From The Publisher Last weekend we went for a lovely trip up to the Karkikari Peninsular where we spent the night at the Carrington Lodge to celebrate a milestone in our lives, and what a beautiful location it is, looking over the golf course to the brilliant white sand-hills with the ocean, sparkling blue, disappearing along with North Cape, to the far horizon. I would recommend this place to anybody, especially for the golfing fanatics. On the Saturday afternoon, while Brian was hacking his way around the back nine holes, I went for a wander around the whole complex and came across another feature of the resort that, in either winter or summer, would have to be definitely the icing on the cake, and that was the swimming pool. On seeing the pool with its beautiful layout and position to take advantage of the spectacular scenery I was once more convinced that a pool would have to be one of the most worthwhile investments one could make to ensure that their property is complete. In a few weeks time it will be officially spring and then the thought of long hot summer days swimming and surfing will be on everybody s mind. property INVESTMENT Mindful Matters Reviewed RMA And Land Prices with Frank Newman include councils, planners, commissioners, lawyers, judges, iwi, activist organsations like DOC and the Environmental Defence Society, an endless queue of experts writing voluminous reports on largely immaterial issues, and others. Each is in there extracting a pint of blood, a pound of flesh, or advancing their cause at the expense of those brave or foolish enough to propose a development. Unlike these industry players, developers must live in the real world. Should they actually get through the consent process with their finances and sanity intact, they have to turn a profit. In this example the landowner not only earned nothing while their capital was tied up for six years, they have paid rates, and a million dollars plus in consent fees. These costs need to be recovered in the section price. The truth is doing anything that involves the RMA and council consent is gamble. There is a high probability that things will go wrong and cost money. A rational business person faced with those risks will only proceed with a project when the returns justify those speculative risks, and few developments pass that hurdle. That limits the supply of new sections and what is created comes at a price that includes the developers risk premium and the excessive consent costs. That s why the average section price in our district is about twice what it should be. That s also why development activity has virtually ground to a halt. Is it any wonder those with a bit of get up and go, get up and go to Australia or Christchurch, taking their spending power with them? Given the multiplier effect, for every dollar they don t spend here, costs society $5. That s why our welfare is one of the biggest industries in Northland, and that s the real cost of excessive and environmental and obstructive district councils. The RMA was created as an enabling Act. It has become disabling as case law has evolved through the courts. Unfortunately much of that case law has been shaped by resolute environmental activists pursuing their narrow agenda, and for that we are all paying the price. Reader write Last week the Economist magazine ran an article reporting New Zealand has one the world's most over-valued housing markets. This may explain why. It involves a well-intentioned individual and a scruffy piece of land on the Tutukaka Coast. The 6.6 hectares (16 acres) had been a forestry block that backed onto a coastal settlement. The pines were removed in 2005, and Pampas grass has been thriving ever since. He bought the land in 2006, with the intention of rezoning it from Coastal Countryside to Living. The proposal was for a low density residential development comprising 24 sections. A substantial area was to be set aside as a reserve for native revegetation, and included covenants preventing residents for owning dogs and cats, lest their pets prey upon local Kiwi which have been returning to the Coast in significant numbers. By law the owner of the swimming pool is responsible for making it safe and secure by installing and maintaining a pool fence and gate. Pool owners with fences that do not comply with the law can be hit with large penalties and on-the-spot fines. So, take a look at the following checklists to ensure your pool is secure. What Needs To Be Fenced? For the purposes of the Act a swimming pool is defined as any excavation, structure or product containing water over 400mm deep that is used or is capable of being used for swimming, wading, paddling or bathing and includes spa and inflatable pools. All pools must be fenced. Pools must remaining empty until an approved complying fence is installed. Contact your local council for more details. It is recommended that where possible pools and the immediate pool area are surrounded by isolation fencing to prevent thoroughfare of young children from the house to the pool. The fencing must comply with the Fencing of Swimming Pools Act 1987 and the Building Code. Pool Fence Checklist There is a pool fence separating the pool from the neighbours. The pool fence restricts access from the house to the pool. The outside of the pool fence is at least 1.2 meters high all the way around. The bottom of the pool fence is less than 100mm off the ground all the way around. All vertical or near-vertical fence uprights are less than 100mm apart. All horizontal or near horizontal fence rails are at least 900mm apart. The top of the pool fence is at least 900mm above any low horizontal fence rails. The pool fence is well maintained and there are no holes or broken posts or rails. Steps for para-type pools are removed when the pool is not in use. The pool fence is at least 900mm away from any object that would allow a child to climb over the fence - barbecues, trees, rocks, shrubs, furniture etc. Pool Gate Checklist The gate closes by itself from any open position. The gate latches by itself when it closes. The gate opens outwards, away from the pool. Never prop open or tie back the pool gate or otherwise obstruct it from automatically closing. The latch release is at least 1.5 meters above the ground or covered so a child cannot open the gate. The Paper Work The swimming pool and fencing have building approval. There is a sign warning people that a pool is under construction and it is clearly visible from the road at the front of my property. Certification was obtained for the fence (temporary or permanent) around the new pool prior to filling it with water. A final inspection of the swimming pool and permanent fence was obtained and carried out. General Safety Tips Maintain the fence and gate in good condition. Always supervise children in or near a pool. Always make sure the gate to the pool is safely shut. Set rules of behaviour around the pool. Cover the area around the pool with a non-slip surface. Clear away toys and flotation aids when they are not being used. Make sure children and adults alike understand that they must NEVER prop open the pool gate. Ensure there are no objects near the pool fence which a child could use to climb up or stand on to get over the fence. Learn first aid and resuscitation. Pool owners with fences that do not comply with the law can be hit with large penalties and on-the-spot fines.

HeLLO LANDLORD - WELCOME TENANTS Revealing Rights & Responsibilities Lawns, Locks and Lightbulbs Light bulbs The Residential Tenancies Act does not cover who is responsible for lightbulbs. However, if the landlord supplies light bulbs and the tenant takes them without replacing them, or damages them intentionally or carelessly, the tenant would be responsible for their replacement. If the light bulbs remain in place but have blown, responsibility becomes less certain. Standard light bulbs that have blown may be seen as consumables and be replaceable by the tenant, or can be seen as fair wear and tear and be replaceable by the landlord. Non-standard light bulbs that may be more expensive, or require special treatment to fit, may be the responsibility of the landlord. If a light bulb of this kind blows, it is likely to be treated as fair wear and tear. Lawns Tenants should keep the property reasonably clean and tidy, which includes weeding and mowing lawns where the landlord has not accepted responsibility for this under the tenancy agreement. Tenants should also leave the property reasonably clean and tidy at the end of the tenancy. Locks And Locking Devices The landlord must provide and maintain locks and similar devices as necessary to ensure the property is reasonably secure. Neither the landlord nor the tenant can remove, add to or alter any locking device without the consent of the other. Doing this without consent and without reasonable excuse is unlawful and carries a penalty of up to $1,000. Ensure tenants have access to their room, toilet and bathroom facilities at all times and advise any tenant who will be affected by altering, adding or removing any lock. A boarding house tenant must not interfere with any lock without the landlords consent and must return all keys provided by the landlord on termination of the tenancy.
