R (c)(2)(d)(ii), certification is not required for "the rebuilding, upgrading, bundling of conductors or reconductoring of an existing transmission facility; or the installation of an additional circuit(s) on facilities that were originally designed and certificated for multiple-circuit capacity. Activities described previously which occur in the certificated area of another utility require the prior consent of that utility. For purposes of this section, "upgrading" to a higher voltage shall be limited to 230 KV or less and "rebuilding" work shall be limited to the replacement and/or respacing of structures along an existing route of the transmission line." On August 31, 1995, Houston Lighting & Power Company (HL&P) filed a report pursuant to P.U.C. SUBST. R (c)(2)(D)(ii) regarding activities exempted from the requirement for a Certificate of Convenience and Necessity (CCN). HL&P repaired and replaced the 138KV CKTS. 03 and 94, HA(E) 133-SF, along the San Jacinto River at Interstate 10 due to flood damage in October The replacement and/or respacing of structures was located in the current right-of-way, The General Counsel recommends that this project be exempted from the requirement for a CCN pursuant to P.U.C. SUBST. R (c)(2)(D)(ii). Pursuant to P.U.C. SUBST. R (c)(2)(D)(vi), HL&P should have filed this report 30 days prior to commencement of construction. General Counsel requested an explanation from HL&P for the failure to file the report timely. HL&P filed a letter stating that due to the immediate and unforeseen nature of the repairs, and HL&P personnel involved in Docket 13943, this project was filed as the company' s schedule permitted. General Counsel believes that the reasons stated by HL&P constitute good cause for making an exception to the 30-day filing requirement. 6 6. Provide a general de9iption of the project. Include: (a) Nescription of the construction (length, voltage, structure type); (b) a description of the location of the project; (c) the reason for the project; (d) the subsection that exempts the activities; and (e) an explanation of why the activities are exempted. Response: (a). DESCRIPTION OF CONSTRUCTION: In October 1994, Harris County and counties to the north of it experienced very heavy rainfall, resulting in flooding along the San Jacinto River. The rising water caused the rupture of several pipelines used to transport petroleum products, and the resulting fires damaged or destroyed a number of homes on the north side of the 1-10 bridge over the river. The flood waters also caused extensive damage to two HL&P 138KV transmission lines, Ckts. 03 and 94. HL&P replaced three 138KV lattice steel tower structures (structures #52, 53 and 54) with the same size and type structures (using the existing foundations), approximately 4,100 ft. of ACSR conductor, and 4,100 ft. of 1-3/8 in. HS static wire on the Channelview - Lynchburg Ckt. 03 transmission line, (see area marked as Location I on the attached topo map, Figure 1). The width of the right-of-way for Ckt. 03 is 65 ft. A new long span tangent steel lattice tower, new structure #9, was installed on the Champion International (Sheldon) - Power Systems Arco Ckt. 94 transmission line to replace a damaged double-circuit, double static 800-ft. span tangent steel lattice tower, old structure #9 (see area marked as Location 2 on the attached topo map, Figure 2). This structure had been on the west high bank of the San Jacinto River, but the west bank of the river was eroded to the extent that structure #9 was suspended by its insulators and surrounded by the expanded river. The new structure was built on a new foundation approximately 70 ft. west of the new high bank of the San Jacinto River. The existing ACSR conductor on Ckt. 94 was repaired and reused. The width of the right-of-way for Ckt. 94 is 60 ft. Both Ckts. 03 and 94 were rebuilt using the existing centerline and remain entirely within existing rights-of-way. (b). DESCRIPTION OF THE LOCATION OF PROJECT: The 138KV Ckt. 03 repair project is on the San Jacinto River in eastern Harris County, approximately 8,500 ft. south of the 1-10 bridge crossing of the San Jacinto River, near the point where the river enters the Houston Ship Channel (see Figure 1). The 138KV Ckt. 94 repair project is also on the San Jacinto River in eastern Harris County, approximately 5,500 ft. north of Highland Shores Road and 10,000 ft. west of Crosby-Lynchburg Road (see Figure 2) (c). REASON FOR PROJECT: Both of these repair projects were necessary due to damage to transmission line facilities caused by the flooding. (d). SUBSECTION EXEMPTING ACTMTIES FOR PROJECT: Subsection (c)(2)(d)(ii) of the Public Utility Commission of Texas Substantive Rules exempts this project. (e). EXPLANATION OF WHY ACTIVITIES ARE EXEMPTED FOR PROJECT: Subsection (c)(2)(d)(ii) exempts rebuilding and reconductoring of existing transmission facilities. The project complied with this subsection since the project was limited to the replacement and/or respacing of structures and the replacement of conductor along an existing route of the transmission line. The work was completely within the existing transmission rights-of-way and associated easements; therefore, no new landowners were involved with this project. 7 7. Attach a map, or map Of sufficient detail to describe the Act and locate it in the county. Response: This flood-related rebuild project is located entirely within eastern Harris County. The location of the repair work on the transmission lines is shown on the U.S.G.S. topo maps for Highlands, TX (see Figures 1 and 2). 8. Attach copies of the prior consent of any utility certificated to area in which the activity occurs, as required. Response: The facilities are located entirely within Houston Lighting & Power Company's certificated service area. 9. Attach copies of prior consent of landowners crossed by the facilities, as required. Response: No new landowners were crossed by the construction. 10. Is new or additional right-of-way required for this project? Yes X No. If yes, attach: (a). A copy of the direct notice mailed to each landowner of adjacent property within 200 feet of the proposed project. Response: This rebuild project was done to replace existing transmission facilities damaged by flood waters. Since no new right-of-way was necessary for this project and the centerline of the lines did not change, no landowners were notified of this project. (b). A list of parks and recreation areas within 1,000 feet of the centerline of the project (include the distance). Response: There are no parks and recreation areas within 1,000 feet of this project. (c). A list of airports within 10,000 feet of the centerline of the project (include the distance). Response: There are no airports within 10,000 feet of the project.
