdened with problems associated with connecting and balancing wind farms. To a certain extent that was understandable. However, that lobby is now joined by the agricultural biogas lobby as well as a baggage of non-scientific beliefs and aversions of politicians, who, for many years, have been against wind energy.
