The Bidder hall give an undertaking on their letter head tating that the Bidder ha not been black lited by any of the Government Authority or PSU. In cae, in the pat, the Bidder company / firm wa blacklited by any Govt. Authority or PSU, the name of uch company / firm hould have been removed from the black lit a on date of ubmi of the tender, failing which the Bid hall be rejected. In cae, the acce control erver olut i not PCI-DSS certified a on date of ubmi of the bid, the Bidder hould ubmit an undertaking tating that the bidder would obtain the required certificat within a period of nine month from the date of receipt of the purchae order from the Bank. Requet Bank to clarify that the ACS will confirm only to PCI-DSS tard not to ISO 2700, CERT IN IT Act 2000 34 2 3.40.2 ISO 2700 PCI- DSS Certificati on The acce control erver olut hould be PCI-DSS certified. Sect / Subect 36 22 3.43 Penalty for Nonperforma nce during Productio n Operat In cae any complaint regitered by the cardholder at Card Centre forwarded by the Bank to the Bidder, remain unreolved/ open beyond 24 hour, olely on account of inact by the elected Bidder, a penalty of R. 500/- (Rupee Five Hundred only) per intance per day ubject to a maximum of 5% of the total annual contract value will be levied from the 2nd day, beide recovery of the damage uffered by the Bank, if any, due to uch act. Liability on account of any Sytem Comprom ie Bidder hall inform the Bank immediately with full detail of any ecurity lape / compromie for taking neceary tep againt miue on account of uch occurrence alo take tep to mitigate the rik. Bidder hall be fully liable in cae of any Security lape / Compromie liability ariing in uch cae hall be reimbured by the Bidder to the Bank which i ubject to a maximum of the yearly contract value. Bidder Utiliatio n of Know- How Peronnel for Competit or The Bank will requet a claue that would require a NOC to be obtained from the Bank for uing any know-how gained in thi contract, if awarded, for another organiat whoe buine activitie are imilar in part or in whole to any of thoe of Un Bank of India anywhere in the world, without prior written conent of the Bank. Bidder Utiliatio n of Know- How Peronnel for Competit or The Bank will requet a claue that would require a NOC to be obtained from the Bank for uing any know-how gained in thi contract, if awarded, for another organiat whoe buine activitie are imilar in part or in whole to any of thoe of Un Bank of India anywhere in the world, without prior written conent of the Bank. The BIDDER i already agreeing to confidentiality obligat under thi agreement. Know-How i the Intellectual Property of the BIDDER, the ame need not be ubject to any retrict or prior conent. Thi limit hall not apply to third party claim for a) IP infringement indemnity; b) Bodily injury (including death) damage to real property tangible peronal property caued by Bidder' gro negligence. 3.47.3. For the purpoe of thi ect, Contract value at any given point of time, mean the aggregate value of the purchae order placed by Bank on the Bidder that gave rie to claim, under thi tender. The BIDDER requet that the limitat on it direct liability to be retricted to ix (6) month payment. Further, the indirect conequential liabilitie to be excluded under all circumtance.
