Total HR Management PEO (Professional Employer Organization) Shared Employment Arrangement
Co/Shared Employment The PEO Foundation Co-Employment, or Shared Employment, is THE defining characteristic of a PEO (Professional Employer Organization) arrangement. So what is it? So, what isit?
3 Simultaneous Relationships PEO Customer Employees Employment Relationship
Overlapping Responsibilities Shared Employment Liability Client Service Agreement C.S.A PEO Human Resources Workers Compensation Risk Management Benefits Payroll CLIENT EMPLOYEE Direction and Control
Overlapping Responsibilities How it works: Some things PEO does Many things client keeps doing Some things we do together
Co/Shared Employment The Foundation Think about it this way: Client is inthe business of making widgets. Knows a LOT about widget making. PEO is inthe business of being an employer and getting the little details right. Hiring the PEO lets the client focus on what it does best!
Co-Employment Co/Shared Employment is a relationship between two or more employers in which each has actual or potential legal rights and duties with respect to the same employee or group of employees. Shared Employment message toclient: Right now, you have a relationship with your employees and you have 100% of the liability for your employees When you engage our firm, we sign an agreement called a client service agreement CSA for short.
Selling Co-Employment Shared Employment message to client: The CSA outlines the responsibilities and liability that we share in the areas of human resources, workers compensation, employee benefits, and payroll What does not change is direction and control of employees You maintain 100% direction and control And you no longer have 100% of the liability; we share some of the liability with you
What PEO is NOT PEO is not an insurance company PEO does not take over running the client s business PEO does not eliminate all liabilities PEO does not interfere in supervision, direction or control of the client s employees.
Risk Management At its foundation, PEO is about managing risks. Ultimately, the best clients are those that understand that compliance is hard, risk is everywhere, and you can t bury your head in the sand. Think beyond Workers Compensation risk management PEO is involved in mitigating risk in nearly all aspects of the employment relationship
Loss of Control The PEO neither wants nor needs control over the client s business. In fact, the PEO really, really does not want any control over the client s business. The PEO s core strength is in managing the details of employment, not in making widgets
Loss of Control Message to the Client: You will actually gain control because you ll have a team of experts to deal with employment related issues. You ll tell your employees what they ll do, when they ll do it, what they ll get paid to do it, and when you don t want them to do it anymore
PEO enables HR PEO is in the business of the nit-picky little details of being an employer that are easy to screw up. Things that look small, but that can bite you in the shorts.
PEO enables HR PEO s taxpayer identificationnumber: Enables the PEO to manage tax liabilities and sponsor employee benefit programs. PEO s own UI account (moststates): Enables the PEO to more easily and directly manage unemployment claims. PEO s own WC policy (most states, optional): Enables PEO to more directly manage workers compensation claims.
