JOINT STATUS REPORT Pursuant to the Court s December 31, 2013 order staying discovery in this matter (Dkt. Nos. 100, 101), the Parties submit this Joint Status Report regarding the status of Defendant Bostwick Laboratories ( Bostwick ) discussions with the government regarding ability to pay and settlement. On January 8, 2014 representatives for Bostwick and representatives of the United States Department of Justice ( DOJ ) and other governmental agencies had a conference call to permit the government to inquire about the financial documents previously provided by Bostwick. At the conclusion of the call, DOJ indicated it would send a supplemental request for documents to

That supplemental request was received, and Bostwick provided the requested documents to DOJ today, January 15, As soon as the government completes its review of the newly requested documents, another conference call will be promptly scheduled. Relator is evaluating the proposed settlement to determine if he consents that the settlement is fair, adequate, and reasonable. Moreover, in light of Bostwick Labs inability to pay, there has also been a resolution with Bostwick Labs of a small portion of Relator s fees and costs pursuant to 31 U.S.C. 3730(d). As a term of the settlement, Relator and Bostwick Labs are discussing how any third party discovery from the company might proceed. The proposed settlement does not, at this time, include Dr. Bostwick, who would continue as a defendant in this action.
