The guide s purpose is to provide a resource for all health employers (ot just hospitals) seekig work-based learig parterships with local K-12 istitutios. Not oly is it iteded to be used by employers developig such a program, it ca also serve as a valuable tool for existig work-based learig programs. The guide presets a spectrum of model employer/k-12 parterships that serve as real life examples of successful programs. Califoria Partership Academies Lauched by state legislatio i 1984, the Califoria Partership Academies (CPAs) model is a three-year program, grades te through twelve, structured as a school-withi-a-school. There are curretly 340 fuded programs throughout Califoria. Academies icorporate itegrated academic ad career techical educatio, busiess parterships, metorig, ad iterships. CPAs represet a high school reform movemet focused o smaller learig commuities with a career theme. Motivatioal activities with private sector ivolvemet ecourage academic ad occupatioal preparatio, such as itegrated ad project-based curriculum, metor program, classroom speakers, field trips, ad exploratio of post-secodary ad career optios. Furthermore, workplace learig opportuities, such as job shadowig, studet iterships, ad voluteer experiece, erich studets educatioal experieces. Accordig to the Califoria Departmet of Educatio, research idicates that for the academic years, studets from CPAs averaged a higher pass rate tha the geeral populatio for both the Eglish Laguage Arts test ad mathematics exam o the Califoria High School Exit Exam (CAHSEE). Health Sciece Capacity Buildig Project The Califoria Health Sciece Capacity Buildig Project, authorized by the Goveror s Career Techical Educatio Iitiative, is coordiated by CDE ad the Califoria Commuity Colleges Chacellor s Office. The primary purpose of the project is to build quality pipelie programs throughout the state to prepare studets to trasitio ito health care occupatios ad post-secodary educatio programs that will result i qualified workers to meet critical health workforce shortages. Approximately forty applicats are awarded up to $75,000 i urba, suburba ad rural commuities i Califoria. CDE makes fial award determiatios based o applicatio quality ad geographic locatio. Selected programs must be structured to allow participatig studets to explore a variety of careers i health care begiig i grade seve. I grades ie through twelve, studets begi developig kowledge ad skills to prepare them for the trasitio to post-secodary educatio ad specific careers i health care. FACES for the Future Coalitio The FACES for the Future Coalitio is a collaborative of programs throughout Califoria workig to address health equity for all commuities through the traiig ad empowermet of youg people. A pipelie educatio program focused o preparig youth to become future health care leaders. FACES offers health career exploratio, academic support, psycho-social itervetio ad youth leadership developmet. The coalitio focuses o helpig youth from uderserved commuities; however, it also emphasizes the importace of educatig all youth iterested i health professios about health disparities ad the impact of culture o health care. Cosequetly, FACES provides excitig ad dyamic educatio to all youth, ad supplies ecessary tools for developig their skills as carig cliical providers. FACES goals are two-fold: (1) to trasform the lives of youg people by supportig their path to successful careers i health professios, ad (2) chagig health outcomes i uderserved commuities by diversifyig the health workforce through the presece of FACES studets i those careers. Health ad Sciece Pipelie Iitiative Health ad Sciece Pipelie Iitiative (HASPI) is a collaborative effort amog etities i Sa Diego Couty to improve studets ultimate success i health care. HASPI cosists of middle schools, high schools ad commuity colleges that are actively preparig studets for college sciece courses ad health traiig programs, ad is iteded for studets of all academic levels ad backgrouds. HASPI has three primary goals: (1) icrease health care career awareess, (2) improve performace i high school ad college sciece courses, ad (3) stregthe trasitio ad retetio rates i college programs. HASPI high school educators recogize it is imperative to expose studets to highly cotextualized scieces before they reach college, especially sice erollmet i prerequisite courses has prove to be a challege. Thus, HASPI exposes its studets to a variety of courses such as medical biology, physiology, ad sports medicie. Furthermore, HASPI esures that these courses, while providig exposure ad a uique perspective to learig, also fulfill Uiversity of Califoria ad Califoria State Uiversity requiremets. Regioal Occupatioal Ceters ad Programs Regioal Occupatioal Ceters ad Programs (ROCPs) were established i 1967 ad are fuded uder Propositio 98 through the aual Budget Act. I Califoria, there are curretly 74 ROCPs i Califoria servig 555,000 high school studets ad adults aually. ROCPs provide exemplary career educatio, career developmet ad workforce preparatio to cotribute to studet academic ad career success. ROCPs strive to prepare studets to (1) eter the workforce with the skills ad competecies ecessary to succeed, (2) pursue advaced traiig i higher educatioal istitutios, ad/or (3) upgrade existig skills ad kowledge. ROCPs were established as regioal ceters or programs to allow studets from various schools or districts to atted career techical traiig programs regardless of their geographic locatio. A study coducted by the Uiversity of Califoria i 2004 compared studets i 21 ROCPs throughout the state to a cotrol group of similar high school studets ot erolled i ROCP programs. The study foud that high school ROCP studets improved their high school grade poit averages, had better twelfth grade attedace rates ad erolled i postsecodary educatio i large umbers. The study also foud that ROCP studets eared higher wages tha compariso group peers ad had more success i securig raises ad promotios o the job. Esurig that a studet is properly classified is very importat as misclassificatio ca implicate liability for a variety of employmet related taxes, fees ad pealties. Uder Califoria law, a idividual is presumed to be a employee uless the employer ca demostrate that he/ she is either a iter or a voluteer. a. Iter The defiitio of a iter ca be foud i both state ad federal law. 1. State Labor Commissioer Opiio Letter, April 7, DOL Fact Sheet #71 The employer must be able to show that the iter/traiee is erolled i a boa fide itership or traiig program based o six criteria: 1. The traiig, eve though it icludes operatio of the employer s facilities, is similar to that which would be give i a vocatioal school; 2. The traiig is for the beefit of iters/traiees; 3. The iters/traiee do ot displace regular employees, but work uder their close observatio; 4. The employer derives o immediate advatage from the activities of iters/traiee, ad o occasio the employer s operatios may be impeded; 5. The iters/traiees are ot ecessarily etitled to a job at the coclusio of the traiig period; ad 6. The employer ad the iters/traiees uderstad they are ot etitled to wages for the time spet i traiig. b. Voluteer The defiitio of voluteer uder federal ad state law is ot as well defied. The DOL has stated the geeral rule as follows: Idividuals who voluteer or doate their services, usually o a part-time basis, for public service, religious, or humaitaria objectives, ot as employees ad without cotemplatio of pay, are ot cosidered employees of the religious, charitable, ad similar ot-forprofit orgaizatios which receive their services. It is geerally agreed that idividuals who doate their time to a hospital to miister directly to the comfort of patiets (i.e., readig, writig letters, respodig to requests for driks, sacks, etc.) are ot employees. However, whe idividuals perform work that is also performed by paid staff or work that is ot miisterig directly to the comfort of patiets, the status is less clear. Courts ad admiistrative agecies apply various multifactor tests to determie whether a idividual is a voluteer. Thus, classificatio ivolves a fact-itesive aalysis that geerally takes ito accout the followig: 1. Whether the orgaizatio is for-profit or ot-for-profit. 2. Whether the services performed by the idividual are for humaitaria, public service or religious reasos. 3. The ature of the etity receivig the services. 4. Whether the idividual performs services without cotemplatio of paymet. 5. Whether the idividual is subject to the orgaizatio s employmet policies. 6. The amout of time that it takes the idividual to complete the work. 7. Whether the idividual is reimbursed for expeses. 8. Whether the ecoomic realities idicate a employmet relatioship. 9. Whether the idividual elimiates the eed for employees or reduces the amout of work available to employees. 10. Whether the idividual siged a agreemet that reflects the parties itet to create a voluteer relatioship. 11. The amout of cotrol exercised over the voluteers. Voluteer leaders who write work rule orgaizatioal policies based solely o recommedatios ad iformatio from their peers i the voluteer sector may place their orgaizatios at risk. Examples of Youth Employmet Models The Youth Employmet & Developmet (Y.E.D.) Health Careers Academy, hosted by Cedars-Siai Medical Ceter (CSMC), provides employmet ad traiig opportuities for Los Ageles youth, selected from Fairfax High School. Y.E.D. Health Careers Academy aims to provide career exposure, work site values ad skills to high school studets. The program is desiged with three compoets: (1) schoolbased learig/health academy, (2) work-based learig (e.g. CSMC), ad (3) metorig. Together these compoets allow participats to stregthe their scholastic, techical ad work-related skills. Depedig o a class schedule, a average week for a studet i the program might iclude a work shift from 2:00 p.m.-5:00 p.m. o Moday, Wedesday, ad Friday; a Health Academy Class o Tuesday ad Thursday, madated by LA Uified School District. VI. Partership Developmet a. Hospitals are extraordiarily busy places. Last miute requests are ofte deied. Make parterig as simple as possible so that idustry parters ca egage easily. If the burde of the partership is o the employer, your chaces for success are low. Desigate a idividual or team of idividuals to oversee ad guide studets. Provide orietatio for studets oce the program begis to esure they uderstad the expectatios, rules ad how to comply with state ad federal laws ad regulatios. Provide feedback to educatio parters o a regular basis so that there is clear commuicatio about all aspects of the parterships. VII. Protectio for All a. Liability Issues I the iterest of protectig all parties, should somethig go wrog, it is a good practice to have a few thigs spelled out i writig. School will otify Agecy at least te days prior to ay chage i coverage. Upo the Agecy s request, the School shall also provide the Agecy with certificates of isurace or self-isurace. 3.
