Divided into two separately bookable seminars, the Annual Alternative Dispute Resolution (ADR) Conference explores challenges faced by lawyers who change hats; ADR in the mining, sugar and insurance industries; mediation in public sectors including tax and defence; family law; arbitration and ethical issues in ADR. The speaker will explore essential mediation and negotiation skills that usurp adversarial traits of lawyers who are used to fighting their client s case; effective communication as opposed to legal opinion; and the generation of options and solutions as opposed to adhering to rigid legal principles. Against the background of the current National Mediator Accreditation System s approach to standards and ethical issues, this session focuses on ethical dilemmas arising in the context of mediation practice. 4.15pm 5.00pm The role ADR plays in native title; an Indigenous service provider perspective 3 June 2012 marks the twentieth anniversary of the historic High Court judgment in Mabo (no. 2.). This presentation examines the importance of ADR in an evolving jurisprudence involving multi-party proceedings attempting to reconcile diverse, longstanding interests. The paper will provide a brief overview of the complex legal, social and historical issues associated with the resolution of native title matters; the various institutions that have a statutory ADR role to perform; and the unique challenges that beset inter and intra-indigenous dispute resolution.
