1 CITY OF DAYTON COUNCIL MEETING JULY 1, 2014 A regular meeting of Dayton City Council was held on Tuesday, July 1, 2014, 7:00 p.m. in the board meeting room of the Dayton Independent Schools Administration Building, Third & Clay Street, Dayton, KY. Mayor Rankle opened the meeting with a silent pray and led the Pledge of Allegiance. Fischer present Member Boruske present MAYOR'S REPORT: Member Gunning is on vacation. This vacation was planned well in advance of tonight's meeting. Barb Washington, Asst. City Clerk/Treas., is retiring after 18 years of service to the city. Congratulation and Best of Luck to Barb. Member Hurtt s first day of retirement is today. She retired from Western Southern after 36 1/2 years. Congratulations also to Member Hurtt. The City once again won first place in the annual Bochie Ball Tournament. This is part of the Italian Fest in Newport. Mayor Rankle read a letter of resignation from Dr. Barbara Cook. Dr. Cook is resigning from the Ethic's Board. Motion by Member Volter, seconded by Member Hurtt to accept the resignation with regret. Motion Carried--so ordered. Mayor Rankle apologized to the Citizens of Dayton. Mayor Rankle stated he is here to represent the Citizens of Dayton in the best possible way and apologized to the Citizens of Dayton for not representing them in a positive nature. Manhattan Harbor Development Co. LLC would like to develop the Southside of the Floodwall from O'Fallon Avenue to Berry Avenue. The development would include condos and high end apartments. The group will attend the next council meeting and give a full presentation. The city is looking for volunteers to serve on the following boards: Ethic's Board Parking Citation Board Housing Authority Board Board of Adjustments two volunteers needed. one volunteer needed. one volunteer needed. two volunteers needed. If interested call Donna Leger, Clerk/Treas., and submit your name. Chief O'Brien presented Corporal Nick Timon with a plaque. Corporal Timon graduated from the Academy of Police supervision. This is a three week course and one of the best programs they have in Richmond. CITY ADMINISTRATOR'S REPORT: Request from Tammy Hilton, 705 Vine Street, for a handicap parking space. City Adm. Giffen reported that Ms. Hilton does not meet all the requirement. Ms. Hilton does not own the home. Member Gifford would like to review the handicap parking ordinance. Member Gifford does not feel its right to reject someone for a handicap parking space if they have lived in the city for a length of time. Whether they own the house or not should not matter. Thirty applications were received for the Main Street Manager Position. The search was narrowed down to twelve applications, and then to six. The job has been offered to Chris Robinson of London, Kentucky. Mr. Robinson is the Main Street Manager in London, KY. Mr. Robinson has until the end of the week to accept the job. The city has an informal committee called the Dayton Riverfront Committee. This committee will study the possibility of a pier on the city's riverfront. City Adm. Giffen and the committee took a trip to

2 Maysville Kentucky to look at Maysville s pier. Katherine Hamilton, Committee Chair, first brought this to council s attention about a year ago. The pier would be for the citizens of Dayton to use, share and enjoy. Currently there are grants available for this type of project. The Committee will come back next month with more information and would like to have input from the community. Anyone is welcome to join the committee. CONSENT AGENDA: Motion by Member Hurtt, seconded by Member Volter to approve the minutes from the May 20, 2014 meeting as received. Motion carried--so ordered. ORDINANCES & ORDERS: Second Reading: CITY OF DAYTON, KENTUCKY #8 AN ORDINANCE ADOPTING THE CITY OF DAYTON, KENTUCKY'S ANNUAL BUDGET FOR FISCAL YEAR JULY 1, 2014 THROUGH JUNE 30, 2015, & ESTIMATING REVENUES & RESOURCES AND APPROPRIATING FUNDS FOR THE OPERATION OF CITY GOVERNMENT. This ordinance adopts the budget for Fiscal Year 2015 for the General Fund, Municipal Aid Fund, Park Board Fund, Park Tax Fund, Urban Renewal Fund, Sergeant Park Fund, and the Civic Club Fund. I, John C. Fisher, an attorney licensed to practice law in the Commonwealth of Kentucky, acting as attorney for the City of Dayton, Kentucky, do hereby certify that this summary was prepared by me at the direction of the Council of the City of Dayton, and that said summary is a true and accurate summary of the contents of the ordinance. John C. Fischer Motion by Member Boruske, seconded by Member Burns to approve 2014#8 as read. Comments: Mayor Rankle is concerned that $335,000 of the surplus was used to balance the budget. Everyone is hoping the development of the Riverfront will help the budget. The city will not get 100% of the tax money from the Riverfront Development. Grant Park is almost completed but 75% of the tax money goes to pay off the bonds. The bonds at Grant Park will last about 20 years. The city does get 100% of the taxes on Riverpointe but the school taxes on Riverpointe homes goes to the county. Member Hurtt reported that the Finance Committee, City Adm. Giffen and all Department Heads had to make cuts. Member Hurtt is concerned that council did not take a 4% increase on real estate taxes. Member Hurtt said the City of Dayton is one of the few cites in this area that do not take the 4% each year. The city is losing thousands of dollars. 3 CITY OF DAYTON, KENTUCKY #9 AN ORDINANCE AMENDING THE CITY OF DAYTON, KENTUCKY'S ANNUAL BUDGET FOR FISCAL YEAR JULY 1, 2013 THROUGH JUNE 30, 2014, & ESTIMATING REVENUES & RESOURCES AND APPROPRIATING FUNDS FOR THE OPERATION OF CITY GOVERNMENT. This ordinance amends the budget for Fiscal Year 2014 for Urban Renewal Fund. The General Fund, Municipal Aid Fund, Park Board Fund, Park Tax Fund, Sergeant Park Fund, and the Civic Club Fund are not amended. I, John C. DEPARTMENT HEAD'S REPORT: Scott O'Brien, Police Chief, submitted a copy of his report. There was 554 calls for service in June. The total for the fiscal year was 7808, which averages 650 calls per month. We have been awarded a Law Enforcement Protection Grant for $2,800. This will be used for backup weapons. The department is evaluated every three years by the KLCIS Board. In 2011 the Police Department received a score of 57% which is considered average. This year the score was 87%, which is considered excellent. The department currently has two grants pending. One is a Cops Grant which will put another Officer in the schools and a Safe Harbor Grant which will be used to purchase more cameras. Mayor Rankle thanked Chief O'Brien for being proactive. Don Riley, Director of Codes, submitted his report. Anyone installing a pool or deck must get a zoning and building permit. If the pool is over 24" high the pool must have a locking gate. If you're not sure if you need a permit call the City Building or Campbell County Planning and Zoning before you start work. The next Code Board meeting is July 14th. Don Riley suggested council adopt the 2012 International Code and the 2013 Kentucky Building Codes. Rick Lucas, Supt. Public Works, reported that the Public Work's crew is staying busy with grass cutting. Mike Auteri, Fire Chief, submitted a copy of his report. The Firefighters have participated in the following events: June 8 th, attended the Bellevue Primary Care Community Open House at Daymar College they also attended the June Area Maritime Community Rescue and Response Sub-committee meeting. June 14 th, attended the Concert at the Bellevue Beach Park and Block Party on Foote Avenue. The crews have been out training daily on the new equipment on the fire boat. Member Boruske said the next Fire Board Meeting will be held on August 20, at this location, 6:00 p.m.

4 Donna Leger, Clerk/Treas., submitted a copy of the 2013/2014 and 2014/2015 financials for the General Fund. STANDING COMMITTEE REPORTS: Public Safety (Member Volter): Member Volter complemented the Chief on all the hard work they do. Parks & Real Estate (Member Burns): The Park Board will not meet this month. The net is up at Gil Lynn Park. The next Park Board Meeting is July 7, 2014 at the VFW Hall. PETITION: Member Burns noted that last month Nicole Brickler made a presentation to council for a Memorial Walk Way on top of the floodwall in honor of her father. Council was to give her more direction on how to proceed. Ms. Brickler is here tonight. Member Gifford said this will give a lot of people with loved ones the opportunity to honor them also. Mayor Rankle said this was going to be referred to a committee but the committee has not been formed. City Adm. Giffen spoke with Ms. Brickler and a meeting has been set for July 15 th at 1:00 p.m. Member Hurtt reported the Dayton Eagles will have a festival on August 2nd. The Eagles would like the street closed between Fifth & Sixth Ave. on Berry. Mayor Rankle said he does not think council has any objections. Dorothy Hauser would like to see Ordinance 2014#5 repealed. Ms. Hauser works late and is worried she will not be able to get a cab to bring her home to Dayton if the cab driver has to purchase an occupational license. The cab drivers can refuse service and said they would. This ordinance is detrimental to those who do not drive. Mr. Hauser has a petition with several signatures to repeal ordinance 2014#5. Motion by Member Volter, seconded by Member Hurtt to repeal ordinance 2014#5. Comments: Member Burns said he made the previous motion. The idea was to stop Ohio Cab drivers that park on our streets. A Senior Citizen approached Member Burns about a cab with Ohio plates that sits in front of his house. Member Burns still thinks the city needs to stop cars and cabs that park in our city with Ohio plates. Member Burns is currently working with a lady to get free taxi service for residents. Chief O'Brien was also told by the County Attorney s office that there was no possible way the Dayton Police can stop and enforce this ordinance. The cab would have to be stopped for some other violation first. Once a year Member Gifford s band plays in Highland Heights and they have to buy a $ Occupational License. Joe Neary asked council to clarify the council meeting place. This is causing a lot of confusion for the residents. City Adm. Giffen spoke with the VFW and they welcome the council meetings with an advanced notice. They will shut down the bar. City Adm. Giffen recommended against the VFW suggesting it was not a professional location and asked that council recommend staying at the school meeting room.

Jason Steffen candidate for State Senate thanked council for the proclamation they did honoring Governor Paul Patton on June 29, Tammy Kroger asked if council could invest in some microphones. Mayor Rankle will look into this request. UNFINISHED BUSINESS: Member Burns asked Rick Lucas, Supt. Public Works, to look at the alley between Ervin Terrace and Vine Street. There is water ponding in this area. Council agreed to purchase an ad for the Dayton High School All Sports Program. The ad will be paid by each person individually. City funds will not be used. Dayton Day at Coney Island is July 18th. EXECUTIVE SESSION: Mayor Rankle entertained a motion to go into executive session to discuss KRS (b) deliberations on the future acquisition or sale of real property by a public agency, but only when publicity would be likely to affect the value of a specific piece of property to be acquired for public use or sold by a public agency. Motion by Member Gifford, seconded by Member Hurtt to go into executive session. Motion carried-so ordered. Motion by Member Boruske, seconded by Member Gifford to go back into regular session.
