1 PROSPECETUS Haryana PWD (Buildings, Roads & Bridges)_ Enlistment of Contractors for Class-I 1. Rules regarding the enlistment of Contractor Haryana P.W.D. (B&R) Branch has decided to amend the procedure for enlistment of contractors in Class-I for the department. It has, therefore, been decided to provide the information in this Brochure for the working and intending contractors. (i) Categories of contractors. The enlistment of the contractors has been categorized in the following classes:- ` Class of Contractor Amount upto which the Contractor can tender 1.Class-I For unlimited amount of work upto any extent 2. Class-II Upto Rs., 50,00,000/- 3. Class-III Upto Rs. 20,00,000/- 4. Class- IV Upto 5,00,000/- 5. Class-V Upto Rs. 1,00,000/- (i) The enlistment of Class-I will be done by the office of the Engineer-in- Chief, Haryana PWD B&R Branch. (ii) The enlistment of Class-II & III will henceforth be done by any of the Superintending Engineers of PWD (B&R) Branch. (iii) The enlistment of Class-IV & Class V will be done by the Executive Engineer concerned. Accordingly an application form for enlistment of contractors is enclosed in this Brochure as Annexure A to be submitted separately for (i) Building Works (ii) Bridges Works & (iii) Road Works. 2. Enlistment Fee (a) Amount of Fee As per revised instructions of Haryana Govt., the enlistment fee of different classes will be as under:- 1. Class-I Rs. 5000/- 2. Class-II Rs. 4000/- 3. Class-III Rs. 3000/- 4.Class-IV Rs.1000/- 5. Class-V Rs. 500/-

2 -2- (b) Deposit of Enlistment Fee The contractors will be at liberty to get the enlistment fee deposited in any office of Sub Divisional Engineer of this Department. The contractor will be required to produce the proof of deposit of fee while applying for enlistment,.renewal. It is clarified that there will be separate fee for each category i.e. Building Works, Road Works and Bridges Works. 3. Renewal of Enlistment The enlistment will be valid for a period of two financial years. After expiry of the period of 2 financial years, the enlistment will be required to be renewed for which the renewal fee will be 50% of the amount mentioned above against each category. The renewal will be effective for a period of 2 financial years after which further renewal will be required. 4. Application Form Application form for Class- I Contractor can be downloaded from the website of Haryana PWD B&R Deptt. or can be obtained from the office of Executive Engineer(General) C/O Engineer-in-Chief, Haryana PWD B&R Branch Plot No 1-2, Nirman Sadan, Sector-33,Chandi9garh 5. Guidelines for enlistment The following guidelines have been brought out for the information of the contractors so as to enable them to submit their applications complete in all respects. Class-I (a) The agency desirous of enlistment in this category will be required to have executed satisfactorily at least 5 works costing more than Rs lacs each during the last five years or works of an equivalent amount which means even if the contractors has undertaken one or two works costing Rs lacs or above will also be eligible. (b) The contractor will be required further to show his financial soundness, employment of Graduate Engineer or diploma holder having not less than 10 years experience, holding equipments warranted for effective execution of work. 6. List of documents to be attached with the Application Form./ (i) (ii) (iii) Certificate of immovable property with its market value duly attested by the Collector or first Class Magistrate with proof. Solvency Certificate from any Schedule Bank indicating clearly the financial position, cash in hand, in the bank or Credit Limits as per Annexure-B on letter Pad of Bank. Registered copy of Deed or Articles of Association in case the party is a Firm/Company.

3 -3- (iv) If the Firm or the Limited Company wants to get itself enlist it should produce the registered partnership deed alongwith the name of the person holding the Power of Attorney. An attested copy of the Power of Attorney should also be enclosed. (v) trucks etc. Details of the Machinery, Tools and Plants including the No. of (vi) Detail of Technical Staff permanently employed with the technical qualification with experience of each employee. (a For enlistment in Class-I qualified Engineer or diploma holder with experience is required to be employed for technical guidance. Proof regarding employment of a Degree Holder Engineer or having equivalent qualifications is required to be enclosed alongwith the application. (vii) (viii) (ix) (x) (xi) (xii) List of previous enlistment from Haryana PWD B&R or U.T. Chandigarh Admn..or any other enlisting agency. The agency should attach a list of work done duly supported by allotment letters, if any, during the last five years. Certificate from the Superintending Engineer/Executive Engineer regarding satisfactory completion of the works executed, should be enclosed. List of works tendered but not allotted should be enclosed with the application. Latest Income Tax Clearance certificate, Pan No. from the competent authority in original or an attested copy. Original receipt of fee. Original documents shall also be produced for verification if the application is found in order. (xiii) Affidavit for not Blacklisted by any Semi/Govt. Deptt. (xiv) Residential Proof. 7. Submission of application. Application Form for Class-I duly completed with all documents should be submitted in the office of Engineer-in-Chief, Haryana PWD B&R Br Chandigarh on any working day during working hours.

4 -4-8. General (i) For any enquiry/information write/contract the Executive Engineer(General) Telephone No., Office of the Engineer-in-Chief, Haryana PWD B&R Branch Chandigarh. (ii) Contractors who are near relatives of Engineering Officers in the grades of S.E/Executive Engineer and Asstt. Engineer of Haryana PWD B&R Branches; will not be allowed to tender for works in the Circle( Responsible for award and execution of contract) where their near relative is working. Contractors who are near relatives of Working. Contractors who are near relatives of Chief Engineer will not be allowed to work in the Department as a whole. NOTE By the term near relative is meant Wife,Husband,Parents,Children Brother,Sister,Brother/Sister-in-law, Son/Daughter in law, Uncle, First Cousion and Father-in-law. (iii) They should also intimate the change in their permanent address if any in future. In case they fail to intimate such changes to the Department their names be removed from the approved list of the contractors. (iv) (v) The contractor/firm shall not enter into any fresh partnership without the prior knowledge of the Department such proposals, if any shall be submitted in advance giving full detail of the attending partnership/sole-proprietorship alongwith the draft partnership deed affidavit. Any departure from this will render the Contractor/Firm liable to be removed from the approved list of Contractors of this Department. The contractors will be required to certify that they will not get themselves registered under more than one name.

5 Annexure-A Application for enlistment of Contractors. 1. (a) Name of applicant and full address (b) Place of business (Head Office and Branches) if any. Telephone No. Telegraphic address 2. Whether the firm is a Private or Public Ltd. Co. or Undivided Hindu Family or Individual registered partnership firm (Attested copies of Deeds or Articles of Association to be enclosed). 3. Name of person holding the Power of Attorney (Attested copy of power of Attorney to be enclosed). 4. Name of partners with their respective shares in the firm (Attested copy of the Partnership deed to be enclosed.) 5.(a) Name of Bankers and full address. (b) In case of Limited Liability Companies, copy of last balance sheet duly audited should be attached. Particular of immovable properties with their fresh market value(attach certificates from Dy. Commissioner/ Collector or a First Class Magistrate). 6. Class & Category in which enlistment sought.

6 2 7. Area in which the contractor wants to work. 8.Whether the contractor desires to deposit lump sum security exemption from payment of earnest money or will deposit money alongwith each tender? List of work s executed:- a) Name of work b) Amount of work executed c)year of execution d)authority under which carries out be shown in separate statement. 9. Resources of contractors:- a) Detail of Technical Staff permanently employed technical qualifications and experience of each employee. b) Details of Tools and Plants and transport etc. c) Details of workshop, if any with location. 10. For contractors seeking enlistment for Public Health Works whether the applicant is a licensed plumber or has a licensed plumber under his employment? (Attested copy of plumbing licence to be enclosed. 11. For contractor seeking enlistment as furniture contractor:- a)whether the applicant has properly fitted wood workshop and if so, give details and location of the workshop.

7 -3- b) Details of stock of timber, paints, polishes and other finishing equipment held by the applicant. c) Number of designers employed capable of producing well throughout schemes for large buildings. 12. For contractor seeking enlistment as Electrical contractor:- a) Whether the applicant possess a valid Electrical Licence (Attested copy of Licence to be attached. b) Details of technical personnel employed with their qualifications and experience. 13.a) Whether the applicant is already enlisted in Punjab PWD B&R/P.H. Irrigation Branches and Capital Project, If so, in which class and category. b)whether enlisted with any other Deptt. If so in which class and category showing amount up to which qualified to tender.? 14. Whether the applicant is a shareholder or partner of any firm enlisted in this Deptt or any other Deptt. 15. Whether the applicant or any of his partners or shareholders is/are Members of the Indian Parliament or any State Legislature. 16.Has the applicant or any or his partners or shareholders been blacklisted or removed from the approved list or contractors, demoted to a lower class or orders passed banning, suspending business with the applicant etc. by any department in the past.?

8 4 17. Whether the contractor has read the rules for enlistment of contractors and is prepared to abide by them. Signature of Contractor (Name of the Contractor)

9 -5- CERTIFICATE 1. I/We certify that I/We will not get myself/ourselves registered as contractors in the Punjab PWD B&R/PH Branches, Capital Project under more than one name. 2. I/We attach a list of these persons who are working with me/us in any capacity and who are near relatives of any gazetted officer in the Punjab PWD B&R/PH Branches, Capital Project and Irrigation Branch, I/We also undertake to intimate names of such persons who are employed by me/us subsequently. (Contractors who are near relatives of Engineering Officers, the grades for Superintending Engineers & Assistant Engineers all inclusive of the Punjab PEWD B&R Br/PH Branches and Capital Project will not be allowed to tender for works in the Circles ( responsible for award and execution of contract) where their near relatives will be working. Contractors who are near relatives of a Chief Engineer will not be allowed to work in the department.(engineer will not be allowed to work in the department as whole.) Note:- By the term near relatives is meant wife,husband Parents, children brothers sisters,, Brother/sister-in-law, son/daughter-in-law., uncle, first cousion and father-in-law. 3. a) certify that I did not retire as an Engineer of Gazetted rank or as a Gazetted Officer employed in Engineering or administrative duties in the Engineering Deptt. of the Govt of Punjab during the last two years. I also certify that I have neither under my employment any such person nor shall I employee any such person within two years of his retirement except with the prior permission of the Government. I further certify that I am/am not a dismissed Government servant and undertake not to employ directly or indirectly any person dismissed from Government service in my business without the prior permission of the registering authority. (For individuals seeking enlistment in their own name.)

10 6 We certify that none of the Partners/Directors retired as an Engineer of Gazetted rank or as a Gazetted Officer employed in Engineering or Administrative Duties in the Engineering Departments of the Government during the last two years. We also certify that we have neither under our employment any such person nor shall we employ any such person within two years of his retirement except with the prior permission of the Government. and We further certify that Partner(s) is /are nor dismissed Government servant Director(s) is/are We undertake not to employ directly or indirectly any person dismissed from Government service in our business without the prior permission of registering authority. (The inapplicable certificate may be deleted according to an individual or a Limited Company or a partnership firm is seeking enlistment). For limited Companies and Partnership Firms. 4. I/We agree to notify the officer accepting this application and registering my/our names on the PWD B&R/PH List of contractor of any changes in the foregoing particulars as they occur and to verify and confirm these particulars annually on Ist April. 5. I/We note that registration as a contractor does not carry with it the right to tender for works. I/We also understand and agree that the appropriate PWD B&R/PH. Authority have right as they may decide, no to issue tender form in any particular case and to suspend, remove or blacklist my/our name from the approved list of contractors in the event of submission of non-bonafide tenders or for technical or other delinquency in regard to which decision of the appropriate PWD B&R/PH. Authority shall be final and conclusive.

I/We certify that the above particulars are correct and that should it be found that I/We have given a false certificate or that if I/We fail to notify the fact of my/our subsequent amalgamation with another contractor or firm, my/our name is liable to be removed from the PWD B&R/PH List of contractors and any contract that I/We may be holding at the time is liable to be rescinded. Important Notes: 1) All relevant certificates should be attached with the application. 2) Application for enlistment in Buildings Roads & Bridges and Water Supply, Electrical or Furniture should be submitted on separate forms. 3) Income-Tax Clearance Certificate for the latest assessment year should be sent along with the application. Without the Income Tax Clearance Certificate the enlistment will not be considered.

12 -8- Information to be supplied by Agencies desiring enlistment besides the usual Application form for Enlistment,. FOR BRIDGE WORKS PART-A 1.List of works for which tenders submitted in Haryana. 2.List of tenders submitted and works got allotted during the last five years period (Separately for Haryana and outside) in the following form) i)serial No. ii) List of bridges works above Rs lakh.s. iii Total Cost. iv) Allotted to Agency, giving names of works. v)date of start vi)date of completion, vii) Extension in time, if any, over the original stipulated time of agree ment in each case Viii) Whether any penalty levied on the contractor on any of those works with details of the final recovery made in each case. ix) Whether the penalty was reduced and the reason for the delay. Similar list should be prepared for building and road works. 3 List of works for which tenders submitted but no work could be got allot

13 -9- Separate lists for roads, bridges and building works above Rs lakh in respect of last five years have to be enclosed. PART-B List of works above Rs lakhs executed successfully and completed during the last five years in any other part of the country other than Haryana, giving the details of road, bridge and building works. 4. Constitutional and certified copy of the registered Partnership Deed of the Firm or the Company or the Corporation along with the details of its Attorneys, position of capital both working and subscribed, equity, loans of all types, details of machinery in hand, details of other equipments, details of tools and plants, assets resources, man-power (design and execution, including particulars of technical and academic qualifications of person incharge of the Undertaking or employed with salaries above Rs. 2500/- per month consolidated.) 5. Details of associate Firm or Consultants with their complete particulars and experience.

14 -10- ANNEXURE B Specimen form of Solvency Certificate from the Scheduled Bank. This is to certify that to the best of our knowledge and information M/S Shri having marginally noted address, a customer of our bank is respectable and can be treated as good any engagement up to a limit of Rs (Rupess ) This certificate is issued without any guarantee or responsibility on the Bank or any of the Officers.
