1 Fire Damage epairs: Desais Quantity Amount No BILL NO. 1 PELIMINAIES BUILDING AGEEMENT AND PELIMINAIES The JBCC Series 2000 Minor Works Agreement (August 2007 edition 4.0) prepared by the Joint Building Contract Committee shall be the applicable building agreement, amended as hereinafter described The JBCC Minor Works Agreement Contract Data EC (Edition 4 - July 2007) and the JBCC Minor Works Agreement Agreement Contract Data CE (Edition 4 - August 2007) form an integral part of this agreement The ASAQS Preliminaries (November 2007 edition) published by the Association of South African Quantity Surveyors for use with the said JBCC Minor Works Agreement (Edition 4 -August 2007) shall be deemed to be incorporated in these bills of quantities Contractors are referred to the abovementioned documents for the full intent and meaning of each clause thereof These clauses are hereinafter referred to by clause number and heading only. Where standard clauses or alternatives are not entirely applicable to this agreement such modifications, corrections or supplements as will apply are given under each relevant clause heading and such modifications, corrections or supplements shall take precedence notwithstanding anything contrary contained in the abovementioned documents Where any item is not relevant to this specific agreement such item is marked N/A, signifying "not applicable" SYSTEM OF MEASUEMENT Where possible, the system of measurement used in this document is the "Standard System of Measuring Building Works" (Latest Edition) as published by the Association of South African Quantity Surveyors. But there are instances herein where the onus is placed on the contractor to timeously establish what the necessary details, thicknesses and other similar design information is for existing work, or alterations thereto, in order to be able to price the various items of the works. It is incumbent upon the contractor to be totally familiar with the existing work and what is required in terms of the new works by familiarising himself with the design drawings, inspecting the site, making notes thereon in detail and establishing from the principal agent comprehensive and detailed design requirements. These bills of quantities have been prepared from incomplete design documentation and must be regarded as only a guide as to what is required BILL NO. 1 PELIMINAIES Page -1-

2 Fire Damage epairs: Desais PEAMBLES FO TADES The Model Preambles for Trades (2008 edition) as published by the Association of South African Quantity Surveyors shall be deemed to be incorporated in these bills of quantities and no claims arising from brevity of description of items fully described in the said Model Preambles will be entertained Supplementary preambles are incorporated in these bills of quantities to satisfy the requirements of this project. Such supplementary preambles shall take precedence over the provisions of the said Model Preambles The contractor's prices for all items throughout these bills of quantities must take account of and include for all of the obligations, requirements and specifications given in the said Model Preambles and in any supplementary preambles PICING OF PELIMINAIES In terms of subclause in the Contract Data - Contractor to Employer (CE) for the purpose of adjustment of these preliminaries, the amount entered into the amount column in these preliminaries is to be divided into one or more of the three categories provided namely Fixed (F), Value elated (V) and Time elated (T) SECTION A - MINO WOKS AGEEMENT Definitions (A1) 1 Clause Definitions and Interpretation Preparation (A2 - A4) 2 Clause Security and Guarantees 3 Clause isk and Insurance F:... 4 Fire Damage epairs: Desais Payment (A13 - A14) 13 Clause Valuation and Payment to the Contractor The inclusion of materials and goods stored off site in the amount authorised for payment in terms of clause 13.5 shall be at the sole discretion of the principal agent and such inclusion shall only be considered upon the provision, by the contractor, of an approved guarantee issued by a registered commercial bank. [13.5.2] 14 Clause Adjustment to the Contract Value All fluctuations in costs, with the exception of fluctuations in the rate of Value Added Tax, shall be for the account of the contractor Where prices are submitted by the contractor during the progress of the works in respect of contract instructions or in regard to a claim under the terms of the contract and notwithstanding the fact that such prices may be used in an interim payment certificate, there is to be no presumption of acceptance. 10 Fire Damage epairs: Desais 49 Warranties for material and workmanship Where warranties for materials and/or workmanship are called for, the contractor shall obtain a written warranty, addressed to the employer, from the firm supplying the materials and/or doing the work and shall deliver same to the principal agent on the final completion of the contract. The warranty shall state that workmanship, materials and installation are warranteed for a specified period from the date of final completion and that any defects that may arise during the specified period shall be made good at the expense of the firm supplying the materials and/or doing the work, upon written notice to do so. The warranty will not be enforced if the work is damaged by defects in the construction of the building in which case the responsibility for replacement shall rest entirely with the contractor F:...V:...T: Co-operation of contractor for cost management It is specifically agreed that the contractor accepts the obligation of assisting the principal agent in implementing proper cost management. The contractor will be advised by the principal agent of all cost management procedures which will be implemented to ensure that the final building cost does not exceed the budget. The principal agent undertakes to make available to the contractor all budgetary allowances and cost assessments/reports to enable the proper procedure to be implemented and the contractor shall attend all cost plan review and cost management meetings. The contractor undertakes to extend these procedures, as necessary, to all subcontractors F:...V:...T: Testing of windows for watertightness Each window shall be tested for watertightness with water sprayed on using adequate pressure. If in the opinion of the principal agent, the pressure proves to be inadequate, then the pressure shall be boosted by means of compressed air or other approved means F:... V:... T: Sub-contractor List The contractor shall provide the principal agent with a list of all sub-contractors enlisted on the project prior to appointment, for comment and discussion to performance and work quality experienced on previous projects. 11 Fire Damage epairs: Desais 53 Overtime Should overtime be required to be worked for any reason whatsoever, the cost of such overtime is to be borne by the Contractor, unless the Principal Agent has specifically authorized, in writing, prior to the execution thereof, that costs for such overtime is to be borne by the Employer F:... T: Prime cost amounts Notwithstanding any information to the contrary in the contract document or preliminaries, references to "Prime Cost" or "PC" shall mean the cost at which an item or material is obtained inclusive of delivery to site and exclusive of value added tax. Unless otherwise stated installation is not included in the Prime Cost and the contractor is to include this in his rate. The prime Cost does not include any allowance for wastage and refers to cost per net measurable unit. The contractor is to allow for wastage, shrinkage, bulking etc. F:... V:... 12 Fire Damage epairs: Desais 56 Occupational Health and Safety Act The Contractor shall fulfill the requirements of the Occupational Health and Safety Act (Act 85 of 1993) and shall specifically undertake to comply with the following provisions: a) The Contractor shall ascertain and acquaint himself with the provisions of the aforementioned Act b) The Contractor shall take all the necessary steps to comply with such provisions, read together with any regulations promulgated in terms of the aforementioned Act, as well as the aforementioned health and safety policy, provided that: i) the Employer at any reasonable time be given the opportunity to satisfy himself by means of an inspection on site that such provisions are being complied with; ii) in the event of failure to comply with any such provision, the employer shall call on the Contractor in writing to remedy such failure within a reasonable period of time as set out in the employer's notice; and iii) failing which, the employer may take the necessary remedial steps himself in order to rectify the failure, in which event the employer may recover, or deduct from monies owing, from the Contractor, all cost he had incurred F:... 17 Fire Damage epairs: Desais Protection In taking down and removing existing work the utmost care is to be observed to avoid any structural or other damage to the remaining portions of the buildings. The Contractor must also protect all work not removed such as walls, floors, doors, windows or other joinery, loose and fixed fittings and electrical appliances, etc. from damage during the progress of the work and provide all necessary materials for so doing. TheContractor will be held solely responsible for any damage to persons or property and for the safety of the structure throughout the whole of this Contract and must make good at his own expense any damage that may occur. Old Materials to be carted away Old materials from alterations and/or demolitions except where described as to be re-used or handed over, as well as all rubbish etc must be regularly carted from the site and not be allowed to accumulate on or around the site emoval of demolished, or other, materials arising from the alterations and demolitions Descriptions of "removing", or "carting away", of such material shall be hereby deemed to include loading such material onto trucks directly from the works, or, alternatively, from stock piles situated on site, and taking such material to a registered dump-site that has been located off-site by the contractor for such disposal. The availability of such dump-site, and its possible subsequent replacement, is at the sole risk of the contractor and no claims in respect of additional costs arising from this possibility will be entertained. 18 Fire Damage epairs: Desais Handing over of materials Where certain materials or articles from demolitions or alterations are described as to be handed over by the contractor to the egional epresentative or epresentative Agent, such materials or articles shall be properly stored by the contractor until handing over thereof. The contractor shall obtain an official receipt listing the materials or articles and dates of handing over. If the contractor fails to submit the receipt when requested to do so it shall be deemed that the materials or articles are still in his possession and he will be held liable to the Department for the full replacement value thereof which amount will be deducted from monies due to the contractor Credits The Employer reserves the right to retain any material arising from the Demolition and Alterations works not specifically stated as to be set aside for his use. Contractors are therefore to indicate Credits allowed for materials to be removed as these credit rates will be used to reimburse the Contractor for any such material retained by the Employer.
