CG&E is an Ohio corporation with its principal office and principal place of business at 139 East Fourth Street, Cincinnati, Ohio and mailing address at P.O. Box 960, Cincinnati, Ohio 45201-0960. CG&E is a public utility regulated by the Public Utilities Commission of Ohio and provides retail gas and electric service to customers in southwestern Ohio. CG&E is the parent company of The Union Light, Heat and Power Company (ULH&P), which is a public utility regulated by the Kentucky Public Service Commission and provides retail gas and electric service to customers in northern Kentucky. CG&E owns and operates certain bulk transmission facilities of 69 kv and above located in northern Kentucky that are used to provide electric transmission service for customers of CG&E and ULH&P. 2. Pursuant to KRS 278.714(1) and (5) and 807 KAR 5:100, CG&E hereby submits its application fee with this filing. 132423

3. Pursuant to KRS 278.714(2)(a), the name of the person proposing the construction nonregulated electric transmission line and related appurtenances is CG&E. CG&E s address is stated above. The general telephone number for CG&E is: (513) 421-9500. The name of the project manager for this construction project is Stephen B. Reising, whose business address is: Cinergy Services, Inc., Room EX 467, P. O. Box 960, Cincinnati, Ohio 45201-0960, and whose telephone number is: (513) 287-1931. 4. Pursuant to KRS 278.714(2)(b), the proposed construction will take place in Campbell County and in the City of Melbourne. The new 138 kv electric transmission line will run from CG&E s W.C. Beckjord Generating Station in southwestern Clermont County, Ohio to the Silver Grove Substation in Campbell County, Kentucky. The length of the new line is approximately 6.5 miles long. This Notice of Intent to File Application is being prepared for the portion of the line from Silver Grove Substation to the Ohio River, covering approximately 4.9 miles. The new line will run from the Silver Grove Substation located off S.R. 547 in Melbourne, Kentucky and run in a southeastern direction for approximately 2.23 miles. At this point, which is near the intersection of Nine Mile and Gunkel Roads, the line will turn east and run another 2.67 miles at which point it crosses the Ohio River into Clermont County, Ohio. The proposed transmission line will run within existing easements owned by CG&E. CG&E has enclosed aerial maps at Tab 2 depicting the information required by this section, and a brochure to be made publicly available, which shows the rights-of-way. There are no known public or private parks or schools within one mile of the route for the proposed transmission line. The proposed route traverses a residential neighborhood, as shown on the maps at Figure 132423 2

6 and Figure 7 at Tab 2. The existing transmission steel towers and existing transmission line already crosses this residential neighborhood. 5. Pursuant to KRS 278.714(2)(c), this proposed project is known as the Beckjord-Silver Grove 138,000 Volt Electric Transmission Line and CG&E has designated the new line as circuit number 1880. The transmission line will be 138,000 volts (138 kv) and will include related appurtenances such as poles. The bulk transmission system used to provide electric transmission service for customers of CG&E and ULH&P is configured and operated as a network system, and will continue to be configured on a network basis after the East Bend, Miami Fort 6 and Woodsdale Generating Stations are transferred to ULH&P. CG&E owns this bulk transmission system, which is located in southwestern Ohio and northern Kentucky. Based on a bulk transmission planning study, it has been determined that the proposed transmission line is necessary to maintain the reliability of the bulk transmission network. In addition, the proposed transmission line will also facilitate ULH&P s ability to make economy purchases and back-up power purchases from CG&E, which is contemplated under the Commission s December 5, 2003 order in Case No. 2003-00252. Finally, it is anticipated that this transmission line will mitigate, at least to some degree, the transmission congestion costs that would otherwise be imposed on ULH&P customers after the Midwest Independent System Operator Day 2 energy markets become operational. Beginning at Silver Grove Substation, the new 138 kv line will be located in an existing 300-foot wide easement and run parallel (southeast) to the existing Zimmer- Silver Grove-Red Bank 345 kv line for approximately 2.23 miles or to tower 11 of the 132423 3

Silver Grove-Red Bank line. The new line will be located about 100 feet to the south of the 345 kv line. This section of the line will typically be new single wood pole structures with three 138kV post insulators and static clamps. Poles will range in height from 70-100 feet tall and be spaced 250-350 feet apart depending on the terrain. Where single pole structures are not practical due to changes in terrain or other obstacles, multiple wood pole structures will be employed. Multiple wood pole structures are not anticipated at this time. Currently CG&E performs tree trimming/vegetation management in a 150- foot wide band within the easement for the 345kV line. The new line requires that an additional 50-foot wide band within the easement will need to be maintained. At tower 11, which is near the intersection of Nine Mile and Gunkel Roads, the new line will utilize the southern open arm on the existing structures of the Silver Grove- Red Bank 345 kv transmission line. The new line will run the remaining 2.67 miles through Campbell County, Kentucky into Ohio on these structures. Suspension assemblies will be installed on the open side of the structures to hold the new line. The new Beckjord-Silver Grove 138 kv line will utilize 954 ACSR conductors for the phase wires and an optical ground wire with 48 fibers for the static for the complete length of the project. The line will be designed to operate at 138 kv and the capacity of the line will be 300 megawatts. The approximate latitude and longitude at Silver Grove Substation are: latitude 39 degrees, 1 minute, 32 seconds and longitude 84 degrees, 22 minutes, 36 seconds. The coordinates of the transmission line crossing at the Ohio River are latitude 39 degrees, 0 minutes, 6 seconds and longitude 84 degrees, 18 minutes, 8 seconds. 132423 4

Pursuant to KRS 278.714(d), CG&E states that the proposed transmission line and appurtenances will be constructed and maintained in accordance with accepted engineering practices and the National Electric Safety Code. 7. Pursuant to KRS 278.714(e), CG&E states that it has provided public notice by publication in a newspaper of general circulation in the general area concerned, as required by this section. A copy of the newspaper notice is submitted with this application at Tab 3. 8. CG&E commissioned an archaeological survey report and an ecological assessment report for the proposed transmission line. Copies of these reports are attached at Tabs 4 and 5, respectively. 9. Pursuant to KRS 278.714(f), CG&E states that it has served a copy of this application upon the chief executive officer of each county and municipal corporation in which the proposed line is to be located, and upon the chief officer of each public agency charged with the duty of planning land use in the general area in which the line is proposed to be located. A copy of the certificate of service is submitted with this application at Tab 6. 10. Pursuant to 807 KAR 5:110 Section 3(2)(b)(3), the name of the person responsible for responding to questions concerning information contained in this filing is the undersigned attorney, whose name, address and telephone number are provided below.
